Councilman Kurbitz present after 3 :05 P.M. and-Councilman Robinson present after 3:10 P.M. The invocation was given by Councilman Barber. The minutes of the regular meeting of May 21, 1962 were approved as read. Moved, by Robinson, seconded by Lemon that Ordinance No. 342 authorizing a temporary loan of $20,000.00 from the Water Deposits Fund to the Municipal Airport Fund for the purpose of purchas- ing property offered to the City of Yakima by Le Roy Schreiner and Thomas Pollock in accordance with authorization granted by Resolution No. D -384 and D -385, be passed as read: carried, Barber, Bostic, Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye on roll call. ORDINANCE NO. 3421 'AN ORDINANCE-authorizing a temporary loan of $20,000.00 from the Water Deposits Fund to the Municipal Airport Fund, providing for repayment, and declaring an emergency. An ordinance appropriating $20,000.00 from the unappropriated moneys in the Municipal Airport Fund was read in its entirety by the Clerk of the Council and ordered laid on the table for one week, to be read and considered at the regular meeting of June 4, 1962. In accordance with the formal motion made by the City Council at their regular meeting on April 9, 1962 on the-matter of an appeal from the Planning Commissions Decision'as filed by Mayfair Tavern, Inc., in connection with Petition No. 125 requesting the rezone of certain property locat- ed at 8 North 8th Street and more than 40 days having expired and the Planning Commission having failed to act with regard to making further report on this matter, it was MOVED by Barber, seconded by Morrissey that Ordinance No. 343 rezoning said property from R -3, Multiple Family Residential Zone to B -3, General Business Zone, be passed as read: carried, Barber, Kurbitz, Larson, and Robinson voting aye on roll call. Bostic and Lemon voting nay. ORDINANCE NO. 343, AN ORDINANCE rezoning certain property located at 8 North Eighth Street in the City of Yakima from R -3, Multiple Family Residential Zone, to B -3, General Business Zone. Moved by Lemon, seconded by Robinson that Resolution No. D -406 authorizing an agreement with the State of Washington relating to the installation of an underpass under the By- pass'.Highway to' and from the Rudkin Road Pumping Station and the sewage treatment plant, be passed as read: carried, Barber, Bostic, Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye on roll call. RESOLUTION NO. D -406, A RESOLUTION authorizing the City Manager and the City Clerk to enter into an Agreement with the State of Washington relating to the installation of an underpass under Primary State Highway No. 3. ' WHEREAS, the State of Washington contemplates the construction of a section of Primary State Highway No. 3 over and across property to be purchased from the City of Yakima for a purchase price of $5,352.00, and WHEREAS, the City of Yakima desires to have constructed a corrugated iron underpass under said highway °for access to and from the City's existing Rudkin Road Pumping Station and the sewage treatment plant facilities, which underpass the State of Washington has agreed to construct at the City's expense in conjunction with the highway construction work, and WHEREAS, the City Council of the City of Yakima deems it to be in the best interests of the people of the City that the installation of such underpass be performed by the State of Washington at the City's expense, and that the proceeds.from the sale of.City property to the State be applied toward the cost of constructing such underpass, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and the City Clerk are hereby authorized and directed to enter into an Agreement with the State of Washington, Washington State-Highway Commission, relative to the construction of an underpass under Primary State Highway No. 3, a copy of which Agreement is attached hereto and by this reference made a part hereof. RESOLUTION NO. D -407, A RESOLUTION authorizing the sale and conveyance of City -owned property. WHEREAS, the City is the owner of certain land within Yakima County, and WHEREAS, the State of Washington; Department of Highways, finds it necessa to acquire title to a strip of land over, upon and across said City -owned land for State Highway purposes in the construction and improvement of Primary State Highway No. 3, and WHEREAS, after due consideration by the City Council, the Council deems it in the best interests of the people of the City of Yakima to convey such necessary land to the State of Washington by quit claim deed for a consideration of $5,352.00, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That in accordance with the authority vested in the City Council by virtue of R.C.W. 47.12.040, the City Council does hereby authorize and direct the City Manager and the City Clerk of the City of Yakima to execute and deliver to the State of Washington, Department of Highways, a quit claim deed conveying the following described property situated in Yakima County, Washington: All that portion of the hereinafter described Parcel "A" lying West of I F, 310 MAY 28, 1962 a line drawn parallel with and distant 30 feet East, when measured At right angles, from the "FG" center line survey of Primary State Highway No. 3, East Yakima Avenue to Union Gap. The hereinbefore mentioned Parcel "A" is described as follows: The South Half of the Southeast Quarter of the Southeast Quarter of Section 29, Township 13 North, Range 19, E.W.M., EXCEPT the West 200'feet. ALSO the North Half'of the Southeast quarter of the Southeast Quarter of Section 29, Township 13 North, Range 19, E.W.M.; for a consideration to the City of $5,352.00 ATTEST: J. RESOLUTION NO. D -408, A RESOLUTION- authorizing the City Manager and the City Clerk to grant an easement to the State of Washington. WHEREAS, in connection with the construction by the State of Washington of Primary State Highway No. 3, East Yakima Avenue to Union Gap, it is necessary that the State be afforded an easement over property owned by the City for the purpose of relocating an irriga- tion ditch, and WHEREAS, the City Council of the City of Yakima deems it in the best inter- ests of the people of the City to grant such an easement and permission for such construction, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and the City Clerk of the City of Yakima are hereby authorized and directed to execute and deliver to the State of Washington a deed of easement granting permission to the State to construct an irrigation facility across land owned by the City described as follows, to -wit: Attest; J. Smith City Clerk A strip of land 15 feet wide and 1,320 feet long in the Southeast Quarter of the Southeast Quarter of Section 29, Township 13 North", Range 19, E.W.M., lying Easterly of, parallel with and contiguous to the existing Easterly right -of -way line of Primary State Highway No. 3, East Yakima Avenue to Union Gap, and extending from the North to the South line of the above - mentioned subdivision. BOSTIC Mayor Moved by Larson, seconded by Lemon that Resolution No. D -409 rejecting all bids to supply liquid chlorine to the City of Yakima for the balance of the Calendar year 1962 and authorizing the extension of the present contract through December 31, 1962, be passed as read: carried, Barber Bostic, Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye on roll call. Discussion dis- closed that all bids received and considered by the bid board for the supplying of liquid chlorine were identical. RESOLUTION NO. D -4092 A RESOLUTION rejecting all bids to supply liquid chlorine to the City of Yakima and authorizing the City Manager and the Purchasing Agent to extend the present contract through December 31, 1962. WHEREAS, heretofore, the City of Yakima, by and through its Purchasing Agent, advertised for the receipt of bids for the supplying to the City of Yakima of liquid chlorine for the requirements of the City for the balance of the calendar year 1962, and WHEREAS, four companies, to -wit: Cascade Carbonics & Chemical Corp., Yakima Valley Spray Company, Pennsalt Chemicals, and Van Waters & Rogers, submitted bids to the Purchasing Agent of the City of Yakima to supply said requirements, said bids being identical in every respect, and WHEREAS, the City Council believes and finds it to be in the best interests of the people of the City of Yakima to reject all of the aforementioned bids and to extend the present contract through December 31, 1962, which will allow credit for 15 tons purchased during 1962 and place the City in a volume bracket. that will result in a net savings to the City of $300.00, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the bids submitted by Cascade Carbonics & Chemical Corp., Yakima Valle: Spray Company, Pennsalt Chemicals, and Van Waters & Rogers to supply the 1962 requirements of the City of Yakima for liquid chlorine are hereby rejected, and the City.Manager and the Purchasing Agent are hereby authorized and directed to extend the present contract for supplying liquid chlorine through December 31, 1962. RESOLUTION NO. D -4101 A RESOLUTION of intention to create a local improvement district. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA*: That it is its intention to improve the property within the following'de- scribed district by,constructing a pipe sewer with the necessary wye branches and manholes; all of said improvement to be constructed in full accordance with the plans and specifications to be prepared by the office of the City Engineer and filed with the City Clerk. The district to be served by and specially benefitted by and assessed for the above - described improvement is situate in the City of Yakima, Yakima County, Washington, and described as follows: On Conestoga Boulevard from a point 735 feet East more or less of the centerline of North Nob Hill Road to the centerline of North Nob Hill Road. On North 46th Avenue from Conestoga Boulevard to 150 feet more or less South of Modesto Way. On Modesto Way from North 46th Avenue to the centerline of North Nob Hill Road. All costs and expenses in connection with the construction of said improve - ments, including the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor as provided by the laws and as above described, except a proportional cost of the sewer lift station, force main and trunk sewer shall be paid by the Water -Sewer Fund. The said assessment shall be made according.to special benefits derived from the improvement without regard to the zone and termini method. The City Engineer is hereby directed to submit to the City Council at or prior to the date herein fixed for said hearing, all of the data and other information required by law to be by him submitted. Ernst and Kenneth E. Matson and fixing tree date of hearing on said resolution and petition for the 18th day of June, 1962, and repealing resolution No. D -398, be passed as read: carried, Barber, Bostic, Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye on roll call. Discussion disclosed that due to an inadvertent.error in procedure, it is necessary to commence action on Petition No. 143 anew. RESOLUTION NO. D -4111 A RESOLUTION of intention to create a local improvement district. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: I r � 3 1.2 MAY 2$,1962 That it is its intention ti improve the following described property by constructing the necessary mains, firehydrants, valves, and other appurtenances for the purpose cf supplying water for domestic use and fire protection; all of said improvement to be constructed in full accordance with the plans and specifications to be prepared by the office of the City Engineer and filed with the City Clerk. The district to be served by and specially benefitted by and assessed for the'abobe- described improvements is situate in the City of Yakima, Yakima County, Washington, and described as follows: Lots 15, 16, 181 20 and 21 Carriage Hill Addition; Lots 76, 77, 80, 811 84 and 85, Carriage Hill Addition; and Lots 65 through 67 and 87 through 99, Carriage Hill Addition. All persons who may desire to be heard with reference to said proposed improvements are hereby notified.to appear at a meeting of the City Council to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 3:00 o'clock p.m., on Monday, the 18th day of June, 1962, which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method -of payment for said improvement; and the City Clerk is hereby directed to give notice of said hearing and of the intention to make the aforesaid improvements. Bostic not voting. RESOLUTION NO. D -412, A RESOLUTION of appreciation and commendation for the services performed by Thomas c. Bostic during his tenure as a member of the City Council and as Mayor of the'City of Yakima. WHEREAS, Thomas C. Bostic was duly elected in 1959 to the first City Council of the City of Yakima under the present Co- uncil- Manager form of government, and WHEREAS, Mr. Bostic has served as the first Mayor of the City of Yakima under such form of government and has unstintingly devoted his time and effort to the responsibili ties of such office, and WHEREAS, Mr. Bostic has at all times, during his tenure of office, accepted his responsibilities and performed his duties conscientiously and in a highly commendable manner; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Council of the City of Yakima, acting on behalf of all the citizens of the Citjr of Yakima, does hereby express its sincere appreciation and commends Council- man Thomas C. WHEREAS, Ed M. Morrissey has served as a member of the Yakima City Council sihce March 19, 1962, and has, at all times, during his tenure of office, accepted his responsi- bilities and performed his duties conscientiously and in a highly commendable manner; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Council of the City of Yakima, acting on behalf of all of the citizens of the City of Yakima, does hereby express its sincere appreciation and commends Councilman Ed M. LARSON Mayor Pro Tem Manager Smith reported on and reviewed a written report as submitted by Councilman Munger,, Lynch and Lemon,who are serving as a committee on Parking and Transit problems,'said report making specific recommendations for parking meter revisions. Discussion pointed out that only one company makes the parts necessary for the recommended revision and that they can be purchased on time without interest charge. Councilmembers wishing to adopt the committee's recommendations, it was MOVED by Larson, seconded by Morrissey that the report as submitted by the Committee on Parking and Transit Problems be approved and accepted and that the City Attorney be and is hereby instructed to prepare the necessary resolution authorizing the staff to negotiate for the purpose of carrying out said recommendations: carried, Barber, Bostic, Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye by voice vote.
