All members of the City Council being absent and the majority of said members attending the con-
vention of the Association of Washington Cities in Seattle, Washington, the regular meeting to
be held on this date was cancelled.
JUNE 14, 1961
The City Council met in regular session, Assistant Mayor Larson presiding. Councilmen Barber,
Keith, Lemon, and Robinson, City Manager Smith and City Attorney Arntson present on roll call.
Mayor Bostic absent and excused. Councilman Maxwell absent and excused by action of the Council
on this date. `
The invocation was given by Councilman Keith.
The minutes of the regular meeting of May 31, 1961 were approved as read.
Moved by Robinson, seconded by Lemon that - Councilman Maxwell be and is hereby excused from this
meeting of June 14, 1961 and the two following regular meeting of the City Council on June 21,
1961 and June 28, 1961: carried, Barber, Keith, Larson, Lemon and Robinson voting aye by voice
vote. Bostic and Maxwell absent.
In accordance with action taken by the City Council at their regular meeting on May 31, 1961, the
hearing on the assessment roll for L.I.D. No. 891, being the Lincoln and North 29th Avenue Sewer
District was continued. Mr. Garret Anderson, property owner in said district, having requested tl
the deletion of certain orchard property at the time of the formation of this district, namely
September 21, 1960, and having been informed at that time that the proper time to make such an
adjustment would be when the City Council sits as a Board of Equalization for the purpose of con-
sidering the spreading of assessments, again reviewed the circumstance in connection with his
request,maintaining that he had been promised that his property would be deleted from the district
in exchange for certain easement property for street purposes. Councilman Barber contended that
if a promise has been made it should be kept. Councilman Robinson explained that the right -of-
way for Lincoln Avenue, while in question when the request to delete was first made, had been
satisfied and it was found that a 40 foot strip had been deeded to Yakima County for Lincoln Ave.;
before Mr. Anderson owned his property, and that while some time in the future, an additional
10 foot easement may be needed to widen Lincoln Avenue, it is not needed at this time and this
orchard tract is located in the district and is the same as any vacant lot that may be in this
or any other local improvement district, even though the service is not desired at this time.
Manager Smith explained further that the 10 foot easement to widen Lincoln Avenue is not needed
at this time and is not in the plans for arterial improvement for the next 6 years. City Engineer
Mayo explained that a local improvement district must stand on it's own feet and pay it's own
costs and that street right -of -ways are included in the City's Budget and paid from funds
appropriated for this purpose. _ All persons having been heard, and there being no other protests
in writing or otherwise, it was MOVED by Robinson, seconded by Keith that Ordinance No. 251 con-
firming the assessment roll and every part thereof for L.I.D. No. $91, be passed as read:
carried, Keith,,,Larson, Lemon and Robinson voting aye on roll call. Barber voting nay. Bostic
and Maxwell absent.
ORDINANCE NO. 251, AN ORDINANCE confirming the assessment roll covering Local Improvement
District No. 891 as created and established by Ordinance No. 161 -a of the Ordinances of the City
of Yakima. -
This being the time fixed by the City Council for the hearing on Petition No. 79, as filed by
G. A. Drake, praying for the annexation of certain property between Chestnut and Walnut and 44th
and 45th Avenue and the Planning Commission recommending that said property be annexed and be
zoned as R -1 Single Family Dwellings, and there being no protests in writing or otherwise, it was
MOVED by Barber, seconded by Lemon that Ordinance Igo. 252 providing for said annexation and zoning
be passed as read: carried, Barber, Keith, Larson, Lemon and Robinson voting aye on roll call.
Bostic and Maxwell absent.
ORDINANCE NO. 2521 AN ORDINANCE providing for the annexation by the City of Yakima, Washington
of certain property contiguous to the City of Yakima, and zoning the same as R -1, Single Family
Residence Zone, and declaring an emergency.
This being the time fixed by the City Council for the hearing on Petition No. 83 as filed by
Donald Evans, praying for the annexation of certain,property south of Mead Avenue between 12th
Avenue and Pleasant, and the Planning Commission recommending that said property be annexed and
zoned as R -1 single family dwellings, and there being no protests filed in writing or otherwise,
it was MOVED by Barber, seconded by Lemon that Ordinance No. 253 providing for said annexation
and zoning, be passed as read: carried, Barber, Keith, Larson, Lemon and Robinson voting aye on
roll call. Bostic and Maxwell absent.
ORDINANCE NO. 253, providing for the annexation by the City of Yakima, Washington, of certain
property contiguous to the.City of Yakima, and zoning the same as R -1, Single Family Residence
Zone, and declaring an emergency.
This being the time fixed by the City Council for the hearing on Resolution No. D -267, being a
resolution of intention to improve certain streets by the construction of concrete curbs and
gutters and the surfacing of certain streets and the construction of sidewalks on certain streets
The following written protests were filed with the City Clerk: Mr. F. J. Tobin; Mr. Eugene Naff
and others protesting the improvement of 34th Avenue from Lincoln to Jefferson; Mr. Byron C.
Weber at 3309 Jefferson Avenue protesting cost to him and suggesting that Lincoln Avenue between
16th and 24th Avenues needs first consideration; Mr. P. M. Strickland and others protesting the
improvement of Lincoln Avenue from 32nd to 45th Avenue and Mr. Virgil L. Ruark and wife protestinf
the construction of sidewalks. Persons present were heard both for and against said matter and
instructed to file their protests in writing. Manager Smith.explained that the sidewalk will be
built on the North side of Lincoln Avenue and that this is the first local improvement district
to participate in the new gas tax money from the State and that 75% of the arterial improvement
cost will come from the State Gas Tax Money and only 1/4 will be paid by the district. Councilmal
Robinson asked persons present to consider this improvement carefully because of the State
matching funds available to the City for the improvement of arterials. All persons having been
heard, it was MOVED by Keith, seconded by Barber that the hearing on Resolution No. D -267, be
continued for one week or until the regular meeting of the City Council on June 21, 1961, in
order that the percentage of protests can be figured: carried, Barber, Keith, Larson, Lemon and
Robinson voting aye by voice vote. Bostic and Maxwell absent.
A petition, being Petition No. 90, requesting the vacation of a portion of 39th Avenue, having
been filed June 8, 1961 with the City Clerk, by William Pflueger and others, it was MOVED `bY

the purpose of constructing curbs, gutters, and the surfacing of Mavis Avenue East from 40th
Avenue to the Yakima Valley Canal Company right -of -way, having been filed June 9, 1961 with the
City Clerk by P.: H. Hamilton and others, it was MOVED by Lemon, seconded by Keith that said
petition be referred to the City Manager for study and recommendation: carried, Barber, Keith,
Larson, Lemon and Robinson voting aye by voice vote. Bostic and Maxwell absent.
In order to comply with the provisions of Chapter 7, Laws of 1961 providing for a 1/2 cent
additional fuel tax to cities and towns upon the matching by said cities or towns of at least
25% of the costs of approved,projects conducted exclusively for construction, improvement and
repair of arterial streets, it was MOVED by Robinson, seconded by Lemon that Ordinance No. 254
creating the Arterial Street Fund for said state funds and city matching funds, be passed as
read: carried, Barber, Keith,'Larson, Lemon and Robinson voting aye on roll call. Bostic and
Maxwell absent.
ORDINANCE NO. 254, AN ORDINANCE creating the Arterial Street Fund of the City of Yakima, .
Moved by Barber, seconded by Keith that Ordinance No. 255 placing certain property located at
1514 Lincoln Avenue on the Irrigation Maintenance Roll of Local Improvement District No. 382, be
passed as read. There being an error in the description-of said property in the ordinance as
read by the Clerk of the Council, it was MOVED by Robinson, seconded by Keith that the last line
of the description of said property on page 1 and page 2, be corrected to read "thence North
89.45' West 50 feet to the point of beginning." carried, Barber, Keith, Larson, Lemon and Robins
voting.aye by voice vote. Bostic and-Maxwell absent. Assistant Mayor Larson then called for the
vote on the orginal motion as amended: carried, Barber, Keith, Larson, Lemon and Robinson voting
aye on roll call. Bostic and Maxwell-absent.

RESOLUTION NO. D -275, A RESOLUTION authorizing the performance of certain oiling and seal coati
on Englewood Avenue by Yakima County.
WHEREAS, Yakima County has called for bids and is opening the same on June
15, 1961 for the oiling and seal coating of certain roads in Yakima County, including that portio:
of Englewood Avenue lying between Prospect and North 32nd Avenue, and
WHEREAS, a 600 -foot portion of Englewood Avenue included within said--pro-
ject lies entirely within the City of Yakima and 4,800 feet lies half in and half out of the
City of Yakima, and
WHEREAS, the City Council finds that it is advantageous to the City of
Yakima to have said work performed under a contract to be let by Yakima County and that the
approximate cost which the City of Yakima would be required to bear for such purposes would be
the sum of $1,000.00, now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:

That the City Manager of the City of Yakima is hereby authorized and
directed to negotiate with Yakima County for the participation by the City of Yakima in the
oiling and seal.coating of the above - mentioned portions of Englewood Avenue and to direct the
payment by the City of Yakima to Yakima County the proportionate cost for performing such work,
said sum and proportionate cost not to exceed the sum of $1,000.00

property on South 6th Avenue from R -3, Multiple Family Residence to B -3, General Business and
said petition having been referred to the Planning Commission for recommendation and the Planning
Commission recommending said rezone, it was MOVED by Lemon, seconded by Robinson that the City
Attorney be and is hereby directed to prepare the necessary ordinance for rezoning said property:

Manager Smith reported on the progress of the 1961 street repair program, the new telephone systen
being installed in the City Hall and city participation in the construction of sidewalks. No
formal action was taken on these matters.
There being no further business to come before the Council, it was MOVED by Keith, seconded by
Lemon that we do now adjourn at the hour of 5:40 P.M. carried, Barber, Keith, Larson, Lemon and
Robinson voting aye by voice vote. Bostic and Maxwell absent.
