Councilmen Barber, Keith, Lemon and Robinson, City Manager Smith and City Attorney Arntson present on roll call. Bostic and Maxwell absent and excused. The minutes of the regular meeting of October 11, 1961 were approved as read. !fir.: Ray Mc Graw, Finance Director, introduced Mr. Joe Gleason, the new Accountant, to members of the Council. This being the time fixed by the Council'.for the continuation of the hearing on Petition No. 103 as filed by Clarence Williams, and Manager Smith reporting that the School Officials have been contacted regarding the vacation of the alley running west between 17th and 18th Avenue and that they have no objections to said vacation, and there being no other objections in writing or other wise to said action, roll call was taken on the pending motion as recorded in the minutes of . October 11, 1961 and it carried, Barber, Larson, Lemon, Keith and Robinson voting aye on roll call. Bostic and Maxwell absent. ORDINANCE NO. 292, AN ORDINANCE providing for the vacation of that portion of the alley located South of Lot 10, Block 2, Summitview Addition, in the City of Yakima, Yakima County, Washington. Petition No. 113 having been filed with the City.Clerk on October 16, 1961 by Paul A. Cook re- questing the rezone of certain property located on East Yakima Avenue and North 7th Street, it was MOVED by Robinson seconded by Barber -that said petition be referred to the Planning Commissi for study and recommendation: carried, Barber, Keith, Larson, Lemon and Robinson voting aye by voice vote. Bostic and Maxwell absent. Moved by Keith, seconded by Lemon that Resolution No. D -323 being a resolution of intention to improve certain property by the construction of pipe sewers in accordance with the request duly filed on Petition No. 93, and fixing the date of hearing on said resolution for November 6, 1961, be passed as read: carried, Barber, Keith, Larson, Lemon and Robinson voting aye on roll call. Bostic and Maxwell absent. RESOLUTION NO. D -3z3, A RESOLUTION of intention to create a Local Improvement District. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That it is its intention to improve the property within the following de- scribed district by constructing a pipe sewer with the necessary wye branches and manholes; all of said improvement to be constructed in full accordance with the plans and specifications to be prepared by the office of the City Engineer and filed with the City Clerk. The district to be served by and specially benefitted by and assessed for the above-described-improvement is situate in the City of Yakima, Yakima County, Washington, and described as follows: Lots 1 through 7, inclusive, and Lots 11 through 16, inclusive, Drakes Addition. All persons who may desire to be heard with ,reference to said proposed im- provement are hereby notified to appear at a meeting of the City Council to be held at its office in the Citv Hall in the City of Yakima, Yakima County, Washington, at the hour of 3:00 O'clock p.m., on Monday, the 6th day of November, 1961, which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto; and for de- termining the method of payment for said improvement; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvements. All costs and expenses in connection with the construction of said improve- ment, including the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor as provided by the laws and as above described. The.said assessment shall be made according to special benefits derived from the improvement without regard to the zone and termini method. The City Engineer is hereby directed to submit to the City Council, at or prior to the date herein fixed. for said hearing, all of the data and other information required by law to be by him submitted. LARSON Mayor Pro Tem Moved by Barber, seconded by Robinson that Resolution No. D -324 revoking and cancelling the Supplemental Agreement dated February 2, 1961 with Baxter Aircraft, Inc., be passed as read: carried, Barber, Keith, Larson, Lemon and Robinson voting aye on roll call. Bostic and Maxwell absent.ZDi.scussi.on disclosed that this action is legal inasmuch as the terms of said agreement have never been complied with by Baxter Aircraft, Inc., and that Mr. Baxter has no objections to the cancellation of the agreement. RESOLUTION NO. D -3241 A RESOLUTION revoking and cancelling the Supplemental Agreement dated February 2, 1961 with Baxter Aircraft, Inc., WHEREAS, in Resolution No. D -225 the'��ity Manager and the City Clerk of the City of Yakima were authorized to enter into a Supplemental Agreement with Baxter Aircraft, Inc., the conditional assignee of a-lease for certain property on the Yakima Municipal Airport from Jame,- A. Sellers, providing for a ten -year extension of said lease, conditioned upon the performance by Baxter Aircraft, Inc., of certain work therein specified, and WHEREAS, the said Baxter Aircraft, Inc., is in process of dissolution and has not performed the conditions prescribed in said Supplemental Agreement, and the City Council finds that it is in the best interests of the City of Yakima to cancel and revoke the same, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: 1 1 1 i l 1 225 OCTOBER 18, 1961 That the Supplemental Agreement between the City of Yakima and Baxter Aircraft,. Sellers providing for the payment-of back rent on certain property at the Airport, be passed as read: carried, Barber, Keith, Larson, Lemon and Robinson voting aye on roll call. Bostic and Maxwell absent. Discussion established that this is�th.e same property as covered by the action taken in Resolution No. D -324. RESOLUTION NO. D -325, A. RESOLUTION authorizing the City Manager and the City Clerk to execute and agreement with James A. Sellers providing for the payment of back rent at the Yakima Municipa.' Airport. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and the City Clerk of the City of Yakima are hereby authorized and directed to- execute on behalf of the City an Agreement with James A. Sellers pro- viding for the payment of back rent for certgin.property at the Yakima Municipal Airport, a copy of which Agreement is hereto attached and by this reference made a part hereof. Bostic and Maxwell absent.iscussion established that this action is necessary to purchase a uniform for the new meter man; that the remainder of the money will be used to buy rain coats for both meter men; that these men replace worn or damaged clothing on their own unless the damage was done while they are on duty and is no fault of their own. The merits of the scooter vs the motorcycle were also discussed and it i7s believed that the motorcycle is superior to the scooter. RESOLUTION NO. D -326, A RESOLUTION transferring the sum of $1,039.00 within the 1961 appropria- tion for 12 - Finance Department. WHEREAS, surpluses exist in Accounts 7 -03, Assistant Supervisor (Acct.II), 7 -04, Clerical (Acct. Clk I), and 7 -05, Other Per Annum, of the Salaries classification of the 1961 appropriation for 12 - Finance Department, and WHEREAS, additional moneys are required in Account 7 -30, Clerical & Office, of the Maintenance & Operation classification of the 1961 appropriation for 12 - Finance Department, to allow for necessary additional purchases of postage and office supplies, and WHEREAS, to provide uniforms for a replacement parking meter man addition- al moneys are required in Account 7 -36, Uniforms, of the Maintenance & Operation classification, and WHEREAS, t'o- provide for repairs to automotive and office equipment for the balance of the 1961 year additional moneys are required in Accounts 7 -40, Automotive, Parts &II Repairs, and .7 -46, Equipment - Parts & Repair, Etc., of the Maintenance & Operation classifica- tion, and WHEREAS, at the time of the adoption of the 1961 Budget, it could not havE reasonably been foreseen that the transfers herein would be required, and the City Council finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfers, and that the action ccntemplated herein is authorized by R.C.W. 35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Sectionl. LARSON Mayor Pro Tem I OCTOBER 1$, 1961 The City Engineer reporting the Final Estimates on work performed at the Yakima Municipal Airport during the month of September, 1961: Apron Extension Superior Asphalt & Concrete 5,840.7$ Apron Lighting Knobel's Electric $115$7.$7 it was MOVED by Keith, seconded by Lemon that the.progress report as submitted by the City Engineer, dated October 18, 1961, be approved and the progress estimates therein set forth be approved and payment of same be and is hereby authorized: carried, Barber, Keith, Larson, Lemon and Robinson voting aye on roll call. Bostic and Maxwell absent. Discussion established that the final cost of this project has not been determined at this time; that payment has not been received from F.A.A.; that a bill for 90% of the total cost has been submitted to the F.A.A. and that a final bill will be submitted in about 30 days. Manager Smith explained that a new type of shield for the six mercury vapor lights has been ordered because of the bad glare that the lights ive to the control tower. Council members having questioned the cost of the project be- ing 114, of the contract, City Engineer Mayo.explained that this came about because the central ramp area as constructed is slightly larger than had been anticipated. He also explained that additional days have been allowed to the contractor but it had been necessary to bill the con- tractor $50.00 a day liquidl,ed damages for three extra days. Manager Smith reminded Council members that DistricC14 Legislative meeting will begin with a dinner at 7:00 p.m. on Monday, October 30, 1961 at the Chinook Hotel. This meeting will be in conjunction with the Association of Washington Cities and there will be representatives from their staff at the meeting. Manager Smith reported on his interviews with Consulting Engineers in connection with the propos- edmodifications to the sewage treatment plant, stating that since said engineers feel that it is unethical to submit bids, a series of questions have been compiled for each firm to. answer in order to evaluate the applicants. A firm will be selected within the next few weeks. He ex- plained the procedure of the "Report Phase" or "Phase One" of the project which will be completed when the engineering-firm has completed their investigations and are ready to advise the City of their recommendations on the best procedure to solve the existing problems. It is hoped that thi project can be completed by the first of May, but the date is veryindefinite. City Engineer Mayo reported on the progress of the current street projects and discussed same with members of the Council, explaining that we are anticipating the completion of the Lincoln Avenue project this fall. The matter of damage to streets by the Cascade Natural Gas Company was discussed and it was established that representatives from the company have been working with the City Engineering staff and have two different crews working on the repairing of streets damaged by them.. Citv Engineer Mayoalos reported on the current-leveling and seal coating projects. In discussion of this matter, it was generally agreed that more effort should be made to keep the public in- formed on street projects and. was suggested that informative type signs at the various project sites might be erected. Councilman Robinson having inquired as to whether or not the N.P.Railwav might be making improve- ments on the crossings on B and D Streets, the City Engineer explained that the railroad crews are,now busy keeping the mountain crossings open and that no further work is anticipated on these crossings-until next year. There being no further business to come before the Council, it was MOVED by Keith, seconded by Lemon that we do now adjourn at the hour of 4:15 P.M.: carried, Barber, Keith, Larson, Lemon and Robinson voting aye by voice vote.
