The City Council met in regular session, Mayor Larson, Councilmen Brazier, Kurbitz, , Lemon,
Lynch and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman
Munger absent and excused.
Councilman Lynch gave the invocation.
The minutes of the regular meeting of June 4, 1962 were approved as corrected.
In accordance with action taken by the City Council at their regular meeting of June 4, 1962, the
matter of vending on the streets of the City of Yakima, was again considered. Councilman Robinson
explained that after considering the changes in the area of Fair Avenue due to the construction of
the By -Pass Highway, he felt that Fair Avenue should be deleted from Section 2, as read '.arid amend-
ed, and it was MOVED by him, seconded by Lemon that Fair Avenue be deleted from Section 2, as
amended: carrie,�, Brazier, Kurbitz, Larson, Lemon, Lynch, and Robinson voting aye by voice vote.
Munger absent. All persons having been heard on this matter and a motion to pass the original
ordinance as read on June 4, 1962, having been made by Robinson, seconded by Brazier, and certain
amendments to said ordinance having been duly adopted by the Council at their regular meetings of
June 4, 1962 and at this meeting, Mayor Larson called for a roll call vote on the original motion
as amended and Ordinance No. 345 relating to street selling in the City of Yakima was passed:
Brazier, Larson, Lemon, Lynch and Robinson voting aye on roll call. Kurbitz voting nay, stating
that this ordinance is making more restrictions which are not needed. Munger absent.
ORDINANCE NO. 345, AN ORDINANCE relating to street selling in the City of Yakima; exempting
certain persons from the prohibition against peddling and street selling; setting out limits
wherein street selling is prohibited; regulating street selling; and amending Section 5.56.050
and adding new Sections 5.56.051, 5.56.053 and 5.56.055, all of the City of Yakima Municipal Code.
Also in accordance with action taken by the Council at their regular meeting of June 4, 1962, it
was MOVED by Lynch, seconded by Lemon that Resolution No. D -417 authorizing the urchase of
equipment and parts for the conversion parking meters for a price not to exceed 42,500.00 plus
sales tax, without calling for bids, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon,
Lynch and Robinson voting aye on roll call. Munger absent. Discussion pointed out that $42,_500.
is more than originally estimated for this project and the increase in cost is due to the fact
that there are only 165 meters to trade in instead of 250 as originally estimated.
RESOLUTION NO. D -417, A RESOLUTION authorizing the purchase of equipment without calling for bids
WHEREAS, it is necessary to purchase parking meters, parking meter parts,
and other parking meter equipment, together with work, labor and materials for the conversion of
parking meters and their installation, from the Dual Parking Meter Company,- a subsidiary of Rock-
well Manufacturing Company, for a price not to exceed $42,500.00 plus sales tax, and
WHEREAS, funds in excess of the amount budgeted for expenditure from park-
ing meter revenue will be available to pay the purchase price for such parking meters, parts and
equipment and work, labor and materials as. contemplated by the contract for the purchase of the
same to be executed by the City and the Dual Parking Meter Company, and
WHEREAS, it is necessary to obtain said.materials as soon as possible, and
an emergency is hereby declared to exist, and
WHEREAS, said materials are obtainable from or;ly one source, and it would
serve no purpose to advertise for bids, and the City Council finds that it is in the best interes
of the people of the City of Yakima to purchase said equipment without calling for bids, now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the Purchasing Agent of the City of Yakima is hereby authorized and
directed to purchase, without calling for bids, parking meters, parking meter parts, and other
parking meter equipment, together with work, labor and materials for the conversion of parking m
meters and their installation, from the Dual Parking Meter Company, a subsidiary of Rockwell
Manufacturing Company, for a price not to exceed the sum of $42,500.00 plus sales tax.

RESOLUTION NO. D -418, A RESOLUTION authorizing the City Manager and the City Clerk to execute a
contract with Dual Parking Meter Company.
WHEREAS, it is necessary to purchase parking meters, parking meter parts,
and other parking meter equipment, together with work, labor and materials for the conversion of
parking meters and their installation, and
WHEREAS, the Dual Parking Meter Company, a subsidiary of Rockwell Manufact
ing Company, has offered to furnished such parking 'meters, parts and equipment and work, labor
and materials for a price not to exceed $42,500.00 plus sales tax, and
WHEREAS, the City Council finds it to be in the best interests of the
people of the City of Yakima to enter into a contract with said company to purchase said equipment
and work, labor and materials, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the City Manager and the City Clerk of the City of Yakima are hereby
authorized and directed to execute a contract with Dual Parking Meter Company, a subsidiary of
Rockwell Manufacturing Company, to purchase parking meters, parking meter parts, and other park -
ing meter equipment, together with work, labor and materials for the conversion of parking meters
and their installation, for a price not to exceed $42,500.00 plus sales tax, a copy of which said

of a bond issue for improvement to the water and sewer system, be passed as read: carried,

RESOLUTION NO. D -419, A RESOLUTION authorizing the City Manager and the City Clerk to enter into
an agreement with Wm. P. Harper & Son & Company for the purpose of assisting with the preparation
of a bond issue for improvements to the water and sewer system of the City of Yakima.
WHEREAS, the City is planning improvements to its combined municipal water
and sewer system which are to be financed by the issuance of approximately $$800,000.00 in water
and sewer revenue bonds, and
WHEREAS, by Resolution No. D -378 the City Manager was authorized to negoti-
ate with financial consultant firms for the purpose of selecting a firm to assist in the plans foz
financing such improvements,-and
WHEREAS, Wm. P. Harper & Son & Company are municipal bond dealers of
Seattle, Washington, and are experienced in municipal financing, and the City Council finds it to
be in the best interests of the people of the City of Yakima to employ said firm as financial
advisers in planning improvements to the water and sewer system, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the City Manager and the City Clerk of the City of Yakima are hereby
authorized and directed to enter into an agreement with Wm. P. Harper & Son & Company to employ
said firm as financial advisers in planning improvements to the City's combined municipal water
and sewer system, a copy of which agreement is attached hereto and by reference made a part here-
of.

A Notice of Intention to Commence Annexation Proceedings having been filed with the City Clerk on
June 5, 1962 by C. L. Shelton and others for the Eden House Nursing Home, Inc., property to be
annexed being located on 40th Avenue between Tieton Drive and Walnut, it was MOVED by Brazier,
seconded by Kurbitz that said notice be accepted and the Council meet with the officers and
representatives of said Nursing Home and property owners at the next regular meeting of the Counci
on June 18, 1962 to determine if the property described in its Notice of Intention to Commence
Annexation Proceedings will be accepted for annexation and if the owners thereof will be required
to assume the City's indebt dness: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and Robinson
voting aye by voice vote.7Tr. C. L. Shelton, President of Eden House Nursing Home,'Inc., explain-
ed that they own 5 acres and tha the owners of the balance of 11 acres are interested in annexing.
Mr. Fred Velikanji, attorney for the Petitioners, explained that his clients must have the zonin
as requested in order that their property will not become nonconforming. He assured the Council
that the matter of 50 foct streets is understood.and protested the signing of an agreement for X1
water and sewer service stating that the agreement used is one that cannot,be lived under.
Councilman Robinson expressed concern over the zoning request and urged that the Planning
Commissions recommendations be obtained before accepting this property for annexation.
Moved by Robinson, seconded by Brazier that Ordinance No. 346 relating to fireworks and regulating
the sale and use of them, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and
Robinson voting aye on roll call. Munger absent.
ORDINANCE NO. 346, AN ORDINANCE relating to fireworks; regulating the sale and use thereof; pro-
viding penalties; repealing Sections 6.04.455, 6.04.460 and 10.04.330 of the City of Yakima
Municipal Code; and declaring an emergency.
An ordinance fixing the salary of the Police Judge or Municipal Judge of the City of Yakima at
$10,000.00 having been read by the Clerk of the Council, it was MOVED by Robinson, seconded by
Brazier that said ordinance be passed as read. Mr. Wes Britt questioned the advisability of in-
creasing this salary since only one of the city's two Justices of the Peace will be able to become
the Municipal Judge and the other one would receive a salary of only $$5,400.00 per annum since the
County has not increased this salary. Councilman Lynch, feeling that a 20% increase over the
$$8,000.00 now paid for this position would be adequate, MOVED and Councilman Lemon secoonded to
amend the original motion to $9,600.00 per annum and this motion lost for the want of a majority
vote. Lemon and Lynch voted aye and Brazier, Kurbitz, Larson, and Robinson voting nay. Munger
absent. Councilman Robinson explained that the Bar Association had made the recommendation of
$$10,000.00 and that they have some responsibility in encouraging sound candidates and the election
of the best candidates and further explained that he felt that this action will encourage higher
caliber men to seek this position. All persons having been heard on this matter, Mayor Larson
called for the vote on the original motion to pass Ordinance No. 347 providing for and fixing the
salary of the Municipal Judge at $10,000.00. Brazier, Kurbits, Larson, Lemon and Lynch and
Robinson vote d- aye on roll. Munger absent.
ORDINANCE NO. 347, AN ORDINANCE fixing the salary of the Police Judge or Municipal Judge of the
City of Yakima and repealing Ordinance No. B -2208.
Moved by Lemon, seconded by Robinson that Resolution No. D -420 authorizing the sale to Margaret
Dahlke of real estate owned by the City of Yakima, be passed as read: carried, Brazier, Kurbitz,
Larson, Lemon and Robinson voting aye on roll call. Munger absent.
RESOLUTION NO. D -420," A RESOLUTION authorizing the sale to Margaret Dahlke of real estate owned
by the City of Yakima.
WHEREAS, the City presently owns real estate consisting of a portion of

Tracts within the City of Yakima, which property consists of vacant lots acquired by the City in
February, 1952, which have not been used by the City and for which the City has no anticipated
need, and
WHEREAS, Margaret Dahlke desires to purchase a portion of said property fo
a price of $130.50, whi h amount is the fair market value placed by competent appraisers on the
property desired to be purchased, and
WHEREAS, the City Council finds that such price is a fair purchase price
for said property and deems it in the best interests of the people of the City of Yakima that said
property be sold for its fair market value according to the appraisal thereof, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the City Manager of the City of Yakima is hereby authorized and
directed to sell the following described real estate situated in the County of Yakima, State of
Washington, to-wit:
Beginning at the Southwest corner of Lot 6, Block 1, J. H.-Hathaway's
Subdivision; thence Easterly along the South line of said Lot 6, tb-a-
point 22 feet West.of the Southeast corner of said Lot 6; thence North
and parallel with the East line ofsaid Lot 6 to the South line of the

'The Planning Commission reporting on Resolution No. D -411, pertaining to sales outside of building'
in B -2 zones and recommending the addition of such an amendment to the Zoning Code, it was MOVED
by Robinson, seconded by Lemon that a hearing be held on this matter at the next regular meeting
of the City Council on June 18, 1962 and the City Attorney be and is hereby instructed to prepare
an ordinance and alternative motion for consideration: carried, Brazier, Larson, Lemon, Lynch,
and Robinson voting'aye by voice vote.- Munger absent.
The Planning Commission also reporting on Resolution No. D -405, pertaining to Pet shops in B -2
zones and recommending against the proposed amendment as set forth in said resolution, it was

regular meeting of the City Council on June 1$,-1962 and the City Attorney be and is hereby in-
structed to prepare the necessary ordinance amending the'zoning code to allow Pet shops in B -2

voting ave by voice vote. Munger absent. Discussion of this matter raised concern regarding
outdoor sales of pets.
The Planning Commission recommending the vacation of a portion of Madera Way as requested on
Petition No. 146 and filed by Marshall Construction Co., Inc., and others, it was MOVED by Lemon,
seconded by Brazier that Resolution No. D -422 fixing the date of hearing on said petition for
the 2nd of July, 1962, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch and

A RESOLUTION fixing the time for hearing on petition for vacation of a
street.
WHEREAS, a petition has been filed with the City Council of the City of
Yakima, a municipal corporation, praying for the vacation of Madera Way described as follows, to-
wit:
now, therefore,
That portion of Madera Way from a point 129 feet East of North 47th
Avenue and West of 47th Avenue through to 48th Avenue in the City of
Yakima, Washington;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That said petition shall be brought on for hearing and determination on
Monday, the 2nd day of July, 1962, at the hour of 3:00 o'clock in the afternoon on said day at
the .office of the City Council of the City of Yakima, at the City Hall in Yakima, Yakima County,
Washington, or as soon thereafter as the same may be heard, and that notice of such hearing be

The Plar-ning Commission recommending that the - Subdivision. Code be amended to eliminat -e the con-
flict whi.ch exists between the zoning code and the 'subdivision code in the matter of minimum lot
size and dimensions, it waEf MOVED by Lemon, seconded by Robinson that said recommendation be
approved and the City Attorney be and!is hereby instructed to prepare the ordinance providing for
said Amendment for the next regular meeting of the City Council on the 18th day of June, 1962:
