HomeMy WebLinkAbout06/25/1962 Business Meeting1 1 r J 1 325 JUNE 25 9 1962 The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, Larson, Lemon Lynch, Munger and Robinson and Acting City Manager Andrews present on roll call. City Manager Smith absent and on vacation. The invocation was given by Councilman George Lemon. The minutes of the regular meeting of June 25, 1962 were approved as read. An ordinance prohibiting hazardous activities in public parks and playgrounds having been read by the Clerk of the Council, it was MOVED by Lemon, seconded by Munger that Ordinance No. 357 regulating activities in public parks and playgrounds, be passed as read: Kurbitz, Larson, Lemon. Munger and Robinson voting aye by voice vote. Brazier and Lynch voting nay. Councilmen Brazier and Lynch qualified their votes by explaining that they are not against this type of ordinance but are protesting the language used in ordinance No. 357 and believe that only that part of the activities named which pose a manifest hazard, such as motorized model airplanes, should be pro- hibited. The ordinance read being an emergency ordinance, which takes a unanimous vote of the Council, to pass and Mr. John F. Chesterly, Chairman of the Metropolitan Park Board and Mr. Ed Putnam, Superintendent of ,the Parks and Playgrounds, being present,and indicating that there is an immediate need for the passage of said ordinance, Councilmen Brazier and Lynch changed their vc to aye and requested the City Attorney to prepare an amending ordinance defining in detail the limitations on hazardous activities. Ordinance No. 357 was then declared pass.ed by a unanimous vote. ORDINANCE NO. 357, AN ORDINANCE prohibiting hazardous activities in publi parks and playgrounds; making exceptions thereto; adding Section 13.16.145 to the City of Yakima Municipal Code; and declaring an emergency. An ordinance appropriating $11,500.00 to the Sewer Expansion Fund having been read in its entirety and laid on the table for one week from the regular meeting of June 18, 1962, and having been read by title only at this meeting, it was MOVED by Brazier, seconded by Lemon that Ordinance No. 358 providing for said appropriation,be passed as read: carried, Brazier, Larson, Lemon, Lynch, 1,unger and Robinson voting aye on roll call. ORDINANCE N0. -358, AN ORDINANCE appropriating the sum of $11 500.00 from the unappropriated money to be deposited in the Sewer Expansion Fund to Account 6 -31, Construction and Other Improve- ments of the Capital or Betterment classification of the 1962 appropriation for 52.9 - Sewer Expansion Fund. This being the time fixed by the Council for the hearing on Petition No. 140 as filed by Donald W. Iv7onroe and.others requestd ng construction of sanitary sewers in Flagg Addition, and Resolution No. D -416, being a resolution of intention to construct sanitary sewers in Flagg Addition, and there being no protests in writing or otherwise, it was MOVED by Robinson, seconded by Munger that Ordinance No. 359, providing for said improvement and creating L.I.D. No. 902, be passed as read: carried, Brazier, Kurbitz,_ Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call. ORDINANCE NO 359, AN ORDINANCE providing for the improvement of certain property by constructi a pipe sewer with the necessary wye branches and manholes; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. Councilman Lemon was excused at the hour of 4 o'clock P.M. and for the balance of this meeting. Petition No. 152 having been filed with the City Clerk on June 19, 1962 by Bernard F. Chouinard and others requesting the construction of water mains and other appurtenances on 31st Avenue Soutr it was MOVED by Lynch, seconded by Munger that said petition be referred to the City Manager and staff for study and recommendation: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinsor voting aye by voice vote. Lemon absent. Petition No. 153 having been filed with the City Clerk on June 20, 1962 by Erland F. Lindgren and others requesting the rezone of certain property located at 502 through 516 North lst Street, from B -2 local business zone to B -3 General Business zone, it was MOVED by Brazier, seconded by Robinson that said petition be referred to the Planning Commission for recommendation: carried , Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye by voice vote. Lemon absent. A NOTICE of Intention to Commence Annexation Proceedings having been filed with the City Clerk by A. E. Clift on June 19, 1962, said notice describing certain property North of Englewood Avenue and east of 58th Avenue, it was MOVED by Robinson, seconded by Lynch that the City Council meet with the petitioner on July 2, 1962 to determine if the property described in the notice will be accepted for annexation and if the owners thereof will be required to assume the Cityts indebtedne carried, Brazier, Kurbitz, Larson, Lynch, Munger, and Robinson voting aye by voice vote. Lemon absent. outside the City for a new plant C. M. Holtzinger Fruit Company having made a written request for water service /which they plari to build on North 6th Avenue, it was MOVED by Lynch, seconded by Kurbitz that Resolution No. D -425 authorizing the execution of a contract with said fruit c=ompany for the construction of a water line outside the corporate limits of the City, be passed as read: carried, Brazier, Kurbitz, Larson, Lynch, Munger and Robinson voting aye on roll call. Lemon absent. RESOLUTION NO. D -425, A RESOLUTION authorizing the City Manager and the City Clerk to execute a contract with C. M. Holtzinger Fruit Co., Inc., for the construction of a water line. WHEREAS, C. M. Holtzinger Fruit Co., Inc., is desirous of being furnished with City water in connection with the operation of its business, the same being outside the corporate limits of the City, and is willing to pay a share of the construction costs pursuant to the provisions of R.C.W. Chapter 35.94 and WHEREAS, it is deemed in the best intersts of the people of the City of Yakima to enter into such contract and to perform such construction, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: e 3s: F r 3 `6 Jt1,NF_25, 1962 That the Citv Manager and the City Clerk of the City of Yakima are hereby authorized and directed to enter into a contract with C. M. Holtzinger Fruit Co., Inc., for the construction of a_12 -inch cast iron domestic water line, a copy of which contract is attached hereto and by reference made a part hereof. Lemon absent The following bids having been received by a bid board for the construction of sanitary sewers and a sewer lift station as provided for in L.I.D. No. 900 and 902 Schedule I Valley Plumbing & Heating 29,168.05 N. L. Kimball 34,629.14 Hughes Construction 137,132-94 Schedule II N. L. Kimball 12,421.76 Hughes Construction 12,625.60 Valley Plumbing & Heating 113,230.88 and the City Engineer recomending that Schedule I be- awarded to Valley Plumbing and Heating Co., and Schedule II be awarded to N. L. Kimball, said bids being the lowest and best bids, it was MOVED by Robinson, seconded by Lynch that said recommendation be accepted and approved and the bicb be awarded to Valley Plumbing & Heating Company in the amount of $29,168.05 on Schedule I and to N. L. Kimball in the amount of $12,421.76 on Schedule II and the City Manager be and is hereby authorized to enter into a contract with said 'contractors upon the filing of the proper bond by them: carried, Brazier, Kurbitz, Larson, Lynd -, Munger and Robinson voting aye by voice vote.
