The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Lemon, Lynch,
Munger and Robinson, City Manager Smith and City Attorney Andrews present on roll call.
The invocation was given by Councilman Lynch.
The minutes of the regular meeting of July 9, 1962 were approved as read.
In accordance with action taken at the regular meeting of the City Council on July 9, 1962, on the
matter of the protest made by citizens living in the East Yakima Avenue area regarding the erec-
tion of a fence by the State Highway Department, fencing off that part of East Yakima Avenue east
of 9th Street, and there being persons present who live in this area, Mayor Larson asked Manager
Smith for hisreport. Manager Smith told of the staff's meeting with Mr. Wallace Foster, Construc-
tion Engineer and Acting District Engineer for the State Highway Department and Mr. Dave Swanson,
Location Engineer for the District Office, stating that the problem confronting residents in the
area with regard to emergency services and convenient access to the downtown area were discussed
with the District Engineers. He related that the matter of a temporary access on to East Yakima
Avenue until such time as the by -pass is completed, was discussed,and while the engineers were
sympathetic to the problem, it is.necessary to take the matter up with the State Highway Depart-
ment in Olympia which is being done by Mr. Foster on this date :and a report from him will be
received immediately upon his return from Olympia. He further pointed out that our records as
well as the State's records show that,the State Highway Department approved the limited - access
design in February 1958 after the approval from the Bureau of Public Roads was obtained. He also
stated that there is a possibility,that before any final decision can be made on the part of the
State, it may be necessary to obtain clearance from the Bureau of Public Roads since they partici-
pated 90,, in the financing of the total construction of the inter - change at Terrace Heights. He
further stated that if the State Officials will recognize our request on a. temporary basis, it
will afford the City sufficient time to work out another access and the financing therefore, befor
the freeway is completed and the fencing restored as will be necessary. Councilman Robinson re-
quested that this matter be included on the agenda for the next regular meeting of the City
Council on July 23, 1962. Councilman Kurbitz complimented persons in the area on the orderly
manner in which they are seeking; a solution to their problems and encouraged them to contact State'
Officials on the matter.
In accordance with action taken at the regular meeting of the Council on July 9, 1962 on a Notice
of Intention to Commence Annexation Proceedings as filed by A. E. Clift, and Mr. Howard Hettinger,
Attorney for i'`ir. Clift, requesting postponement of this matter for a couple of weeks, it was
MOVED-by Lynch, seconded by Munger that this matter be included on the agenda for the regular
meeting of July 30, 1962: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson
voting aye by voice vote.
An ordinance appropriating $13,153.00 from the Water -Sewer Fund to the Sewage Disposal 1962
Budget for the purpose of extending lines and sprinkler system on the "Sanford Property" in
accordance with the recommendations of the Pollution Control Commission, having been read in its
entirety at the regular meeting of July 9, 1962 and laid on the table for one week and having
been read by title only at this meeting, it was MOVED by Lemon, seconded by Robinson that
Ordinance No. 362 providing for said appropriation, be passed as read: carried, Brazier, Kurbitz,
Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call.
ORDINANCE NO. 362, AN ORDINANCE appropriating the sum of $13,153.00 from the unappropriated
moneys in the Water -Sewer Fund to Account 7 -03, Salaries - Part Time, Temporary, Overtime and
Special Assignments, of the Salaries and Wanes classification; to Accounts 7 -11.2, Social Security
and 7 -11.3, Industrial Insurance and Medical Aid, of the Maintenance & Operation classification;
and to Account 6 -31, Construction and Other Improvements,of the Capital or Betterment classifica-
tion, all within the 1962 appropriation for 52.7 - Sewage Disposal.
K Notice of Intention to Commence Annexation Proceedings and a petition, being Petition No'. 154,
praying for the annexation of certain property between Summitview and Chestnut Streets and East of
4561 Avenue, having been filed with the City Clerk on the 10th day of June, 1962 by John G.
Fairbrook and others and Mr. Fairbrook and Mr. John A. Logan being present and representing the
petitioners, it was MOVED by Robinson, seconded by Munger that said petition be accepted for con-
sideration, that the owners of said property therein described, not be required to assume the
City's indebtedness and that the Mayor be and is hereby authorized to convene the Review Board as
specified by statue, for consideration of the proposed annexation: carried, Brazier, Kurbitz,
Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote.!/It was further MOVED by
Brazier, seconded by Lynch that said Petition be referred to the City Manager for study and
recommendation and to the Planning Commission for recommendations on matters of zoning and that
August 13, 1962 be fixed as the date of Public-hearing on said petition: carried, Brazier, Kurbit
Larson, Lemon, Lynch, Munger and Robinson voting; aye by voice vote.
The Planning Commission recommending the rezone of certain property located at 516 North lst
Street as requested on Petition No. 153 and filed by Erland F. Lindgren and others and the Council
having fixed this date for hearing on this matter.at their regular meeting of July 9, 1962, Mr.
Richard Kohl, attorney for Mr. Lindgren, being present, explained that his client is planning to
establish restaurant facilities on his property and that it is necessary to rezone the property
in order that he may serve cocktails in connection with this operation. There being no protests
in writing or otherwise to this request, it was MOjiED by Lynch, seconded by Kurbitz that
Ordinance No. 363 accepting the recommendation of the Planning Commission and rezoning the
property located at 516 North lst Street from B -2, Local Business Zone to B -3, General Business
Zone, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson
voting aye on roll call.
ORDINANCE NO. 363, AN ORDINANCE accepting the recommendation of the Planning Commission and re-
zoning certain property located at 516 North First Street in the City of Yakima, Washington, from
B -2, Local Business Zone, to B -3, General Business Zone.
Councilman Robinson recognizing Mr. Fred Velikanji and Mr. Howard Hettinger, attorneys represent-
ing certain petitioners on Petiton No. 151 as filed by C. 1. Chelton for Eden House Nursing Home
and others, it was MOVED by Robinson, seconded by Lemon that the Council deviate from the regular
order of business and consider matters concerningAhnexation Petition No. 151: carried, Brazier,
Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote' * /The Clerk 'of the
Council then read a letter from the Planning Commission recommending the annexation of the
property described in Petition No. 151 and further recommending that the area west of South 40th
Avenue beoDned as R -3, Multiple - family residence, that the south 205 feet of the area east of
South 40th Avenue be zoned as B -1, Modified Business and that the remainder be zoned as R -2, Two
Family residence. The matter of the date for public hearings on annexation petitions now on file

was then discussed and it was disclosed that the County Auditor has requested that no further
annexations be completed before the primary election on September 11, 1962 because new precincts
can not be established and voters rights assured in or outside of the City in time for the elec-
tion. It was MOVED by Robinson, seconded by Munger that the date for public hearing on Petition
No. 151 be fixed for August 13, 1962: �arried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger
and Robinson voting aye by voice vote. Mr. Velikanji protested this delay stating that his
clients are ready to hook on to city water and sewer. Mr. Lee Campbell, representing Glascam
Builders, who have Petition No. 150 on file, and are awaiting public hearing, stated that the
Federal Housing Administration must have assurance that the .City will service water and sewer
lines and maintain streets in their area and requested the'Council to accept this responsibility
even though their property is not yet annexed. Public Works Director Mayo explained that all
improvements in this area have been made according to city standards and that there will be
little or no maintenance to be done before the annexation can be completed. It was then MOVED by
Robinson, seconded by Lynch that Public Tildrks Director Mayo be and is hereby authorized to ex-
cute the instrument required by the F.H.A. with regard to maintenance and service in the area
sought to be annexed by Glascam Builders. Mr. Howard Hettinger explained to the Council that he
is representing Mr. Roy C. Hayes and Mr. Barney D. Benedictson who have signed the petition but
who are not pressing for annexation but who wish to guard their vested inteterest in businesses
already established on their property. Mr. Hettinger further stated that his clients are interest-
ed in B -1, Modified Business Zone, if annexed.
An ordinance appropriating $1,129.00 from the Current Expense Funds to the Finance 1962 Budget
for the purpose of replacing a motorcycle with a new three - wheeled vehicle for checking parking
meters, having been read in its entirety, was ordered laid on the table for 'one week, to be read
and considered at the next regular meeting of the Council on July 23, 1962.
An ordinance appropriating $520.00 from the Current Expense Funds to the 1962 Inspection Depart-
ment Budget for the purpose of trading an older vehicle for a newer used vehicle, having been
read in its entirety, was ordered laid on the table for one week, to be read and considered at th'
next regular meeting .of the Council on July 23, 1962.
Moved by Lemon, seconded by Munger that Ordinance No. 364 placing a parcel of real property on
the Irrigation Maintenance Roll for Local Improvement District No. 382, be passed as read:
carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger, and Robinson voting aye on roll call.
Discussion pointed out that this property had a private irrigation line at the time of constructs(
of the City Irrigation System and that this system has now deteriorated and city service is needec

Irrigation Maintenance Roll of Local Improvement District No. 382.

it was MOVED by Robinson, seconded by Brazier that the City Engineers report dated July 16, '1962
be approved and the progress estimate therein set forth be approved and payment of-same be
authorized: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by
voice vote.
A vacancy having been created on the Civil Service Commission for City Employees other than Fire
and Police by the resignation of Sidney Reese, it was MOVED by Lynch, seconded by Robinson that
Mr. Frank Fairchild be and is hereby appointed to serve the unexpired term of Mr. Reese on said
Board:--carried.; Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice
vot.
Councilman Kurbitz requested that the matter of a Civic Auditorium be placed on the agenda for
discussion and consideration in the near future. Discussion disclosed that this matter will be
included in the Development Committee's report which will be available soon.
Judge Hogan having made a written request to the City Council to pass an ordinance to establish
a Traffic Safety School, attended this meeting and further explained the importance of this
action as a means of cutting down traffic accidents and educating the public as well as the
violators in these matters. It was informally recommended that this matter be turned over to the
City Manager for study and recommendation.
There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by
Brazier that we do now adjourn at the hour of 4:45 P.M.: carried, Brazier, Kurbitz, Larson,
Lemon, Lynch, Munger and Robinson voting aye by voice vote.
