HomeMy WebLinkAbout08/20/1962 Business Meetingt 345 AUGUST 20, 1962 1 l 1' I 1 1 The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Leon, Lemon, Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman Munger absent and excused. The invocation was given by Councilman Lynch. The minutes of the regular meeting of August 13, 1962 were approved as read. In accordance with action taken by the City Council at their regular meeting of August 13, 1962, the matter of endorsing HJR -1 and SJR -1 providing for the voting of special levies by cities and school districts, was brought forth for determination. Councilman Lynch having explained that he had seconded the tabled motion to endorse these bills, merely for discussion purposes and that he would prefer to vote on these matters individually, it was MOVED by Lemon,'seconded by Klarbitz that the Council refer to these bills separately and consider the matter of endorsing HJR -1 first since it has to do with cities: carried, Brazier, Kurbitz, Lemon and Lynch voting aye by voice vote. Larson and Robinson voting no by voice vote. Munger absent. MOVED by Robinson, seconded by Lynch that the City Council approve and endorse HJR -1 providing for the voting of special levies by cities: carried, Brazier, Kurbitz,'Larson, Lemon, Lynch.and Robinson voting aye by voice vote. Munger absent. Lynch voting no by voice vote. Councilman Lynch explained that he feels that the Council should not concern itself in political issues where municipal affairs are not affected., Petition No. 156 having been filed with the City Clerk_ on the 16th day of August, 1962 by Bruce R. Belfield, said petition requesting the formation of a local improvement district for the paving of a portion of Hanratty Drive, it was MOVED by Robinson, seconded by Brazier that said peition be referred to the City Manager and staff for study and recommendation: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye by voice vote. Munger absent. Moved by Lynch, seconded by Lemon that Ordinance NO-375 providing stopping, standing and parking motor vehicles on the streets of the City of Yakima and amending and repealing certain sections of the Yakima Municipal Code, be passed as read by Councilman Robinson: Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye on roll call. Munger absent. In the discussion of this ordinance it was disclosed that the city plans to overlay Summitview in the near future and that the matter of restricting parking from 7th Avenue to 16th Avenue is being considered. Upon request of the Council, Mr. Ray Munson, Attorney representing Mc Cormick & Sons Florists located at 1406.Summitview, discussed the matter of restricted,parking from 7th Avenue-to 16th Avenue, explaining that all other business'°'i.n this area, have room for off - street parking which his client does not have. He further explained that if parking is restricted in this area, it will do away with his clients walk -in trade which is a major part of his business. Mr. Munson requested the Council to consider restricting the parking on the North side of Summitview during certain hours-of the day, suggesting 4 to 6 P.M. Mr. Stanley Mc Cormick and Mr. Charles Mc Cormicl owners of this business, were present and further emphasized their attorney's remarks. No formal action was taken by the Council on this matter at this time. Moved by Lynch, seconded by Brazier that Resolution No. D -436 denying the claim for damages filed against the Cii-.y of Yakima by Beulah Lee Kobernik, be passed as read:. carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson voting aye on roll call. Munger absent. RESOLUTION NO. D -436, A RESOLUTION denying claim for damages filed against the City of Yakima by Beulah Lee Kobernik. WHEREAS, on December 15, 1961, Beulah Lee Kobernik filed a claim for damages against the City of Yakima, and WHEREAS, the-City Council finds that it is in the best interests of the people of the City of Yakima to deny said claim, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the claim for damages filed against the City by Beulah Lee Kobernik on December 15, 1961, is hereby denied. Hall filed a claim for damages again: the City of Yakima, and WHEREAS, the City Council finds that it is in the best interests of the people of the City of Yakima to deny said claim, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the claim for damages filed January 17, 1962, is hereby denied. WHEREAS, on Mav 2, 19621 Billy Denney filed a claim for damages against th City of Yakima, and WHEREAS, the City Council finds that it is in the best interests of the people of the City of Yakima that such claim be denied, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the-claim for damages filed against the City of Yakima by Billy Denn on May 2, 1962 is hereby denied. WHEREAS, on June 27, 1962 ', Norman Lee Dixon filed a claim for damages agai the City of Yakima., and WHEREAS, the City Council finds that it is in the best interests of the people of the City of Yakima to deny said claim, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the claim for damages filed on June 27, 1962 against the City of Yak by Norman Lee Dixon is hereby denied. RESOLUTION NO. D -4412 A RESOLUTION authorizing the payment of $69.48 to Thomas E. Dow. WHEREAS, on or about January 17 through January 19, 1962, the property ownel by Thomas E. Dow, located at 3509 West Chestnut Street, in the City of Yakima was damaged when the basement flooded as the result of a sewer backup, and WHEREAS, the said Thomas E. Dow, within the time specified by law and City Charter, to -wit, on February 12, 1962 made claim against the City of Yakima for damages sus- tained as a result of said occurence, and WHEREAS, the City Council finds that the sum of $69.48 is a reasonable sum to be paid in settlement. of said claim, and finds it to be iri the best interests of the people of the Citv of Yakima to make such settlement, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKINIA: That the Director of Finance of the City of Yakima is hereby authorized and directed to pay the slim of M9.48 to Thomas E. Dow upon the execution by the said Thomas E. Dow of a release absolving the-City of Yakima from any and all-liability as a result of said occurence. ATTEST: J. A. II WHEREAS, on or about December 11, 1961, Virgil W' Carl sustained damage to his residence at 1310 South Third Avenue in the City of Yakima, Washington as a result of fl-ooding in the basement due to a sewer backup, and WHEREAS, said Virgil W. Carl, within the time specified by law and City Charter, to -wit, on March 8, 1962, made claim against the City for damages as a result of said sewer backup, and WHEREAS, the City Council finds that the sum of $33.50 is a reasonable sum to be paid in settlement of said claim, and finds it to be in the best-interests of the peoplE of the City of Yakima to make such settlement, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the Director of Finance of the City of Yakima, is hereby authorized and directed to pay the sum of $33.50 to Virgil W. Munger absent. RESOLUTIONi NO. D_443, A RESOLUTION - authorizing the payment of $9.65 to Carl W. Livingston.' WHEREAS, on or about March 18, 1962 property owned by Carl W. Livingston located at 210 North 25th Avenue, Yakima, Washington was damaged when the basement of said premis- es becam flooded as a result of a. sewer backup, and WHEREAS, the said Carl W. Livingston within the time specified by law and City Charter, to -wit, on March 19, 1962 made claim against the' City for damages as a result of said incident, and WHEREAS, the City Council finds that the sum of $9.65 is a reasonable-sum to be paid in settlement of said claim, and finds it to be in the best interests of the people of the City of Yakima to make such settlement, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the Director of Finance of the City of Yakima is hereby authorized a directed to pay the sum of $9.65 to Carl W. Livingston upon the execution by the said Carl W. Livingston of a release absolving the City of Yakima from any and all liability as a result of said occurence. ATTEST: J. A. LARSON Mayor Mr. Ben Mumaw, Plumbing Contractor and property owner in the newly annexed area located east of 38th Avenue between Tieton Drive and Walnut Street, being present, protested the operation of the new Eden House Nursing Home on Tieton drive, stating that there is an open sewer on this property, and questioned the City's right to allow this firm to operate without bringing their plumbing up to code specifications As all other city residents and businesses must do. Mr. Mumaw stated that if this situation is not corrected he will institue court suit. The Council informally requested the City Manager to make a report on this matter and to advise the Council what legal authority the city has in these matters in newly annexed areas. Councilman Kurbitz requested information on the progress of the construction of an access'on to East Yakima Avenue through the fence built by the State Highway Department in connection with the By -Pass Highway. Manager Smith reported that arproval of our plan has not been received from the State. Councilman 'Robinson reported that he has received information from Hans Scov, contractor for the bridges, which made it doubtful if this access will b-e allowed for a very long period of time, since the Terrace Heights traffic is to use an over -pass at this point and he suggested that the Manager and staff consider the formation of a local improvement district to as a solution to this problem. Manager Smith reported that Police Chief Oscar Soderstr.om has requested approval for Police Officer John Jenkins to attend school in Los Angeles the first week in September with expenses paid. Manager Smith recommended that this request be granted. MOVED by Robinson, seconded by Kurbitz that said request be granted and that officer Jenkins' expenses be paid: carried, Brazier Kurbitz, Larson, Lemon, Lynch and Robinson voting aye by voice vote. Munger absent. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Robinson that we do now adjourn at the hour of 4:40 P.M: carried, Brazier, Kurbitz, Larson, Lemon Lynch and Robinson voting aye by voice vote.
