HomeMy WebLinkAbout07/05/1961 Business Meeting1 1 1 181 JULY 52 1961 The City Council met in regular session, Mayor Bostic, Councilmen Barber, Keith, Larson, Lemon and Robinson, City Manager Smith and City Attorney Arntson present on roll call. Councilman Maxwell absent and excused. Invocation was given by Councilman Lemon. The minutes of the regular meeting of June 28th, 1961 were approved as read. Manager Smith introduced the Purchasing Agent, Kermit Smith, to members of the Council before any business was conducted. Manager Smith also mentioned that he will have the metermen and the Animal Control Officer presented to the Council at a later date. In accordance with action taken by the City Council at their regular meeting of June 28, 1961, regarding an ordinance amending Ordinance No. B -850 (Electrical Code of the City of Yakima) the Council discussed briefly a memorandum to the council on the proposed changes in the Electrical Code and it being mentioned that a meeting will be held Monday evening with the electrical contractors and that a recommendation on the proposed fees will be discussed at that time, it was moved by Robinson, seconded by Barber that the matter be continued to the next regular meeting of the City Council on the 12th day of July 1961: carried, Barber, Bostic, Keith, Larson, Lemon and Robinson voting aye by voice vote. Maxwell absent. This being the time fixed by the City Council for the hearing on the codification of the charter and all ordinances of the City of Yakima,.Councilman Keith inquired as to the necessity of the emergency clause on the ordinance. Manager Smith explained that there has been such a long delay already and that we have been waiting for the adoption so that we could make some necessary amend- ments to our ordinances which would be easier to do with the code being officially adopted. It was noted by the Council that ample time has been given to the public of the adoption of the Code. and there has been no objection to the emergency clause. —City Attorney Arntson explained that he _.Health.. ORDINANCE NO. 261, AN ORDINANCE adopting the codification of the charter and the ordinances of the City of Yakima of a general, public or permanent nature, or imposing a fine, penalty or for- feiture, as the official Code of said City, as provided for and pursuant to Chapter 97, Laws of 1957, and declaring an emergency. Petition No. 94, being a petition praying for the annexation of certain property Nbrth of Engle- wood Avenue, having been filed by Cragg D. Gilbert with the City Clerk on the 29th day of June, 1961, it was moved by Larson, seconded by Lemon that said petition be referred to the City Manager and Planning Commission for study and recommendation: carried, Barber, Bostic, Keith, Larson, Lemon and Robinson voting aye by voice vote. Maxwell absent. Petition No. 95, being a petition requesting the formation of a local improvement district for curb, gutter and surfacing for South 44th Avenue and Arlington Street having been filed by School District No. 7 with the City Clerk on the 3rd day of July, 1961 and Manager Smith mentioning that the cost of said L.I.D. would be borne entirely by the School District, it was Moved by Lemon, seconded by Keith that said petition be referred to the City Manager for study and recommendation: carried, Barber, Bostic, Keith, Larson, Lemon and Robinson voting aye by voice vote. Moved by Barber, seconded by Larson that Resolution No. D -282 authorizing the transfer of $200.00 in the 1961 budget for the City Civil Service Department, be passed as read: carried, Barber, Bostic, Keith, Larson, Lemon and Robinson voting aye on roll call. Maxwell absent. RESOLUTION NO. D -2829 A RESOLUTION transferring the sum of $200.00 within the 1961 appropriation for 05 - City Civil Service Department. WHEREAS, a surplus exists in Account 7 -31, Publication & Printing, of the Maintenance & Operation classification of the 1961 appropriation for 05 - City Civil Service Dep- artment, and WHEREAS, at the time of the adoption of the 1961 Budget it could not have reasonably been anticipated that additional moneys would be required in Account 7 -21, Professional & Legal, and in Account 7 -30, Clerical & Office, both within the Maintenance & Operation Classif- ication of the 1961 appropriation for 05 - City Civil Service Department, to allow the hiring of a' Court.Reporter to record testimony in'Civil Service appeal hearings and to further provide for additional office supplies and postage expense, and WHEREAS, the City Council finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfers, and that the action contemplated herein is authorized by R.C.W. 35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the following sums are hereby transferred within the 1961 appropriation for 05 - City Civil Service Department, to -wit, From: 7 -31 Publication & Printing To: 7 -21 Professional & Legal 7 -30 Clerical & Office $100.00 100.00 all within the Maintenance & Operation classification of said department. $200.00 $200.00 Section 2. Maxwell absent. RESOLUTION NO. D -2839 A RESOLUTION transferring the sum of $1700.00 within the 1961 appropriation for 32 - Municipal Garbage Service. WHEREAS, surpluses exist in Accounts 7 -06, Hourly Labor, of the Salaries classification, and 7 -46, Equipment - Parts & Repair, etc., of the Maintenance & Operation class- ification, both within the 1961 appropriation for 32 - Municipal Garbage Service, and WHEREAS, at the time of the adoption of the 1961 Budget it could not have been reasonably anticipated that additional moneys would be required in Account 7 -30, Clerical,of the 1961 appropriation for 32 - Municipal Garbage Service to finance the printing and mailing of new informational type cards to all households served by the Municipal Garbage Service, and WHEREAS, the City Council finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfers, and that the action contemplated herein is authorized by R.C.W. 35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the following sums are hereby transferred within the 1961 appropriation for 32 - Municipal Garbage Service, to -wit: From: SALARIES 7 -06 Hourly Labor $600.00 MAINTENANCE & OPERATION 7 -46 Equipment - Parts & Repair, etc. 1,100.00 $ 1,700.00 To: MAINTENANCE & OPERATION 7 -30 Clerical 1,700.00 Section 2. Maxwell absent. RESOLUTION NO. D -2849 A RESOLUTION repealing Resolution No. D -266. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That Resolution No. D -266, adopted by the City Council of May 17, 1961, authorizing the City Manager and the City Clerk to execute an agreement with the Washington State Highway Commission, is hereby repealed. Lemon and Robinson voting aye on roll call. Maxwell absent. RESOLUTION D -2$5, RESOLUTION and Request for the Director of Highways to perform Certain Work. BEFORE THE CITY COUNCIL OF YAKIMA, WASHINGTON It is hereby resolved by the City Council of Yakima that the Director lof Highways is requested and permitted to perform certain work, towit: Grading, draining, surfacing, paving, constructing curb and gutter and sidewalks from Washington State Highway Station 4"71.4 to Station 18+07.4 (Vicinity of Naches Ave. to Vicinity of Ninth Street) all in accordance with the attached plans marked Exhibit B and in the estimated amounts shown on the attached estimate marked Exhibit A. to the amount of $ 35,864.72 Upon presentation of a certified statement of the actual cost of all labor, equipment, material, supplies, supervision and engineering incurred by the Department of Highways under this resolution, a copy of which shall be furnished the City of Yakima, authorization is hereby given to effect reimbursement to the Department of Highways for such work from the Arterial Street Fund, but not to exceed the amount of this resolution. 1 1 1 1 1 1 1 C JULY 5, 1961 Adopted by the City Council of Yakima, Washington this 5th day of July, 1961. RESOLUTION D -2$6, A RESOLUTION by the Council of the City of Yakima, Washington WHEREAS, in the improvement of Primary State Highway No. 3, East Yakima Ave. to Union Gap, by the State of Washington, Department of Highways, it is necessary and advisable for the State of Washington to acquire title to portions of road and street rights of way which lie within the limits of said highway; and WHEREAS, after due consideration by the'City Council of the City of Yakima, Yakima County, Washington, it appears to said council that it will be for the best interests of both the City of Yakima and the State of Washington that the City of Yakima convey said lands to the State of Washington by Quit Claim Deed for a consideration of mutual benefits; NOW, THEREFORE, be it hereby resolved by the Council of the City of Yakima tha the City of Yakima, in accordance with R.C.W. 47.52.090 and through fibs Mayor and City Manager, execute said deed and deliver said deed to the State of Washington, Department of Highways. Maxwell absent. RESOLUTION NO. D -2$71 A RESOLUTION establishing the selling price of the City of Yakima Municip Code and Annual Supplements. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1). That the selling price of the City of Yakima Municipal Code is hereby established at $25.00 per Code. Section 2. That the selling price of each Annual Supplement of the City of Yakima Municipal Code is hereby established at $10.00 per year. Section 3. That all moneys received from the sale of said Codes and Supplements shall be placed in the Current Expense Fund of the City of Yakima. ADOPTED BY THE CITY COUNCIL this,5th day of July, 1961. Maxwell absent. RESOLUTION NO. D -2$$, A RESOLUTION authorizing settlement of claim of Olson Electric Company. WHEREAS, on November 16, 1956, the City of Yakima awarded a contract for high intensity lighting,at Yakima Municipal Airport to Olson Electric Company, a copartnership, and WHEREAS, at the conclusion of the work performed under said contract, the City withheld certain moneys from the final settlement, and WHEREAS, the said Olson Electric Company has brought suit against the City in the sum of $4,727.24,.together with interest, alleged by them to be due upon said contract, and WHEREAS, said suit has been tentatively settled for the sum of $2,050.00, and the City Council finds that it is in the best interests of the people of the City of Yakima to make such a settlement and that said sum of $p2,050.00 is a reasonable sum upon which to settle said claim and suit, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and the City Attorney are hereby authorized to settl the hereinbefore- mentioned claim and suit of Olson Electric Company in the sum of $2,050.00, and the Director of-Finance is hereby authorized and directed to pay said sum of $2,050.00 to said Olson Electric Company from the Airport Improvement Fund upon the execution by said Olson Electri Company of a Release absolving the City of Yakima from any further liability as a result of said contract. Councilman Maxwell absent. lCouncilman Keith commended City Manager Smith on his work and presentation of the budget manual. Mayor Bostic mentioned the appearance of planter boxes in the downtown area and suggested ti-at the Council take official action to recognize same and to encourage others to join the program. A motion of recommendation commending and recognizing the program and encouraging other merchants to install and maintain the planters was offered by Larson, seconded by Barber: carried, Barber, Bostic, Keith, Larson, Lemon and Robinson voting aye by voice vote. Maxwell absent. City Manager Smith submitted a compilation of state shared revenue to the Council showing various funds and moneys coming therefrom. Manager Smith submitted a memorandum to the Council explaining further changes to the electrical code. Manager Smith reported on the muisance of the old depot building and explained that the owner is working on removal of the building. Work is expected to be completed within the next ten days. (There being no further business to come before the Council, it was moved by Barber, seconded by Robinson that we do now adjourn at the hour of 4:10 p.m., carried: Barber, Bostic, Keith, Larson, (Lemon and Robinson voting aye by voice vote.
