Councilmen Barber, Larson, Lemon, Maxwell and Robinson, City Manager Smith and City Attorney Arntson present on roll call. Councilmen Bostic and Keith absent. Councilman Barber gave the invocation. The minutes of the regular meeting of September 6, 1961 were approved as read. Director of Public Works, John Mayo, introduced to members of the Council, Mr. Allen Ray who is City employed as Engineer 1 on the Engineering Staff. Assistant Mayor Larson called on Mrs. Helen Gilbert, Head Librarian for the Yakima Valley Regional Library, who explained that the Library Board has again asked for 2 mills from the City of Yakima for their 1962 operations,•.which has been granted in the City of Yakima Preliminary Budget. She further explained that the Library is now being asked to assume certain retirement costs which have been paid by the City in the past and which they did not know about nor have they taken into consideration when preparing their 1962 Budget. She further stated that the only funds available for this expenditure are in the book fund and requested the Council to consider this matter furth- er in their study of the Preliminary Budget. Assistant Mayor calling on anyone else present wishing to speak on matters on the agenda or other- wise, Mr. Alfred Settlemeyer introduced himself and requested to be heard on the matter of Peti- tion No. 99 as filed by Boise Cascade Corporation,praying for the annexation of certain property contiguous to the City of Yakima. Members of the Council agreeing to deviate from the agenda, the matter of Petition 99 was brought forth for consideration and a letter 'from the Planning Commission was read by the Clerk of the Council recommending the annexation of this property and further recommending that said property be classified as M -2, Heavy Industrial Zone with the ex- ception of residential uses which are recommended to be zoned R -3, Multiple Family Residential. Mr. Settlemeyer then explained that he had protested the inclusion of his property.in this annexa- tion at the Planning Commission hearing and wished to continue his protest at this time, stating that the property in question is that which was formerly owned by Gibson Packing Company and while it has a large building on it and has water and sewer services furnished by the City,:.it is undeveloped land and will not be compatible with the use plans and will be non - conforming and it will cost considerable to bring,the building up to city standards in accordance''with the building code. Members of the Council explained that if this property were excluded from this annexation it would become an island surrounded by the.City limits and the Yakima River with only ingress and egress by way of.C�_ty Streets. It was also disclosed that part of Mr. Settlemeyers property h -as been taken for the Freeway. All persons having been heard both for and against this matter and there being no further protests in writing or otherwise, it was MOVED by Robinson, seconded by Barber that Petition No. 99 as filed by Boise Cascade Lumber Company be and is hereby approved, that the recommendationsof the Planning Commission be and are hereby accepted and that the Mayor be and is herby directed to convene the Review Board in accordance with applicable atatutes: carried, Barber, Larson, Lemon, Maxwell and,Robinson voting aye by voice vote. Bostic and Keith absent. In accordance with Council action taken at the regular meeting of Septem "-')er 6, 1961, the hearing on Petition No. 90 as filed by Wm. Pflueger and others requesting the vacation of a portion of South•39th Avenue, was continued. _Manager Smith having explained that the matter of where this easement should be, has.been cleared and a new ordinance with the proper description prepared, it was MOVED by Robinson, seconded by Barber that Ordinance No. 281 providing for said vacation be passed as read: carried, Barber, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. ORDINANCE NO. 281, AN ORDINANCE providing for the vacation of that portion,/of 39th Avenue within and adjacent to the East side of Walnut Grove Addition, located, in the City` of Yakima, Yakima County, -� _Washington. September 11-1961. Petition No. 105 having been duly filed with the City Clerk /by A. G. Beaman ad others requesting the formation of a local improvement district for the construction of a sewer, it was MOVED by Robinson, seconded by Lemon that said Petition be referred to the City Manager for study and recommendation: carried, Barber, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Bostic and Keith absent. Petition No. 106 having been duly filed-.with the City Clerk on September 11, 1961 by A. G. Beaman and others requesting the formation of a local improvement district for the construction of water mains, it was MOVED by Maxwell, seconded by Lemon that said peition be referred to the City Manager for study and recommendation: carried, Barber, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Bostic and Keith absent. An ordinance appropriating the sum of $79,532.00 from the unappropriated moneys in the Arterial Street Fund for Street and sidewalk construction in accordance with provisions for certain addi- tional moneys to be paid to the city from the state gasoline tax by the State of Washington, was read by the Clerk of the Council and ordered laid on the table for one week, to be further con- sidered at the next regular meeting of the Council on September 20, 1961: Moved by Barber', seconded by Lemon that Resolution No. D -313 authorizing the execution of an agreement with the Washington State Highway Commission providing for the improvement of East Yakima Avenue from Naches Avenue to 9th Street, be passed as read: carried, Barber, Larson, Lemon Maxwell and,Robinson voting aye on roll call.-.Bostic and Keith absent. RESOLUTION N0. D -313, A RESOLUTION authorizing the City Manager and the City Clerk to execute an agreement with the Washington State Highway Commission for the improvement of East Yakima Avenue from Naches Avenue to 9th. Street. WHEREAS, it is advantageous to the `'ity of Yakima to enter into an agreemen with the Washington State Highway Commission for the improvement of East Yakima Avenue from Naches Avenue to 9th Street as a part of its arterial street construction program, which construction -- will tie into the construction of the Terrace Heights Way Interchange on Primary State Highway No. 3, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and the City Clerk of the City of Yakima are hereby authorized and directed to execute on behalf of the City of Yakima an Agreement with the Washington State Highway Commission for the improvement of East Yakima Avenue from Naches Avenue to 9th Street under the same contract with the State Highway Commission, a copy of which said Agreeffient is here - II � r SEPTEMBER 132 1961 to attached and by this reference made a part hereof. D -314, A RESOLUTION transferring funds within the 1961 appropriations for O1- City Council, 52.6 --Sewer Maintenance, 52.7 -'Sewage Treatment and 52.8 - Water. WHEREAS, a surplus exists in Account 7 -99, Miscellaneous, of the Mainten- ance & Operation classification of the 1961 appropriation for 01 - City Council, and WHEREAS, an insufficient amount was appropriated to Account 7 -50, Travel, of the Maintenance & Operation classification of the 1961 appropriation for 01 -City Council, and WHEREAS, surpluses exist in Accounts 7 -13, Industrial Insurance & Medical Aid, 7 -50, Travel, and 7 -5$, Equipment Rental, all within the Maintenance & Operation classifica- of the 1961 appropriation for 52.6 - Sewer Maintenance, and WHEREAS, insufficient amounts were appropriated to Accounts 7 -11, State- wide Pension, and 7 -12, Social Security, within the Maintenance & Operation classification of the 1961 appropriation for 52.6 - Sewer Maintenance, to cover the cost of payments required by law to be made, and WHEREAS, surpluses exist in Accounts 7 -13, Industrial Insurance & Medical Aid 7 -41, Automotive, Motor Fuel, Etc., and 7 -61, Taxes - City, all within the Maintenance & Operation classification of the 1961 appropriation for 52.7 - Sewage Treatment, and WHEREAS, additional moneys are required in Account 7 -33, Field & Non, Office, in order to purchase a supply of diesel oil for stand -by purposes for the compressor station in case of a failure in the electrical supply or pumps; and in Account 7 -38, Department - Special materials, in order to purchase additional chlorine for sewage treatment, necessitated by increased sewage flow during the summer and by the higher requirements of the State Pollution Control Commission, both Accounts being within the Maintenance & Operation classification of the 1961 appropriation for 52.7 - Sewage Treatment, and WHEREAS, a surplus exists in Account 7 -61, Taxes - City, of the Maintenance & Operation classification of the 1961 appropriation for 52.$ - Water, and WHEREAS, insufficient funds were appropriated to Accounts 7 -11, Statewide Pension, and 7 -64, Insurance, Medical & Physical Exams, and additional moneys are-required in Account 7 -37, Expendable Tools, to fill tool replacement requirements apparent for the remainder of the year, and in Account 7 -54, Heat & Fuel, to purchase an adequate supply of coal for heating the warehouse for the remainder of the year, all of which Accounts qre within the Maintenance & Operation classification of the 1961 appropriation for 52.$.- Water; and WHEREAS, at the time of the adoption of the 1961 Budget, it could not have reasonably been foreseen that the above additional expenditures would be required, and the City Council finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfers, and that the action contemplated herein is authorized by R.C.W. 35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the sum of $93.00 is hereby transferred from Account 7 -99 Miscellaneous, to Account 7 -50, Travel, both within the Maintenance & Operation classification of the 1961 appropriation for 01 - City Council. Section 2. That the following sums are hereby transferred within the Maintenance & Operation classification of the 1961 appropriation for 52.6 - Sewer Maintenance; From: 7 -13 Industrial Insurance & Medical Aid $300.00 7 -50 Travel 100.00 7 -58 Equipment Rental 145.00 545.00 To: 7 -11 Statewide Pension $420.00 7 -12 Social Security 125.00 545.00 Section 3. LARSON Mayor Pro Tem Petition No. 103 having been duly filed by Clarence Williams requesting the vacation of the alley running West from North 17th Avenue to the Alley between North 17th and 18th Avenue and-the Plannirig..Commission recommending the vacation of said alley, it was MOVED by Barber, seconded by Robinson that the City Attorney be and is hereby instructed to prepare the resolution� fixing the date-..of hearing on said petition:.:.:.carried, Barber, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Bostic and.Keith absent. Petition No. 104 having been duly filed by Frank M. Bacon requesting the rezone of certain propert located at 1020 South 10th Avenue from R -2, Two - Family Residence to B =3, General Business zone and the Planning Commission recommending that said property be reclassified as requested, it was MOVED by Robinson, seconded by Maxwell that the Planning Commissions recommendation be and is hereby accepted and the City Attorney be and is hereby instructed to prepare the necessary ordinance accepting said recommendation and providing for the rezoning of said property: carried; Barber., Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Bostic and Keith absent. Mr. Jules Schockley, Fireman, being present protested the passage of the Preliminary Budget on the 6th day of September, 1961, stating that the budget manual and other information indicated that it would not be passed until the 13th day of September, further contending that the public had been misinformed and thus were not heard before its passage. He also protested the contribut- ing of tax money to certain departments, namely the Park Department and'the Health District when said departments already have surpluses. He also protested the improving of parks outside the City limits, emphasizing that he is not protesting the purchase of property for parks. Memhers of the Council discussed the park programs, contending that we are not meeting good standards for parks and are statistically behind in park development. They also stressed the fact that,though the Preliminary Budget is passed, they will welcome comments on any part of said budget by anyone, No official action was taken at this time/ Mrs. Dowell Lambert, President of the League of Women Voters, introduced herself and explained to the Council that the league is studying the needs of cities and advised the Council that two representatives will be sitting in on Council meeting.. Manager Smith reported that the Contractor has finished the Airport Ramp and Apron Improvement. He also reported that he will be interviewing consulting engineering firms in connection with pollution control at our Sewage Treatment Plant. Manager Smith also requested'permission to re- fer Ordinance No. 229 which regulates street plantings in the business areas, to the Planning Commission for study and improving. Moved by Maxwell seconded by Robinson that said ordinance be referred to the Planning Commission for study and recommendation: carried, Barber, L'ar.sbn, Lemon, Maxwell and Robinson voting aye by voice vote. Bostic and Keith absent.
