HomeMy WebLinkAbout11/06/1961 Business MeetingF, 230 NOVEMBER 6, 1961 The City Council met in regular session, Mayor Bostic, Councilmen Barber, Keith, Larson, Lemon, Maxwell and Robinson, City Manager Smith and City Attorney Arntson present on roll call. The invocation was given by Councilman Larson. The minutes of the regular meeting of October 30, 1961 were approved as read. An ordinance appropriating $12,000.00 from the unappropriated moneys of the Airport Fund having been read in its entirety at the regular meeting of October 25, 1961 and laid on the table until this date, and read by title only at this meeting, it was MOVED by Maxwell, seconded by Barber that Ordinance No. 294 providing for said appropriation for the purchase of the Lamson Aircraft building at the Yakima Municipal Airport as authorized by Resolution No. D -301, be passedaas read: carried, Barber, Bostic, Keith, Larson, Lemon, and Maxwell voting aye on roll call. Robinson temporarily excused. ORDINANCE NO. 294, AN ORDINANCE appropriating the sum'of $12,000.00 from the unappropriated moneys of the Airport Fund to Account 6 -11, Buildings of the Capital or Betterment Classificatior of the 1961 appropriation for 33 - Airport Fund. This being the time fixed by the Council for the hearing on Resolution No. D -320, being a resolution of intention to create a local'Improvement District for the construction of sanitary sewers.as requested by Petitions No. 97 -a, 105 and 110, it was MOVED by Lemon, seconded by Larson that the ordinance providing for. said improvement and creating a Local Improvement District be passed as read: Discussion followed and indicated that,there are no objections in writing or otherwise but raised the question as to whether or not property may be assessed more than its assessed valuation. Attorney Arntson having asked for time to check the law, it was MOVED by Robinson,,_seconded by Lemon that the Council pass on to the next order of business: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. The next order of business being the hearing on Resolution No. D -323, being a reolution of in- tention to create a local improvement district for the construction of a sanitary Sewer as re- quested by Petition No. 93,*it was MOVED by Robinson, seconded by Larson that Ordinance No. 295 providing for said improvement and creating L.I.D. No. 897, be passed as read: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call, Discussion dis- closed that there is one protest to this action comprising approximately 8% of the district. ORDINANCE NO. 295, An ORDINANCE providing for the improvement of certain property by construct- ing a pipe sewer with the necessary wye branches and manholes; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. The City Engineer reporting the following monthly estimates for work performed on city projects during the month of October, 1961, Superior Asphalt & Concrete Co. No. 896 403.92 it was MOVED by Keith, seconded by Maxwell that the City Engineer's report dated November 6, 1961 with respect to the progress on the various construction projects of the City of Yakima be approti ed and that the progress estimates therein set forth be approved and payment of the same be authorized: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Citv Attorney Arntson having informed the Council that there are no legal technicalities in con- nection with the formation of a local improvement district as set forth in Resolution No. =D-230 as considered earlier in this meeting, Mayor Bostic called for a roll call vote on the motion made by Councilman Lemon and seconded by Councilman Larson to pass Ordinance No. 296 providing for the improvement of certain property by the construction of sanitary sewers and creating L.I. D. K. Powell and Co.,Schedule II; Picatti Bros., Schedule III; Valley Plumbing & Heating, Schedule IV: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Mrs. Ada Bates, a petitioner, being present at this meeting inquired as to the action to be taker on Petition No. 112 as filed by Jeanette Yancey and othe es� re esting that the property-located on the Southwest corner of North Third Avenue and Popla . �i�'yWhager Smith reported th at the owners of said property have agreed to comply with this request but have asked for 60 days in which to ­iemov-e-- salvable machinery and equipment from the buildings and they will then consent to the Fire Department destrying the buildings under a controlled burn. Mrs. Bates indicated that this action will be satisfactory to the petitioners. Manager Smith.,having submitted a written report to members of the Council on,the selection of r., Consulting Engineers for the expansion of the Sewage Treatment Plant in compliance with the request of the State Pollution Control Commission to take steps to reduce the amount of in- adequately treated sewage effluent from said Sewage Treatment Plant to the river, further explain- ed said report. He stated that all interviews had been attended by John Mayo, Director of Public Works, Lloyd Belz, Director of Public Utilities and himself and that after the completion of said interviews and careful evaluation of the firms and their proposals, the staff and himself were unanimous in the choice of Cornell, Howland, Hayes and Merryfield of Seattle and Corvalis, Oregon as the firm best qualified to undertake this study. He also related that Lloyd Belz, Director of Utilities scored the firm of Livingstonand Moore as his second choice and that he and John Mayo, Director of Public Works were of the opinion that Gray and Osborne were the second best qualified firm. Councilman. Lemon challenged the selection of the Oregon firm stating that there is not enough difference in the staffs rdwith Gray and Osborne, only two points, and further stating that he believes this business / given to the local firm if at all possible. Councilman Robinson concurred with the Manager and Staff stating that infiltration is the proble and he believes the Oregon firm has more experience in this matter. Other Councilmen voiced con -I currence with the Manager and staff. MOVED by Robinson, seconded by Barber that the City Manage be and is herebv authorized to retain the firm of Cornell, Howland, Hayes and Merryfield and to negotiate with said firm for the proper contract: carried, Barber, Bostic, Keith, Larson, Lemon Maxwell and Robinson voting aye by voice vote., Lemon voting nay. Discussion with staff members r =x NOVEMBER 6, 1961 Mayo and Belz indicated that this selection had been made on the basis of the people doing the work rather than a firm name and it was suggested by Council,members that the names of such persons be placed in the contract to be executed consummating this action. Manager Smith, in accordance with instructions received from Ken Gilbert, State Superintendent of Elections, informed Councilmembers that their position on the 1962 ballot will be determined by lot and that there is to be two-lots drawn since two members are serving unexpired terms. The Clerk of the Council then conducted the drawing of numbers for position and Councilman Barber drew No. 1, Councilman Larson No. 3, Councilman Bostic No. 4, and Councilman Keith No-. 2, these being the four year terms. 'For the unexpired terms or two year terms,Councilman Maxwell drew No 6 and Councilman Lemon No. 5. Council members having received-a questionaire from the Association of Washington Cities regarding "Cities' Sharine, of State Sales Tax ", it was suggested that the Council act d-n this matter and one answer be given. It was then MOVED by Robinson, seconded by Larson that the Council`replye-- "Yes" to the first four questions on said questionaire: carried, Barber, Bostic, Keith, Larson, Lemon and Robinson voting aye on roll call. Maxwell voting nay. On the request of Public Works Director Mayo,`Mr. Eugene Auve and Mr. Al De Atley,:contractorrs dasng business as Superior Asphalt & Concrete Company, came to this meeting to discuss the present street projects with members of the Council. Mayor Bostic questioned them concerning Sunset Ave. stating that it has taken to long to compete this job and that it is unsatisfactory. Mr. Auve explained that the contract for the street projects was not signed until September 1, 1961 and and that his firm had other projects to finish before he could start. He further explained that these streets will not be as well done as the statehighway because of the difference in thickness of the surfacing and that the change to hot weather next summer and the traffic will take care of the irregularities which are now evident. He also assured the Council that the job will be completed on time. There being no further business to come before the Council, it was MOVED by Maxwell, seconded by Larson that we do now adjourn at the hour of 4:40 P.M., carried, Barber, Bostic, Keith,Larson, Lemon, Maxwell and Robinson voting aye by voice vcte.
