The City Council met in regular session, Mayor Bostic, Councilmen Keith, Larson and Maxwell,
City Manager Smith and City Attorney Andrews-present on roll call. Councilman Barber reported
sick and Councilman Lemon and Robinson absent and excused.
Councilman Larson :gave the invocation.
The minutes of the regular meeting of February 19, 1962 were approved as read.
The matter of a resolution authorizing the execution of an agreement with Ormund 0. Fluegge for
the installation of sewer line which was ordered posponed to this date, was again postponed
since the staff has not been able to get together with Mr. Fluegge.
A Notice of Intention to Commence Annexation Proceedings having been filed with the City Clerk
on February 20, 1962 by Kenneth E. Matson and Joe J. Ernst, said Notice was read by the Clerk of
the Council. It was then MOVED by Maxwell, seconded by Keith that the City Council meet with
the officers and representatives of Ernst - Matson Partnership who are present,to determine if the
property described in said Notice of Intention to Commence Annexation Proceedings will be accept-
ed for annexation and if the.owners thereof will be required to assume the City's indebtedness:
carried, Bostic, Keith, Larson and Maxwell voting aye by voice vote. Barber, Lemon and Robinson
absent. In accordance with this action the Mayor dbvia.ted-from-the regular order of business and
convened the meeting with Mr. Kenneth Matson and Mr. Joe J. Ernst, partners, to discuss the
matters of acceptance of said annexation and whether oi� not the owners thereof will be required
to assume the City's indebtedness. All matters having been agreed upon, it was MOVED by Larson
seconded by Maxwell that the City Council does hereby inform Ernst - Matson Partnership that it wil:
accept the proposed annexation and that the property owners therein will not be required to
assume the City's indebtedness: carried, Bostic, Keith, Larson and Maxwell voting ave by voice
vote. Barber, Lemon and Robinson absent. A petition, being Petition No. 130, fully describing
the property proposed to be annexed by Ernst - Matson Partnership was then filed with the Clerk of

Section 2 of Chapter 282, Laws of 1961 for its consideration of the proposed annexation: carried,

Petition No. 123 as filed by Clarence Sanders, Petition No. 124 as filed by Clarence K. Lally,
Petition No. 125 as filed by the Mayfair Tavern, Inc., and Petition No. 126 as filed by,.-George R.
Fain, having been filed with the City Clerk on the 20th day of February, 1962, all requestion
the rezone of certain property, it was MOVED by Maxwell, seconded by Keith that said petitions
be referred to the Planning Commission for recommendation: carried, Bostic, Keith, Larson and
Maxwell voting aye by voice vote. Barber, Lemon and Robinson absent.

of 9th Avenue North, having been filed with the City Clerk on February 20, 19625 it was MOVED by
Larson, seconded by Keith that said Petition be referred to the staff for study and recommendation
carried, Bostic, Keith, Larson and Maxwell voting aye by voice vote. Barber, Lemon and Robinson
absent.
An ordinance appropriating $286.00 from the unappropriated moneys in the Airport Improvement Fund
to the Airport Improvement 1962 Budget for the payment of the final estimate to Knoble Electric
Company as authorized by the City Council at their regular meeting of February 19, 1962, having
been read by the Clerk of the Council in its entirety, was ordered laid on the table for one
week to be read and considered at the next regular meeting of the City Council_ on March 5, 1962.
Moved by Larson, seconded by Keith that Ordinance No. 323 creating the "Sewer Expansion Fund"
for the purpose of accounting for the use of Government funds used for the purpose of financing
the planning for the expansion of the City's Sewer System, be passed as read: carried, Bostic
Keith, Larson and Maxwell voting aye on roll call. Barber, Lemon and Robinson absent.
ORDINANCE NO. 323, AN ORDINANCE creating the "Sewer Expansion Fund" of the City of Yakima, and
declaring an emergency.
Mayor Bostic reported on his meeting with Mr. Thompson of the Northern Pacific Rail Road regard-
ing the signals on railroad street crossings stating that the problem concerns the through trains
and those trains which are only switching and that it has been suggested that two different types
of .signals be worked out to make these crossings safer.
City.Manager Smith reported that at the noon Council luncheon on this date, Warren Eckles, the
City's negotiator for acquiring property for the airport clear zone, reported to the Council on
the status of his negotiations with the various property owners. The Council came to no definite
conclusions, but did discuss the prospect of exercising eminent domain against those properties
remaining, if any,after the negotiated purchases are closed.
Manager smith also reported on the Northwest City Manager's Conference held at the Chinook Hotel
February 22 through the 24th stating that some 100 delegates representing four states and British
Columbia attended making it a very worthwhile conference.
He also reported that the Association of Washington Cities has written for suggestions for the
convention which is to be held in;Yakima on May 9th and 10, 1962 and asked Councilmen to sub-
mit suggestions.
Public Works Director, U.ohn Mayo, reviewed the city's policy on garbage pickup after a holiday.
Manager Smith also announced that he. and members of the staff will on this date, meet with a
citizens committee in the _ �, -the Fair Grounds to answer
questions on the matter of annexing certain property east of the present city limits and in Fire
District 13. He invited Council: members to attend if possible.

There being no further business to come before the Council, it was MOVED by Keith, seconded by
Maxwell that we do noi,n,T adjourn at the hour of 3:50 P.M. carried, Bostic, Keith, Larson and
Maxwell voting aye by voice vote. Barber, Lemon and Robinson absent.
