HomeMy WebLinkAbout08/06/1962 Business Meeting1 i fl 1 339 AUGUST 6, 1962 The City Council met in regular session_, Mayor Lareon, Councilmen Brazier, Kurbitz, Larson, Lemon Lynch and Munger, City Manager Smith and City Attorney Andrews present on roll call. Councilman Robinson absent and excused. The invocation was given by Councilman Brazier. The minutes of the regular meeting of July 30, 1962 were approved as corrected. Mayor Larson deviated from the regular order of business to welcome Mr. Bob Stephens, City Manager of Delano California, who is visiting in Yakima. An ordinance appropriating $13,356.00 from the Water -Sewer Funds to the 1962 Budget for Domestic Water, was read in its entirety by the Clerk of the Council and laid on the table for one week to be read and considered at the next regular meeting of the Council on August 13, 1962. Moved by Lynch, seconded by Munger adopting,by reference, the Uniform Brazier, Kurbitz, Larson, Lemon, L Manager Smith informed the Council record endorsing the change to the Villesvik, who is an architect and that Ordinance No. 371 relating to building regulations and Building Code, 1961 Edition, be passed as read: carried, ynch,and Munger voting aye on roll call. Robinson absent. that the Yakima Valley Master Builders, Inc., have gone on 1961 code. Also this matter was discussed with Mr. John S. who also endorsed the updating;.of the City's Building Code. ORDINANCE NO. 371, AN ORDINANCE relating to building regulations; adopting by reference the Uniform Building Code, 1961 Edition, copyright 1961 by the Internqtional Conference of Building Officials; and amending Sections 11.04.010, .030, and .040, and repealing Sections 11.04.020 and .050, all of' the'City of Yakima Municipal Code. Moved by Lemon, seconded by Munger that Resolution No. D -430 authorizing the execution of a Lease Extension Agreement with Chateau Enterprises covering their restaurant operations at the Yakima Municipal Airport, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Munger voting aye on roll call. Robinson absent. RESOLUTION NO. D -4303 A RESOLUTION authorizing the City Manager and the City Clerk to enter into a Lease Extension Agreement with Chateau Enterprises, Inc. WHEREAS, under a Lease Agreement dated October 21, 1959, Chateau Enterpris• es, Inc., leased from the City of Yakima certain facilities in the Yakima Municipal Airport Administration Building for the operation of a restaurant, cocktail lounge and other services catering to the public, and said lease is to terminate on August 31, 1962, and WHEREAS, said Chateau Enterprises Inc., desires to extend the termination date of said lease to expire December 31, 1962, and the Enterprises, Council finds it in the best inter- ests of the .people of the City of Yakima to so extend said lease, under the same terms and con- ditions as are provided in said Lease Agreement, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and the City Clerk of the City of Yakima are hereby authorized and directed to enter into a Lease Extension Agreement with Chateau Enterprises, Inc., to extend the termination date of that certain lease Agreement entered into by the City and said Chateau Enterprises, Inc., on October 21, 1959, whereby the City leased certain facilities locat- ed in the Yakima Municipal Airport Administration Building to said Chateau Enterprises,,Inc., for the operation of a restaurant, cocktail lounge and other.services catering,to the public, a copy of which Lease Extension Agreement is attached hereto and by reference made a part hereof. LARSON Mayor Moved by Brazier, seconded by Kurbitz, that Resolution No. D -431, being a resolution of intention to create a local improvement district to construct water mains and appurtenances as requestOd by Gale E. Thompson and others on Petition No. 149 and fixing the date of hearing on said petition for the 27th day of August, 1962, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lvnch, and-Munger voting aye on roll call. Robinson absent. RESOLUTION NO. D -4319 A RESOLUTION-of intention to create a local improvement district. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That it is its intention to improve the following described property by constructing the necessary mains, fire hydrants, valves, and other appurtenances for the purpose of supplying water for domestic use and fire protection; all of said improvement to be construct- ed in full accordance with the plans and specifications to be prepared by the office of the City Engineer and filed with the City Clerk. The district to be served by and specially benefitted by and assessed for the above - described improvements is situate in the City of Yakima, Yakima County, Washington and described as follows: The South Half of the Northeast Quarter of the Southeast Quarter of Section 14, Township 13 North, Range 18, E.W.M. All persons who may desire to be heard with reference to said proposed improvements are hereby notified to appear at a meeting of the City Council to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 3:00 o'clock P.M. on Monday the 27th day of August, 1962, which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto; and for determining the method of payment for said improvement; and the City Clerk is hereby directed to give notice of said hearing and of the intention to make the aforesaid,improvements. A_ portion of the costs and expenses of said improvement, including engine ering, inspection, advertising, publication of notices, if any, and all other expenses incident thereto, shall be leuied and assessed against all of the property legally and properly assessable therefor, as provided by law and as above described, and the balance of the said costs and expens- es shall be borneyby the City Water Department in accordance with Resolution No. C -1051. LARSON Mayor A resolution authorizing the purchase of equipment inlithout calling for bid having been handed to the Council for consideration and Manager Smith having requested time for further consideration of this matter, it was MOVED by Lynch, seconded by Lemon that the matter of this resolution be set aside for further study and consideration by the staff: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Munger voting aye by voice vote. Moved by Lemon, seconded by Lynch that Resolution No. D -432 transferring x¢1,560.00 in the 1962 Budget for the Street Department, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon Lynch and Munger voting aye on roll call. Robinson absent. Discussion indicated that this transfer is necessary to make the final payment for qn Adams Motor Grader which was purchased from Tool Equipment Company of Seattle. RESOLUTION NO. D -432, A RESOLUTION transferring the sum of $1,560.00 within the 1962 appropriati for 31 - Street Department. WHEREAS, a surplus exists in Account 7 -58, Rentals, of the Maintenance & Operation 'classification of the 1962 appropriation for 31 - Street Department, and WHEREAS, in order to make final payment for an Adams Motor Grader which was purchased from'Tool Equipment Company of Seattle, additional funds are required in Account 6 -11, Movable Equipment, of the Capital or Betterment classification of the 1962 appropriation for 31- Street Department, and WHEREAS, at the time of the adoption of the 1962 Budget, it could not have reasonably been foreseen that the above additional sum would be required, and the City Council finds it in the best interests of the City of Yakima to make the aforesaid transfer, and that the action contemplated herein is authorized by R. C. W. 35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1_ That the sum of $1,560.00 is hereby transferred from Account 7 -58, Rentals, of the Maintenance & Operation classification, to Account 6 -11, Movable Equipment, of the Capital or Betterment classification, both within the 1962 appropriation for 31 - Street Department. RICHTER Cty Treasurer Mrs. Harry Cushing,being present at this meeting protested the condition of drainage in the area of the northwest corner of the intersection of Richey Road and Cresent Drive, stating that a pool of water and mud large enough and deep enough to drown a child,has collected at this point, Public Works Director Mayo advised that the staff is working on this problem and that it has been' caused by waste water from property outside the city seeking entrance into an old county drain which has been stopped up by the activity on the adjacent church property. There being no further business to come before the Council,it was MOVED by Lynch, seconded by Brazier that we do now adjourn at the hour of 4:00 P.M.: carried, Brazier, Kurbitz, Larson, Lemon, Lynch::and Munger-_.voting -aye by voice vote.
