HomeMy WebLinkAbout05/21/1962 Business MeetingF, 6 MAY 212 1962 The City Council met in regular session, Mayor Bostic, Councilmen Barber, Kurbitz, Larson, Lemon, Morrissey and Robinson, City Manager Smith and City Attorney Andrews present on roll call. The invocation was given by Councilman Lemon. The minutes of the regular meeting of May 14, were approved as read. In accordance with action taken by the Council at their regular meeting of May 14, 1962, Mayor Bostic recognized Charles Countryman, Attorney representing three Dairy Queen operators, who protested the vending of ice cream bars and ice cream products from skooters and trucks upon the streets of the city. Mr. Countryman stated that his clients have fixed investments, pay taxes, maintain high "standards of sanitation and have no traffic problem since they have off street parking. He asked the Council to recognize the real traffic problem and the safety of children buying from these vendors. Mr. Countryman further stated that his clients are not protesting the operation of Larry Lindquist, but are protesting the possibility of companies with many trucks or skooters being allowed to operate. City Attorney Andrews explained that Ordinance No. 8-875 as amended allows street sales of dairy products which includes ice cream bars, without restric- tion. Mr. Robert E. Willis, attorney for Larry Lindquist, an ice cream vendor, again spoke on behalf of his client. Mr. Charles Madden, the operator of the food concession at the ball park, protested the operation of these vendors. Councilman Robinson reminded those present that the Council cannot legislate on competition, and must be concerned with the problems of traffic and sanitation. All persons having been heard, it was MOVED by Robinson, seconded by Barber that thi: matter be continued for two weeks or until the meeting of June 4, 1962 in order that the Council may study what is being done in other cities on this problem: carried, Barber, Bostic, Kurbitz, Larson, Lemon and Robinson voting aye by voice vote. This being the time fixed by the Council for the hearing on Petition No. 138 as filed by Don E. Foster praying for the annexation of certain property north of Kerns Addition and South of Engle- wood Avenue, and there being no protests in writing or otherwise, it was MOVED by Lemon, seconded by Kurbitz that Ordinance No. 341 providing for said annexation be passed as read: carried, Barber, Bostic, Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye on roll call. ORDINANCE No. 341, AN ORDINANCE providing for the annexation by the City of Yakima, Washington, of certain property contiguous to the City of Yakima, and zoning the same as R -3, Multiple Family Residential Zone. This being the time fixed by the Council for the hearing on the appeal from the Planning Commis - sionts decision denying the request for the rezoning from R -2 to R -3 of certain property situated at the Northeast corner of 12th Avenue and Baker Street as petitioned for by Woodrow Edinger on Petition No. 135, Mr. Edinger explained that he wishes to build an apartment court consisting of 16 to 20 units, in a 2 story building, for students and teachers of the Yakima Valley College. It was established that duplexes can be built on this property without rezoning. Mr. Godfrey, Mrs. Frank Fulmer, Mrs. Novobielski, Mr. Ira Meyer and Mr. John Callison property owners in this area, protested the building of such a structure, stating that it will obstruct the view, that I there will be too much noise from cars and students•, that it will create a parking problem and that this structure will be out of character with the existing single family dwellings. Mr. Novobielski stated that his wife is ill and must have quiet in accordance with her doctorts orders. Councilman Kurbitz stated that a change is inevitable in this neighborhood as the college grows and that the area will support a good apartment house and therefore he is in favor of the college housing. All persons having been heard and i,t. having been MOVED by Robinson, seconded by Lemon that Resolution No. D -403 affirming the action of the City Planning Commission in denying the application of Woodrow Edinger to rezone certain property located at South 12th Avenue and Baker Street from R -2, Two Family Residential Zone to R -3, Multiple Family Residential Zone, be passed as read. A roll call vote was taken by the Clerk of the Council: Bostic, Larson, Lemon, Morrissey and Robinson voting aye; Barber abstaining; Kurbitz voting nay. RESOLUTION NO. D -4031 A RESOLUTION affirming the action of the City Planning Commission in deny- ing the application of Woodrow Edinger to rezone certain property located at South 12th Avenue. and Baker Street in the City of Yakima from R -2, Two Family Residential Zone, to R -3, Multiple Family Residential Zone. WHEREAS, after proper petition and due notice, a hearing was held before the City Planning Commission on May 1, 1962, upon the petition of Woodrow Edinger to rezone the property located at the Northeast corner of South 12th Avenue and Baker Street in the -City of Yakima, Washington, more fully described as follows: That portion of Lot 9 of Plat No. 2 of the Ontario Land Company's Garden Lots, according to the plat thereof recorded in Volume "Art of Plats, page 122, records of Yakima County, Washington, described as follows: Beginning at a point 470 feet West and 211 feet South of the North- east corner of said Lot 9; thence West 140 feet; thence .South 120 feet; thence East 140 feet; thence North 120 feet to the point of beginning; situated in the County of Yakima, State of Washington; from R -2, Two Family Residential Zone, to R -3, Multiple Family Residential 'Zone, and WHEREAS, said Planning Commission by letter notified.the City Council of the City of Yakima of the denial of said petition by the City Planning Commission, and WHEREAS, within the time specified by law, the said pe titioner appealed from the denial of said petition to the City Council, and WHEREAS, a hearing was held by the City Council on said appeal on May 21, 1962, and the City Council finds that the recommendation of the City Planning Commission denying said rezone should be approved upon the grounds that such rezoning is not in accord with good planning and with the Comprehensive Plan of the -City of Yakima, and that the needs of the City and community do not require such change, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the action of the City Planning Commission in denying the application of Woodrow Edinger to rezone certain property located at the Northeast corner of South 12th Avenue and Baker Street in the City of Yakima from R -2, Two Family Residential Zone, to R -3, 1 1 1 1 i J 1 1 307 MAy_2.1_,_1 A62 11 Multiple Family Residential Zone, is hereby confirmed. BOSTIC Mayor T40VED by Larson, seconded by Robinson that Resolution No. D -404 authorizing the City Manager to make application for a federal grant for sewage treatment work, be passed as read: carried, Barber, Bostic, Kurbitz, Larson, Lemon and Robinson voting aye on roll call. Morrissey voting nay. Discussion pointed out that June 1, is the deadline-Tor-making this application. Council- man Morrissey explained that he does not believe this action to be in the best interests of the people,of the City as stated in the Resolution. Councilman Larson and Robinson explained that this issue is not one of federal aid but of participating in a program already set up. RESOLUTION NO. D -404, A RESOLUTION authorizing the City Manager to make application for a federal grant for sewage treatment works. WHEREAS, the City of Yakima contemplates the installation of a sewage treatment works project, generally known as the Washington Avenue Interceptor Sewer, as a portion of the City's sewage treatment works, and WHEREAS, under the terms of Public Law 660, as amended, the United States of America has authorized money grants to municipalities to aid in the construction of sewage treatment works, and WHEREAS, the City Council of the City of Yakima deems it in the best interests of the people of the City to apply for such a federal grant for the purpose of aiding the construction of such Washington Avenue Interceptor Sewer, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager of the City of Yakima is hereby authorized and directed to do all things necessary to apply for a federal money grant in aiding the construction of the City's sewage treatment works project, known as,the Washington Avenue Interceptor Sewer. BOSTIC Mayor Moved by Robinson, seconded by Morrissey that Resolution No. D -405 declaring the intention of the City Council to amend the Zoning Code, be passed as read: carried, Bostic, Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye on roll call. Councilman Barber excused at the hour of 4:30'P.M. Discussion disclosed that this resolution is brought on for consideration due to a request made for the purpose of allowing a pet shop in a B -2 zone, specifically at 1119 Division. RESOLUTION NO. D -4051 A RESOLUTION declaring the intention of the City Council of the City of Yakima to amend Section 12.32.010 of the City of Yakima Municipal Code. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the City Council of the City of Yakima does hereby declare its intention to amend Section 12.32.010 of the City of Yakima Municipal Code by adding a new sub - section 34, to read as follows: " 12.32.010 USE REGULATIONS. In a B -2 Zone, no building shall be erected, reconstructed or structurally altered, nor shall any building or land be used for any purpose except as hereinafter specifically provided and allowed by this chapter, subject to the provis- ions of Chapter 12.56 governing off - street parking requirements. In a B -2 Zone, the following uses only are permitted: 34. Pet shops." Section 2: The Clerk of the Council is hereby directed to file a copy of this Resolution with the Planning Commission of the City of Yakima forthwith; and the Plan- ning Commission is hereby requested to hold a hearing and make a recommendation to the City Council in accordance with Chapter 12.76 of the City of Yakima Municipal Code. No. 897, being the Drake Addition Sanitary Sewer District, it was MOVED by Robinson, seconded by Morrissey-that the hearing on the assess- ment roll be held on the 18th day of June, 1962 and the'City Clerk be and is hereby instructed to give notice of said hearing to each property owner in the district and by publication as prescribed by statue: carried, Bostic, Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye by voice vote. Barber absent. Mayor Bostic made the following announcements: that the following people have accepted appoint- ments to the Development Committee - E. Ellis Cummins, Walter H. Lewis, George Corbett, M. W. (Spike) Cunningham, Donald C. Keith, Don Lemon, Lenore Lambert, Milton Martin, William H. Mays, George C. Miller, Rev. Howard Cole, Nels Haddix, Rev. Yoe T. Denman, Herbert L. Frank, Fred M. Plath, and Jake Matter. that the following Councilmen have been appointed to a committee to study the dawn town parking problem and the transit problem: George Lemon, Elliott "Buck" Munger and Robert Lynch; that the staff has been instructed to look into the feasibility of issuing courtesy parking citations to out -of -state vehicles which park overtime; to Seattle and that West Coast Airlines now has an early morning flight/ leaving Yakima at 6:30 A.M. Mr. Sid Martin, operator of the Yakima Valley Spray Company advised the Council that the Bid Board's method of rejecting identical bids is faulty and unfair, relating that his firm was one of the bidders for supplying Chlorine for the balance of the year for the City of Yakima. Discus- sion disclosed that the City has rejected all bids received for the purchase of chlorine and continued with the successful 1961 bidder who gave an allowance on purchases already made in 1962 under the 1961 contract. Mr. Martin further protested that technically the bids received were not identical -and that if he and other bidders had known that credit for purchases this year was.beink given they would have made similar allowances. Manager Smith reported that the city's method of rejecting bids has been satisfactory to State Examiners and Councilman Robinson stated that it is the city's policy:to reject uniform bids and refer them to the Attorney General for action. Manager Smith reported that he will have a report in the near future on his negotiations with financial consultant firms for the expansion of the sewer system as authorized by Resolution No. D -378. There being no further business to come before the Council, it was MOVED by Kurbitz, seconded by Larson that we do now adjourn at the hour of 5:00 P.M. carried, Bostic, Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye by voice vote.
