The City Council met in regular session, Mayor Larson, Councilman Brazier, Kurbitz, Lemon, Lynch,
Munger and Robinson, City Manager George Smith,and City Attorney Andrews present on roll call.
Councilman Brazier gave.the invocation.
Minutes of the regular meeting of July 2, 1962, approved as corrected.
In accordance with action taken by the City Council at their meeting of July 2, 1962, on a Notice
of Intention to Commence Annexation Proceedings filed by A. E. Clift and the power of attorney
not having been received by Mr. Clift which left the matter in the same position as last week, it
was moved by Lynch, seconded by Lemon that the matter be continued for one week or until July 16th
1962: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye by voice
vote.
An Ordinance appropriating $13,153.00 from Unappropriated moneys in Water -Sewer Fund to Sewage
Disposal having been read in its entirety, was ordered laid on the table for one week to be read
and considered at the next regular Council meeting on July 16, 1962.
Moved by Robinson, seconded by Munger that Resolution No. D -427 authorizing sale of surplus equip-
ment, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger-and Robinson
voting aye on roll call.
RESOLUTION NO. D -4271 A RESOLUTION authorizing the sale of certain surplus equipment owned by the
City of Yakima.
WHEREAS, the City of Yakima is the owner of certain equipment which is
surplus equipment and for which there is no conceivable need or use by the City, and
WHEREAS, it is deemed in the best interests of the City to advertise for
the sale of such equipment by the taking of competitive bids, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That the following equipment be offered for sale in the manner
hereinafter prescribed, and that the net proceeds from the sale of such equipment be paid into the
Street Fund of the City of Yakima:

JULY 9, 1962
RESOLUTION NO. D -42$, A RESOLUTION authorizing the City Manager and the City Clerk to execute
a lease agreement with Firestone Tire & Rubber Company.
WHEREAS, the City of Yakima owns real property, consisting of the old City
Police Station, situated at 10 East Walnut Street, Yakima, Washington which property is now vacant
and for which the City has no foreseeable use, and
WHEREAS, the Firestone Tire & Rubber Company desires to lease a portion of
such property for warehouse purpose, and the City Council of the City of Yakima deems it in the
best interests of the City of Yakima deems it in the best interests of the City to so lease said
space, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the City Manager and the City Clerk of the City of Yakima are hereby
authorized and directed to execute a lease agreement with Firestone Tire & Rubber Company for
warehouse space in City -owned property located at 10 East Walnut Street, Yakima, Washington, a
copy of which lease is attached hereto and by reference made a part hereof.

The Clerk of the Council having read the Planning Commission's report on Petition No. 150,
Councilman Robinson recommended a date of August 13, 1962 for public hearing to stay clear
of any changes in precincts prior to coming elections. Moved by Kurbitz, seconded by Lynch to
-refer the matter back to the Planning Commission with request to modify to B -2 instead of B -3.
lliscussion followed. Mrs. Seipp, a property owner, being present protested the R -4 zoning and
said they would take a B -2 classification and she was sure the Yergens would go along with 'a B -2
zoning. Councilman,Lynch withdrew second to the motion. Moved by Councilman Kurbitz, seconded by
Brazier, that the matter be referred back to the Planning Commission with the request they
recommend B -2 zoning for the Seipp and Yergen property, including also the areas owned by Glascam
Builders. Larson, Lemon, Lynch, Munger and Robinson voting nay. Brazier and Kurbitz aye. Motion
was lost. Councilman Robinson moved, seconded by Lemon that the matter be considered two weeks
from this meeting on July 23, 1962, which would give the Seipps and Yergens time to reconsider
their request, carried: Brazier, Kurbitz, Larson, Lemon, Munger and Robinson voting aye by voice
vote.
Moved by Robinson, seconded by Brazier that the Council deviate from the regular order of business
since there were people present from the East Yakima Avenue area to protest the erection of a
fence along the freeway. They were represented by attorney, Wm. B. Holst, who spoke in their
behalf and stated that the fence allows no egress or ingress, except by foot and causes a police
and fire hazard. Mr. Holst stated there are about thirty families in the area completely blocked
out. Residents present and protesting included Mrs. James Smith, A. C. Chambers and Mr. Mc-
Laughlin who said it was almost impossible to get into the area. Mr. Swanson was present represent
ing the State Hiway Department who stated it was illegal for pedestrian traffic to be on a freeway
John Mayo, Public Works Director, being present explained and went back to the time the bi -pass
was contemplated and that the City had accepted limited access agreement. The people at a hearing
had accepted it and knew what was going on and that the fo- r- -me3City Commission in 1959 had accepted
the State's agreement for limited access plan. Councilman Kurbitz moved that the fence be
immediately removed, and that it be reconstructed at such later date as it appeard it should be
installed. Brazier asked Kurbitz to accept an amendment to the motion, so that the City Manager
might investigate the matter to see by what authority the fence was originally installed before
taking any action toward removing the fence. Councilman Kurbitz stated he would accept the amend-
ment only if Brazier refused to second the original motion, which Brazier refused to do. No other
second was made to Councilman's Kurbitz's original motion. Brazier then moved that the City
Manager investigate the matter to see by what authority the fence was originally installed, and
for study and recommendation to see if a one -way lane could be allowed, and to report by July 16,
1962. Councilman Lynch seconded the motion, carried: Brazier, Kurbitz, Larson, Lemon, Lynch,
Munger and Robinson voting aye by voice vote.
The Planning Commission reporting on Petition No. 153 filed by Erland F. Lindgren and others for
the rezone of property at 516 North First Street, it was moved by Lemon, seconded by Brazier that
the date of hearing for the B -3 rezone be set for July 16, 1962: carried, Brazier, Kurbitz,
Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote.

Manager George Smith reported that the Budget & Legislative Conference for first class cities
will be held at Tacoma, July 27, 1962.
There being no further business to come before the Council, it was moved by Lynch, seconded by
Brazier we do adjourn at the hour of 4:45 p.m.: carried, Brazier, Kurbitz, Larson, Lemon, Lynch,
Munger and Robinson voting aye by voice vote.
