The invocation was given by Councilman Larson. Bostic, Councilman Barber, Larson, Lemon, and Andrews present on roll call. Councilmen Keith The minutes of the regular meeting of March 5, 1962 were approved as corrected. In accordance with action taken by the City Council at their regular meeting on March. 5, 1962, it was MOVED by Robinson, seconded by Barber that Ordinance No. 325 relating to business and ocr cupation taxes upon certain utilities and providing that the application or return for said taxes may be made by an authorized resident agent or local manager of such utilities, be passed as read: carried, Barber, Bostic, Larson, Lemon and Robinson voting aye on roll call. Keith and Maxwell absent. ORDINANCE NO. 325, AN ORDINANCE relating to business and occupation taxes upon certain utilities specifying the manner of applying for Occupation License, specifying.perso ns quthorized to make an application or return, and - amending Section 5.50.080 of the City of Yakima Municipal Code. Also in accordance with action taken by the City Council at their regular meeting on March 5, 196; it was MOVED by Larsen, seconded by Lemon that Resolution No. D -371 fixing the date of hearing on Monday the 2nd day of April,.1962 on'Petit ion No. 130 as filed by Harvey Speckeen requesting the vacation of a utility easement across.certain property located at 3309 West Chestnut, be passed as read: carried, Barber, Bostic, Larson, Lemon, and Robinson voting aye on roll call.. Keith and Maxwell absent. RESOLUTION NO. D -371, BEFORE THE CITY COUNCIL OF THE CITY OF YAKIMA, STATE OF WASHINGTON IN THE MATTER OF THE VACATION OF' a certain public utility easement across the following described. property, to -wit: The East 10 feet of the West 40 feet of the East 70 feet of the West 1$0 feet of-the' South 19q.7 feet of the South Half of the Southeast Quarter of the Northeast Quarter of the Southeast. Quarter, Section 22, Township 13 North, Range 1$, E.W.M., EXCEPT the South 25 feet for street. RESOLUTION NO. BOSTIC Mayor 'This being the time fixed by the City Council for the hearing on the Appeal from the Planning Commission's decision relative to Petition No. 119 as filed by James M. Scrimger and Ted Poy re- questing the rezone of certain property located at 1107 -09A West Yakima Avenue, this matter was discussed with Mr. James Mc Ardle; Attorney for Mr. Scrimger and Mr. Fred Velikanji, attorney for Mr. Poy. Mr. McArdle contended that rezoning as requested would make this property conforming rather than non-conforming as it now is; that this property is not good for multiple family dwell- ings because of the noise from the street traffic and it will improve the property,. -for si e.. Mr. Velikanji stated that his clients property can no longer be rented and that it has not been rentec for the past year. Mr. Finley, Planning Director pointed out that this is a redevelopment area. Also the matter of widening of Yakima Avenue as planed by the engineering staff was discussed. All persons having been heard and the Council wishing to study the matter further, it was MOVED by Robinson, seconded by Larson that this hearing be continued for one week or until March 19, 1962: carried, Barber, Bostic, Larson, Lemon and Robinson voting aye by voice vote. Keith and Maxwell absent. A Notice of Intention to Commence Annexation proceedings together with Petition No. 133 praying for the annexation.of certain property South of Nob Hill having been filed with the City Clerk on this date by Clarence P. Franklund and Carl A. Meeske, it was MOVED by Larson, seconded by Barber that said notice and petition be referred to the Staff and Planning Commission for study and recommendation: carried, Barber, Bostic, Larson, Lemon and Robinson voting aye by voice vote. Keith and Maxwell absent. Discussion ti,ith the staff pointed out that this property and request will tie in with Petition No. 131 and No. 132 as filed by John J. Anderson and Glascam Builders Inc. respectively. Moved by Lemon, seconded by Barber that Ordinance No. 326 relating to Jail prisoners and payment of fines, "be passed as read:. carried, Barber, Bostic, Larson, Lemon and Robinson voting aye on roll call. ORDINANCE NO. 326, AN ORDINANCE relating to Yakima City Jail Prisoners, providing for satisfac- tion of judgment and payment of fine, and amending Section 1.66.01.0 of the City of Yakima Municipal Code. L El 1 1 1 L 277 MARCH 12, 1962 MOVED by Larson seconded by Robinson that Resolution No. D -372 transferring $1,000.00 in the 1962 Sewer-Maintenance Budget, be passed as read: carried, Barber, Bostic, Larson, Lemon and Robinson voting aye on roll-call. Keith and Maxwell absent. RESOLUTION NO. D -372, A RESOLUTION transferring the sum of $1,000.00 within the 1962 appropria- tion for 52.6 - Sewer Maintenance. WHEREAS, a surplus exists in Account 6 -31, Construction and Other Improve- ments, of the Capital or.Betterment classification of the 1962'appropriati.on for 52.6 - Sewer Maintenance, and WHEREAS, additional moneys are required in Account 7 -03, Salaries - Part Time, Temporary & Overtime - Special Assignment, of the Salaries classification of the 1962 appropriation for 52.6 - Sewer Maintenance, in order to pay the cost of extra labor to complete the Tieton - Terrace Storm Sewer project, and WHEREAS, at the ,time of the adoption of the 1962 Budget, it could not have reasonably been.foreseen -that the above additional expenditure would be required, and the City Council finds that it is in the best interests of the people of the City of Yakima to "make the aforesaid transfer, and that the action contemplated herein is authorized by R.C.W. 35. 33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the sum of $1,000.00 is hereby transferred from Account 6 -31, Construction and Other Improvements, of the Capital or Betterment classification, to Account 7 -03, Salaries — Part Time, Temporary & Overtime - Special Assignment, of the Salaries classification, both within the 1962 appropriation for 52.6 - Sewer Maintenance. Section 2. The Director of Finance of the City of Yakima is hereby author- ized and directed to make the aforesaid transfer. ATTEST: J. A. D -373, A RESOLUTION authorizing the City Manager and City Clerk to submit a Request for Aid under the Federal Aid Airport Program of the Federal Aviation Agency for.Airport improvements: WHEREAS, the City of Yakima contemplates certain airport improvements con- sisting of the acquisition and installation of a clear -zone and the relocation of South Sixteenth Avenue in the vicinity of the airport, and WHEREAS, it is anticipated that a portion of the costs for said improve- ments will be borne by the Federal Aviation Agency, and WHEREAS, in order to obtain such federal aid and make it available when needed for such improvements, it is necessary that application therefore be made immediately, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and City Clerk of the City of Yakima are hereby authorized and directed to forthwith execute on behalf of the City a "Request for Aid" under the "Federal Aid Airport Program" of the Federal Aviation Agency requesting aid in connection with the, improvement of the Yakima Municipal Airport consisting of acquiring and installing a clear - zone, and relocating South Sixteenth Avenue. Keith and Maxwell absent. RESOLUTION NO. D -374, A RESOLUTION of appreciation and commendation for the services performed by Donald C. Keith during his tenure as a member of the Yakima City Council. WHEREAS, Donald C. Keith has served as a member of the Yakima City Council since January 11, 1961, and has, at all times, during his tenure of office, accepted his responsi- bilities and performed his, duties conscientiously and ina highly commendable manner; now, there- fore, BE IT RESOLVED BY TH7 CITY COUNCIL OF THE CITY OF YAKIMA: That the City Council of the City of Yakima, acting on behalf of all the citizens of the-City of Yakima, does hereby express its sincere appreciation and commends Councilman Donald C. Coates requesting the rezoning of property at 16 North 7th Street, Petition No. 125 as filed by the Mayfair Tavern Inc., requesting the rezoning of property at 8 North 8th Street, Petition No. 123 as filed by Clarence Sanders requesting the rezone of property at 727 -729 North 16th Avenue and Petition No. 124 as filed.-by Clarence K. Lally requesting the rezoning o'f property at 1705 West Chestnut, and recommending denial of said rezone applicati "ons, it was MOVED by Robinson seconded by Lemon that said reportbe accepted and filed: carried, Bostic, Larson, Lemon and Robinson voting aye by voice.vote. Barber, Keith and Maxwell absent. The Planning Commission also reporting on action taken on Petition No. 126 as filed by George R. Fain requesting the rezone of property located at 412 South 12th Avenue between Division and West Spruce, and recommending the reclassification from R -2, Two Family Residential to B -2, Local Business, it was MOVED by.Lemon, seconded by Larson that said report be accepted and the City Attorney be instructed to prepare the ordinance accepting said recommendation and rezoning said property. carried, Bostic, Larson, Lemon and Robinson voting aye by voice vote. Petition No. 129 as filed by the Ernst- Matson Partnership, praying for the annexation of property North of Englewood Avenue and east of 48th Avenue, having been referred to the Planning Commissio7 for recommendation and said Planning Commission now recommending the annexation of said property, it was MOVED by Robinson seconded by Lemon that said report be received and filed and that this petition be referred back to the Planning Commission for recommendation on zoning of said property carried, Bostic, Larson, Lemon'and Robinson voting aye by voice vote. An order fixing the date of hearing.on- Petition No. 129 was then read by the Clerk of the Council and it was MOVED-by Larson, seconded by Lemon that said order fixing the date of hearing for the 9th day of April,'1962, be accepted and'notice given as prescribed by statue: carried, Bostic,. Larson, Lemon and Robinson voting aye by voice vote. Barber, Keith and Maxwell absent. The term of office on the Civil Service Commission for the Fire and Police, now fi13ed by Charles Lyon, having expired and Mr. Lyon having indicated that he would accept reappointment for another term, it was MOVED by Robinson, seconded by Lemon that Mr. Lyon be reappointed to said Civil Service Commission for a six year term or until January 1, 1968: carried, Bostic, Larson, Lemon and Robinson voting aye by voice vote. Barber, Keith and Maxwell absent. An Appeal from the Decision of the Planning Commission having been filed with the City Clerk on this date by Mr. Elry A. Van Diest, attorney for the Mayfair Tavern, Inc., in connection with Petition No. 125 requesting the rezone of property located at 8 North 8th Street, it was MOVED by Robinson, seconded by Lemon that a hearing be held on this matter on the 26th day of March, 1962 and that interested persons be so notified: carried, Bostic, Larson, Lemon, and Robinson voting aye by voice vote.
