Keith and Maxwell absent.and excused. The invocation was given by Councilman Larson. The minutes of the regular meeting of September 13, 1961 were approved as corrected. In accordance with action taken by the City Council at their regular meeting of September 1_3, 1961) it was MOVED by Larson seconded by Lemon that Resolution No. D -315 fixing the date of hear- ing on Petition No.-103 as filed by Clarence Williams,requesting the vacation of the Alley runing West from North 17th Avenue to the alley between North 17th and 18th Avenue, at the hour of 3:00 o'clock P.M. on Wednesday the 11th day of October, 1961, be passed as read: carried, Barber, Bostic, Larson, Lemon, and Robinson voting aye on roll call. D -315, BEFORE THE CITY COUNCIL OF THE CITY OF YAKIMA, STATE OF WASHINGTON IN THE MATTER OF THE VACATION OF that ) portion of the alley located South of ) Lot 10, Block 2, Summitview Addition, ) RESOLUTION NO. D -315 in the City of Yakima, Yakima County, ) Washington. ) A RESOLUTION fixing the time for hearing on Petition for vacation of alley. WHEREAS, a petition has been filed with the City Council of the City of Yakima, Washington, a municipal corporation, praying for the vacation of the following described portion of an alley, to -wit: now therefore, The alley located South of Lot 10, Block 2, Summitview Addition, according to the official plat thereof, now on file and of record in the office of the Auditor of Yakima County, Washington; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That said petition shall be brought on for hearing an determination 6n Wednesday, the 11th day of October, 1961, qt the hour of 3 :00 o'clock in the afternoon*of said day at the office of the City Council of the_ City of Yakima, at the City Hall in Yakima, Yakima County, Washington, or as soon thereafter as the same may be heard, and that notice. of such hearing be given as provided by law. Bacon, be passed as read: carried, Barber, Bostic, Larson, Lemon and Robinson voting aye on roll call. Keith and Maxwell absent. ORDINANCE NO. 282, AN ORDINANCE accepting the recommendation of the Planning Commission and re- zoning certain property located at 1020 South 10th Avenue in the City of Yakima, Washington from R -2, Two Family Residential Zone, to B -3, General Business Zone. An ordinance appropriating the sum of $79,532.00 in the Arterial Street Furid for the construction of certain arterial streets and sidewalks according to the provisions for receiving ce -rtain ad- ditional moneys from the state gasoline tax to be paid to the City of Yakima by the State of Washington, having been read in it's entirety at the regular meeting of the City Council on the 13th day of September, 1961 and laid'on the table for one week and having been read at this meet- ing by title only, it was MOVED by Robinson, seconded by Larson that Ordinance No. 283 providing for said appropriation, be passed as read: carried, Barber, Bostic, Larson, Lemon and Robinson voting aye on roll call. ORDINANCE NO. 283, AN ORDINANCE appropriating the sum of $79,532.00 to Account 6 -04, Arterial and Sidewalk Construction, of the Capital or Betterment classification of the 1961 appropriation for 37 - Arterial Street Fund. Moved by Larson, seconded by Lemon that Ordinance No. 284 amending the Municipal Code relating to the transfering of money irrithin the same general classifications in the budget by the City Manager in accordance with Chapter 166, Laws of 1961, be passed as read: carried, Barber, Bostic. Larson, Lemon and Robinson voting aye on roll call. Keith and Maxwell absent. ORDINANCE NO. 284, AN ORDINANCE relating to the transfer of money within the same general classi- fications in the budget by the City Manager and amending Section 1.18.010 of the City of Yakima Municipal Code, and declaring an emergency. Moved by Barber, seconded by Lemon that Resolution No. D -316 authorizing the payment of $17.73 to James Stanley Gardner for damages sustained to his automobile as the result of an accident occur- ring in the area of the Grand Nob Market on Nob Hill Boulevard, be passed as read: carried, Barber, Bostic, Larson, Lemon and Robinson voting aye on roll call. Keith and Maxwell absent. RESOLUTION NO. D -316, A RESOLUTION authorizing the payment of $17.73 to James Stanley Gardner. WHEREAS, on or about April 21,'1961 James Stanley Gardner sustained damag- es to his automobile as the result of an accident occuring in the area of.the Grand Nob Market located at Nob Hill Boulevard and Grandview Avenue in the City of Yakima, Washington, and 'WHEREAS, the said James Stanley Gardner, within the time specified by law and City Charter, to -wit: On April 28, 1961, made claim against the City of Yakima for damages in the sum of $17.73 as the result of said accident, and 1 D it 1 1 h 1 215 SEPTEMBER 20, 1961 WHEREAS, the City Council finds said sum of $17.73 to be a reasonable sum tote paid in settlement of such claim, and finds that it is in the best interests of the people of the City of Yakima to make such settlement, now, therefore, BE IT RESOLVED BY THE CITY COUCIL OF THE CITY OF YAKIMA: That the Director of Finance of the City of Yakima is hereby authorized. and-,directed to pay the sum of $17.73 to James Stanley Gardner in full settlement of his claim against the City of Yakima upon the execution by the said James Stanley Gardner of a Release ab- solving the City from any and all liability as a result of said occurrence. Municipal Airport during the month of September, 1961, said estimates being the Semi -Final Estimates on this project, for payment: Yakima Municipal Airport Apron Lighting Project FAAP #9 -45- 023 -6107 Yakima Municipal Airport Apron Extension Project FAAP #9 -45 -023 -6107 Amount due is equal to 15% retainage Knobel's Electric Superior Asphalt & Concrete Co. No payment $10,367.71 it was MOVED by Larson, seconded by Lemon that said progress report dated 9/20/61 be approved, that the - progress estimates as set forth be improved and payment be and is hereby authorized: carried, Barber, Bostic, Larson, Lemon and Robinson voting aye by voice vote. Moved by Lemon, seconded by Robinson that the Investment Committee's Report dated September 18, 1961 as submitted by City Manager Smith, and read by the Clerk of the Council, recommending certain banks and banking proceedures for'city funds, be approved and accepted: carried;..Barber, Bostic, Larson, Lemon and Robinson voting aye by voice vote,. Keith and Maxwell absent. (The following is the above named report: Monday, September 18, 1961 10:30 A.M. At the request of Mayor Thomas C. Bostic, the Finance Committee met in the office of the City Manager, George D. Smith. Mayor Thomas C. Bostic, City Manager, George D. Smith and City Treasurer, Gladys H. Richter of the Finance Committee and Director of Finance,Ray Mc Graw were present. Mayor Thomas C. Bostic requested the meeting to discuss the amount of.money placed in the local banks. The practice of the City of Yakima keeping the deposits, as near as practicable, on a percentage-ratio, based on the total amount of deposits of each bank, was discussed. It was recommended by Mayor Thomas C. Bostic, and approved by the Finance Committee, that with one exception of the bank of Yakima, the deposits in the local banks be kept in the Seattle First National Bank, The National Bank of Commerce and the Central Yakima Branch National Bank of Washington to reflect a percentage ratio basis. Mayor Thomas C. Bostic recommended that the active account of the City of Yakima be rotated every two years between the banks wherein the bank deposits warrant proper servicing the City of Yakima account, based on this percentage.basis. It was recommended by Mayor Thomas C. Bostic, and was approved by the Finance Committee, that beginning January 2, 1962, The National Bank of Commerce be used as the active account, and that deposits in the various banks be adjusted on January 2, 1962 to reflect the percentage of bank deposits as of December 31, 1961., ATTEST: Gladys H. SMITH City Manager Mayor Bostic requested that the City Attorney prepare,for consideration, the necessary legislatio for changing the City Council's meeting date to Monday of each week, stating that said legislati does not need to be an emergency. No formal action was taken on this matter at this time. Manager Smith reported that a revolving signal has been placed on the Meade Avenue railroad crossing There being no further business to come before the Council, it was MOVED by Lemon, seconded by Barber that we do now adjourn at the hour of-4-.00 o'clock P.M: carried, Barber, Bostic, Larson, Lemon and Robinson voting aye by voice vote.
