The Invocation was given by Councilman Morriss 297 ostic, Councilmen Barber, Kurbitz, Larson, Lemon, Andrews.present on roll call. Councilman Robinsor. The Minutes of the regular meeting of April 23,1962 were approved as read. Moved by Larson, seconded by Lemon that Resolution No. D -395 authorizing the execution of a Supplemental Agreement with Congdon Orchards, Inc., for the lease of certain property located at the Yakima Municipal Airport, be passed as read: carried, Barber, Bostic, Kurbitz, Larson, Lemon, and Morrissey voting aye on roll call. Robinson absent. RESOLUTION NO. D -395, A RESOLUTION authorizing the execution of a Supplemental Agreement with Congdon Orchards, Inc.,, for the lease of certain property on the Yakima Municipal Airport. Robinson absent. RESOLUTION NO. D -3961 A RESOLUTION transferring the sum of $115.00 within the 1962 appropriation for 14 - Legal Department. WHEREAS, a surplus exists in Account 7 -50, Travel & Training, of the Maintenance & Operation classification of the 1962 appropriation for 14 - Legal Department, and WHEREAS, in order to kee required in Account 6 -71, Books, of the Capital riation for 14 - Legal Department, and current and up to date, additional moneys are or Betterment classification of the 1962 approp- WHEREAS, at the time of the adoption of the 1962 Budget, it could not have reasonably been foreseen that the above additional expenditure would be required, and the City Council finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfer, and that the action contemplated herein is authorized by R.C.W. 35.33.120, now, therefore, BE IT RESOLVED BY THE CI Section 1. Robinson absent. P 298 APRIL 30, 1962 RESOLUTION No. D -397, A,RESOLUTION of appreciation for all Hospitals in the City of Yakima. WHEREAS, Hospitals are developed in the public interest, and WHEREAS, Hospitals assemble the professionally- trained personnel and the scientific and technical equipment and facilities to care for the ill and the injured, and WHEREAS, Hospitals keep abreast of the progress made in medical science and translate these advances into services for the individual patient and the community, and WHEREAS, Hospitals provide individual care to meet the physical, personal, spiritual and emotional needs of each patient, and WHEREAS, Hospitals stand ready to meet any emergency at any hour of the day or night, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Council of the City of Yakima, acting on behalf of all the citizens of the City of Yakima, in recognition of National Hospital Week, May 6th to 12, does hereby salute its hospitals for achievements in the provision of health care, for placing the welfare of each individual patient as their uppermost goal, and for keeping abreast of the advances in medical science and bringing them to our City. Bostic City Clerk Mayor The City Council having received a letter from the Yakima County Bar Association recommending that the salary of the Municipal Judge be increased to a total of $10,000.00 and Council members agreeing that this matter is one to be decided by the new Council since they will make the decisions in the matters of budgeting funds -for such a raise, it was informally agreed that the City Manager write a letter to the Association acknowledging their recommendations, expressing thanks for their interest and explaining the present Council's decision on the matter. Mayor Bostic then read a Proclamation declaring Tuesday, May 1, 1962, as Law Day USA in the City of Yakima, which he explained that he had signed. Mr. Stephen Huza, former Commissioner of Finance, filed with the Clerk of the Council, petitions signed by the citizens of the City of Yakima, pleading that the City Council either repeal Ordinance No. 300 relating to a business and occupation tax upon certain utilities or hold a special election in order that the registered voters of the City of Yakima may vote to repeal said ordinance and amend the Yakima Municipal Code on this matter, since the Utilities are passing this tax back to the customer. On presentation of said petitions, Mr. Huza expressed criticism of the operations of City Government stating that there are "too many Chief's and not enough Indians" and naming the Engineering and Personnel Departments as examples. Mrs. Desmond protested, naming the tax a business and occupation tax when it is paid by the people. Mr. Thoman, Manager of the Pacific Power & Light, explained that due to the cost of administering this ordinance, his Company does not itemize this tax on the customer's bill. Mayor Bostic explained the,effects of repealing this tax at this time, since the 1962 Budget was-predicated on its collection and expressed disagreement with Mr. Huza's method of meeting this problem since he started his protest after the 1962 Budget and Ordinance No. 300 were passed and did not partici- pate or encourage others to participate in the hearings on either the Budget or the ordinance. He also read par.ts,of examiners reports and minutes of Chamber of Commerce Committee meetings wherein the City Commission had been criticized for over estimating receipts and Mr. Huza had promoted a similar Business and occupation tax. Councilman Barber, Larson and Morrissey express- ed concurrence with the Mayor's remarks, Councilman Larson stressing that the public wants servicE but is not willing to pay the cost. Mr. Sid Martin suggested that more effort be spent on gettin€ back money taken from cities by the state and requested that the Council consider the advisabilit3 of holding evening meetings in order that working people will have an opportunity to attend them. It was suggested that perhaps one meeting a month be held in the evening. Councilman Kurbitz voiced endorsement of this idea. No formal action was taken on.these matters at this meeting. City Manager Smith reported that $6,728.91 has been spent on the spring clean up, that this covered 616 truck loads of brush and refuse making the cost $1.76 per cubic yard. There being no further business to come before the Council, it was MOVED by Larson, seconded by Lemon that we do now adjourn, at the hour of 5:15 P.M.: carried, Barber, Bostic, Kurbitz, Larson, Lemon and Morrissey voting aye by voice vote.
