APRIL 16, 1962
The City Council met in regular session, Mayor Bostic, Councilmen Kurbitz, Larson, Lemon,
Morrissey and Robinson, City Manager Smith and City Attorney Andrews present on roll call.
Councilman Barber absent and excused.
The invocation was given by Councilman Larson.
The minutes of the regular meeting of April 9, 1962 were approved as read.
In accordance with action taken 'by the City Council a:t their regular meeting of April 9, 1962 on
the matter of rezoning the property located at 1107 -09A West Yakima Avenue as requested by James
M. Scrimger and others on Petition No. 119, it was MOVED by Robinson, seconded by Lemon that
Ordinance No. 333 rezoning said property from R -3, Multiple Family Residential Zone to B -2,
Local Business Zone, be passed as read: carried, Bostic, Kurbitz, Larson, Lemon, Morrissey and
Robinson voting aye on roll call. Barber absent.
ORDINANCE NO. 333, AN ORDINANCE rezoning certain property located at 1107 - 1109 -A West Yakima Ave-
nue in the City of Yakima from R -3, Multiple Family,Residential Zone, to B -2, Local Business
Zone.
Also in accordance wi'.h action taken by the Council at their regular meeting of April 9, 1962,
it was MOVED by Larson, seconded by Kurbitz that Resolution No. D -391 authorizing the execution
of an Airport Fixed Base Operator's Lease with Noland - Decoto Flying Service, Inc. for certain
land located at the Yakima Municipal Airport, be passed as read: carried, Bostic, Kurbitz, Larson
Lemon, Morrissey and Robinson voting aye on roll call.
RESOLUTION NO. D -391,. A RESOLUTION authorizing the City Manager and the City Clerk of the City
of Yakima to enter into an Airport Fixed Base Operator's Lease with Noland Decoto Flying Service,'
Inc.
WHEREAS,,Noland Decoto Flying Service, Inc., desires to lease certain
land located on the Yakima Municipal Airport from the City of Yakima, said premises to be used
for the purpose of a tie -down area for aircraft, and
WHEREAS,. the City Council finds it to be in the best interests of the
people of the City of Yakima to enter into an Airport Fixed Base Operator's Lease with said
Company, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the City Manager and the City Clerk of the City of Yakima are hereby
authorized and directed to enter into an Airport Fixed Base Operator's Lease with Noland Decoto
Flying Service, Inc., for certain land located. on the Yakima Municipal Airport, a copy of which
said lease is attached hereto and by this reference made a part hereof.

The lease prepared and attached to said resolution having been discussed by the Council, and it
having been agreed that a five year lease with a five year option instead of 10 years as written
will serve the best interests of the City, it was MOVED by Robinson, seconded by Larson that
said lease be corrected /to read as follows:

"ARTICLE II- TERM Subject to the earlier termination as hereinafter provided, the term of this
lease shall be for the periof of five (5) years, commencing Mayl, 1962 and ending April 30, 1967;
'SUBJECT, however, to an option hereby granted by the lessor to the Lessee to renew this lease for
an additional term of five (5) years under the same conditions as the term hereof" etc. >
and on page 2, sub section; 2 and 3 and (c)
112. From January 1, 1963 through December 31, 1966, the sum of $403.86 per year" etc.
"3. The sum of 0134.62 to be paid on or before January 1, 1967, for the period from January 1,
1967 through April 30, 1967."

A Petition, being Petition'No. 140, having been filed with the City Clerk on April 11, 1962,
said petition requesting the formation of a local improvement district for the purpose of
constructing sanitary sewers in Lots`23 -32 Block 1, Flagg Addition and Lots 11 -15 Block 2,
Flagg Addition,: :.it was MOVED by Lemon, seconded by Morrissey that said petition be referred, to
the City Manager and staff for study and recommendation: carried, Bostic, Kurbitz, Larson, Lemon
Morrissey and Robinson voting aye by voice vote.
An Ordinance appropriating $2,605.00 from the unappropriated moneys in the Airport Fund to the
1962 Airport Budget for the purpose of certain improvements at the Yakima Municipal Airport,
having been read in its entirety by the Clerk of the Council, it was ordered laid on the table
for one week to be read and considered at the next regular meeting of the City Council on April
23, 1962.
Moved by Larson, seconded by Robinson that Resolution No. D -392 extending the retirement date
of Oscar E. Soderling for a period of one year or until July 1, 1963, be passed as read: carried
Bostic, Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye on roll call. Barber absent.
RESOLUTION NO. D -3921 A RESOLUTION extending the retirement date of Oscar E. Soderling.
WHEREAS, Oscar E. Soderling is an employee of the City of Yakima and is
under the Statewide City Employees Retirement System, and
WHEREAS, the said Oscar E. Soderling will reach the extended retirement
age of 68 by July 1, 1962, and
WHEREAS, the said Oscar E. Soderling is satisfactorily performing his
duties as a City Employee and is in good physical condition and health, and it is deemed in the
best interests of the people-of the City of Yakima to extend the retirement date of the said
Oscar E. Soderling for the period of one year, now, therefore.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the retirement date of Oscar E.-Soderling, an employee of the City
of Yakima, is hereby extended for the period of one year from July 1, 1962.

The Planning Commission having submitted recommendations for amending the Zoning Code, it was
MOVED by Minson, seconded by Lemon that the City Attorney be and is hereby instructed to pre -
parelpo$Han FSr said amendments and that the hearing on said matter be had at the regular
meeting of the City Council on the 23rd day of April, 1962: carried, Bostic, Kurbitz, Larson,
Lemon, Morrissey and Robinson voting aye by voice vote. Barber absent.
Mayor Bostic having recognized Mr. Frank Glaspey, Jr. and Mr. Leland Campbell, Councilman Kurbitz
explained that he wished the Council to reconsider its action to extend water and sewer services
outside the City of Yakima, rather than annex certain property as requested by Mr. Glaspey and
Mr. Campbell on Petition No. 137, stating that if we wish to grow we must annex whenever possible.
Mr. Glaspey explained that they are ready to develop their property and have.two -ways to go, they
can hook up to Nob Hill Water and install septic tanks or hook up to the City water and sewer,
but questioned the legality of signing agreements which will bind the third party for water and
sewer service outside the City of Yakima and contended that it will be easier to annex this
property now than after it is developed and sold to individuals. Mayor Bostic and Councilman
Robinson explained that the decision of the Council on April 9, 1962 with regard to Petition No.
131, as filed by John J. Anderson, 133 as filed by Clarence D. Franklund and 137 as filed by
Glascam Builders, had been made in the interest of good planning since annexation of the property
described in these petitions would create islands and islands create problems. It having been
indicated that the problem of "islands" can--be overcome.:-and after much discussion of the City's
policy, statue governing annexations, evaluation of property to be annexed, the property to be
annexed including the property of United Builders and it's zoning and the property owned by
Humble Oil Company and itts zoning, it was MOVED by Larson, seconded by Kurbits that the Council
consider a new petition for annexation covering the area south of Nob Hill Boulevard to Viola
Avenue and from 22nd Avenue to 31st Avenue excluding the property south of the present city limits
between 24th-Avenue and 28th Avenue extended, being the property occupied by-Karr Orchards, and
that the property occupied by United Builders be accepted as an industrial zone and the Service
Station-property owned by Humble Oil Company b'e accepted as a business zone: carried, Bostic,
Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye by voice vote. Barber absent.
There being no further business to come before the Council, it was MOVED by Lemon, seconded by
Larson that we do now adjourn at the hour of 6 P.M: carried, Bostic, Kurbitz, Larson, Lemon,
Morrissey and Robinson voting aye by voice vote. Barber absent.
