Moved by Maxwell, seconded by Barber that Councilman Robinson serve as Acting Mayor in the absence of the Mayor and Assistant Mayor: carried, Barber, Keith, Lemon,.and..MAkwell voting aye by voice vote. Robinson not voting. Bostic and Larson absent. The City Council then met in regular session, Acting Mayor Robinson, presiding, Councilman Barber Keith, Lemon and Maxwell, City Manager Smith and-City Attorney Arntson present on roll call. 1layor Bostic and Councilman Larson absent and excused. The invocation was given by Councilman Keith. The minutes of the regular meeting of May 3, 1961 were approved as corrected. In accordance with action taken by the City Council at a regular meeting on May 3, 1961, the hearing on Petition No. 76 as filed by Mr. N. S. Norris, requesting the rezone of property located on the NE corner of Nob Hill Boulevard and South 38th Avenue was continued. Mr. Norris, petitioner, being present, was heard for said rezone and Mr. Kreher, property owner near the area to be rezoned, being present was heard against said rezone. Mr. Kreher also filed with the Clerk of the Councilmaa written protest signed by Esther M. and D. E. Berg. All person having been heard both for and against.this matter and having explained that while sympathetic with Mr. Norris and his ideas to.develop this property, they must concur with the Planning.Commission in the interest of good planning, it was MOVED by Maxwell, seconded by Barber that the City -Plat Attorney be and is hereby instructed to prepare a resolution concurring with the decision of 'the/ and denying the rezone of said property: carried, Barber, Keith, Lemon, Maxwell and Robinson voting aye on roll call. Bostic.and Larson absent. This being the time fixed by the City Council for the hearing on Petition No. 77 as filed by the Yakima School District No. 7, requesting the vacation of the alley adjacent to the Adams - School Property, and there being no protests in writing or otherwise, it was MOVE-by Lemon, seconded by Maxwell that Ordinance No. 247 providing for the vacation of said alley, more proper- ly described as-adjacent to Lots 6 through 25 Block 2, Bungalow Addition, be passed as read: carried, Barber, Keith, Lemon, Maxwell and Robinson voting aye on roll call. Bostic and Larson absent. ORDINANCE NO. 247, AN ORDINANCE providing for the vacation of that portion of the alley adjacent to Lots 6 through 25, Block 2, Bungalow Addition, located in the City of Yakima, Yakima County, Washington. This being the time fixed by the City Council for the hearing on Petition No. 81 as filed by Earl Moirier and others, requesting the the vacation of the .north- south-�.alley'- directly behind the Montgomery Ward Store, more properly described as the alley in Block 90, Town of North Yakima, persons present were ;h both for and against said petition. Mr. Fred Velikanje, attorney for Mr. Moirier, explained� r i client owns the property on both sides of the alley to be vacated and that he needs the use of said alley in order th -at -he ca -n restrict the use of it in connection with the operation of his parking lots. Mr. Gene Cook, l.essCe-e and operator of the parking lots, explained that he has a one -man operation and customers park their cars and drive,out this alley without paying. Mr. Nels Hattuck, a member of the board for the First Metho'.dist:- Church,- -.L , explained they have no objections to the vacation as long as, they are'not involved in the costs of moving.existing utilities and as long as there is no building built on it, since their church members have the use of the parking lot after regular business hours and on Sunday. It was,also disclosed that the Police Department has asked that.the sandwich boards, which control the abuse of parking without paying, be removed. All persons having been heard on this matter and the Council believing that this problem can be solved without vacating the alley, it was MOVED by Keith, seconded by Barber that the City Attorney be and is hereby instructed to prepare the necessary legislation denying this vacation: carried, Barber, Keith, Lemon, Maxwell and Robinson voting aye on roll call. Bostic and Larson absent. The Council asked Manager Smith, without formal action, to take this problem under advisement. A petition, being Petition No. 87, having been filed with the City Clerk May 4, 1961, by.Kurt Subklewe and others, requesting the organization of a local improvement district for the purpose of improving certain property on North Naches Avenue from East 11K11 Street to a point 305 feet North, by the construction of curbs and gutters and the surfacing of said street, it was MOVED by Keith, seconded by Barber that said petition be accepted and referred to the City Manager for recommendation: carried, Barber, Keith, Lemon, Maxwell and Robinson voting aye on roll call. Bostic and Larson absent. A resolution authorizing the.execution of a Supplemental Agreement with -the Congdon Orchards, Incl for the lease of certain property located at the Yakima Municipal Airport,,having been read by the Clerk of the Council and Council members wishing to study this matter further, it was MOVED by Barber, seconded by Lemon that action on said resolution be posponed for one week: carried, Barber, Keith, Lemon, Maxwell and Robinson voting aye by voice vote. Bostic and Larson absent. Moved by Barber, seconded by Lemon that Resolution No. D -261 rejecting all bids to supply liquid chlorine to the City of Yakima and authorizing the purchasing agent to purchase said chlorine on the open market, be passed as read: carried, Barber, Keith, Lemon, Maxwell and Robinson voting aye on roll call. Bostic and Larson absent. RESOLUTION N0. D -261, A RESOLUTION rejecting all bids to supply liquid chlorine to the City of Yakima and authorizing the Purchasing Agent to purchase such liquid chlorine on the open market. WHEREAS,,heretofore the City of Yakima, by and throu. -h its Purchasing Agent, advertised, for the receipt of bids for-the supplying to the City of Yakima of liquid chlorine for the 1961 requirements of the City,, and WHEREAS, two companies, to -wit: Pennsalt Corp. and Van Waters & Rogers, submitted bids to the.Purchasing Agent of the City of Yakima to supply said requirements, said bids being identical in every respect, and WHEREAS, the City Council believes and finds that the City can purchase, said liquid chlorine at a price under that bid by said companies, and that such bids should be rejected and the Purchasing Agent authorized to purchase said liquid chlorine on the open market, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: L L ing Comm. 1 1 1 ii 1 1 it u 159 MAY 10, 1961 ithat the bids submitted by Pennsalt Corp. and Van Waters & Rogers to supply the 1961 requirements -of the City of Yakima -for liquid chlorine are hereby rejected, and the'City Manager and the Purchasing Agent are hereby authorized and directed to purchase said liquid chlorine upon the open market for a price less than that submitted by said two bidders. D -2621 A RESOLUTION transferring funds within the Maintenance & Operation classifications of the 1961 appropriations for 04 - Planning Department, 24 - Engineering•Depart- ment and 31 Street Department. WHEREAS, surpluses exist in Accounts 7 -33, Field & Non Office, of the 1961 appropriation for 04 - Planning Department, 7 -41, Automotive, Motor Fuel, Etc., and 7 -83, Train- ing Schools, of the 1961 appropriation for 24 - Engineering Department, and 7 -34, Materials - Heavy, of the 1961 appropriation for 31 - Street Department, all within the respective Maintenanc and Operation classifications thereof, and WHEREAS, additional moneys are needed in Accounts 7 -46, Equipment, Parts & Repair, Etc., of the Maintenance & Operation classification for both 04 - Planning Department and 24 - Engineering Department for the repair of the blueprint machine used jointly by said departments, which repair could not reasonably have been anticipated at the time of the adoption of the 1961 Budget, and WHEREAS, insufficient moneys were appropriated in the 1961 appropriation for 24 - Engineering Department for Account 7 -50, Travel, to cover all of the-travel that is necessary and the City Council finds that additional funds should be provided in said account in order that attendance can be had from the Engineering Department to the Annual Meeting of the American Public Works Association, and WHEREAS, at the time of the adoption of the 1961 Budget it was not anticipa ed that it would be necessary to rent a heater planer to smoth the pavement surface on East Yakim Avenue and no moneys were appropriated for that purpose, and . WHEREAS, the City Council finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfers, and the action contemplated herein is authorized by R.C.W. 35.33.120, now therefore, BE IT RESOLVED BY•THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. Drake and others praying for the annexation of certain property located between Chestnut and Walnut and 44th Avenue and 45th Avenue, having been referred to the Planning Commission for recommendation' ,'the Clerk of the Council read a letter from said Planning Commission directed to the City Council, recommending the annexation of said property and further recommending that it be zoned as R -1 single family residence zoning classification. MOVED by Keith, seconded by Lemon that the Order Fixing the Date of Hearing on said petition for the 7th day of June, 1961, be passed as read: carried,•Barber, Keith, Lemon, Maxwell and Robinson voting aye on roll call. P 160 MAY 10, 1961 Petition No. 83, as filed by Donald V. Evans and others, praying for the annexation of certain property located South of Mead Avenue between Pleasant and 12th Avenue, having been referred to the Planning Commission for recommendation, the Clerk of the Council read a letter directed to the City Council from the Planning Commission which recommended the annexation of said property and further recommended that it be classified as R -1, single family residence. Council members remembering that the convention for the Association of Washington Cities is to be held on June 7 through the 9, 1961,'and` °that as many members as possible will be attending said convention, it was MOVED by Maxwell, seconded by Lemon that the City Council reconsider the matter of a date for the hearing on Petition No. 79. - carried, Barber, Keith, Lemon, Maxwell and - Robinson voting aye by voice vote. Moved by Keith, seconded by Lemon thatthe order fixing the date of hearing on Petition No. 79 be amended to fix said date for the 14th day of June, 1961: carried, Barber, Keith, Lemon, Maxwell and Robinson voting aye by voice vote. Moved by Maxwell, seconded by Lemon that the order fixing the date of hearing on Petition No. 83 be amended to fix said date for the 14th day of June 1961. carried, Barber, Keith, Lemon, Maxwell and Robinson voting aye by voice vote. Bostic and Larson absent. Petition No. 86 having been referred to the Planning Commission for recommendation, said petition having been filed by A. G. Beaman and others requesting the rezone of certain property located between 38th and 40th Avenue and Tieton Drive and Webster Avenue from R -1 single family residence to R -3 Multiple family dwellings, the Clerk of the Council read a letter from the Planning Commission directed to the Council, recommending the rezone of said property. After discussion,it was MOVED by Barber, seconded by Maxwell that the City Attorney be and is hereby instructed to prepare an ordinance accepting the decision of the Planning Commission and rezoning that certain property located between 38th and 40th Avenue and Tieton Drive and Webster Avenue from R -1 single family to R -3 Multiple family residence: carried, Barber, Keith, Lemon, Maxwell and Robinson voting aye by voice vote. The following bids having been received and considered by a bid board, for the Yakima Municipal Airport Apron extension,and Apron Lighting: Schedule I - Apron Extension Valley Cement Company = Yakima $34;060.00 Yakima Asphalt Paving Company - Yakima 35,100.00 Bohannon Asphalt Paving Company - Yakima 39,707.20 Schedule II - Apron Lighting Knobel's Electric - Yakima $10,388.79 Picatti Bros: - Yakima 13,824.20 and the City Manager concurring with the City Engineer's recommendation that the bid of Valley Cement Company for Schedule I - Apron Extension and the bid of Knobel's Electric for Schedule II - Apron Lighting are the lowest and best bids, it was MOVED by Lemon, seconded by Keith that said bids be awarded on-the condition that they are approved by the Federal Aviation Agency and the City Manager be and is hereby authorized to execute the necessary contracts on behalf of the City of Yakima upon the filing of the proper bonds by said contractors and at such time as the approval of the Federal Aviation Agency has been obtained: carried, Barber, Keith, Lemon, Maxwell and Robinson voting aye by ovice vote. Bostic and Larson absent. The City Engineer reporting the completion of L.I.D. No. 891, being the 29th Avenue and Lincoln Avenue Sanitary Sewer District, it was MOVED by Keith, seconded by Maxwell that the City Clerk be and is hereby instructed to give-notice of hearing on the assessment roll for said L.I.D. for the hour of 3 otclock P. M. on the 31st day of May, 1961 by publication and to each property owner as required by statue: carried, Barber, Keith, Lemon, Maxwell and Robinson voting aye by voice vote. Bostic and Larson absent. The City Engineer reporting the following as Monthly Estimate No. 1 for work performed on Schedule II - Fencing P.P. &c L. Co., Wasteway, for payment': it was MOVED by carried, Barber, E1 Dorado Fence Company $32563-52 Barber, seconded by Lemon that said report be accepted and payment made accordingly": Keith, Lemon, Maxwell and Robinson voting aye on roll call.
