The City Council met in regular session, Mayor Larson, Councilmen Kurbitz, Lemon, Lynch, Munger
and Robinson, City Manager Smith and City Attorney Andrews present on roll call.
The invocation was given by Councilman Lemon.
The minutes of the regular meeting of September 10, 1962 were approved as corrected.
In accordance with action taken by the City Council at their regular meeting ofSeptemb -.er *..10,1962,
the matter of the annexation of certain property North of Fechtor Road was brought on for action
and Mr. Dick Miller, real4tor representing the petitioners, Mr. and Mrs. D. A. Fellows, Mr. and
Mrs. Ronald Poole and Mr. and Mrs. Jack M. King, filed a new petition, being Petition No. 165 to
supercede Petition No. 161 a "s filed by the same petitioners at an earlier date and acted on by_
the Council on the 4th day of September, 1962. It was' then MOVED by Robinson, seconded by Lemon
that the order fixing the date of hearing on Petition No. 165 for the 8th day of October, 1962
as read by Councilman Robinson, be passed, that the Mayor be and is hereby authorized to convene
the Review Board as specified by statute and that said petition be referred to the staff for
study and recommendation and to the Planning Commission for recommendations on matter of zoning:
carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote.
This being the time fixed by the Council for the hearing on Resolution No. D -445, being a
resolution of intention to improve certain streets and alleys by constructing concrete curbs and
gutters and the surfacing of said streets and alleys, said improvements having been requested by
petitions No. 91, 100, 102, 108, 118, 127, 139, 141, 142, 147, 148, 1551 156, 1579 158, 159, 160,
persons present were heard both for and against these matters. Manager Smith explained the
procedure for handling petitions and the formation of local improvement district. He explained
that these various small projects of the same nature are being consolidated into one local
improvement district in order to cut costs and further explained that protests may be filed until
30 days after the passage of the ordinance creating the district but must be filed in writing.
The Council then proceded to hear those persons present, both for and against each project as set
forth in Resolution No. D -445.
On Project 1, 2 and three, North 54th Avenue & Englewood Hill Drive, Englewood Hill Drive from a
point 2701 East of Minnesota Avenue to a point 8801 East of Minnesota Avenue and North 47th Avenue
respectively there were no protests in writing or otherwise.
On Project No. 4, Mavis Avenue, Public Works Director Mayo reported that 35% written protest has
been filed at this time. No oral protests were heard.
On Projects No. 5, 6 and 7, North 42nd Avenue, Mary Lin Drive, and Barge Street respectively,
Public Works Director Mayo reported that 13% written protest has been filed at this time. No oral
protests were heard.
On Project No. 8, Willow Street, there is 17% written protest filed in writing and Mrs. Dale
Shelton protested this improvement if certain drainage problems are not taken care of. Mr. Mayo
assured Mrs. Shelton that this project will include the piping and draining of.this area. In
.answer to Mr. Meader's question as to whether or not a bridge will be constructed to the west of
his property, Mr. Mayo informed him that such a bridge.is not included in this project. Manager
Smith explained that there will be a small park strip similar to Naches Avenue on the completion
of the Willow Street project.
On Projects No. 9, 10, and 11, Hanratty Drive, South 28th Avenue, and South 21st Avenue respect-
ively there were no protests filed in writing. Mr. Johnson inquired as the School Districts
participation in the Hanratty Drive project and Mr. Mayo explained that he has talked to Rolla
Goold, Assistant Superintendent of the Yakima School District, and while he has no commitment, he
(does not anticipate any problem with the School District. Mr. Stan Lebens spoke for the project
on 21st Avenue. Mr. Mitzlaff asked for information on irrigation lines in the 21st Avenue Project
pointing out that there are old lines in this district.
On Project 12, Plath Avenue; Mr. Mayo advised that there is a 7% protest in writing on file at
this time. Discussion of this project disclosed that the original protest which was filed the day
after the petition has not been included in this figure as some of the persons protesting are not
in this district. Councilman Lynch and Robinson suggested that, since this project is being
figured from 18th to 20th Avenue instead of 16th to 20th Avenue as requested on the original
petition, the original protestors be notified of the change in the.area to be improved. Euclid
J. Menard protested being included in this project since he does not use Plath Avenue. Mr. Stan
Lebens explained problems of drainage in this area.
On Project No. 13, Conestoga Blvd.., there were no protests in writing or otherwise.
On Projects Nos. 14 and 15, South 9th Avenue and the S2 of West Chestnut Street, it was disclosed
that Petition No. 118 as filed by Sister Carmeline, Administrator for St. Elizabeth Hospital has
been withdrawn due to 100% protest.
On Project No. 16, 17 and 18, East Washington Street, Alley in Block 7, and Alley in Block 355
respectively there were no protests in writing or otherwise.
On Project 19, Alley in Block 357, there is a 5 % written protest on file at this time. No oral
protests were heard at this meeting.
On Project 20, Alley in Block 288, there is a 19% written protest on file at this time and Miss
Betty Beautrow, Mrs. Hambrook, Mrs. McDonald and Mrs. Arthur G. Holden protested this project
orally and Miss Beautreau assured the Council that they will bring in the necessary written
protests to delete this project from the district.
On project 21, two lots in alley between 18th and 19th, Lombard Lane to Bonnie Doone, there were
no protests.
All persons having been heard both for and against these matters it was informally agreed by the
Council that this hearing be continued until the next regular meeting of the Council on September
24, 1962 and that the ordinance creating a local improvement district be prepared for consideration
at that time.

Mr. Elery Van Diest, attorney for the Mayfair Tavern, Inc., having filed Notice of Intention to
Commence Annexation Proceedings with the City Clerk on the 14th of September, 1962, it was MOVED
by Robinson, seconded by Munger that said notice be received: carried, Brazier, Kurbitz, Larson,
Lemon, Munger and Robinson voting aye by voice vote. The Council then proceeded to meet with Mr.
Gene Johnson, Secretary of said Corporation, who was also present to determine if the property
described in its Notice of Intention will be required to assume the City's indebtedness and after
discussion, it was Moved by Robinson, seconded by Lynch that this property owner will be required
to assume the City's existing indebtedness: carried, Brazier, Kurbitz, Larson, Lemon, Munger and
Robinson voting aye by voice vote.
Manager Smith reported on the 1962 Arterial Street Projects Traffic Signals. He reported that
the total cost for six intersections will be $35,650.00, approximately $6000 per intersection and
that these projects are approved for State gas tax participation on a 75% - 25% basis, making the
direct cost to the City under $1500 per intersection.
There being no further business to come before the Council, it was moved by Kurbitz, seconded by
Lynch that we do now adjourn at the hour of 5:00 P.M.: carried, Brazier, Kurbitz, Larson, Lemon,
Lynch, Munger and Robinson voting aye by voice-vote.
