HomeMy WebLinkAbout10/30/1961 Business Meetingr I OCTOBER 30, 1961 In accordance with Ordinance No. 285 as passed by the City Council at their regular meeting.on September 27, 1961, said Council held their first regular meeting on Monday, October 30, 1961 instead of Wednesday as previously scheduled. Mayor Bostic, Councilmen Barber, Keith, Larson, Lemon, Maxwell and Robinson City Manager Smith and City Attorney Arntson present on roll call. The invocation was given by Councilman Larson. The minutes of the regular meeting of October 25, 1961 were approved as corrected. A Notice of Intention To Commence Annexation Proceedings.Thaving been duly filed by the Boise - Cascade Corporation with the City Clerk on this date, was read by the Clerk of the Council. MOVED by Robinson, seconded by Maxwell that the City Council forthwith meet with the officers and repre- sentatives of Boise - Cascade Corporation, now present, to determine if the property described in its Notice of Intention To Commence Annexation Proceedings will be accepted for annexation and if the owners thereof will be required to assume the City's indebtedness: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. In compliance with this action the two matters, acceptance of said annexation and whether or not the owners thereof.will be required to assume the City's indebtedness, were discussed with Mr. Chester Thomas, Attorney for said Boise Cascade Corporation. All-matters having been agreed upon, it was MOVED by Lemon, seconded by Barber that the City Council inform Boise - Cascade Corporation that it will accept the proposed annexation and that the owners of property therein will not be required to assume the City's indebtedness: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. A petition praying for the annexation of certain property, fully described in said petition, was 'then filed with the City Clerk by Boise- Cascade Corporation and read by the Clerk of the Council. IIt was then MOVED by Larson, seconded by Lemon that the Petition of Boise - Cascade Corporation for annexation of the property therein described to the City of Yakima, be approved and'the Mayor be authorized to convene the Review Board, specified in Section 2 of Chapter 282,-Laws of 1961, for its consideration of the proposed annexation: carried, Barber, Bbstic, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Mayor Bostic having informed the Council that the Review Board would not be available until the hour of 3:30 P.M., it was MOVED by Robinson, seconded by Keith that the Council return to further order of business pending the arrival of the Board of Review: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting ave by voice vote. This being the time fixed by the Council to further consider a resolution re- establishing the annual irrigation maintenance rates and charges and providing for a surcharge in certain areas for CD the year of 1962 and a motion to adopt said reasolition having been made at the regular meeting of October 25, 1961 and further action tabled, Council members discussed further the matters of re- placing old lines, costs and conversion to a utility,. with Manager Smith and Frank Stein, Irrigation Superintendent. All persons having been heard on this matter, Assistant Mayor Larson called for a vote on the motion to adopt Resolution No. D -32$, providing for irrigation rates and surcharges for 1962 and it carried: Barber Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. Mayor Bostic not voting since he has convened the Review Board for the Boise- Cascade Annexation at this time, in accordance with actions taken earlier in this meeting. RESOLUTION NO. D -32$, A RESOLUTION re- establishing the annual irrigation maintenance rates and charges and providing for a surcharge in certain areas in the City of Yakima. WHEREAS, because of increased costs in the maintenance of the irrigation system.of the City of Yakima it is necessary to increase the annual irrigation mainenance rates and charges, and WHEREAS, because of extraordinary maintenance required in the rehabilita- tion of the diversion dam on the Naches River at Nelson Bridge it is necessary to add a surcharge for the period of one year to the annual irrigation maintenance rate of the General Sjrstem and its sub - districts, that is Irrigation Local Improvement District Numbers, 308; 521; 528; 542; 594; and 616, and WHEREAS, because the required-replacement of 'the 16 inch steel transmission line, it is necessary to add a surcharge for the period of one year to the annual irrigation main - tenance rate of the West Yakima System and its sub - districts, that is Irrigation Local Improvement District Numbers, 395; 50$;, 510, 527; and 563, and WHEREAS, because of the required replacement of the 3 inch steel pipe line, it is necessary to add�a surcharge for the period of three years to the annual irrigation main- tenance rate of the North Hillcrest System, that is Irrigation Local Improvement District Number 621, and WHEREAS, because of the necessity of constructing new screening boxes and pump houses it is necessary to add a surcharge for the period of one year to the annual irrigation maintenance rate of the Lenox Avenue System Irrigation Local Improvement District Number 664, and the De Atley Park System, Irrigation Local Improvement District Number 624, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That from and after January 1, 1962, the annual irrigation maintenance rates and charges to be assessed by the Irrigation Department of the City of Yakima shall be as follows: Area served by Gravity System $ .00105 Per sq.ft. of land Area served by Lenox Pump System _ 00125 _ rr . 't Area served by other pump System .00135 Section 2. That for a one year period beginning January 1, 1962, there shall be added to the said annual irrigation maintenance rates and charges in the following listed Irrigation Local Improvement Districts, to -wit: 308, 521, 528, 542, 594 and 616, a surcharge whic; shall be computed on the annual basis of $.006 per square foot of land. Section 3. That for a one year period beginning January 1, 1962, there shall be added to the said annual irrigation maintenance rates and charges in the following listed Irrigation Local Improvement Districts to -wit: 395, 50$, 510, 527 and 563, a surcharge which shat be computed on the annual basis of .006 per square foot of land. That for .a period of three years beginning January 1, 1962, there shall be added,�o- the said annual Irrigation Maintenance rates and charges in the following Irrigation Local Improvement District, to -wit: 621,'a surcharge which shall be computed on the annual basis of $.0011 per square foot of land. Section 5. That for a period'of one year beginning January 1, 1962, there shall be added to the said annual irrigation maintenance rates and charges in the following listec Irrigation Local Improvement Districts, to -wit: 624 and 664, a surcharge which shall be computed on the annual basis of $.000$5 per square foot of-land. Section 6. That Section 2 of Resolution No. D -65, as amended by Resolutior No. D -71, is hereby continued in full force and effect. Sellers to Shell Gil Company of certain property located at the Yakima Municipal Airport, be passed as read: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. -Bostic not voting. RESOLUTION NO. D -329, A RESOLUTION consenting to sublease on the Yakirra Municipal Airport from James A. Sellers to Shell Oil Company, Incorporated. WHEREAS, in Resolution No. D -226, the City of-Yakima consented to the sub - letting of a portion of the property on the Yakima Municipal Airport by the assigned lessee, Baxter Aircraft, Inc., to Shell Oil Company, In., and WHEREAS, pursuant to said sublease the said Shell Oil Company, Inc., made certain installations on said property, and WHEREAS, subsequent thereto•, the conditional assignment of said lease to Baxter Aircraft, Inc. -, was cancelled and revoked and the title thereto reverted to-the assignor, James A. Sellers, and WHEREAS, the said Shell Oil Company, Inc., is desirous of subletting the same portion of said property from James A. Sellers under certain terms and conditions as de- termined between the said Shell Oil Company, Inc., and the said James A.' Sellers and the City of, Yakima is agreeable to such sublease, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the sublease of certain space upon the Yakima Municipal Airport from James A. Sellers to Shell Oil Company, Incorporated, a copy of which sublease agreement is hereto attached and by this reference made a part hereof,-is hereby approved. BOSTIC City Clerk Mayor Manager Smith and City Engineer Mayo reported on the street projects pointing out that the Contractors are having problems and running behind schedule but should be finished in about 3 weeks, weather permitting. Manager Smith informed Council members that Mr. Boldt will be in Yakima November 1, 1961 to dis- cuss the rough draft of a workable renewal program the time and place of.said meeting yet to be fixed. Mayor.Bostic having filed the Findings and Determination of the Review Board on Boise - Cascade Corporation Petition for Annexation to the City of Yakima with the City Clerk, it:i_wa.s MOVEDby Keith, seconded by Larson that the findings and determinations of the Review Board-on .the Petition of the Boise - Cascade Corporation for annexation of certain property to the City of Yakima be received and approved: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Discussion disclosed that the Review Board was comprised of the Mayor, Thomas C. Bostic; Chairman of School Board of Yakima. School District No. 7, Mr. Ralph Sundquist; Alternate, State Department of Commerce & Economic Development, Mr. F. G. Sutherlin; Chairman of the Board of Yakima County Commissioners, Lee Crossen; Chairman of School Board of Moxee School District No. 90, Mr:'-Jack L. Sisk; and a Resident and Property Owner of area proposed to be annexed Mrs. Annie L. Payne. Continuing the annexation procedure, it was MOVED by Robinson, seconded by Maxwell that this matter be brought on for public hearing on Monday the 13th day of November, 1961 and that the order fix- ing such date and providing for legal notice, be read: carried, Barber, Bostic, Keith, Larsoh, Lemon, Maxwell and Robinson voting aye by voice vote. The Clerk of the Council having read said order, it was MOVED by Maxwell, seconded by Barber that said order fixing the date of hearing 'on Monday the 13th day of November, 1961 on Petition for annexation as filed by the Boise Cascade Corporation, be adopted as read: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. There being no further business to come before the Council, it was MOVED by Barber, seconded by Keith that we do now adjourn at the hour of 4:10 P.M.: carried, Barber, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote.
