The invocation was given by Councilman Lemon.
The minutes of the regular meeting of November 27, 1961 were approved as read.
In accordance with action taken at the regular meeting' of November 27, 1961, and there being a full
Council present at this meeting, the City Council proceded to consider again the ordinance relat-
ing to a business and occupation tax...upon certain utilities and making certain exemptions as re-
quested by the Cascade Natural Gas Company. Mr. Tom Paddison, Manager of the Washington Banners
Cooperative filed, with the Council, a letter further protesting this tax, since it will be'passec
on to industry, and urging the passage of this amendment. Mr. Hal Minton, a representative of
the Cascade Natural Gas Company, again s-tated�.the Company's request.for the exemption for accounts
o.yEr.500.00. Since the ordinance now being considered has been changed by the deletion of the
emergency clause and addition of the 30 day clause, and upon the advise of the City Attorney, the
Clerk of the Council read in its entirety, an ordinance relating to business and occupation taxes
on certain utilities and providing for certain exemptions. It was then MOVED by Keith, seconded
by Maxwell that said ordinance be adopted as read and discussion followed. -Mr. Paul Cook contrac-
tor and motel operator questioned this action in connection with his motel operations. Mr. Harry
Christy declared the action discriminatory. Mayor Bostic having suggested that this matter be
referred to the Chamber of Commerce area industrial council for consideration and recommendation,
it was MOVED by Robinson, seconded by Lemon that further action be postponed until the 18th of
December, 1961 and that the ordinance now being considered, be-referred to said industrial council
for recommendation: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting
aye by voice vote_.
In accordance with action taken at the regular meeting of November 27, 1961., it was MOVED by
Barber, seconded by Lemon that Resolution No. D -338 authorizing the cancelling and rescinding a
lease agreement which is now in effect with'Robert Glover d /b /a Industrial Instrument Laboratory
be passed as read: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting
aye on roll call.
RESOLUTION NO. D -338, A RESOLUTION authorizing the City Manager and the City Clerk to execute an
agreement with Robert Glover, d /b /a Industrial Instrument Laboratory, cancelling and rescinding
a Lease Agreement on Yakima Municipal Airport.
WHEREAS, on October 13, 1960, under authority of Resolution No. D -185, the
City of Yakima entered into a Lease Agreement for a three year term commencing August 1,.1960
with Robert Glover, d /b /a Industrial Instrument Laboratory, for the lease by the City to the said
Robert Glover of that certain building located on the Yakima Municipal Airport, known as the
"Old Administration Building ", together with certain adjacent land, and
WHEREAS, the business operated by the said Robert Glover has expanded to
the-point that the facilities in the Old Administration Building have become totally inadequate ar
the said Robert Glover was required by business circumstance to move into the building owned by
James A. Sellers and located on leased property adjacent to the new Administration Building,'.-and
WHEREAS, the said Robert Glover has requested that he be relieved of the
obligations contained in said lease and has offered to pay the City of Yakima the sum of $500.00
at the rate of $25.00 per month, as consideration and liquidated damages for such cancellation
and rescission, and
WHEREAS, an Agreement to accomplish the same has been prepared and is
attached hereto, and the City Council finds that it is in the' best interests of the people of the
City of Yakima to authorize the execution of said Agreement and cancel and rescind the said
Lease Agreement, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the "ity Manager and the City Clerk of the City of Yakima are hereby
authorized and directed to execute on the behalf of the said City an Agreement with Robert Glover,
d /b /a Industrial Instrument.Laboratory, cancelling and that certain Lease Agreement
,rescinding
made and entered into on October 13, 1960 between the City and the said Robert Glover and for the
payment by the said Robert Glover to the City of the sum of $500.00, at the rate of $25.00 per
month, a copy of which Agreement is attached hereto and by this reference made a part hereof.

call.
RESOLUTION NO. 339, A RESOLUTION authorizing the execution of a lease agreement for the "Old
Administration Building" at the Yakima Municipal Airport to the Civil Air Patrol, Inc.
WHEREAS, the Civil Air Patrol, Inc., is a governmental corporation furnish-
ing and performing a valuable service to the community in connection with Civil Defense activities
and rescue and disaster work, and
WHEREAS, said Civil Air Patrol, Inc., does not have facilities in the City
of Yakima suitable or convenient for the performance of its functions, and
WHEREAS, the "Old Administration Building" located on the Yakima Municipal
Airport is presently unoccupied and there seems to be no immediate prospect of a tenant for the
same and said building is suitable and adaptable for purposes of the Civil Air Patrol, Inc., and
WHEREAS, the City Council finds that it is in the best interests of the
people of the �'ity of Yakima to lease and let said premises to said Civil Air Patrol, Inc„ for
an indefinite period of time for a nominal consideration, now, therefore,

That the `ity Manager and City Clerk of the City of Yakima are hereby
authorized and directed'to enter into a lease agreement with the Civil Air Patrol, Inc., for an
indefinite term for a nominal consideration for the lease of the "Old Administration Building"
located at the Yakima Municipal Airport by the-ity of Yakima to said Civil Air Patrol, Inc.',
according to the terms and conditions of an agreement hereto attached and by this reference incor-
porated herein.

An ordinance appropriating $3,150.00 in the City Garage Fund to Automotive Parts & Repair in the
Citv Garage 1961 Budget, was read by the Clerk of the Council and ordered laid on the table for on
week or until the regular meeting of December 11, 1961.
Moved by Larson, seconded by Maxwell that Ordinance No. 303 authorizing the use of fire apparatus
and personnel beyond the corporate limits of the City of Yakima, be passed as read:- carried„

cussion determined that this ordinance formalizes mutual aid programs between the Citv Fire Depart,
ment and the County Fire districts to act in case of emergencies.
ORDINANCE NO. 303, AN ORDINANCE authorizing the use of fire apparatus, and personnel operating
the same, beyond the corporate(-;limits of the City of Yakima and prescribing conditions thereof.

RESOLUTION NO. D -340, A RESOLUTION authorizing the `'ity Manager and the "ity Clerk to execute an
Agreement with the firm of Cornell, Howland, Hayes and,Merryfield to furnish engineering services
to the City of Yakima for preliminary investigation of sewerage system.
WHEREAS, the "jity Council of the City of Yakima has determined that it is
necessary to en age an engineering firm to make a preliminary investigation of the sewerage system
of the City of akima to establish design criteria and prepare preliminary designs -for improvement;
and additions to the sewerage system, and
WHEREAS, Cornell, Howland, Hayes & Merryfield, a professional engineering
partnership, has heretofore been selected as the engineering firm to furnish such engineering
services, and
WHEREAS, it is necessary to enter into a contract with said firm, now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the it y Manager and the City Clerk of the City of Yakima are hereby
authorized and directed to execute an agreement to-furnish engineering services to the City of
Yakima for preliminary investigation of sewerage system with Cornell, Howland, Hayes & Merryfield,
a professional engineering partnership, a copy of which Agreement is hereto attached and by this
reference made a part hereof.

application to the United States Community Facilities Administration for funds to defray costs of
development of preliminary plans for expansion of waste treatment facilities and correction of
ground water infiltration, be passed as read: carried, Keith, Larson, Lemon, Maxwell and Robinson
voting aye on roll call. Barber absent.
RESOLUTION NO. D' -341, A RESOLUTION authorizing the City Manager to execute an application to the
United States Community Facilities Administration for funds to defray costs of development of
preliminary plans for expansion of waste treatment facilities and correction of ground water in-
filtration.
WHEREAS, City of Yakima (herein called the "Applicant ") after thorough con-
sideration of the various aspects of the problem and study of available 'data has hereby determined
that the construction of certain public works, generally described as expansion of waste treatment
facilities and correction of ground water infiltration, is desirable and in the public interest
and to that end it is necessary that action preliminary to the construction of said works be taken
immediately; and
WHEREAS, under the terms of Public Law 560, 83rd Congress, as amended, the
United States of America has.authorized the making of advances to public bodies to aid in financ-
ing the cost of engineering and architectural surveys, designs, plans, working drawings, specifi-
cations or other action preliminary to and in preparation for the construction of public works;
and
WHEREAS, the applicant.has examined and duly considered such act and the
applicant considers it to be'in the public interest and to its benefit to file an.application
under act and to authorize other action in connection therewith;
NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, ".the governing body
lof said applicant, as follows:
1. That the construction of said public works is essential to and is to
the best interests of the applicant, and to the end that such public works may be provided as
promptly as practicable it is desirable that action preliminary to the construction thereof be
undertaken immediately;

12. That George D. Smith, City Manager, be hereby authorized to file in
behalf of the applicant an application (inform required by.the United States and in conformity
with said act) for an advance to be made by the United States to the applicant to aid in defray-
ing the cost of plan preparation for the above described public works, which shall consist gener-
ally of developmdnt of preliminary plans for expansion of waste treatment facilities and correc-
tion of ground water infiltration;
3. That if such advance be made, the applicant shall provide or make
necessary arrangements to provide such funds, in addition to;the advance, as may be required to
defray the cost of the plan preparation of such public works;
4. The said George D. Smith, City Manager, is hereby authorized to furnisl
such information and take such action as may be necessary to enable the applicant to qualify for
the advance;
5. That the officer designated in the preceding paragraph is hereby design
nated as the authorized representative of the applicant for the-purpose of furnishing to the
United States such information, date and documents pertaining to the application for an advance aE
may be required; and otherwise to act as the authorized representative of the applicant in con-
nection with this application.
6. That certified copies of this resolution be included as part of the
application for an advance to be submitted to the United States.

by Gary Germunson to George M. Germunson, the purchaser's interest in a land contract with the.

call. Barber absent., /Discussion disclosed that this property is located at 1222 Ledwi.ch-Avenue,
that it became city owned property through foreclosure sale and was sold to gary Germunson in
accordance with Resolution No. D -1$1.
RESOLUTION NO. D -342, A RESOLUTION authorizing the City Manager to consent to the assignment by
Gary Germunson to George M. Germunson of the purchaser's interest in a Land Contract with the
City of Yakima.
WHEREAS, by Resolution No. D -181 the Mayor, City Manager andf:the City Clerk
were authorized to execute a Land Contract with Gary Germunson for the sale of certain land owned
by the City, and
WHEREAS, said Land Contract was executed on the 10th day of October, 1960,
and
WHEREAS, the said Gary Germunson is desirous of assigning his interest in
said Land Contract to George M. Germunson, and the City Council finds that there is no valid
reason bhy it should not consent to such assignment, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF.YAKIMA:
That the City Manager is hereby authorized to execute the Consent to
Assignment by Seller of the assignment by -Gary Germunson to George M. Germunson of the purchaser's
interest in a Land Contract dated the 10th day of October, 1960, for the purchase of certain
property -owned by the City of Yakima.

WHEREAS, surpluses exist in Account 7 -08, Extra Help, of the Salaries
classification, in Accounts 7 -13, Industrial Insurance & Medical Aid, 7 -439 Structures & Buildings

WHEREAS, because the operation of the new PBX sys tem is more expensive
than the old system, there is a shortage of funds in Account 7 -57, Telephone & Telegraph, of the
Maintenance & Operation classification of the 1961 appropriation for 34 - City Garage, and
WHEREAS, additional moneys are required in Account 6 -61, Furniture &
Fixtures, of the Capital or Betterment classification of the 1961 appropriation for 34 - City
Garage, to purchase a filing cabinet, and
WHEREAS, at the time of the adoption of the 1961 Budget, it could not
have reasonably been foreseen that the above additional expenditures would be required, and the
City Council finds that it is in the best interests of the people of the City of Yakima to make
the aforesaid transfers, and that the action contemplated herein is authorized by R.C.W.35.33.120,
now, therefore,

Manager Smith having requested that -the Council fix a date for public hearing on said plan, it
was MOVED by Maxwell, seconded by Keith that said hearing be held -at the regular meeting of
