HomeMy WebLinkAbout12/16/1961 Business MeetingI DECEMEER 18, 1961 The City Council met in regular session, Mayor Bostic,, Councilman Barber, Keith, Larson and Maxwell, City Manager Smith and City Attorney Arntson present on roll call. Councilman Lemon and Robinson absent and excused. The Invocation was given by Councilman. Keith. The minutes of the regular meeting of December 11, 1961 were approved'as read. This being the.time fixed by the Council to further consider a business and occupation tax on utilities as amended by an ordinance read and considered at the regular meeting of December 4, 1961, a letter from the Yakima Area Industrial Council, was read by the Clerk of the Council. Said letter stated in part that "it was our conclusion that any deterrent to local or new in- dustries and their "job opportunities'{ through taxation of utilities is undesirable:' and further urged city government to avoid and keep such taxation at a minimum. Since no one present wished to speak further on the ordinance and'a motion to pass said ordinance had been made by Councilman Keith and seconded by Councilman Maxwell at the regular meeting of December 4, 1961, Mayor Bostic called for the vote on the motion and Ordinance No. 308 relating to said business and occupation tax, making certain exemptions and amending the: Yakima Municipal Code accordingly, was* passed: Councilman Barber, Bostic,:,Keith and Maxwell voting aye on roll call. Larson voting nay. Lemon and Robinson absent. ORDINANCE NO. 308, AN ORDINANCE relating to business and occupation taxes upon certain utilities; adjusting the tax rates, amending Section 5.50.050 of the City of Yakima Municipal Code. In accordance with action taken by the City Council at their regular meeting of December 11, 19613 it was MOVED by Barber, seconded by Larson that Ordinance No. 309 adopting the Six -Year Compre- hensive _Street Program for the City of Yakima,.be passed as read: carried; Barber, Bostic, Keith Larson, and Maxwell voting aye on roll-call. Lemon and Robinson absent. ORDINANCE NO. 309, AN ORDINANCE adopting the Six -Year Comprehensive Street Program for the City of Yakima, and declaring an emergency._ In accordance with action taken by the City Council at their regular meeting of December 11,, 1961, it was MOVED by Keith, seconded by Maxwell that Ordinance No. 310 accepting the recommendation of the Planning Commission and rezoning certain property located between East Beech Street and East Maple Street on South 3rd Street from R -3, Multiple Family Residential Zone to B- 3,'General Business Zone, be passed as read: carried, Barber, Bostic, Keith, Larson and Maxwell voting aye on roll call. Lemon and Robinson absent. ORDINANCE NO. 310, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property located between East Beech Street and East Maple Street on South 3rd Street, in the City of Yakima, Washington, from R -3, Multiple Family Residential Zone, to B -3, General Business Zone. Also in accordance with action taken by the C- °ty Co-L..ncil at their regular meeting 'of December 11, 1961, it was MOVED by Larson, seconded by Keith that Ordinance No. 311 accepting the recommenda- tion of,the Planning Commission and rezoning certain-property located at 410 -416 North Second Street from R -3 Multiple Family Residential Zone to B -2 Local Business Zone, be passed as read: carried, Barber, Bostic, Keith, Larson, and Maxwell voting aye on roll call. Lemon and Robinson absent. ORDINANCE NO. 311, AN ORDINANCE accepting the recommendation of the Planning Commission and re- zoning certain property located at 410 -416 North Second Street, between East "D" Street and East "E" Street, in the City of Yakima, Washington, from R -3, Multiple Family Residential Zone, to B -2, Local Business Zone. Petition No. 117 having been filed with the City Clerk by Lester Beaver and others requesting the formation of a Local Improvement District for the installation of water mains and other appurten- ances, it was MOVED by Larson, seconded by Barber that said petition be referred to the City Manager for recommendation: carried, Barber, Bostic, Keith, Larson and Maxwell voting aye on roll call. Lemon and Maxwell absent. Moved by Maxwell, seconded by Keith that Resolution No. D -346 transferring $3,800.00 within the 1961 Sewer Maintenance Budget, be passed ^as read: carried, Barber, Bostic, Keith, Larson and Maxwell voting aye on roll call. Lemon and Robinson absent. RESOLUTION NO. D -346, A RESOLUTION transferring the sum of 3,800.00 within the 1961 appropria- tion for 52.6 - Sewer Maintenance. WHEREAS, a surplus existes in Account 7 -47, Sewer Infiltration - Repair, Etc., in the Maintenance and Operation classification of the 1961 appropriation for 52.6 - Sewer Maintenance, and WHEREAS, in order to pay trunk sewer construction costs which were incurre with the establishing of a sanitary sewer in Local Improvement District No. 898, additional moneys are required in Account 6 -06, Sanitary Sewer, of the Capital or Betterment classification of the 1961 appropriation for 52.6 - Sewer, Maintenance, and WHEREAS, at the time of the adoption of the 1961 Budget, it coulc not have - reasonably been foreseen that the above additional expenditure would be required, and.the City Council finds that it is in the best interests of the. people of the City of Yakima to make -the aforesaid transfer, and that the action contemplated herein is authorized by R.C.W. 35.33.120, now therefore, BE IT RESOLVED BY THE. CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. -That the sum of $3,800.00 is hereby transferred from Account 7 -47, Sewer Infiltration - Repair, Etc., of the Maintenance & Operation . classification, to Account 6 -06, Sanitary °Sewer, of the Capital or Betterment classification, both within the 1961 appropriation for 52.6 - Sewer.Maintenance. Section 2. Lemon and Maxwell absent. RESOLUTION NO. D 347, A RESOLUTION transferring the sum of $100.00 within the 1961 appropriatio' for 23 - Inspection Department. WHEREAS, a surplus exists in Account 7 -03, Assistant Supervisor, of the Salaries classification of the 1961 appropriation. for 23 Inspection Department, and WHEREAS, due to additional inspection functions being added to the Buildi Department, additional moneys are required in Account 7 -41, Automotive, Motor Fuel, Etc.,'of the Maintenance & Operation classification of the 1961 appropriation for 23 - Inspection Department, to provide fuel for the balance of the year, and WHEREAS, atthe time of the adoption of the 1961 Budget, it could not have reasonably been foreseen that the above additional' expenditure would be required, and the City Council finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfers, and that the action contemplated herein is authorized by R -C -W. 35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the sum of $100.00 is hereby transferred from Account 7 -03, Assistant Supervisor,'of the Salaries classification, to Account 7 -41, Automotive, Motor Fuel, Etc., of the Maintenance & Operation classification, both within the 1961 appropriation for 23 - Inspection Department. Lemon and Robinson absent. RESOLUTION NO. D -348, A RESOLUTION transferring the sum of $514.00 within the 1961 appropriatio for 14 - Legal Department. WHEREAS, surpluses exist in Accounts 7 -31, Publication & Printing, 7 -40, Auto., Parts & Repair, 7 -41, Auto., Motor Fuel, Etc., 7 -50, Travel, 7 -58, Equipment - Rental, and 7 -64, Insurance, Medical & Physical Exams, all within the Maintenance & Operation classification of the 1961 appropriation for 14 - Legal Department, and WHEREAS, because the present City Attorney has resigned and it is necess to purchase office equipment to furnish the office for the new City Attorney, additional moneys are required in Account 6 -61, Furniture & Fixtures, of the Capital or Betterment classification of the 1961 appropriation for 14 - Legal Department, and WHEREAS, at the time of the adoption of the 1961 Budget, it could not have reasonably been foreseen that the above additional expenditures would be required, and the City Council finds that it is in the. best interests of the people of the City of Yakima to make the aforesaid transfers, and that the action contemplated herein is authorized by R- C.W.35. 33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. Lemon and'Robinson absent. Mayor Bostic announced that the next regular meeting of the City Council will be held on January 2, 1962 and that the Council will not meet on December 26, 1961. Manager Smith reported on the snow removal to date,stating that it has cost the City some $8,936.00 over a period of ten days. There being no further business to come before the Council, Council members extended Seasons Greetings to all City Employees. It was then MOVED by Barber, seconded by Larson that we do now adjourn at the hour of 4 :03 P.M.: carried, Barber, Bostic, Keith, Larson and Maxwell voting aye by voice vote.
