HomeMy WebLinkAbout07/12/1961 Business Meeting1 Y, 1 � I 185 JuT.V X6.1 The City Council met in regular session, Mayor Bostic, Councilmen Barber, Keith, Larson, Lemon, II Maxwell and Robinson, City Manager Smith and City Attorney Arntson present on roll call. Invocation was given by Councilman Barber. City Manager Smith introduced the Animal Control Officer, Kenneth Wilson and the metermen, James Coffey and William Hettich to the members of the Council before any business was conducted. Minutes of the meeting July 5, 1961 approved as corrected. In accordance with action taken by the City Council at their regular meeting of July 5, 1961, an ordinance amending the electrical code was read by Councilman Robinson. There being no persons present wishing to be heard on this matter, it was moved by Keith, seconded by Lemon that Ordinanc, No. 262 establishing amendments to the electrical code, be passed as read: carried, Barber,Bostic Keith, Larso mAgxwell and Robinson voting aye on roll call. ORDINANCE NO. 262, AN ORDINANCE providing for the safeguarding of life and property by regulating the installation, alteration, repair, use and operation of electric wires, appliances, apparatus and devices in or about building on private or public property; providing for the licensing for regulation and revenue'of electrical contractors, dealers and wiremenp defining approved elect- rical materials and appliances; prohibiting the sale or use of unapproved materials and appliances providing penalties for the violation hereof; amending Sections 11.16.030;11.16.040;11.16..050; 11.16.110; 11.16. 130;11.16 .160;11.16.170;11.16.200;11.16. 220;11.16 .240;11.16.250;11.16.260;11.16. 2$0;11.16.290; and 11.16.300; and repealing Section 11.16.230, all of the City of Yakima Municipal Code. This being the time fixed by the Council for the hearing on Resolution No. D -279, being a resolu- tion of intention for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features, there were about twenty persons present to be heard on the matter. Among those protest - ing and asking questions of clarification on the project and all questions being satisfactorily answered by the City Manager and the engineering staff were - Mr. Albert Tessier, 301 North 13th Avenue, protesting the improvement of alley, block six of Loma Vista Addition and asking the Council to consider list of protests naming eleven taxpayers. Mrs. Bellum opposed paving on S.E. corner of Walnut and Frances Avenue. Dr. E. R. Stephenson and Dick Maddux questioned the cost of Frances Avenue. Dr. Stephenson protested the cost of the improvement and indicated that the im- provement could be put in under city standards for less by Mr. Maddux. Mayor Bostic was interest - ed in hearing from Mr. Maddux in what areas he felt he could do the job to same standards on such a small scale. Delete Item 3 of Section 2 being the Alley in Blk 6 Loma Vista and Block 2, Highland. All persons having been heard for and a A93 inst said project, moved by Barber, seconded by Larson that ordinance No. 263 creating L.I.D. be passed as corrected: carried, Bostic, Keith, Larson RR9well and Robinson voting aye on roll call. Councilman Barber excused at 4:20 P.M. ORDINANCE No. 263, AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features; establishing a Local Imp ro vemen t District, providing for the method of payment thereof, and creating a special fund. This being the time fixed by the Council for the hearing on Resolution No. D -281 to improve the South half of Douglas Drive and North Naches Avenue, protests were registered by Guy and Elva Vanwye and Mr. Sullen. The percentage of protests registered being 8.7% and all persons being heard for and against said project, it was moved by Keith, seconded by Robinson that Ordinance No. 264 creating L.I.D. #894 be passed as read: carried, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. Barber absent. ORDINANCE NO. 264, AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features: establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. A petition, being petition No. 96, having been filed with the City Clerk on June 26th, 1961, by William Filter requesting the rezone of property at 205 and 207 South 6th Street from A-3 resid- ential to B -2 Local business zone, it was moved by Robinson, seconded by Lemon that said petition be referred to the City Manager and the Planning Commission for study and recommendation: carrie Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. Barber absent. Petition No. 97 having been filed with the City Clerk by C. E. Paulson of IceR6na Company of Sela to allow ice skating rinks in B -2 as well as in B -3 Zone, it was moved by Larson, seconded by Lemon that said petition be referred to the City Manager and the Planning Commission for study an recommendation: carried, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. An ordinance relating to parking in the City of Yakima and the issuance of citations for violat- ions thereof, was read in its entirety by Councilman Robinson and it was moved by Lemon, seconded by Larson that said Ordinance No. 265, be passed as read: carried, Bostic, Keith,. Larson, Lemon, Maxwell and Robinson voting aye.on roll call. Barber absent. ORDINANCE NO. 265, AN ORDINANCE relating to parking in the City of Yakima and the issuance of citations for violations thereof, providing bail therefor, and amending Sub - Section (a) of Secti 9.36.280; Section 9.16.070; Section 9.36.070; and Section 9.36.120; and repealing Section 9.36.130, all of the City of Yakima Municipal.Code. I I 186 JULY 12, 1961 An ordinance appropriating the sum of $1,000.00 within the 1961 appropriation for 11 - City Manage having been read in its entirety by Councilman Robinson, was ordered laid on the table for one week, to be read and considered at the next regular meeting of the City Council on July 19, 1961. Moved by Maxwell, seconded by Robinson that Resolution No. D -2$9, being a resolution of intention to improve certain streets from Tieton Drive to Nob Hill Blvd. and fixing the date of hearing at the hour of 3:00 P:M. Wednesday, the 2nd of August, 1961, be passed as read: carried, Bostic, Keith, Larson, Lemon, Maxwell and Robinson,voting aye on roll call. Barber absent. RESOLUTION NO. D -2899 A RESOLUTION of intention to create a local improvement district BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That it is its intention to improve the follovd.ng streets by grading, ballasting, surfacing with asphaltic concrete and constructing concrete curbs and gutters, to- gether with necessary drainage features: 1. South 44th Avenue from Tieton Drive to Nob Hill Blvd. 2. South Half of Arlington Street from 655 feet East of South 44th Avenue to 615 feet West of South 44th Ave. All persons who may desire to be heard with reference to said proposed improvements are hereby notified to appear at a meeting of the City Council to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 3:00 o'clock P. M. on Wednesday, the 2nd day of August, 1961, which time and place are hereby fixed for the hearing of all matters relating to said improvements, and for determining the method of payment for said improvements; and the,City Clerk is hereby directed to give due notice of said _ hearing and of the intention to make the aforesaid improvements. All costs and expenses in connection with the construction of said improvements, including the engineering, inspection, advertising, publication of notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor as provided by the laws and as above described. The assessments shall be made according to special benefits derived from the improvement without regard to the zone and termini method. The City Engineer is hereby directed to submit to the City Council at or prior to the date fixed herein for said hearing, all of the date and other information required by law to be by him submitted; all of said improvements to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. Barber absent. RESOLUTION NO. 290, A RESOLUTION transferring the sum of $298.00 within the 1961 appropri- ation for 22 - Fire Department. WHEREAS, surpluses exist in Accounts 7 -37, Expendable Tools; 7 -64, Insurance, Medical & Physical Exams; and 7 -67, Insurance, Fire, Theft, Liability, all within the Maintenance & Operation classification of the 1961 appropriation for 22 - Fire Department, and WHEREAS, it is deemed in the best interests of the people of the City of Yakima to send the Assistant Chief of the Fire Department to the combined meeting of Pacific Coast - Intermountain Association of Fire Chiefs and International Association of Fire Chiefs to be held in Los Vegas, Nevada, on September 25 through 28, 1961, said international meeting being held only in the Pacific Coast area every five or six years, and WHEREAS, it is necessary to purchase equipment cabinet to house alarm equipment, and WHEREAS, because of the resignation of a firefighter after the time that he had indicated he would resign, a greater reduction was heretofore made in Account 7 -05, Other Per Annum, of the Salaries classification of the 1961 appropriation for 22 - Fire Department, than would allow the payment of salary requirements for the balance of the year, and WHEREAS, at the time of the adoption of the 1961 Budget, it could not have been reasonably been foreseen that the above expenditures would be required, and WHEREAS, the City Council finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfers, and that the action contemplated herein is authorized by R.C.W. 35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the following sums are hereby transferred within the 1961 appropriation for 22 - Fire Department, to -wit. Barber absent. RESOLUTION NO. D -291, A RESOLUTION approving the assignment of the contract for the improvement of the Yakima Municipal Airport apron extension from Valley Cement Company to Superior Asphalt and Concrete,Company. WHEREAS, on June 5, 1961 the City of Yakima entered into a contract with Valley Cement Company for the construction of an apron extension at the Yakima Municipal Airport, and WHEREAS, at the time of entering said contract, said Valley Cement Company filed a contract bond with the City of Yakima guaranteeing the faithful performance of said contract, and WHEREAS, on July 5, 1961 said Valley.Cement Company requested permission from the City of Yakima to assign said contract to Superior Asphalt and Concrete Company, and WHEREAS, on July 11, 1961 the Federal Aviation Agency, through its District Airport Engineer, confirmed in writing that it had no objection to the said assignment of said contract, and WHEREAS, the City Council does not object to such assignment of said contract under the conditions hereinafter set forth, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the City Council hereby approves the assignment of the contract for the apron extension at-the Yakima Municipal Airport (Federal Aviation Agency Project No. 9 -45- 023 -6107) from Valley Cement Company to Superior Asphalt and Concrete Company. Section 2. This approval of assignment shall in no way relieve the Valley Cement Company of its primary obligation and liability under the terms of the contract and is conditioned upon the written consent to such assignment by the United Pacific Insurance Company, the surety of Valley Cement Company, and the further filing with the City Clerk of a contractor's performance bond by Superior As halt and Concrete Company with an acceptable casualty company as surety in the principal sum of 934,060.00, binding themselves to the City of Yakima for the performance of said contract. WHEREAS, a surplus exists in Account 7 -15, Benefits, of the Maintenance & Operation classification of the 1961 appropriation for 61 - Firemen's Relief & Pension Fund, and WHEREAS, at the time of the adoption of the 1961 Budget it could not have reasonably been anticipated that one of the firefighters under 22 - Fire Department would resign :..' and request a refund of the moneys paid by him into'the Firemen's Relief and Pension Fund,..and WHEREAS, there is insufficient money in said Firemen's Relief & Pension Fund to refund the money to said resigning firefighter, and WHEREAS, the City Council finds it is in the best interests of the people of the City of Yakima to make the aforesaid transfers, and that the action contemplated herein is authorized by R.C.W. 35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: io r JULY 12, 1961 Section 1. BOSTIC Mayor Annexation Petition No. 92, praying for the,annexation of property bounded by West'Chestnut Street, South 45th Avenue, South 46th Avenue and West Walnut Street having been referred to the Planning Commission for recommendation and the Planning Commission recommending annexation of said property and further recommending that it be classified as R -1, single family residence, it was Moved by Larson, seconded by Maxwell that the City Manager and the City Attorney follow out the normal procedure to annex said property: carried, Bostic, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Recommendation of the Planning Commission requesting the reclassification of property at 103 South 7th Avenue having been read by the Clerk of the Council, it was moved by Robinson, seconded by Keith that the City Attorney be and is hereby instructed to prepare an ordinance accepting the recommendation of the Planning Commission to rezone said property from R -3 to B -3: carried,Bostic, Keith, Larson, Lemon, Maxwell "and Robinson voting aye by voice vote.
