The City Council met in regular session, Mayor Bost Barber, arson, orrissey an
Robinson, City Manager Smith and City Attorney Andrews present on roll call. Councilman Kurbitz
present at 3:10 P.M. Councilman Lemon absent and excused.
The invocation was given by Councilman Barber.
The minutes of the regular meeting of April 16, 1962 were approved as read.
An ordinance appropriating $2,605'.00 from the unappropriated moneys in the Airport Fund, having
been read in it's entirety at the regular meeting of the City Council on the 16th day of April,
1962, and having been read by title only at this meeting, it was MOVED by Robinson, seconded by
Morrissey that Ordinance No. 334., be passed as read: carried, Barber, Bostic, Kurbitz, Larson,
Morrissey and Robinson voting aye on roll-call. Lemon absent.
ORDINANCE No. 334., AN ORDINANCE appropriating the sum of $2,605.00 from the unappropriated
moneys in the Airport Fund to Account 7- 43.1, Structures & Buildings - Repair & Supplies, of the
Maintenance & Operation classification, and Accounts 6 -11, Movable Equipment, 6 -21, Stationery
Equipment, 6 -31, Construction & Other Improvements, and 6 -41, Furniture & Fixtures, of the
Capital or Betterment classification, all within the 1962 appropriation for 39 - Airport Fund.
In accordance with the recommendation of the Planning Commission and action taken by the City
Council at their regular meeting of April 16, 1962, it was MOVED by Barber, seconded by Morrissey
that Ordinance No. 335 regulating the yard area of residences in R -2, Two Family Residential
Zones, providing for exceptions to yard area requirements and amending the Yakima Municipal Code,
be passed as read: carried, Barber, Bostic, Kurbitz, Larson, Morrissey and Robinson voting aye
on roll call. Lemon absent.
ORDINANCE NO. 335, AN ORDINANCE regulating the yard area of residences in R -2, Two Family
Residential Zones, providing for exceptions to yard area requirements, and amending Sections
12.16.040,'12.16-050 and 12.16.070 of the City of Yakima Municipal Code.
Also in accordance with action taken by the Council at their regular meeting of April 16, 1962,
it was MOVED by Larson, seconded by Robinson that Resolution No. D -393, authorizing the execution
ofa modification of Farm Lease Agreement with Robert C. Dunbar, be passed as read:. carried,
Barber, Bostic, Kurbitz, Larson, Morrissey and Robinson voting-aye on roll call. Lemon absent.
RESOLUTION NO. D -393, A RESOLUTION authorizing and directing the City Manager and the City Clerk
to execute a Modification of Farm Lease agreement between the City of Yakima and Robert C Dunbar.
WHEREAS, on the 15th day of April, 1960, the City of Yakima and Robert C.
Dunbar entered into a Farm Lease agreement covering certain property at the Yakima Municipal
Airport, and
WHEREAS, both the City of Yakima and Robert C. Dunbar desire that said
agreement be modified so as to reduce the area of property covered by said lease agreement, and
the City Council deems it to be in the best interests of the people of the City of Yakima to so
modify said agreement, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the City Manager and the City Clerk of the City of Yakima are hereby
authorized and directed to modify that certain Farm Lease agreement dated April 15, 1960, between
the City of Yakima and Robert C. Dunbar, by executing a Modification of Farm Lease, a copy of
which is attached hereto and by reference made a part hereof.

Moved by Larson, seconded by Kurbitz that Ordinance No. 336 providing for irrigation rates for
domestic water use during the irrigation season and establishing procedure for obtaining such
rates and amending the Yakima Municipal Code, be passed as read,by Councilman Robinson: carried,
Barber, Bostic, Kurbitz, Larson, Morrissey and Robinson voting aye on roll call. Lemon absent.
ORDINANCE No. 336, AN ORDINANCE providing for irrigation rates for domestic water use during
the irrigation season; establishing procedure for obtaining such rates; adding Section 7.68.252,
amending Section 7.68.267, and repealing Chapter 7.20, all of the City of Yakima Municipal Code;
and declaring an emergency.
Moved by,Barber, seconded by Robinson that Resolution No. D -394 vacating a public utility easemen
held by the City.of Yakima and located on Lot 25, Bloch 1, Highland Home Tract, be passed as read
carried, Barber, Bostic, Kurbitz, Larson, Morrissey and Robinson voting aye on roll call. Lemon
absent.
RESOLUTION NO. D -394., A RESOLUTION vacating a public utility easement.
WHEREAS, the. City of Yakima is presently the holder of a public utility
easement across property within the City,-of Yakima described as Lot 25, Block 1, Highland Home
Tract, according to the plat thereof recorded in Volume "F" of Plats, page 43, records of -Yakima
County, Washington, and
WHEREAS, the City is not utilizing a portion of said easement, and the
City Council of the City of Yakima deems it in the best interests of the people of the City of
Yakima to vacate that portion of the easement not being utilized, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the City of Yakima does hereby vacate the public utility easement
across the property described as follows:
The East $3.5 feet of the South 10 feet of Lot 25,
Block 1, Highland Home Tract, according to the plat

records of Yakima County, Washington..

Councilman Kurbitz explaining to the Council that the growth of Yakima is of great interest to
him, presented.a sign reading 1110,000 More by 164, Let's Grow" to be used as a slogan and asked
that it be placed in a suitable place in the City Hall.
Mayor Bostic having explained that he has been invited to represent the City of Yakima at Centur
21 Fair in Seattle on May 8, 1962, Central Washington Day, and requesting that he be given...permi
sion to attend with expenses paid, it was MOVED by Robinson, seconded by Larson that permission
be granted for this official visit and that the Mayor's expenses be paid: carried, Barber,Bosti
Kurbitz, Larson, Morrissey and Robinson voting aye by voice vote. Lemon absent.
A vacancy having been created on the Planning Commission by the untimely death of Mr. George
Van Aken, it was moved by Larson, seconded by Kurbitz that Mr. Charles Fowler be and is hereby
appointed to serve the unexpired term of Mr. Van Aken,or until August 31, 1962: carried, Barber,
Bostic, Kurbitz, Larson., Morrissey and Robinson voting aye by voice vote. Lemon absent.
Manager Smith reported that he hopes to have information ready by May 1, 1962 on his negotiation
with various financial consultant firms in connection with the matter of assisting in the plans
for financing expansions to the City's sewerage system, in accordance with Resolution.No.D -378.
He further reported that the Garbage Utility is coming out of the red.
Manager Smith requested that the Council consider sending a delegate to Seattle on May 7, 1962
to attend a meeting.on Emergency Planning to be held in the Olympic Hotel under the direction of
Mr. Edward A. McDermott, Director of the Office of'Emergency Planning. No formal action was
taken on this matter at this time.
There being no further business to come before the Council, it was MOVED by Barber, seconded by
Robinson that we do now adjourn at the hour of 4:00 P.M.,'carried, Barber, Bostic, Kurbitz,
Larson, Morrissey and Robinson voting aye by voice vote. Lemon absent.
