Councilmen Barber, Keith, Lemon and Maxwell, City Manager Smith and City Attorney Arntson were present on, roll call. Mayor Bostic and Councilman Robinson absent and excused. Councilman Maxwell absent on roll call but present after 3:10 P.M. The invocation was given by Councilman Lemon. Councilman Maxwell present for the balance of this meeting. The minutes of the regular meeting of August 9, 1961 were approved as read. In accordance with action taken by the City Council at their regular meeting of August 9, 1961 on Petition No. 90 as filed by Wm Pflueger and others petitioning to vacate a portion of South 39th Avenue, it was MOVED by Keith, seconded by Barber that Resolution No. D -302 fixing the-date of hearing on said petition at the hour of 3 o'clock P.M. on the 6th day of September, 1961, be passed as read:: carried, Barber, Keith, Larson, Lemon and Maxwell voting aye on roll call. RESOLUTION NO. In accordance with action taken by the Council at their regular meeting of August 9, 1961 on'said petition requesting the rezone of property located at 205 and 207 South 6th Street, it was MOVED by Lemon, seconded by Maxwell that Ordinance No. 275 accepting the recommendation of the Planning Commission and rezoning said property from R -3, Multiple Family. Residential Zone to B -2, Local Business Zone, be passed as read: carried, Barber, Keith, Larson, Lemon and Maxwell voting aye .o on roll call. ORDINANCE NO. 275, AN .ORDINANCE accepting the recommendation of the Planning Commission and re- zoning certain property located at 205 and 207 South 6th Street, between East Walnut Street and East Spruce Street, in the City of Yakima, Washington. In accordance with action taken by the City Council on Petition No. 94 as filed by Crag D. Gilbe praying for the annexation of Lots 44 and 45 of State Addition, it was MOVED by Keith, seconded by Lemon that the order fixing the date of hearing on said petition for the 6th day of September, 1961 be approved as read: carried, Barber, Keith, Larson, Lemon and Maxwell voting aye by voice vote. Bostic and Robinson absent. In accordance with action taken by the City Council at their regular meeting of August 9, 1961 on Petition No. 98 as filed by J. Stanley Easter requesting the rezone 'of certah property at 1128 West Lenox Avenue, it was MOVED by Maxwell, seconded by Lemon that Ordira nce No' 276 accepting the recommendation of the Planning Commission and rezoning said property from R -2, Two Family Residential Zone to R -3 Multiple Family residential zone; be passed as read: carried, Barber, Keith, Larson, Lemon and Maxwell voting aye on roll call. ORDINANCE NO. 276, AN ORDINANCE accepting -the recommendation of the Planning Commission and re- zoning certain property located at 1128 West Lenox , between Queen Avenue and Twelfth Avenue, in the City of Yakima, Washington. In accordance with action taken by the City Council at thdr regular meeting of August 9, 19610 it was MOVED by Barber, seconded by Lemon that Resolution No. D -303 authorizing the purchase of certain property at 610 South 3rd Avenge for $11,000.00 and providing for the transfer of this sum 1 1 1 20 AUGUST 160 1961 within the 1961 Budget for the Street Department, be passed as read: carried, Barber, Keith, Lemon, Larson and Maxwell voting aye on roll call. Bostic and Robinson absent. RESOLUTION NO. D -3030 A RESOLUTION authorizing the City Manager to purchase property known as 610 South 3rd Avenue, Yakima,' Washington and transferring the sum of•$11,000.00 within the 1961 appropriation for 31 - Street Department. WHEREAS, there is a"durplus of funds in Account 7 -34, Materials - Heavy, of the Maintenance 8c Operation classification of the 1961 -appropriation for 31 - Street Depart- ment, and WHEREAS, certain real property known as 610 South Third Avenue is sur- rounded on three sides by property owned by the.City.and' under the control -of the Street Department and used for the City Warehouse installations, and WHEREAS, said property is necessary for the full utilization of said City Warehouse property, and WHEREAS, said property known as 610 South Third Avenue has become avail= able to the City for-the purchase price of'$11,000.00,• and the City Council finds that the sum of $11,000.00 is the reasonable•value of said property; that it could not have been anticipated at the time of the adoption of.the 1961 Budget that said property would become available and ,could be purchased; that it is in the best interests of the people of the,City of Yakima,to, make the transfer herein provided and ;'to"purchase said property:; and that the:action contemplated herein is authorized by R.C.W.,35.33.120, now therefore, THE CITY COUNCIL OF THE CITY ,OF YAKIMA. *. BE IT RESOLVED BY Section 3': That the City Manager is hereby.authorized and directed to urchase that certain -- parcel of real property known as 610 South Third Avenue for `the sum of 111000.00. Section 2. That-the-sum of $11,000.00, is hereby transferred from Account 7 -34, Materials - Heavy, of,the Maintenance 6 Operation classification,' to Account 6 -09, Land Acquisition, of the Capital''or Betterment classification, both within the 1961 appropriation for 31 - Street Department. _ Section 3.. City of Yakima Municipal Code and increasing the number of days that garbage may be.dumped at- the Sanitary Land Fill and increasing the dumping charge; be passed'as read: carried, Barber; Keith, Larson, Lemon and Maxwell'voting'aye on roll call. Bostic and Ro binson absent: ORDINANCE N0, 277, AN ORDINANCE amending Sriib- Section (h) of-Section 40:16.180 of the City of Yakima Municipal Code.by increasing the number-of days that garbage may be dumped,at the Sanitary Land Fill and increasing the dumping charge', _ and declaring an' eme rgency. Councilman Barber, Lemon and Maxwell discussed the importance of putting the streets in -good repair when curb cuts are made or utility lines installed. . -t Manager Smith reported that Mr. W. C. Britt has accepted his appointment.to the Board of _Adjustment in accordance with the action taken by the City Council at,the.ir regular meeting off, August 9, 1961. He also reported that it would be approximately 2 we before information would be available on the garbage haul under the new regulations and rates as provided for in Ordinance No. 259 and that.wo rk.on,the streets in the vicinity'of the Fairgrounds would begin next week.' r There being no further business to come .before the .Council, it was MOVED by Barber;, seconded by Lemon that we do now adjourn at the hour of 4:20 P.M.: carried,..Barber, Keith, Larson, Lemon and Maxwell vo ting' aye on roll call.
