The minutes of the regular meeting of Awust 6, 1962 were approved as read. An ordinance appropriating 413,356.00 from the unappropriated moneys in the Water -Sewer Fund to the 1962 Budget for Domestic Water having been read in its entirety at the regular meeting of the Council on the 6th day of August 1962 and laid on the table for one week, was read by title only at this meeting and it was MOVED by Lemon, seconded by Lynch that Ordinance No. 372 providing for said appropriation, be passed as read.- carried,. Brazier, Kurbitz, Lemon, Lynch, Munger and Robinson voting; aye on roll -call. ORDI ,IANCE NO. 372, AN ORDINANCE appropriating the sum of $13,356.00 from the unappropriated = - moneys in the Water -Sewer Fund to Accounts 6 -11, Movable Equipment, and 6 -81, Capital Materials - Inventory, of the Capital or Betterment classification of the 1962 appropriation for 52.8 - Domestic Water. This being the time fixed by the Council for the hearing on Petition No. 150 as filed by Glascam Builders and others, it was MOVED by Robinson, seconded by Lynch that Ordinance No. 373 providing for the annexation of certain property South of Nob Hill Blvd., be passed as read: Miss Bernice Wetzel, property owner, again protested the zoning proposed for her property and discussed the matter of easement to--make 31st Avenue a 50 foot street. No action was taken by the Council on this matter. Councilmen Lemon and Kurbitz expressed concern regarding the zoning of the Wally Klingele property and Miss Wetzelts- property stating that they believe these properties should be zoned B -2, Local Business Zone. Councilmen Lynch and Robinson expressed the belief that the property belonging to hr. Klingele and Miss Wetzel, which is now being used as residential propert should be rezoned if and when the owners have plans to file,showing proposed change of usage. Mr. Howard Hettinger, Attorney, speaking on behalf of his client, Mr. Wally Klingele,-stated that Mr. Klingele has his home and business on his property which willpnon- conforming under the proposed ordinance and urged the Council to give consideration to'.this matter. It was MOVED-by Kurbitz, seconded by Lemon that Section 3 pf Ordinance No. 373 be amended to include the Klingele and Wetzel property as B -2, Local Business Zone: Brazier, Kurbitz, and Lemon voting aye on roll call. Larson, Lynch, Munger and Robinson voting nay on .roll call. This motion lost for the want of a majority vote. Mavor Larson then called for the vote on the original motion to pass Ordinance No. 373 as read"'vand it carried: Brazier, Kurbitz, Larson, Lemon, L,,nch, Munger and Robinson vot- ing aye on roll call. ORDINANCE NO. 373, AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima, and zoning said property. This date also being the date fixed by the Council for the hearing on Petition No. 151 as filed by C. L. Shelton, said petition praying for the annexation of certain property located between Tieton Drive and Walnut Street, it was MOVED by Lemon, seconded by Munger teat Ordinance No. 374 providing for said annexation and zoning said property, be passed as read: carried, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. Brazier voting nay on roll cal °Mr. Ben Mumaw, property owner and petitioner, questioned the Council regarding the size of signs and existing uses of property in this area and was advised that the existing uses will be allowed to continue and the signs will be allowed to remain even though non - conforming. The Council questioned Mr. Shelton, property owner and petitioner regarding the building of a hamburger stand and Mr. Vel.ikanji, attorney-for Mr. Shelton, informed them that his client has a building permit and indicated that it will be built. ORDINANCE NO. 374, AN ORDINANCE; providing for the annexation by the City of Yakima of certain property contiguous to the City of Yakima and zoning said property. This also being the date fixed for the hearing on Petition No. 154 as filed by John A. Logan and John G. Fairbrook praying for the annexation of certain property east of 45th Avenue between Summitview and Chestnut, and it having been established by the Planning Commission that in- sufficient signatures have been obtained on said petition, Manager Smith explained that no action can be taken by the Council at this time because it has no jurisdiction and that it will now be necessary for the petitioners to file a new petition. Moved by Robinson,seconded by Munger that Resolution No. D -433 requesting planning assistance from the State Department of Commerce and Economic Development to carry out a Planning Program, be passed as .read: carried, Larson, Lynch, Munger and Robinson voting aye on roll call. Brazier Kurbitz and Lemon votin g nay on roll call. In discussing the motion Councilman Brazier, Lemon and Kurbitz voiced opposition to this action and the perpetuating of federal government participa- tion in matters of state and local government. Councilman Lynch also expressed opposition to the infringement of the federal government, but expressed the belief that the problem of government grants must be taken up with the proper..government officials and that, in the mean time, this money is available and that comprehensive planning is necessary to the growth of the city. Councilman Robinson explained that we should not seek or receive funds with strings attached and that he can not see any in this action. RESOLUTION NO. D -433, A RESOLUTION requesting planning assistance from the State Department of Commerce and Economic Development and authorizing the City Manager of the City of Yakima to carry out a Planning Program. WHEREAS, the City of Yakima desires to provide for a planning study c6ntri- buting to an over -all program for future community development, the preservation of community values, the prevention of conditions tending to cause urban blight, and the promotion of the general health, safety and welfare of its citizens, and WHEREAS-, the State Department of Commerce and Economic Development, under authority of Chapters 157 and 215, Statutes 1957, Regular Session, may provide planning assistance for such a program and receive financial assistance from the Urban Renewal Administration, as authorized by Section 701 of the Housing Act of 1954 (Public Laws 860, 83rd Congress), as amended by the Housing Act of 1959 (Public Laws 86 -372, 86th Congress, now, therefore, BE IT RESOLVED BY THE CITY MUN CIL OF THE CITY OF Y AKIMA: That.the City of Yakima hereby, requests the State Department of Commerce and Economic Development to provide planning assistance under authority of Chapters 157 and 215 Statutes 1957, Regular Session, with such financial assistance as may be provided by the Urban Renewal Administration, under authority of Section 701 of the Housing Act of 1954 (P.L.860, 83rd 1 1 1 1 1 1 1 1 343 AUGUST 13, 1962. Congress, as amended by the Housing Act of 1959 (P.L. 86 -372, 86th Congress). That such planning assistance is more particularly described in a project description that is attached hereto and made a part of this resolution as if fully set forth herein. That the City of Yakima, subject to ax;proval of such planning assistance by the State and Federal authorities, hereby authorizes: (a) payment to the State Department of Commerce and Economic Development of a sum not to exceed $250.00, and, (b) use of personnel of the Planning Department of the City of `.6kima for technical assistance in this project, which, assistance has an estimated value of $2 650.00. That the total estimated cost of the project as planned is 49,850.00. That the City Manager of the City of Yakima is hereby authorized and empowered to execute in the name of the City of Yakima all necessary contracts and agreements to implement and carry out the purposes specified in this resolution. LARSON MAYOR Moved by Brazier, seconded by Lemon that Resolution No. D -434 authorizing the execution of a Supplemental Agreement with Chet Hollenbeck, d /b /a Western -Way Rental System, Inc., for the operation of an automobile rental.business at the Yakima Airport and extending the effective date of an existing agreement to November 30, 1962, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. RESOLUTION NO. 434, A RESOLUTION authorizing -and directing the City Manager and the City Clerk of the City of Yakima to execute a Supplemental Agreement with Chet Hollenbeck, d /b /a Western - Way Rental Systems, Inc. WHEREAS, on the 25th day of November, 1959, the City of Yakima entered into an Agreement with Chet Hollenbeck, d /b /a Western -Way Rental Systems, Inc., for the operation of an automobile rental business at the Yakima Municipal Airport which Agreement by its terms terminates on.the 14th day of August, 1962, and WHEREAS, the City Council of the City of Yakima finds it in the best interes' of the City to extend the term of said Agreement to the 30th day of November, 1962, now, therefor BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and City Clerk of the City of Yakima are hereby author. ized and directed.to execute a Supplemental Agreement with Chet Hollenbeck, d /b /a Western -Way Rental Systems, Inc., extending the effective date of an existing Agreement between said parties to the 30th day of November, 1962, a copy of which Supplemental Agreement is attached hereto and by this reference made a part hereof. LARSON Mayor __M'oved'by Munger, seconded by Lynch that Resolution No. D -435 stating the general policy of the City Council regarding extension of the retirement age of City employees beyond the age of 65 be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. RESOLUTION NO. D -435, A RESOLUTION stating the general policy of the City Council of the City of Yakima, regarding extension of the retirement age of City Employees beyond the age of 65. WHEREAS, the Statewide City Employees' Retirement System authorized the City to extend the retirement of employees eligible for retirement for a period of five years, an( WHEREAS, from time -to -time requests for the extension of the retirement age of City Employees beyond the age of 65 years come to the attention of the City Council, and the Council desires to consider these requests as objectively as possible, and WHEREAS, a previous consideration for granting extensions beyond the age of 65 years was the fact that a number of employees did not have the minimum number of quarters to qualify for Old Age Survivor's Insurance coverage upon reaching age 65, and . WHEREAS, all employees, as of July 31, 1962, now have the required number of quarters to qualify for Old Age Survivor's Insurance coverage, and WHEREAS, the City Council desires to state its general policy in consider- ing future requests for retirement age extensions, and deems it in the best interests of the City that all employees be retired upon reaching the retirement age of 65 years, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That no extensions of the retirement age of City Employees beyond the age of 65 years will be granted in the future. LARSON Mayor Mr. Larry Mathews, requested the City Council's endorsement of SJR -1 and ',HJR -1 providing for the voting of special levies by School Districts and Cities. After discussion of this matter, it was MOVED by Robinson, seconded by Lynch that the Council endorse SJR -1 and HJR -1. Some of the members of the Council washing to study this matter further, it was MOVED by Lemon, seconded by Brazier that the motion to endorse said legislation be laid on the table for one week: s 9 r 344 AUGUST 13, 1962 Ilcarried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting ave by voice vote. -I[ The following; bids having; been received by a bid board for certain Arterial Improvements: C & E Construction Company, Yakima, Washington 161,161.25 Yakima, Cement & Asphalt Paving Company, Yakima, Washington 1492620.25 Superior Asphalt & Concrete Company, Yakima., Washington ,145,355.75 Manager Smith reported that the staff has met lith the two low bidders, Yakima. Cement & Asphalt Paving Company and Superior Asphalt & Concrete Company, to discuss their proposed plans for accomplising the necessary work as well as their firmst available equipment and supervisory man power and that after due consideration he is recommending the bid of Superior Asphalt & Concrete Company in the amount of $145,355.75 as the lowest and best bid. MOVED by Lemon, seconded by Robinson that this bid be awarded to Superior Asphalt and Concrete Company and that the City Manager be 'and is hereby authorized to enter into a contract on behalf of the City of Yakima upon the filing of the proper bond by said contractor: carried, Brazier, Kurbitz, Larson, Lemon, Lync Munger and Robinson voting aye by voice vote. Mr. E. J. Auye, President of.,Superior Asphalt and Concrete Company, being present, assured the Council that his Company will do a good job and thanked them for this award. Manager Smith further reported on the mutual aid agreements between fire departments and fire districts, stating that due to the increased workload, he is proposing; that we discontinue to give free service to other town; and districts and put this operation on a contract basis. He further explained that the City Attorney will prepare individual contracts to be submitted to the Council in the near future. This matter was discussed and it was MOVED by Robinson, seconded by Kurbitz that the City Manager and staff continue these negotiations: carried, Brazier, Kurbita, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote.
