Councilmen Kurbitz, Lemon, Lynda Munger and Robinson,.City Manager Smith and City Attorney Andrews present on roll call. Mayor Larson absent and excused. The invocation was given by Councilman Kurbitz. The minutes of the regular meeting of June 25, 1962 were approved as read. In accordance with action taken by the City Council at.their regular meeting of June 25, 1962 on a Notice of Intention to Commence Annexation Proceedings as filed by Mr. A. E. Clift, and Mr. Clift being present, the matter of ownership of the property to be annexed was discussed. Mr. Clift informed the Council that he is not the recorded owner of said property and his only interest is in the platting and developing of it and that the property is owned by a relative who lives in California. Councilman Robanson suggested that Mr. Clift obtain a formal Bower of Attorney to act for the legal owner in these matters. It having been determined that the signa- ture of the legal owner can be obtained on a Notice of Intention to Commence Annexation Procealing and on a Petition praying for the annexation of certain property before the next regular meeting of the City Council, it was MOVED by Robinson, seconded by Lynch that this matter be continued for one week or until July 9, 1962: carried, Brazier, Kurbitz, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Larson absent. This being the time fixed for the hearing on Petition No 146 as filed by Marshall Construction Company and others requesting the vacation of a portion of Madera Way and there being no protests in writing or otherwise, it was MOVED by Lynch, seconded by Lemon that Ordinance No. 360 provid- ing for said vacation be passed as read: carried, Brazier,.Kurbitz, Lemon, Lynch,'Munger and Robinson voting aye on roll call. Larson absent. ORDINANCE NO. 360, AN ORDINANCE providing for the vacation of that portion of Madera Way from a point 129 feet East of North 47th Avenue and West of 47th Avenue through to 48th Avenue in the City of Yakima, Washington. Councilman Robinson recognizing Mr. O.E. "Babe" Hollingbery, Moved and Councilman Lemon seconded deviate from the order of business and consider a regarding the St. to regular proclamation Elizabeths Hos�spital: carried, Brazier, Kurbitz, Lemon, Lynch, Munger and Robinson voting aye by voice vote. 7r. Hollingbery explained that he is a member of the advisory committee for the expansion of St. Elizabeth" Hospital and the proclamation which he is requesting the Mayor to sign is to establish July 10, 1962 as the "Kick -off" date for a drive for funds. It was MOVED by Robinson, seconded by Lynch that the Mayor be and. is hereby authorized to execute said proclama- tion: carried, Brazier, Kurbitz, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Lar on abs nt There being an error in the property description set forth in Ordinance No. 305, it was MOVED by Robinson, seconded by Lemon that Ordinance No. 361 providing for the vacation of a certain public utility easement and repealing Ordinance No. 305, be passed as read: Brazier .carried, Kurbitz, Lemon, Lynch, Munger and Robinson voting aye on roll call. ORDINANCE NO. 361 AN ORDINANCE providing for the vacation of a certain public utility easement across the following described property, towit: The South 6 feet of the North 334.85 feet of the East 63.5 feet of the West 127.3 feet of the Northeast Quarter of the Northwest Quarter of the Northwest Quarter of Section 22, Township 13 North, Range 18, E.W.M.; repealing Ordinance No. 305 and declaring an emergency. Moved by Kurbitz, seconded by Lemon that Resolution No. D -426 transferring $260.00 in the 1962 Budget for Sewage Disposal, be passed as read: carried, Brazier, Kurbitz, Lemon, Lynch, Munger and Robinson voting aye on roll call. Larson absent. RESOLUTION NO. D -426, A RESOLUTION transferring the sum of $260.00 vrithin the 1962 appropriation for 52:7 - Sewage Disposal, and WHEREAS, a surplus exists in Account 7 -55.4, Heat & Fuel, of the Maintenance & Operation classification of the 1962 appropriation for 52.7 - Sewage Disposal, and WHEREAS, it is necessary that additional funds be transferred to Account 6 -21, Stationary Equipment, of the Capital or Betterment classification, in order to purchase an incubator, pipette outfit and stirrer for the Sewage Plant laboratory in order to provide infor- mation for the sewage system improvement program, and WHEREAS`, at the time of the adoption of the 1962,Budget, it could not have reasonably been foreseen that the above additional sum would be required, and the City Council finds it in the best interests of the City of Yakima to make the aforesaid transfer, and that the action contemplated herein is authorized by R.C.W. 35.33.120, now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the sum of $260.00 is hereby transferred from Account 7 -55.4, Heat & Fuel, of the Maintenance & Operation classification, to Account 6 -21, Stationary Equipment, of the Capital or Betterment classification, both within the 1962 appropriation for 52.7 - Sewage Disposal. Section 2. The Director of Finance of the City of Yakima is hereby authorized and directed to make the aforesaid transfer. ADOPTED BY THE CITY COUNCIL this 2nd- doy of July, 1962. BRAZIER, JR., DEPUTY CITY CLERK MAYOR Pro Tem /The Trading Post at 810 ',Nest Lenox having filed application for a Fireworks Permit, it was MOVED by Lynch, seconded by Munger that said application be approved: carried, Brazier, Kurbitz, Lemon, Lynch, Munger and Robinson voting aye by voice vote. Larson absent. On January 15, 1962 the City Council passed Resolution No. D -351 authorizing the ,use-of fire apparatus and personnel to operate same to provide fire protection to Yakima 'County Fire District No. 13 for a period of six months or until July 15, 1962. This matter was reviewed with Mr. Richard Smith, Attorney for Fire District 13 and W. K. "Pete" Moore, City Fire Chief. Mr. Smith requested three months extention of the Cityts fireprotection service,stating that r 3128 JULY 23 1962 Fire District 13 is,preparing to vote on a $15,000.00 Bond issue in September and if it passes the district will then be able to buy a used fire truck. He indicated that if the bond issue does not pass, Fire District 13 will probably again offer the $2,000.00 tax money received by them, to the City of Yakima and request city fire protection. Chief Moore stated th at the City's basic policy is to serve outside the city only when city property is in danger. He also stated that we are in the season of grass fires and that this area is particularly hazardous on this score and one piece of equipment will be tied up for this use. City Attorney Andrews explained the City's fire protection program with regard to weedy lots and further explained that this program cannot be carried on; outside the corporate limits of the City. Councilman Lynch stated that he believes that Fire District 13 has passed by it's opportunity by not annexing to the City, that the City has shown it's "goodwi_ll ".by giving protection for a period of 6 months, that we can not be magnanimous with taxpayers money, that this district has other alternatives in that it can borrow equipment or contract with Fire District 4 at Terrace Heights. Councilman Kurbitz stated that a precedent is being set and that a definite limitation should be fixed. Councilman Robinson ex- plained that he is opposed to extending further service under any other circumstances, that it is an expense to the City and hazardous to city.property, but that this area is important to the City and if they vote to bond themselves, they have done as much as they can. Councilman Robinson then MOVED and Councilman Kurbitz seconded that the City Attorney prepare a resolution extending fire protection for two months or until September 17, 196E: Kurbitz ' n Robinson voting aye on roll call. It was also disclosed in this discussion that the Harcourt Taylor property, which is located in this district, has been purchased by the Metropolitan Park District. City commented on the 1963 Budget Manual which was handed to members of the Council on this date. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Lemon that we do now adjourn at the hour of 4:35 P.M: carried, Brazier, Kurbitz, Lemon, Lynch, Munger and Robinson voting aye by voice vote.
