APRIL 9, 1962
The City Council met in regular session, Mayor Bostic, Councilmen Barber, Kurbitz, Larson, Lemon,
Morrissey and Robinson, City Manager Smith and Assistant Attorney Prediletto present on roll call.,
The Invocation was given by Councilman Barber.
The minutes of the regular meeting of April 2, 1962 were approved as read..
In accordance with action taken by the Council at their regular meeting-of April 2, 1962, with
regard to the appeal from the decision of the Planning Commission on the rezoning of certain
property located at 8 North 8th Street as requested by the Mayfair Tavern on Petition No. 125, it
was Moved by Morrissey, seconded by Barber that the Formal Motion as prepared by the City Attorne]
read by Councilman Robinson and incorporated herein as,a part of these minutes, be passed as read
carried, Barber, Kurbitz, Larson and Morrissey voting aye on roll call. Bostic, Lemon and
Robinson voting nay.
MOTION, A MOTION recommending the rezone of specific property located at 8 North 8th Street in
the City of Yakima from A -3, Multiple Family Residential Zone, to B -3, General Business Zone; dis-
approving the recommendation of.the Planning Commission that the petition for such rezone be
denied; and requesting a further report of the Planning Commission.
WHEREAS, after proper petition and due notice, a hearing was held before the City
Planning Commission on March 6, 1962, upon the petition of Mayfair Tavern, Inc., to rezone the
property located at 8 North 8th Street in the City of Yakima, Washington, more fully described
as follows:
Lot 4, Block 150, Huson's Addition to North Yakima, now in Yakima, Washington,
according to the plat thereof recorded in Volume "A" of Plats, page 11, records of Yakima
County, Washington';
from R -3, Multiple Family Residential Zone, to B -3, General Business Zone, and
WHEREAS, on March 12, 1962, said Planning Commission by letter notified the City Council
of the City of Yakima of the denial of said petition by the City Planning Commission, and
WHEREAS, on March 12, 1962, the said petitioner filed its notice of appeal from the
denial of the said petition with the City Clerk of the City of Yakima, and
WHEREAS, a hearing was held by the City Council on said appeal.on March 26, 1962, which
said hearing was continued until April 2, 1962, and
WHEREAS, the City Council finds as a result of said hearing that to deny the petition
would have the effect of depreciating the value of the property without increasing or otherwise
affecting the value or use of other property in the same general area; that the adjoining Lots
1,2 and 3 of said Block 150 have been used as business property for many years and are presently
being so used, and that the highest and best use of such property is for business purposes, and
WHEREAS, the City, Council further finds that the anticipated use of the property will
not be a nuisance or obnoxious to the adjoining residential zone, and that the rezoning of the
property will enable the owners thereof to make a more desirable use of it and of the adjoining
Lots 1, 2 and 3, which are now used for business purposes, and will permit off - street parking on
the north side of East Yakima Avenue and less interference with vehicular traffic on that street,
and
WHEREAS, the City Council further finds that the public necessity and convenience and
general welfare would best be served by such rezoning and such rezoning is in accord with good
planning practice, and the petition for rezone should be granted and the decision of the
Planning Commission should be disapproved, now, therefore,
THE CITY COUNCIL OF THE CITY OF YAKIMA DOES HEREBY MOVE:
That the decision of the Planning Commission denying the petition of Mayfair Tavern, Inc,
for the rezone of property from R -3, Multiple Family Residential Zone, to B -3, General Business
Zone, of the aforesaid property located at 8 North 8th Street in the City of Yakima, be dis-
approved; and that the Planning Commission of the City of Yakima be requested to make a further
report-to the City Council within 40 calendar days of the receipt of this Motion by the Planning
Commission with respect to such rezoning; and that the Clerk of the Council be directed to
deliver a copy of this Motion to the Planning Commission forthwith.

In accordance with a request made by formal written motion passed by the City Council at their
regular meeting of March 26, 1962 regarding the appeal from the decision of the Planning Commis-
sion in connection with Petition No. 119 as filed by James M. Scrimger and others, requesting the
rezoning of property at 1107 -09 West Yakima Avenue, and the Planning Commission now reporting
that, after review of the facts presented, denial of the application is considered in the best
interest of the public and city, it was Moved by Larson, seconded by Kurbitz that the City
Council finalize it's action and the City Attorney be and is hereby instructed to prepare an
ordinance rezoning said property from R -3, Multiple Family Residence to B -2, Local Business:
carried, Barber, Bostic, Kurbitz, Larson, Lemon, Morrissey, and Robinson voting aye by voice vote.
This being the time fixed by the City Council for the hearing on Petition No. 129 as filed by,
Ernst- Matson Partnership, praying for the annexation of certain property contiguous to the City
of Yakima, it was Moved by Robinson, seconded by Larson that the findings and determination of
the Review Board as convened by the Mayor in accordance with Chapter 282 Laws of 1961, be
received and approved: carried, Barber, Bostic, Kurbitz, Larson, Lemon, Morrissey and Robinson
voting aye by voice vote. -There being no protests in writing or otherwise and all proceedings
having been had in accordance with statue, it was MOVED by Larson, seconded by Lemon that
Ordinance No. 330 providing for the annexation of certain fully described property in said
ordinance and contiguous to the City of Yakima, and zoning said property as R -1 Single Family
Residential Zone, be passed as read: carried, Barber, Bostic, Kurbitz, Larson, Lemon, Morrissey
and Robinson voting aye on roll call..

ORDINANCE NO. 330, AN ORDINANCE providing for the annexation by the City of Yakima of certain
property contiguous to the City of Yakima, and zoning the same as R -1, Single Family Residential
Zone.
A petition, being Petition No. 139, having been filed with the City Clerk on the 4th day of April,
requesting the organization of a local improvement district for the construction of curbs, and
gutters and the surfacing of both sides of Plath Avenue from 16th Avenue to 20th Avenue, it was
MOVED by Robinson, seconded by Lemon that said petition be referred to the City Manager and staff
for study and recommendation: carried, Barber, Bostic, Kurbitz, Larson, Lemon, Morrissey and
Robinson voting aye by voice vote.
Moved by Robinson, seconded by Barber that Ordinance No. 331 declaring a.residence building at
1224 Fair Avenue and 12242 Fair Avenue to be a nuisance and requiring the abatement and removal
of said buildings, be passed as read: carried, Barber, Bostic, Kurbitz, Larson, Lemon, Morrissey
and Robinson voting aye on roll call.
ORDINANCE NO. 331, AN ORDINANCE declaring residence buildings at 1224 Fair Avenue and 12242 Fair
Avenue, within the City of Yakima, to be a nuisance; requiring the abatement and removal of the
same; providing for serving of Ordinance; and directing the City Attorney of the City of Yakima
to commence an action for abatement of said nuisance, and declaring an emergency.
MOVED by Barber, seconded by Larson that Ordinance No. 332 declaring a residence building at
1102 South Naches Avenue to be a nuisance and requiring the abatement and removal of said
building, be passed as read: carried, Barber, Bostic, Kurbitz, Larson, Lemon, Morrissey and
Robinson voting aye on roll call. Manager Smith reported that upon notification of these proceed
ings, persons responsible for this property, made application and were issued a demolition permit
and he recommended that this ordinance be passed to make sure that the property is cleaned up.
ORDINANCE NO. 3321 AN ORDINANCE declaring a residence building at 1102 South Naches Avenue,
within the City of Yakima, to be a juisance; requiring the abatement, and removal of the same;
providing for serving of ordinance; directing the City Attorney of the City of Yakima to commence
an action for abatement of said'nuisance; and declaring an emergency.
Moved by Lemon, seconded by Robinson that Resolution No. D -389 authorizing negotiation and
contract for work, labor and materials without calling for bids from the Union Concrete Pipe
Company to repair a wooden' pipeline located along the Old Naches Highway owned by the City of
Yakima and used for the transmission of water, be passed as read: carried, Barber, Bostic,
Larson, Lemon, Morrissey and Robinson voting aye on roll call.
RESOLUTION NO. D -3891 A RESOLUTION authorizing the City Manager to negotiate and contract for
work, labor and materials without calling for bids.
WHEREAS, there are two breaks in a portion of the 34 -inch wooden pipeline
owned and used by the City of Yakima for the transmission of water, which portion of pipeline is
approximately 200 feet long and is located along the Old Naches Highway, and
WHEREAS, the Union Concrete Pipe Company of Parker, Vashington, is
presently installing concrete pipeline connected with the said wooden pipeline, which installatior
is being performed pursuant to a contract between said company and the State Department of
Highways, and
WHEREAS, due to possible damage to adjacent orchards and the need for
irrigation water, it is necessary that said portion of said pipeline be repaired immediately and
that there is not sufficient time to allow for calling for bids for work, labor or materials, and
WHEREAS, it is believed that said Union Concrete Pipe Company will be
willing to make the necessary repairs to said 34 -inch wooden pipeline at a similar rate as such
work, labor and materials are being performed and furnished by the said company for the State
under the aforesaid contract, and
WHEREAS, the City Council finds that an emergency exists which affects
the health, safety and welfare of the people of the City of Yakima, and that it is in the best
interests of the people of the City of Yakima that the said pipeline be immediately repaired with
out calling for bids-for work, labor or materials, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the City Manager of the City of Yakima is hereby authorized to
negotiate and contract for work, labor and materials, without calling for bids, from Union Concre
Pipe Company to repair two breaks in a portion of the 34 -inch wooden pipeline owned and used by
the City of Yakima for the transmission of water, which portion of pipeline is approximately 200
feet long and is located along the Old Naches Highway, at a similar rate as such work,-labor.and
materials are being performed and furnished to the State of Washington by said company.

budget for the Fire Department, be passed as read: carried, Barber, Bostic, Kurbitz, Larson,
Lemon, Morrissey and Robinson voting aye on roll call.
RESOLUTION NO. D -390, A RESOLUTION transferring the sum of $p266.00 within the 1962 appropriation
for 22 - Fire Department.
WHEREAS, a surplus exists in Account 7 -34, Materials & Supplies, of the
Maintenance & Operation classification of the 1962 appropriation for 22 - Fire Department, and
WHEREAS, additional moneys are required in Account 6 -21, Stationary Equip-
ment, of the Capital or'Betterment classification of the 1962 appropriation for 22 - Fire Depart-
ment, in order to purchase a refrigerator and a range to equip the new Airport Fire Station, and
WHEREAS, at the time of the adoption of the 1962 Budget, it could not have
been reasonably been foreseen that the above additional expenditure would be required, and the

City Council finds that it is in the best interests of the people of the City of Yakima to make
the aforesaid transfer, and that the action contemplated herein is authorized by R. C. W. 35.33•
120, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That the sum of $266.00 is hereby transferred from Account 7 -34,
Materials & Supplies, of the Maintenance & Operation classification, to Account 6 -21, Stationary
Equipment, of the Capital or Betterment classification, both within the 1962 appropriation for
22 - Fire Department.
Section 2. The Director of Finance of the City of Yakima is hereby authorized and
directed to make the aforesaid transfer.

The Planning Commission reporting on Petition No. 131 as fdIddl*by John J. Anderson and others,
Petition No. 133 as filed by Clarence D. Franklund and others and Petition No. 137 as filed by
Glasca. Builders, Inc., and recommending that the areas contained in said petitions not be annexed
to the City of Yakima at this time since they do not conform to the city's annexation policy
established in Resolution No. C -1404, and further recommending that city water and sewer services
be extended outside the present city-limits to serve these areas, it was MOVED by Robinson,

Mr. Harry J. Ley, property owner at 114 South 10th Street requested consideration of the manner
in which rates are being computed for the use of domestic water during the irrigation season.
Manager Smith explained that an amendment to the Water Code is being prepared to take care of some
400 customers who are being charged in the same manner.
Councilman Barber was excused at the hour of 4:30 P.M.
Manager Smith told of a visit with Mr. Cyril Lentz of the Bureau of Reclamation who has advised
h,im that the City should update it's request for water from the Bumping Lake Project. He related
that Mr. 0. W. Lindgrens report made in 1961 states that 6,000 acre feet should be reserved for
the City and that he and the staff now recommend that 9,000 acre,feet be reserved for the City's
use. It was MOVED by Robinson, seconded by Lemon that the City Manager be authorized to file a
request for 9,000 acre feet of water from the Bumping Lake Storage project: carried, Bostic,
Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye by voice vote. Barber absent.
Manager Smith also reported that he has received a request from Mr. Noland of,Noland- Decoto Flying
Service to lease certain property at the Yakima Municipal Airport. Mr. Noland has offered to
lease the property west of their pr..e'3d.ent,:parking strip at 1/2¢ per square foot and to seed and
maintain this property. Discussion disclosed that a small portion of the property is now included
in a lease to Mr. Robert Dunbar and that Noland - Decoto Flying Service will use the property for
added aircraft tie - downs. Discussion completed, it was MOVED by Lemon, seconded by Robinson that
the City Attorney be and is hereby instructed to prepare a 5 year lease for Noland - Decoto Flying
Service covering this request: carried, Bostic, Kurbitz, Larson, Lemon, Morrissey and Robinson
voting aye by voice vote. Barber absent.
There being no further business to come before the Council it was MOVED by Robinson, seconded by
Larson that we do now adjourn: carried, Bostic, Kurbitz, Lemon, Morrissey and Robinson voting aye
by voice vote. Barber absent.
