Councilman Keith absent and excused. The invocation was given by Councilman Larson. The minutes of the regular meeting of January 29, 1962 were approved as corrected. An ordinance appropriating $46,040.00 from the unappropriated moneys in the Water Sewer Fund to the 1962 Budget for the purchase of certain property from Lawrence Sanford, having been read in its entirety at the regular meeting of January 29, 1962 and laid on the table for one week, was read by title only at this meeting. It was then MOVED by Robinson, seconded by Lemon that Ordinance No. 314 providing for said appropriation, be-passed as read: carried, Barber, Bostic, Larson, Lemon, Maxwell and Robinson voting aye on roll-call. Keith absent. ORDINANCE NO. 314, AN ORDINANCE appropriating the sum of $46,040.00 from the unappropriated moneys in the Water -Sewer Fund "to Accounts 6 -01, Land, and 6 -21, Stationary Equipment, of the Capital or Betterment classification -of the 1962 appropriation for 52.7 - Sewage Disposal Department. An ordinance appropriating $17,074.00 from the unappropriated moneys in the Current Expense Fund to the Fire Department 1962 Budget for the purchase of a fire truck, having been read in its entirety at the regular meeting of January 29, 1962 and laid on the table for one week, was read by title only at this meeting. It was then MOVED by Larson, seconded by Maxwell that Ordinance No. 315 providing for said appropriation be passed as read: carried, Barber, Bostic, Larson, Lemon, Maxwell and Robinson voting aye on roll call. Keith absent. - ORDINANCE NO. 315, AN ORDINANCE appropriating the sum of $17,074.00 from the unappropriated moneys in the Current Expense Fund to Account 6 -11, Movable Equipment, of the Capital or Better- ment classification of the 1962 appropriation for 22 = Fire Department. In accordance with action taken by the City Council at their regular meeting of January 29, 1962, it was MOVED by Maxwell, seconded by Barber that Resolution No. D -359 authorizing the City Manager to engage an independent negotiator in the matter of acquiring property for the clear CD zone at the Yakima Municipal Airport, be passed as read: carried, Barber, Bostic, Larson, Lemon Maxwell and Robinson voting aye on roll call. Keith absent. RESOLU`.I'ION NO. D -359, A RESOLUTION authorizing the City Manager to engage an independent negotiator in the matter of acquiring property for the clear zone at the Yakima Municipal Airport. WHEREAS, it is the intention of the City of Yakima to expand the clear zone at the Yakima Municipal Airport, and WHEREAS, the several parcels of property to be acquired by the-City for such expansion have been duly appraised, and negotiations with the owners of the properties for their acquisition should be commenced, and WHEREAS, the City Council finds it in the best interests of the people of the City of Yakima that such negotiations on behalf of the City be conducted by some qualified, independent negotiator, now; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager of the City of Yakima is hereby authorized and directed to engage a qualified, independent negotiator to conduct negotiations with the owners of the several parcels of property to be acquired by the City of Yakima for the expenasion of the clear zone at the Yakima Municipal Airport. Wright Construction Company, said petition praying for the annexation of certain property located between South First Street and Fair Avenue and Lindy Lane and Mead Avenue, and there being no protests in writing or otherwise to said action, it was MOVED by Larson, seconded by Robinson that Ordinance No. 316 providing for said annexation, be passed as read: carried, Barber, Bostic, Larson, Lemon, Maxwell and Robinson. voting aye on roll. ORDINANCE NO. 316, AN ORDINANCE providing for the annexation by the City of Yakima, Washington, of certain property contiguous to the City of Yakima, and zoning the same as B -3, General Business Zone. Moved by Barber, seconded by Lemon that Resolution No. D -360 authorizing the execution of an agreement for Public Works Plan Preparation with the United States Housing and Home Finance Agency for the purpose of procuring an advance in the sum of $11,500.00 for the purpose of de- fraying the cost of plan preparation for the expansion of waste treatment facilities and correc- tion of ground water infiltration for the sewage system, be passed as read: carried, Barber, Bostic, Larson, Lemon, Maxwell and. Robinson voting aye on roll call. Keith absent. RESOLUTION NO. D -360, A RESOLUTION authorizing the City Manager and the City Clerk to execute an Agreement for Public Works Plan Preparation with the United States Housing and Home Finance Agency. WHEREAS, the City of Yakima has heretofore filed an application for an advance in the sum of $11,500.00 from the United States of America, through the Housing and Home Finance Agency, for the purpose of defraying the cost of plan preparation for-the expansion of waste treatment facilities and correction of ground water infiltration for the sewage system of the City of Yakima, and WHEREAS, the said Housing and Home Finance Agency has approved the said application, and F, FEBRUARY 2_,,__19j62 WHEREAS, it is in the best interests of the people of the City of Yakima to accept said advance for the purposes specified, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and the City Clerk of the City of Yakima are here- by authorized and directed to enter into-an Agreement for Public Works Plan Preparation with the Housing and Home Finance Agency for the purpose of procuring an advance in the sum of $11,500.00, a copy of �vhich agreement is attached hereto and by this reference made a part hereof. Keith absent. Discussion pointed out that this action is taken to take advantage of a 30% discount on this merchandise. RESOLUTION NO. D -361, A RESOLUTION authorizing the purchase of reflectorized traffic signs without calling for bis. WHEREAS, it is necessary to purchase a quantity of refledtorized traffic signs for use by the Street Department, and funds therefor are available in the 19,62 appropriatio for 31 - Street Department, and WHEREAS, it is necessary to obtain such equipment as soon as possible, and WHEREAS, Minnesota Mining Company of 3663 First Avenue South, Seattle 4, Washington, is the only supplier of this equipment, and it would serve no purpose to advertise for bids for the same, and the City Council finds that it is in the best interests of the people of the City of Yakima. to purchase said equipment from said company without calling for bids, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the Purchasing Agent of the City of Yakima is hereby authorized and directed to'purchase, without calling for bids, a. sup -ly of reflectorized traffic signs in such quantity wo that the total price thereof will not exceed the sum of $519.00 including sales tax. BOS`.I'IC Mayor Moved by Larson, seconded by Robinson that Resolution No. D -362 granting permission to the Washington State Department of Highways to replace a section of irrigation pipeline which crosses Primary State Highway.No. 5, be passed as read: carried, Barber, Bostic, Larson, Lemon, Maxwell and Robinson voting aye on roll call. Keith absent. RESOLUTION NO. D -362, A RESOLUTION granting permission to the Washington State Department of Highways to replace a section of an irrigation pipeline owned by the City of Yakima, and holding harmless the said Department of Highways. WHEREAS, the Washington State Department of Highways is presently engaged in highwav construction work along the route of. Primary State Highway No. 5 near its junction with Fruitvale Boulevard, and WHEREAS, the Department of Highways finds it desirable in the course of such construction to replace a section of the City's 34 -inch irrigation pipeline which crosses Primary State Highway No. 5 at a point designated as Station 863 + 50, which section of pipeline is located outside the right -of -way of said primary state highway and across private property over ,,hich the City holds a right -of -way and easement for pipeline purposes, and WHEREAS, said Department of Highways has agreed to replace said pipeline without cost or expense to the City of Yakima, and the City Council finds it to be in the best interests of the Cit7 of Yakima to grant permission to the said Department of Highways to enter upon said easement and replace said pipeline, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the City of Yakima hereby grants permission to the Washington State Department of Highways to replace a section of the Citv's 34 -inch irrigation. pipeline which crosses Primary State Highway No. 5 at a point designated as Station $63:+ 50, which section of pipeline is located outside the right -of -way of said primary state highway and across private property over which the City holds a right -of -way and easement for pipeline purposes. Section 2. That the City of Ya.kin;a hereby holds harmless the said Washington State Department of Highways from any and all liability for damages which might occur by reason of the replacement of the said irrigation pipeline; provided, however, that this resolution does not relieve any contractor performing such work from liability and obligations as may be included in the contractor's bond and insurance covering this construction work. Keith absent . Mr. G. K. Brewster, a citizen, being present, suggested that the City of Yakima investigate the parking meters being used in the City of Everett, concluding that the visibility of these meters seems to be better. In the discussion of the matter of parking meters, Manager Smith informed Council members that a study is being made of the parking meter situation, giving special atten- tion to the short time meters. Public Works Director Mayo:.informed the Council that there is less break up in the streets this year and that the breakage caused by frost is showing only in streets which have'not yet been seal coated or repaired as planned.) 3 FEBRUARY 5, 1962 Manager Smith reported that the 1962. Northwest Roads and Streets Conference is to be held in Corvalis Oregon, beginning February 6 and ending on the 9th and he recommended and .requested that three members of the staff, Mr. John Mayo, Mr. Al Richards- and Mr Kenneth Knight be permitted to attend this conference. MOVED by Maxwell seconded by Larson that these -three men be allowed to attend said conference and that ±heir expenses be paid: carried, B= Irber, Bostic, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Keith absent. Manager Smith also announced that Wednesday, the 7th day of February, 1962 is Boy Scout Civic Dav and that the Scouts will again take over the operation of the City government for two hours. He-invited all Councilmen to attend the ceremonies at 10:00 at the City Kl on that day. Councilman Robinson asked to be excused from the next 3 meetings and Councilman Maxwell asked to be exc>>_sed from the next meeting of the Council. Permission was granted.
