HomeMy WebLinkAbout11/13/1961 Business MeetingP33 NOVEMBER 13, 1961 The City Council met in regular session, Mayor Bostic, Councilmen Barber, Keith, Larson, Lemon, Maxwell and Robinson,-.�City-;Manager. Smith_and.City Attorney Arntson present on roll call. The invocation was given by Councilman Lemon. The minutes of the regular meeting of November 6, 1961 were approved as read. This being the time fixed by the Council for the hearing on Petition No. 99 as filed by Boise - Cascade Inc., praying for the annexation of certain property, it was MOVED by Keith, seconded by Lemon that Ordinance No. 297 providing for said annexation and zoning said property as M -2 Heavy Industrial and R. -3, Multiple - Family Dwellings, be passed as read: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinoon voting aye on roll call. /Mr. Chester Thomas, Attorney for Boise - Cascade, being present, indicated that all matters are acceptable to his firm. There were no further protests to said annexation. ORDINANCE NO. 297, AN ORDINANCE providing for the annexation by the City of Yakima of certain property contiguous to the City and zoning the same. An ordinance appropriating the sum of $675.00 from the Yakima Ditch Protection Bond Redemption Fund to Interest and Debt Redemption for the purpose of paying the firet interest payment on said bonds, was read in its entirety by the Clerk of the Council and ordered laid on the table for one week, to be read and considered at the next regular meeting of the Council on November, 20, 1961. The City of Yakima having purchased certain property located.at 610 South 3rd Avenue for the ex- pansion of it's warehouse property in accordance with Resolution No. D -303, it was MOVED by Larson, seconded by Robinson that Ordinance No. .29$ eliminating said property from the irrigation maintenance charges of Local Improvement District No. 30$, be passed as read: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. Discussion dis- closed that Mr. Alva Taylor has paid to the City, $100.00 for the salvable materials in the - buildings on this property. ORDINANCE NO. 29$, AN ORDINANCE eliminating certain property known as 610 South Third Avenue, within the City of Yakima, Washington, from irrigation maintenance charges of Local Improvement District No. 30$: An ordinance amending an ordinance providing for a business and occupational tax, increasing .the tax rates, providing for a surcharge and amending the Yakima Municipal Code, was read by the Clerk of the Council. It was then MOVED by Barber, seconded by Robinson that said ordinance be passed as read. Discussion followed and it was pointed out that this ordinance is not intended to cover bottled gas. It was then MOVED by Lemon seconded by Keith that Section-2, (c) be amend - ed'to read "selling or furnishing natural gas for heat"- carried, Barber, Bostic, Keith, Larson Lemon, Maxwell and Robinson voting aye by voice vote: Ar. Marshall Jones,-President of the Cascade Natural Gas Company and Mr. Ed Thoman of the Pacific Power & Light asked that service incomes of their respective companies be exempt from "gross income ". The City Attorney having discussed the legality of this point, it was MOVED by Robinson, seconded by Maxwell that Section 2 (c) be amended further to read 11(2 %) of the total Gas revenue" instead of 11(2% of the total gross income" as read and Section 3 line 4 be amended to read "total gas revenue" instead of "total gross income" as read: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Mr. Ron Johnson, manager of the Pacific Northwest Telephone Company indicated that the ordinance as read, properly covers their incomes. After further dis- cussion and it being generally agreed that more consideration should be given to this matter, it was•MOVED by Maxwell, seconded by Barber that the matter of passage of the ordinance relating to business and occupation taxes upon certain utilities be tabled until the next regular meeting of the City Council on Monday the 20th day of November, 1961: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. Moved by Barber, seconded by Robinson that Resolution No. D -329 transferring $5,374.00 within the 1961 Budget for the Municipal Garbage Department, be pay: ;sed as read: carried, Barber, Bostic Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. RESOLUTION NO. D -3-29) A RESOLUTION transferring the sum of $5,374.00 within the 1961 appropria- tion for 32 - Municipal Garbage. WHEREAS, a surplus exists in Account 641, Automotive Equipment, of the Capital or Betterment classification of the 1961 appropriation for 32 - Municipal Garbage, and WHEREAS, insufficient funds were appropriated to Accounts 7 -12, Social Security, 7 -13, Industrial Insurance & Medical Aid,.and 7 -54, Heat & Fuel, of the Maintenance & Operation classification of the 1961 appropriation for 32 - Municipal Garbage, and WHEREAS, more automotive parts and repair work were required than had bee anticipated for and appropriated to Account 7 -40, Automotive, Parts & Repair, of the Maintenance & Operation classification, and WHEREAS, additional moneys are required ih Account 7 -41, Automotive, Motor Fuel, Etc., of the Maintenance & Operation classification, to cover the cost of using additional automotive equipment, and WHEREAS, because the,operation of the new PBX system is more expensive than the old system, there is a shortage of funds in Account 7-57, 'Telephone & Telegraph, of the Maintenance & Operation classification, and WHEREAS, in order to pay the taxes on increased revenue, additional moneys are required in Accounts 7 -60, Taxes - State, and 7 -61, Taxes - City, of the Maintenance & Operation classification, and WHEREAS, at the time of the adoption of the 1961, Budget, it could not have reasonably been foreseen that the above additional expenditures would be required, and the City Council finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfers, and that the action contemplated herein is authorized by R.C.W. 35.33• 120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the following sums are hereby transferred within the I 234 NOVEMBER 13, 1961 1961 appropriation for 32 - Municipal Garbage: From: CAPITAL OR BETTERMENT 6 -41 Automotive Equipment To: MAINTENANCE & OPERATION $5,374.00 7 -12 Social Security $ 717.00 7 -13 Industrial Insurance & Medical Aid 94.00 7 -40 Automotive, Parts & Repair 2,000.00 7 -41 Automotive, Motor Fuel, Etc. 500.00 7 -54 Heat & Fuel 50.00 7 -57 Telephone & Telegraph 100.00 7 -60 Taxes - State 663.00 7 -61 Taxes - City 1,250-00 5,374.00 S Section 2. (S E A L) THOMAS C. BOSTIC Mayor The Planning Commission recommending the vacation of Public Utility Easement on the property at 512 North 45th Avenue as requested by Clarence E. Marshall and others on Petition No. 107, it was MOVED by Maxwell, seconded by Larson that the City Attorney be and is hereby instructed to pro- ceed with action to vacate in accordance with the statute: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell, and Robinson votingi=!aye by voice vote. The Planning Commission also recommending the rezone of certain property located at East Yakima Avenue and North 7th Street between Yakima Avenue and "A" Street in accordance with Petition No. 113 as filed by Paul A. Cook Inc., it was MOVED by Lemon, seconded by Keith that the City Attorney be and is hereby instructed to prepare the ordinance rezoning said property for the next regular meeting of the City Council on November 20,. 1961: carried, Barber, Bostic, Keith, Larson; Lemon, Maxwell and Robinson voting aye by voice vote. Manager Smitireported that he and the staff have had a meeting with the contractors on the Kiwani: Park Pump and Pumphouse project and they are now ready to proceed with this project. He also ad- vised the Council that the City' Finance Department has won a coveted award from the Municipal Finance Officers Association on their 1-9461 Annual Financial Report.
