This being the time fixed b stat e a,d City Charter for the seating of new Council members and t
the election of a Mayor and�qxglst)Nt_ yor for the coming biennium, and Mr. Donald H. Brazier,
Jr., Mr. John M. Larson, Mr. Robert R. Lynch, and Mr. Elliott Munger having been duly elected
to the office of Councilman and having taken their oath of office on this -date before Judge
Barnett of the Superior Court, Councilman Robinson, acting as temporary chairman, called the
meeting to order at the hour of 3:00 P.M. and Councilman Brazier, Larson, Lemon, Lynch, Munger
and Robinson,`City Manager Smith and City Attorney Andrews present on roll call. Councilman
Kurbitz was absent until 3:03 P.M. and present for the balance of this meeting.
Councilman Robinson then asked members of the Council to elect a temporary chairman and it was
MOVED by Brazier, seconded by Lemon that Councilman Robinson act as temporary chairman:
carried, Brazier, Larson, Lemon, Lynch and Munger voting aye by voice vote. Robinson not voting
and Kurbitz absent.
Councilman Brazier gave the invocation.
Chairman Robinson then called for nominations for Mayor and Councilman Lemon nominated Councilman
Robinson who declined the nomination, stating that he is not available for this position., Counci.
man Brazier then nominated Councilman Larson for said position and there being no further nomina-
tions, it was MOVED by Brazier,
seconde",by Lemon'that the nominations be closed and a unanimous ballot be cast for Councilman
John M. °Larson for Mayor of the City of Yakima for the coming bienium: carried, Brazier, Kurbitz
Lemon, Lynch and Munger voting aye by voice vote. Larson not voting.
Mayor Pro Tem and
Mayor Larson presiding, called for nominations for /Assistant Mayor. Councilman Lynch nominated
Councilman Brazier and Councilman Lemon nominated Councilman Munger who declined the nomination
stating that he does not have the time to serve in this position. There being no further-nomina-
tions, it was MOVED by Robinson, seconded by Lemon that the nominations be closed and a unanimous
ballot be cast for Donald H. Brazier, Jr. for Assistant Mayor: carried, Eurbita, Larson, Lemon)
Lynch, Munger and Robinson voting aye by voice vote. Brazier not voting.
The minutes•of the regular meeting of May 28, 1962 were approved as read.
Manager Smith introduced our new Utilities Director, Burton Anderson, from Anchorage Alaske, to
members of the Council.
An ordinance appropriating the sum of $20,000.00 from the unappropriated moneys in the Municipal
Airport Fund to the 1962 Budget for the purchase of the Le Roy Schreiner and Thomas Pollock
property as authorized by Resolution No. D -384 and D -3$5, having been read in its entirety at the
regular meeting of May 28, 1962, and read by title only at this meeting, it was MOVED by Robinson
seconded by Lynch that Ordinance No. 344 providing for said appropriation, be passed as read:
carried, Brazier, Kurbitz, Larson, Lemon, Lynch, Munger and Robinson voting aye on roll call.
Discussion pointed out that this property is to be used in connection with the expansion of the
Clear Zone at the Yakima Municipal Airport and that there are three-other parcels of land which
which must be obtained by condemnation and that these procedings have been delayed until a
better alignment for 16th Avenue can be worked out. It was also pointed out that this project
must be completed in order that the City may continue to participate in government funds for the
expansion of the Airport.
ORDINANCE N0. 3442 AN ORDINANCE appropriating the sum of $20,000.00 from the unappropriated
moneys in the Municipal Airport Fund to Account 6 -01, Land, of the Capital or Betterment classi-
fication of the 1962 appropriation for 39 - Municipal Airport Fund.
In accordance with action taken. by the City Council at their regular meeting of May 28, 1962, it
was MOVED by Lynch, seconded by Lemon that Resolution No. D -415 approving the recommendations of
the Committee on Parking and Transit Problems, with regard to certain parking meter revisions
and authorizing the staff to negotiate with Rockwell Manufacturing Company for the purchase of
materials for said revision, be passed as read: carried, Brazier, Kurbitz, Larson, Lemon, Lynch
Munger and Robinson voting aye on roll call.
RESOLUTION NO. D -415, A RESOLUTION approving recommendations of the Committee on Parking and
Transit Problems, setting forth the policy of the City Council with regard to parking meter
revisions, and authorizing the City Manager to negotiate with Rockwell Manufacturing Company for
the purpose of carrying out such pollicy.
WHEREAS, on May 2$, 1962 the Committee on Parking and Transit Problems,
consisting of E. R.(Buck) Munger, Robert Lynch and George Lemon, submitted to the City Council
a report containing recommendations for parking meter revisions, and
WHEREAS, after careful study of such report, the City Council desires to
adopt the recommendations as the guiding policy of the City Council with regard to parking
meter revisions, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the report dated May 2$, 1962 made by the Committee on Parking and
Transit Problems, and the recommendations contained therein, a copy of which is attached hereto,
is hereby approved and adopted as the guiding policy of the City Council with regard to parking
meter revisions;,pnd_ the) City Manager of the City of Yakima is hereby authorized and directed to
negotiate with Rockwell Manufacturing Company for the purpose of purchasing and financing
necessary parking meter clock mechanisms and other parking meter parts as well as for any work,
labor and materials necessary to effectuate the recommendations of said committee contained in
said report.

In accordance with action taken by the City council at their regular meeting of May 21, 1962, An
ordinance relating to street vending in the City of Yakima was read,.-by the Clerk of the Council
and it was MOVED by Robinson, seconded by Brazier that said ordinance be passed as read. After
discussion, it was MOVED by Robinson, seconded by Munger that said ordinance be amended in
Section 2 to include Sunset Avenue, Englewood and Fair Avenue and 1•ifie'1..seven.of the amendment in
Section 2 be changed to read "Walnut Street East of llth Avenue": carried, Brazie , Kurbitz,
Larson, Lemon, Lynch, Munger and Robinson voting ahe by voice vote. After furVAiscussion, it

it was MOVED by Robinson, seconded by Lynch that Section 2 be amended to read "that the provision'
of this ordinance shall not apply to persons or firms engaged in primary business of selling or
delivering milk or cream on a regular established route": carried, Brazier, Larson, Lemon,
Lynch, Munger, and Robinson voting aye by voice vote. Mr. Lyman Edward Barber, a vendor of ice
cream bars, questioned members of the Council on his operations since he vends from a cart on
side walks. He also protested the inclusion of Fair Avenue as a street where vending is prohibit -
" ed. Mr. Fred Palmer, attorney representing Larry Lindquist, stated that this ordinance as amende
by the Council is satisfactory to his client. Councilman Kurbitz indicated that-le feels that th'
action is anticipating something that isn,'.t giving any trouble and that this ordinance is no
improvement over the ordinance now in force. It was MOVED by Lemon, seconded by Munger that this
matter be continued to the next regular meeting of the City Council on June 11, 1962, in order
that Section 2 and 3 can be clarified and more consideration given to Mr. Lyman Barbers operationss�

Brazier and Lynch voting nay.- Mr. T. A. Ziegler, a commercial sprayer, protested the manner in
which this ordinance is being enforced, relating that Barnhardt & Sons, of Kennewick, has been
knocking on doors solicitipg business, that he has reported this information and nothing has been
done about it. Mrs. Arthur Schubal varified Mr. Zieglers complaint as to persons knocking on
doors solicity business. Mr. Allen Hanigan, 7AAA" Tree Service also varified this complaint.
Chief Soderstrom explained that this is a difficult ordinance to enforce and that he ha; been un-
able to get persons to testify.in connection with violations. , , z
Mr. W. E. Brown, Sr. protested paying a parking ticket.
Moved by Brazier, seconded by Kurbitz that Resolution No. D -416, being a resolution of intention
to improve certain property in Flagg Addition by constructing sewers, as requested on Petition No.
140 as filed by Donald Monroe and others, and fixing the date of hearing on said resolution and
Petition for the 25th day of June,.1962, be passed as read,: carried, Brazier,_Kl4rbitz, ]Larson
Lemon, Lynch, Munger and Robinson voting-aye on roll call.
RESOLUTION NO. D -416, A RESOLUTION of intention to create a local improvement district.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That it is its intention to improve the property within the following
described district by constructing a pipe sewer with the necessary wye branches and manholes; all
of said improvement to be constructed in full accordance with the plans and specifications to be
prepared by the office of the City Engineer and filed with the City Clerk.
The district to be served by and specially benefitted by and assessed for
the above - described improvement is situate in the in the City of Yakima, Yakima County, Washingtor
and described as follows:
Lots 23 through 32, Block 1, Flagg Addition;
Lots 11 through 15, Block 2, Flagg Addition; and
The route of the proposed sanitary sewer shall be parallel and
approximately 148 feet North of Lincoln Avenue. Beginning at
the existing sanitary sewer 140 feet East of North 32nd,AVenue
and running West to North 35th Avenue.
All persons who may desire to be heard with reference to said proposed
improvement are hereby notified to appear at a meeting of the City Council to be held at its
office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 3:00
o'clock P.M. on Monday, the 25th day of June, 1962, which time and place are hereby fixed for the
hearing of all matters relating to said proposed improvement or objections thereto, and for
determining the method of payment, for said improvement; and the City Clerk is hereby directed -to
give due notice of said hearing and of the intention to make the aforesaid improvements'.
All costs and expenses.in connection with the construction of said improve-
ments, including the engineering, inspection, advertising, publication of notices, and all other
expenses incident thereto, shall be levied and assessed against all of the property legally and
properly assessable therefor as provided by the laws and as above described except a proportional
cost.of the sewer lateral shall be paid by the Water -Sewer Fund of the City of Yakima.
The said assessment shall be made according to special benefits derived
from the improvement without regard to the zone and termini method.
The City Engineer is hereby directed to submit to the City Council at or
prior to the date herein fixed for said hearing, all of the data and other information required
law to be by him submitted.

Mr. William Flood, a representative of the Zebra Fire Works Company advised th Council that he
has two applications, one from the Junior Chamber of Commerce and one from th�, ,ySheriff's Posse,
to purchase fireworks in accordance ?,,,rith the new state law and urged the City Council to amend
the City Code to bring it in line with this statue in order that these and other organizations
may purchase the new typ fireworks. Discussion of this matter disclosed that a proposed ordinanc,
relating to fireworks has been submitted to Council members for study, that the new type of fire-
works allowed are cones and candle Fountains, that the State Fire Marshall has jurisdiction over
sales of fireworks, and that there are four companies that can deliver fireworks. City Attorney
Andrews stated that the question is, whether or not cities can prohibit the sale of these new
types and explained that he has been awaiting the Attorney Generals opinion on the matter. All
persons having been heard, it was MOVED by Robinson, seconded by Brazier that the proposed
ordinance relating to fireworks and regulating the sale and use of them, be place on the agenda
for the next regular meeting of the City Council on June 11, 1962: carried, Brazier, Kurbitz,
Larson, Lemon, Lynch, Munger and Robinson voting aye by voice vote.
Councilman Kurbitz read a letter signed by Dr. Fred C. Hopp, protesting the manner, in which
garbage pickup is being made. No formal action was taken on this matter and it was informally
referred to the City Manager for handling. .
Manager Smith,having submitted a written report to members of the Council on the matter of the
selection of a Financial Consultant for Sewer Bond issues, reviewed said report and recommended
that the City engage the Firm of Wm. P. Harper & Son & Company as the City's Financial Cunsultant
After discussion, it was MOVED by Robinson, seconded by Munger that the Manager's recommendations
be accepted and approved and that the City Attorney be and is hereby authorized to prepare the
necessary resolution authorizing the staff to engage the firm of TIh P. Harper & Son & Company
as the City's Financial Consultant for Sewer Bond Issues: carried, Brazier, Kurbitz, Larson,
Lemon, Lynch, Munger and Robinson voting aye by voice vote.
There being no further business to'come before the Council, it was MOVED by Kurbitz, seconded by
Brazier that we do now adjourn at the hour of 5:15 P.M: carried, Brazier, Larson, Lemon, Lynch,
Munger and Robinson voting aye by voice vote.
