The invocation was given by Councilman Keith. The minutes of the regular meeting of January 22, 1962 were approved as read. A resolution consenting to the assignment from National Rental & Leasing Corporation to Spokane National Car Rentals, Inc. of interest in an automobile rental business at the Yakima Municipal Airport, having been set over to this meeting and Manager Smith reporting that the National Rental & Leasing Corporation has paid,in full, it's obligations to the City and reporting favor- ably on the credit rating and operations of the Spokane National Car Rentals, Inc., it was MOVED by Barber, seconded by Keith that Resolution No. D -355 consenting to said assignment, be passed as read: carried, Barber, Keith, Larson, Lemon, Maxwell end Robinson voting aye by voice vote. Bostic absent. RESOLUTION NO. D -355, A RESOLUTION consenting to the assignment from National Rental & Leasing_ Corporation to Spokane National Car Rental, Inc., of the Lessee's interest in an automobile rental business at the Yakima. Municipal Airport. WHEREAS, National Rental & Leasing Corporation entered into an agreement with the City of Yakima for'an automobile _rental business at the Yakima Municipal Airport, said agreement being dated March 15, 1960, and WHEREAS, said National Rental & Leasing Corporation has heretofore assign- ed all of its right, title and interest in and to said agreement and the business 'conducted on said premises to Spokane National Car Rentals; and the City Council deems it in the best interest of the people of the City of Yakima to consent to such assignment, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City of Yakima hereby'consents to the assignment of said automo- bile rental business at the Yakima Municipal Airport from National Rental & Leasing Corporation to Spokane National Car Rentals, Inc., and the City Manager 'and the City Clerk of the City, of Yakima are hereby authorized and directed to execute the consent of the City of Yakima to such assignment, a copy of which assignment is hereto attached and by this reference made a. part hereof. Bostic absent. RESOLUTION NO. D -356, A RESOLUTION authorizing and directing the City Manager to purchase certain property from Lawrence Sanford-. WHEREAS, by Resolution No. D -327 the City Manager was heretofore author- ized and directed to negotiate ird th Lawrence Sanford for the purchase of certain property lying principally in the Northeast Quarter of Section 32, Township 13 North, Range 19, E.W.M., consist ing of a parcel of land in excess of 80 acres, situated south of certain property owned by,the City of Yakima and occupied by the sprinkler system of the industrial waste sewer system, and WHEREAS, as a result of said negotiations, the City now has the opportunit to purchase said property from the said Lawrence Sanford, which property is necessary for the expansion of the sprinkler system of the industrial waste sewer system, and .WHEREAS, the City has had said property duly appraised, and the value determined in said apr_�raisal is in excess of the surd of $46,000.00, and WHEREAS, the City Council finds it to be in the best interests of the people of the City of Yakima to purchase said property for the sum of $46,000.00, now, therefore,; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKII4' "1A: That the City Manager of the City of Yakima is hereby authorized and directed to purchase the hereinbefore- described property from Lawrence Sanford for the sum of $4,6)000.00. Sanford property as authorized in Resolution No. D -356, having been read by the Clerk of the Council, was ordered laid on the table for one week or until the regular meeting of the Council on February 5, 1962. An ordinance appropriating the sum of $17,074.00 from the unappropriated moneys in the Current Expense Fund to the 1962 Budget for the Fire Department, having been read in its entirety by the Clerk of the Council, was ordered laid on the table for one week to be read and considered at the regular meeting of the Council on the 5th day of February, 1962. Moved by Robinson, seconded by Lemon that Ordinance No. 313 relating to the sale of Liquor and tr operation of stills in the City of Yakima, be passed as read: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. ORDINANCE NO. 313, AN ORDIN:TANCE relating to the sale of liquor and oration of stills in the City of Yakima, and amending Section 5.44.180 of the City of Yakima Municipal Code, and declari an emergency. Moved by Keith, seconded by Maxwell that Resolution No. D -357 authorizing the sale of one 1946, Model K -12, 3/8 Cubic Yard Insley Power Shovel owned by the City, be passed as read: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. Bostic absent. RESOLUTION NO. D -357, A RESOLUTION authorizing and directing the City Manager to dispose of surplus equipment owned by the City of Yakima. WHEREAS, the City of Yakima owns one 1946, Model K -12, 3/3 Cubic Yard Insley Power Shovel, Serial No. 1775, which is surplus equipment of no further use to the City, and WHEREAS, it is in the best interests of the City of Yakima that said power -shovel be disposed bf by negotiating for the sale thereof, now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager of the City of Yakima is hereby authorized and directed to dispose of the aforesaid 1946, Model K -12, 3/8 Cubic Yard Insley Power Shovel, Serial No. 1775, by negotiating for the sale thereof to the best advantage of the City. LARSON Cit�T Clerk Mayor Pro Tem Moved by Maxwell, seconded by Barber that Resolution No. D -358 transferring $9,000.00 within the 1962 Budget for the purchase of a fire truck, the acquisition of which was originally planned by the use of a rental- purchase plan, be passed as read: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. Bostic absent. RESOLUTION? NO. D -358, A RESOLUTION transferring the sum of $9,000.00 within the 1962 appropria- tion for 22 - Fire Department. WHEREAS, a surplus exists in Account 7 -58, Rentals, of the Maintenance & Operation classification of the 1962 appropriation for 22 - Fire Department,. and WHEREAS, additional funds are required in Account 6 -11, Movable Equipment, of the Capital or Betterment classification of the 1962 appropriation for 22 - Fire Department, in order to purchase a fire truck, the acquisition of which was originally planned by the use of a rental - purchase plan, and WHEREAS, at the time of the adoption of the 1962 Budget, it could not have reasonably been foreseen that the above additional expenditure would be required, and the Citv Council finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfer, and that the action contemplated herein is authorized by R.C.W.35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIIIIA: Section 1. That the sum of $9,000.00 is hereby transferred from Account 7 -58, Rentals, of the Maintenance & Operation classification, to Account 6 -11, Movable Equipment, of the Capital or Betterment classification, both within the 1962 appropriation for 22 - Fire Department. LARSON City Clerk Mayor Pro Tem Z Manager Smith gave a report on the preliminary study of the proposed Sumac Fairview Annexation in accordance .�,Tith action taken by the Council to furnish Fire District 13 with fire protection for a period of 6 months. He related that a larger area than presently covered by Fire District 13 is being studied for this annexation because of the similarity of development and problems common to all of the area. He recommended for annexation, the area from the City limits at the Yakima River on the North to 600 feet South of Lenox Avenue and from the Yakima River on the East to the present City limits on the West. He pointed out that making Lenox Avenue a boundary line would create maintenance problems as only 1/2 of the street would be in the City and that it is desirable to control the development on the south side of Lenox because of the interchange for the freeway. He also pointed out that the Fair Grounds is being included in this study but that it can be deleted if the County Commissioners refuse permission to annex it. Mr. G. K. Brewster a property owner in the area,'protested this action stating that the property involved cannot bear the cost of city improvements. Discussion.also pointed out that this action will reduce fire insurance rates better than 1/2 the present rate, that the Commissioners of Fire District 13 will try to determine whether or not the people in this area are interested in annexing to the F, 262 JANUARY 29, 1962 City and by which method, petition or election. Upon completion of discussion, it was MOVED by Robinson, seconded by Keith that the City Council concur with the City Manager and staff on the area recommended to be annexed. carried, Barber, Keith, Larson, Lemon, Maxwell. and Robinson voti aye by voice vote. Mr. G. K. Brewster also inquired as to the cities policies on the removal of trees on property lines and in the parking strip. It was explained by Public Works Director Mayo that trees which become an obstruction in water and sewer lines or heave sidewalks or streets or constitute a danger to the public, are taken down by the City when on city property., but that the City is not in the tree removing business. It was also pointed out that the sidewalk is the property owners responsibility and that trees are usually removed as the result of a complaint of the property owner or other citizens. City Attorney Andrews reported that, in accordance with the order given by the City Council at their regular meeting of January 8, 1962, the matter of whether or not the demand for arbitration is properly made by Superior Asphalt & Concrete Company, contractor, has been submitted to the Superior Court Judge for ruling and he has ruled against the contractor and granted a Stay of Arbitration to the City of Yakimaq ruling that the points of dispute are not ones that can be arbi In compliance with the request made by the City Council on December 11, 1961 for the up to date appraisals for all property being considered for the expansion of the Clear zone at the Yakima Municipal Airport, and copies of the appraisals received from Mr. Warren Eckles, the appraiser, having been submitted to Council members prior to this meeting, Manager Smith discussed this matter and recommended and requested th�3t some person other than a member of the staff be author- ized to act on behalf of the City to negotiate for the purchase of the property needed for'— this project. It was MOVED by Lemon, seconded by Robinson that the City Manager be and is hereby authorized to find someone qualified to act on behalf of the City as negotiator in the matter of purchasing property at the Yakima Municipal Airport for the expansion of the Clear Zone and that he also have the necessary resolution prepared authorizing this action: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye bIT voice vote.
