Keith,' Larson, Lemon, Maxwell and Robinson,,�City Manager-Smith-and' City Attorney Arntson present on roll call. Mayor Bostic absent and excused. The invocation was given by Councilman Keith. The minutes of the Budget hearing on October 2, 1961 and the regular meeting of October 4, 1961 were approved as corrected. This being the. time fixed by the Council for the hearing on Petition No. 103 as filed by Clarence Williams requesting the vacation of an alley running west from North 17th and 18th Avenues, it was Moved by Lemon, seconded by Barber that the ordinance providing for said vacation be passed as read. (no vote taken at this point) Discussion disclosed that there were no protests in writing or otherwise;(that this alley is now being used for a private driveway. Since the School District had not been advised of the action to vacate said alley and the Council feeling that this could be used as an access route to the' Roosevelt School, it was MOVED by Robinson, seconded by Maxwell that this hearing be continued for one week, or until October 18, 1961, in order to specifically give notice to Mr. Gould and the School District about the proposed vacation: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson. Bostic absent. A petition, being Petition No. 112, having been filed with the City Clerk by Jeanette Yancey and others, requesting action to repair or tear down buildings located on the Southwest corner of North Third Avenue and Poplar Street, and there being persons present wishing to speak on this matter, Assistant Mayor Larson recognized "Mrs. Alex Muir, W. A. Renfrow and Ada M. Bates who further emphasized the need to take action on this matter.. Manager Smith informing the Council that there are numerous files on this property and requesting two weeks to bring said files up to date so that a "proper report can be made to the Council, it was MOVED by Robinson, seconded by Lemon that Petition No. 112 be referred to the City Manager for study and recommendation: carried Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Bostic absent. Councilman Robinson requested that the Police Department keep a closer -watch on said property in the meantime. Moved by Lemon, seconded by Keith that Ordinance No. 291 granting the Boise- Cascade Corporation permission to construct, maintain and operate a railway spur over and across North 8th Street and the alley east of North 8th Street, be passed as read: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. Bostic absent. Discussion disclosed that this is an extension of the existing spur track and is needed in Boise - Cascade's expeansion program and that the surrounding property will be zoned M -2, Heavy Industrial. ORDINANCE NO. 2911" AN ORDINANCE granting Boise- Cascade Corporation permission to construct, maintain and operate a railway spur over and across North 8th Street and the alley east of North 8th Street, just south of the tracks of the Northern Pacific Railway Co., Moxee Branch, within the City of Yakima, Washington. Moved by Maxwell, seconded by Barber that Resolution No. D- 320, -being a resolution of intention to improve certain property by the construction of pipe sewers in accordance with requests duly filed by petition Noss 97 -a, 105 and 110, and fixing the date of hearing on said resolution for November 6, 1961, be passed as read: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinso voting aye on roll call. Bostic absent. RESOLUTION NO. D =320, A RESOLUTION of intention to create a Local Improvement District. BE IT RESOLVED BY THE CITY COUNCIL OF THE -CITY OF YAKIMA: That it is its intention to improve the property within the following de- scribed district'by constructing a pipe sewer with the necessary wye branches and manholes; all of said improvement to be constructed in full accordance with the plans and specifications to be prepared by the office of the City Engineer and filed with the City Clerk. by, specially benefitted by and assessed for City of Yakima, Yakima County, Washington, and The district to be served the above - described improvement is situate in the described as follows, to -wit: Lots 3 through 12 inclusive, Ditter Place °Addition Lots 1 through 16 inclusive, Peach Ten Addition The Northwest Quarter of the Northwest Quarter of the Northeast Quarter of Section 27, Township 13 North, Range 18, E.W.M., which includes the proposed plat of Meadow Courts. All persons who may desire to be heard with reference to said proposed improvement are hereby notified to appear at a meeting of the City Council to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 3:00 o'clock p.m. on Monday, November 6, 1961, which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of payment for -said improvement; and the `pity Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvements. All costs and expenses in connection with the construction of said improve( ment, including the engineering; inspection, advertising, publication of notices, and all other expenses incident thereof, except the additional cost occasioned by the construction of the trunl sewers, shall be levied and assessed against all of the property legally and'properly assessable therefor as provided by the laws and as above described. The said assessment shall be made according to special benefits derived from the improvement without regard to the zone and termini method.. Bostic absent. RESOLUTION NO. D -321, A RESOLUTION transferring funds within the 1961 appropriations for 21 - Police Department and 24 - Engineering Department. WHEREAS, a surplus exists in Account 7 -05, Other Per Annum (Patrolmen), of the Salaries classification of the 1961 appropriation for 21 - Police Department, and WHEREAS, an error was made in the 1961 Budget in the appropriation of money to Account 7 -05, Other Per Annum (Police Service), of the Salaries classification of the 1961 appropriation for 21 - Police Department, and WHEREAS, more parts and repair work were required for the repair of police vehicles than had been anticipated and appropriated to Account 7- 40,,Automotive, Parts & Repair, of the Maintenance & Operation classification of the 1961 appropriation for 21 - Police Depart- ment, and WHEREAS, insufficient funds were appropriated to Account 7 -41, Automotive, Motor Fuel, Etc., of the Maintenance & Operation classification of the 1961 appropriation for 21- Police Department, to take care of an increase in the cost of fuel and increased necessary opera- tion of police vehicles, and WHEREAS, surpluses exist in Accounts 6 -41, Automotive Equipment, and 6 -51, Office Machines & Equipment, of the Capital or Betterment classification, in Account 7 -0$, Extra Help, of the Salaries classification, and in Account 7 -67, Insurance - Fire, Theft, Liability, of the Maintenance & Operation classification, all within the 1961 appropriation for 24 - Engineer. ing Department, and WHEREAS, the contractor upon several street projects in the City of Yakima is working for periods beyond normal working days in order to speed up the work, and,'as a con- sequence thereof, the City inspectors are required to work overtime and additional moneys are required in Account 7 -07, Overtime, of the Salaries classification of the 1961 appropriation for 24 - Engineering Department, and WHEREAS, at tYie time of the adoption of. the 1961 Budget, it could not have reasonably been foreseen that the above additional expenditures would be required,,and the City Council finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfers, and that the action contemplated herein is authorized by R.C.W. 35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY.OF YAKIMA: Section 1. D -322, A RESOLUTION authorizing the payment of $81.35 to Cascade Natural Gas II Corporation. Q WHEREAS, on or about July 24, 1961 employees of the City of Yakima Water Department broke a gas service line at 1511 South 12th Avenue while in-process of installing'a new water line, and WHEREAS, Cascade Natural Gas Corporation, the owner of said gas service line, within the time specified by law and City Charter, to -wit: On August 30, 1961, made claim against the City of Yakima for damages in'the sum of $81.35 as the result of said accident, and WHEREAS, the City Council finds said sum of $81.35 to be a reasonable sum to be paid in settlement of such claim, and finds that it is in the best interests of the people of the City of Yakima to make such settlement, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL. OF THE CITY OF YAKIMA: That the Director of Finance of the City of Yakima is hereby authorized and directed to pay the sum of $81.35 from the Water -Sewer Fund of the City of Yakima to the said Cascade Natural Gas Corporation in full settlement of its claim against the City of Yakima upon the execution by the said Cascade Natural Gas Corporation,of a Release absolving the City-from any and all liability as a result of said occurrence. LARSON Mayor Protem In accordance with action taken by the Council t- -TP -'' ^; at their regular meeting of September 13, 1961, the Clerk of the Council read a report from the Planning.Commission recommend- ing that Ordinance No. 229 regulating street planting should be revised in three general items, namely that street beautification should not be limited to group efforts, that the insurance re- quirements should be reviewed and some regulation of the type of trees grown in planters. Said report also suggested that the Park Superintendent should be consulted and that participation by individuals and organizations should be encouraged by a less restrictive ordinance, favorable publicity and by special recognition for outstanding efforts. Discussion of this matter indicat- ed that property damage requirement of $50,000.00 is to costly and that the original thought was that the insurance policy would be taken out by a group not by an individual. MOVED by Maxwell seconded by Barber that this matter be referred to the City Manager and staff for study: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Bostic absent. Manager Smith reported on the „rehabilitation of the City Streets for 1961 stating that the unit cost per yard is $1.07 as compared to $1.38 for the year of 1960. The City Engineer supported the managers report stating that the rehabilitation program is completed and that streets are now being leveled for seal coating and some asphaltic concrete overlays which he expects will be completed by November 1, 1961. Manager Smith.also reported that several months ago the city's Insurance Company advised him of a new type coverage for city property and that at that time it was not feasible to take advantage of of the new coverage because our policy had just been renewed. He described the policy as an "institutional type policy” and stated that it required the city to make quarterly inspections of it's property and report to the insurance carrier. He further stated that this new coverage would reduce next year's insurance rates approximately $1,000.00 for the City. Members of the Council.,discussed the matter of street curbs in certain areas with the City Manager and City Engineer. No formal action was taken on the matter. The matter of prior approval of investments as suggested by the.State Examiners was discussed and it was generally agreed that this is very impractical. No formal action was taken on this matter. There being no further business to come before the Council, it was MOVED by Barber, seconded by Keith that we do now adjourn at the hour of 4:30 P.M: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote.
