HomeMy WebLinkAbout04/02/1962 Business Meetingr 286 APRIL 2, 1962 The City Council met in regular session, Acting Mayor Larson presiding, Councilmen Barber, Kurbits Lemon, Morrissey and Robinson and City Manager Smithpresent on roll call. Mayor Bostic absent anc excused and City Attorney Andrews absent. The invocation was given by Councilman Lemon. The minutes of the regular meeting of March 26, 1962 were appratved as read, Acting Mayor Larson welcomed newly elected Councilman Kurbitz to the council table. In accordance with action taken by the Council at their regular meeting on March 26, 1962, the matter of a resolution authorizing the execution of a modification of the Ralph R. Richardson Ground Lease Agreement at the Yakima Municipal Airport was brought on for discussion. Manager Smith having informed the Council that negotiations on this matter have not been completed and requesting that action be postponed until April 23, 1962, it was MOVED by Robinson, seconded by Morrissey that this matter be posponed until the regular meeting of the Council on April 23,.1962: carried, Barber, Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye by voice vote. Bostic Also in accordance with action taken by the City Council regarding the matter of rezoning of property located at 8 North 8th Street as requested by the Mayfair Tavern Inc., a resolution affirming the action of the City Planning Commission'in denying this application was read by the Clerk of the Council. It was then MOVED by Robinson, seconded by Lemon that this resolution be passed as read. This motion failed for want of a majority vote, Councilmen -Lemon and Robinson voting aye on roll call. Councilmen Barber, Kurbitz, Larson and Morrissey voting.Nay..' t was then MOVED by Robinson, seconded by Lemon that the City Attorney be and is hereby instructed to prepare a formal written motion reciting the disapproval by the City Council of the recommendation of the Planning Commission and the reasons for disapproval and referring the matter of rezoning of property at 8 North 8th Street back to the Planning Commission with a request for a further report within forty days: carried, Barber, Kurbitz, Larson, Lemon, Morrissey, and Robinson voting aye by voice vote. Bostic absent. This being the time fixed for the hearing on Petition No. 130 as filed by Harvey H. Speckeen re- questing the vacation of a public utility easement at 3309 West Chestnut, and there beingrn pro- tests in writing or otherwise, it was MOVED by Lemon, seconded.by Barber that Ordinance No. 328 providing for said vacation, be passed as read: carried, Barber, Kurbitz, Larson, Lemon, Morrisey and Robinson voting aye on roll call. ORDINANCE NO. 32$, AN ORDINANCE providing for the vacation of a certain public utility easement across the following described property, to -wit: The East 10 feet of the West 40 feet of the East 70 feet of the West 180 feet of the South 197.7 feet of the South Half of the'Southeast Quarter of the Northeast Quarter of the Southeast Quarter, Section 22, Township 13 North, Range 1$, E. W. M.; EXCEPT the South 25 feet .for street. A Notice of Intention to Commence Annexation Proceedings together with a petition, being petition No. 138, praying for the annexation of certain property contiguous to the City of Yakima and located north of Richey Road and Kerns. Addition and South of Englewood Avenue, having been filed with the Clerk of the Council earlier-in this meeting, said notice was read by the Clerk and it was MOVED by Robinson, seconded by Lemon that this petition be referred to the Planning Commissior for recommendation: carried, Barber, Kurbitz, Larson, Lemon, Morrisey and Robinson voting aye by voice vote. Moved by Barber, seconded by Robinson that Ordinance No. 329 relating to vagrancy and amending the Yakima Municipal Code , be passed as read: carried, Barber, Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye on roll call. Bostic absent. ORDINANCE NO. 329, AN ORDINANCE relating to vagrancy in the City of Yakima, amending Section 6.04.495 of the City of Yakima Municipal Code, and declaring an emergency. Moved by Morrissey, seconded by Barber that Resolution No. D -384 accepting an offer by Le Roy Schreiner to sell to the City of Yakima certain property within the clear zone of the Yakima Municipal Airport for $7,800.00 and authorizing the purchase thereof, be-passed as read: carried, Barber, Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye on roll call. Bostic absent RESOLUTION NO. D -3$41 A RESOLUTION accepting an offer by "LeRoy Schreiner and Faye N. Schreiner husband and wife, to sell to the City of Yakima certain property within the clear zone of the Yakima Municipal Airport, and authorizing and directing the purchase thereof. WHEREAS, LeRoy Schreiner and Faye N. Schreiner, husband and wife, have offered to sell to the City of Yakima certain property within the clear zone of the Yakima Municipal Airport, which property is more specifically described on the attached document en- titled "Offer to Sell ", and WHEREAS, the City Council of the City of Yakima finds it to be in the best interests of the people of the City to accept said offer and to purchase said property,now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City of Yakima-does hereby accept the offer by LeRoy Schreiner anc Faye N. Schreiner, husband and wife, to sell to the City of Yakima the property described in the attached "Offer to Sell ", a copy of which is attached hereto and by this reference made a part hereof; and the City Manager is hereby authorized and directed to purchase and acquire said property for the City of Yakima. D -385, � RESOLUTION accepting an offer by Thomas Pollock to sell to the City of Yakima certain property within the clear zone of the Yakima Municipal Airport, and authorizing and directing the purchase thereof. WHEREAS, Thomas Pollock has offered to sell to the City of Yakima certain property within the clear zone of the Yakima Municipal Airport, roach property is more specifical- ly described on the attached document entitled "Offer to Sell ", and WHEREAS, the City Council of the City of Yakima finds it to be in the best interests of the people of the City to accept said offer and to purchase said property, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City.of Yakima does hereby accept the offer by Thomas Pollock to sell to the City of Yakima the property described in the attached "Offer to Sell ", a copy of which is attached hereto and by this.reference made a part hereof; and the City.Manager is hereby) authorized and directed to purchase and acquire said property for the City of Yakima. LARSON Mayor Pro Tem Moved by Barber, seconded by Morrissey that Resolution No. D -386 rejecting all bids to supply liquid asphalt to the City of Yakima and authorizing the Purchasing Agent to purchase such liquid asphalt on the open market, be passed as read: carried, Barber, Kurbitz, Larson, Lemon, Morrissey and Robinson voting aye on roll call. Bostic absent. Discussion disclosed that this item was submitted for bids and that*the four bids received and considered by the bid board were identical in amount, $13,357.24, and that this matter in full detail will be referred to the Justice Department in Washington D. C. RESOLUTION NO. D -3$6, AN RESOLUTION rejecting all bids to supply liquid asphalt to the City of Yakima, and authorizing the Purchasing Agent to purchase such liquid asphalt on the open market. WHEREAS, heretofore the City of Yakima, by and through its Purchasing Agent, advertised for the receipt of bids for the supplying to the City of Yakima of liquid asphalt for the 1962 requirements of the City, and WHEREAS,, four oil companies,.to -wit: Shell Oil Company, Standard Oil Company, Union Oil Company and Refinery Sales Co., submitted bids to the Purchasing Agent of the City of Yakima to supply said requirements, said bids being identical in every respect, and WHEREAS, the City Council believes that the City can purchase said liquid- asphalt at a price under that bid by said companies, and that such bids should be rejected and the Purchasing Agent authorized to purchase said liquid asphalt on the open market, now, therefor l, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the bids submitted by Shell Oil Company, Standard Oil Company, Union Oil Company and Refinery Sales Co., to supply the 1962 requirements of the City of Ykima for liquid asphalt, are hereby rejected, and the City Manager and the Purchasing Agent are hereby authorized and directed to purchase said liquid asphalt upon the open market for a price less than that submitted by said four bidders. Bostic absent. It was agreed that this license be granted providing there is no expense to the City of Yakima. RESOLUTION NO. D -3879 A RESOLUTION authorizing the Mayor of the City of Yakima to grant a fallout shelter license. WHEREAS, a request has been made to the City of Yakima that a license or privilege be granted to the Federal Government and to the State of. Washington and to Yakima County, as well as to the general public, for the use of Yakima City Hall as a public fallout shelter, and WHEREAS, a need exists for civil defense fallout shelters for the protec- tion,of the general public, and WHEREAS, the City Council of the City of Yakima finds it to be in tke best interests of the people of the City of Yakima to grant such a license for such purpose, now, therefore,_ BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the Mayor of the City of Yakima is hereby authorized and directed to grant to the Federal Government and to the State of Washington and to Yakima County and to the general public a license or privilege to use the basements, corridors, and other common areas of the City Hall Building, as 'well as any other common use parts of the City Hall Building which the Federal Government and the political subdivision shall determine appropriate, for the use as civil defense fallout shelter, and to make such grant by the execution of a document entitled "Fallout Shelter License or Privilege", a copy of which is attached hereto and by reference made a part hereof. Bostic absent9 Again it was emphasized by­.Council members that this license be granted providing there is no expense to the City of Yakima. RESOLUTION NO. D -3$$ Manager Smith called attention to the widening of East Yakima Avenue in connection with the By- Pass construction, to the striping of the streets, to the clearance of the recently purchased Torstvet" property which is being included in the City's shop area, and to the clean -up program being carried on at this time. There being no further business to come before the'Council, it was MOVED by Barber, seconded by Lemon that we do now adjourn at the hour of 4:00 P.M.: carried, Barber, Kurbitz, Larson, Lemon, Morrissey, and-Robinson voting aye by voice vote.
