HomeMy WebLinkAbout05/03/1961 Business MeetingF, 156 MAY 3, 1961 In the absence of Mayor Bostic and Assistant Mayor Larson Councilman Robinson having been elected temporary Chairman to serve in the absence of Mayor Bostic and Councilman Larson at the regular meeting of April 26, 1961 all in accordance with the rules a fcl.procedure-as adopted by the Council, Councilman Robinson opened the meeting by calling for nominations for acting mayor. Moved by Keith, seconded by Barber that Councilman Robinson be appointed Acting Mayor: carried, Barber, Keith, Lemon and Maxwell voting aye by voice vote. The'City Council met in regular session. Councilman Robinson, Acting Mayor, Barber, Keith, Lemon, Maxwell, City Manager Smith, City Attorney Arntson present on roll call. Councilmen Bostic and Larson absent and excused. Invocation was given by Councilman Lemon. Minutes of the meeting of 'April 26th were approved as corrected. In accordance with action taken by the Council at their regular meeting of April 26, 1961, it was moved by Lemon, seconded by Maxwell that ordinance No. 245 rezoning certain between-West "B" street and West "C" Street and between North 3rd Avenue and North 4th Avenue in the City of Yakima be passed as read: carried, Barber, Keith; Lemon, Maxwell and Robinson voting aye on roll call. Bostic and Larson absent. ORDINANCE NO. 245, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property located between West "B" Street and West "C" Street and between North 3rd Avenue and North 4th Avenue in the City of Yakima, Washington. An ordinance appropriating the sum of $2,263.00 for codification of ordinances, having been read in its entirety at the regular meeting of the City Council on the 26th day of April, 1961,.and having been laid on the table for one week, and having been read by title only at this meeting, it was moved by Maxwell, seconded by Barber that Ordinance No. 246 be passed as read: carried, Barber, Keith, Lemon, Maxwell and Robinson voting aye on roll call. Bostic and Larson absent. ORDINANCE NO. 246, AN ORDINANCE appropriating the sum of $2,263.00 from Current Expense Fund to Account 6 -85, Books, of the Capital or Betterment classification for 15 - Statutory & General, and declaring an emergency. In accordance with action taken by the City Council on 4/19/61 acting on the appeal of N. S. and Anna Norris appealing from the decision of the Planning Commission on rezone of property located at 38th Avenue and Nob Hill and setting a date of hearing for this meeting,,the following persons spoke for the rezone of the property - Ryan Packard, an individual interested in the rezone, Rex Campbell, Builder, also remarked that the rezone of this property would be beneficial to the area. Fred Vertner, real estate agent, remarked that Nob Hill is an arterial and is ideal for business property. Mr. Roper of True's Oil Company spoke favorably of the rezone. The question of right - of -way of 38th Avenue was brought before the Council and Mr. Norris stated that unless the propert could be rezoned it would not be possible for him to expend $4,000.00 for paving of that portion of 38th Avenue. Mr. Norris, being the owner of the property, also stated he had owned the propert for twenty years with the hope that some day he could sell it for a business site and stating that this would be the only service station on the North side of Nob Hill Boulevard from 6th Avenue West, consisting of eight miles. A Mr. Kreher against the rezone and referred the Council to the petition signed by a number of residents in the area. All persons having been heard for and against said rezone, it was moved by Barber and seconded by Lemon that the hearing be contin- ued for one week to May 10, 1961: carried, Barber, Keith, Lemon, Maxwell and Robinson voting aye on roll call. Bostic and Larson absent. Councilman Lemon excused at 4 P.M. Due to the late filing of Petition No. 86 by A. G. and Irene Beaman asking for rezone of property between 38th and 40th Avenue and Tieton Drive and Webster Street, the Council informally acknowl- edged the petition and is now awaiting the action of the Planning Commission. Moved by Keith, seconded by Barber that Resolution No. D -260 providing for the transfer of $1200.0 in the 1961 Irrigation Budget, be passed as read: carried, Barber, Keith, Maxwell and Robinson voting aye on roll call. Bostic, Larson and Lemon absent. (RESOLUTION NO. D -260, A RESOLUTION transferring the sum of $1,200.00 within the Maintenance & Operation classification of the 1961 appropriation for 51- Irrigation Department. WHEREAS, there is a surplus of money in Account 7 -43, Structures & Build - ing-s - Repairs, Supplies, Etc., of the Maintenance & Operation classification of the 1961 approp- riation for 51 - Irrigation Department, and WHEREAS, at the time of the adoption of the 1961 Budget, it could not have reasonably been anticipated that more money would be required for pump and other maintenance repairs and that additional moneys are required in Account 7 -46, Equipment - Parts & Repair, Etc., of the Maintenance & Operation classification of the 1961 appropriation for 51 - Irr,igation Depart- ment, and WHEREAS, the City Council finds that it is in the best interests of the people of the City of Yakima to make the aforesaid transfers, and the action contemplated herein is authorized by R.C.W. 35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the sum of $1,200.00 is hereby transferred from Account 7 -43, Structures & Buildings - Repairs, Supplies, Etc., to Account 7 -46, Equipment - Parts & Repair, Etc., all within the Maintenance & Operation classification of the 1961 appropriation for 51 - Irrigation Department. Imake the aforesaid (ATTEST: J. A. Smith City Clerk Section 2. The Director of Finance; is hereby authorized and directed to transfers. City Manager Smith reported on the pollution survey of our Sewage Treatment Plant and that it will be necessary for the city to engage an engineering firm to make the investigation of present conditions at the plant. City Manager Smith also reported that the Keys to the City have been received and are ready for distribution. Councilman Barber asked the Council to give some consideration to reducing the speed on 28th and 29th Avenue, between Lincoln and Summitview, because of school children using the streets. City Manager Smith was asked to take the matter up with the Traffic Board. There being no further business to come before the Council, it was moved by Barber, seconded by Keith that we adjourn at the hour of 5:40 P.M.: _carried, Barber, Keith, Maxwell and Robinson voting aye by voice vote.
