HomeMy WebLinkAbout09/24/1962 Business MeetingI 358 SEPTEMBER 24, 1962 The City Council.met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lynch, T41unger and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman Lemon absent and excused. The invocation was given by Councilman Lynch. The minutes of the regular meeting of September 17, 1962 were approved as read. In accordance with action taken by th.e Council at their regular meeting of September 14, 1962, the matter of the protests and an ordinance creating a local improvement district for the improvement of certain streets and alleys as requested by Petitions No. 91, 100, 102, 10$, 118, 127, 139, 141, 142, 147, 148, 155, 156, 157, 158, 159, 160, was considered by the Council. Councilman Robinson having read an ordinance providing for said improvements and creating Local Improvement District No. 903, be passed as read. Discussion of protests filed followed and Public Works Director Mayo reported that the percentage of protests on each district remains the same except for project 5,6 and 7, North 42nd, TJ;ary Lin Drive and Barge Street which now has 23% pro- test, most of which is on Mary Lin Drive, project 8, Willow street which now has 19% protest and project 20, Alley in Block 2$$ which now has 44/ protest on file. No persons being present to be heard on this matter, Mayor Larson, called for the vote on the pending motion and it carried: Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye on roll call. Lemon absent. ORDINANCE NO. 37$2 AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features'; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. "An Ordinance appropriating $45,796.00 from the Municipal Garbage Fund to the Capital or Betterment classification in the Municipal Garbage Budget for 1962 and a Resolution authorizing a temporary loan of $45,796.00 from the Cumulative Reserve for Domestic Water Supply Development to the Municipal Garbage Fund, being the next two items of business on the agenda, it was MOVED by Robinson, seconded by Munger that these matters be set over to the next regular meeting of the Council on October 1, 1962: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. Lemon absent. VMoved by Lynch, seconded by Kurbitz that Resolution No. D -450 transferring $320.00 within the 1962! Fire Department Budget, be passed as read: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye on roll call. Lemon absent. RESOLUTION NO. D -4501 A RESOLUTION transferring the slam of $320.00 within the 1962 appropriation for 22 - Fire Department. The City of Yakima desiring to vacate a public alley located between Walnut and Chestnut and 9th and 10th Avenue, it was MOVED by Robinson,seconded by Brazier that Resolution No. D -451 fixing the time of hearing on this matter for the 15th day of October, 1962, be passed as read: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye on roll call. Lemon absent. RESOLUTION NO. D -451, A RESOLUTION fixing the time and place for hearing on vacation of alley. Moved by Robinson, seconded by Lynch that Resolution No. D -452 declaring the intention of the City Council to amend the Zoning Code with regard to set back requirements for off street parking, be passed as read: carrie , Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye on roll cal.. Lemon absent. the discussion of this matter, Councilman Robinson explained that he is in�a ing this amendment, that he is a member of the Advisory Board for St. Elizabeths Hospital and that the restrictions for off street parking as set forth in the Zoning Code have recently come to his attention as the result of the hospital planning for and constructing an off street parking lot at the corner of South 10th Avenue and ;Test Chestnut ftreet. He further explained that he felt that wh.e.re a tight fence of landscape screen from four to six feet in heimht is built along the property line as required by the Zoning Code, it should be possible to park cars to the property line and that when there is a public sidewalk along the lot, parking should be permitted to the edge of the sidewalk with suitable curbs or bumper guards to prevent encroachment on the sidewalk and to protect the view of drivers at intersecting streets and that no setback areas be required. Councilman Brazier, Kurbitz and .Lynch explained that they are voting for the resolution in order that the-Planning Commission can make recommendations and are not necessarily in favor of the suggested liberalization of the Zoning Code. Mr. Tom Hargis, former member of the Planning Commission and Archetect for the St. Elizabeth's Hospital also protested -the setback restrictions now required by the Zoning Code for off street parking lots. RESOLUTION NO. D -452, A RESOLUTION declaring the intention of the City Council of the City of Yakima to amend Section-12-56.100 of the City of Yakima Municipal Code. Moved by Kurbitz, seconded by Lynch that Resolution No. D -453 authorizing the purchase of equip- ment without calling for bids, be passed as,.read: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. \mon absent. RESOLUTION NO. D -453, A RESOLUTION authorizing the-purchase of equipment without calling for bids, Moved by Kurbitz, seconded by Brazier that Resolution No. D -454 authorizing the purchase of materials and hiring of labor i,�ithout calling for bids, be passed as read: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye on roll call. Lemon absent. RESOLUTION NO. D -454, A RESOLUTION authorizing the purchase of materials and hiring of labor without calling for bids. Manager Smith having requested permission to send Mr. P-I111 Page, Sewage Disposal Superintendent to the Pacific Northwest Polution Control School which is to be held in Salem Oregon, September 25th, to.the 27th,with expenses, which will be approximately $95.00,x, it was MOVED by Kurbitz, seconded by Munger that permission be granted and that Mr. Page's expenses be paid: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. Lemon absent. Manager Smith reported that the Junior Chamber members have volunteered to help the City in re- moving view obstructions on intersections. They will aid with publicity to bring the problem to ,the attention of the property owners and will assist in the actual surveys and contacts. (Manager Smith also advised Council members that the Association of Washington Cities District meeting will be held in Yakima on October 17, 1962 and that this will be a dinner meeting; conveni at 6:30 P.M. 1 1 1 1 SEPTEMBER 24, 1962 There being no further business to come before the.
