APRIL 26, 1961
The City Council met in regular session, Mayor Bostic, Councilmen Barber, Keith, Lemon,'Maxwell-
and Robinson, City Manager Smith and City Attorney Arntson present on roll call. Councilman
Larson absent.
The invocation was given by Councilman Barber.
The minutes of the regular meeting of April 19, 1961 were approved as read.
An ordinance creating the "Ditch Protection Bond Construction Fund" and appropriating $4,OOQ00
to said fund from the unappropriated moneys of the Current Expense Fund, having been read in it's
entirety at the regular meeting of the City Council on the 19th day of April, 1961 and laid on
the table for one week, and having been read by title only at this meeting, it was MOVED by
Robinson, seconded by Lemon that Ordinance No. 241 creating said fund and appropriating money to
same, be passed as read: carried, Barber, Bostic, Keith, Lemon, Maxwell and Robinson voting aye
on roll call. Larson absent. :
ORDINANCE NO. 2419 AN ORDINANCE creating -the "Ditch Protection Bond Construction Fund", appropriz
ing money to the same, and declaring an emergency.
The law firm of Preston, Thorgromson, Horowitz, Starin & Ellis of Seattle Washington having been
authorized.by Resolution No. D -244 as passed by the City Council on March 22, 1961, to continue
the professional services for the purpose of completing the Ditch Covering Bond Issue as approved
by the qualified electors of the City of Yakima at a special election held on November 8, 1960,
and said firm now submitting for consideration, an ordinance providing for the issuance and sale
of general obligation-bonds of the city in the principal sum of $45,000.00 for the purpose of
providing part of the funds necessary to acquire, construct and install protective fences and
the covering of certain portions of the Old Union -Ditch and the Pacific Power & Light Company
was,teway.in the City of Yakima as provided in Ordinance No. 171, passed by the City Council on
October 5, 1960, it was MOVED by Keith, seconded by Barber that Ordinance No. 242, as prepared
by said firm, providing for the issuance and sale of said general obligation bonds, be passed
as read: carried, Barber, Bostic, Keith, Lemon, Maxwell and Robinson voting aye on roll call.

AN ORDINANCE of the City Council of the City of Yakima, Washington, providing for the issuance
and sale of general obligation bonds of the city in the principal sum of $45,000, for the purpose
of providing part of the funds necessary to acquire and install pipe to cover and chain link
fencing to enclose certain irrigation ditches as provided in Ordinance No. 171, passed and
approved October 5, 1960, and approved by the qualified electors of the city at a special election
held therein on November 8, 1960; creating a Ditch Protection Bond Redemption Fund for the pay-
ment of the principal of and interest on said bonds; providing the date, form, terms and maturi-
ties thereof, and for unlimited tax levies to pay such principal and interest; and declaring an
emergency.
In accordance with action taken by the City Council at their regular meeting of April 19, 1961,
it was MOVED by Barber, seconded'by Keith that Resolution No. D- 255,approving and concurring with
the tentative decision of the Planning Commission for the tentative approval of the proposed plat
of Webber Addition No. 1, be passed as read: carried, Barber, Bostic, Keith, Lemon, Maxwell and
Robinson voting aye on roll call. Larson absent.
RESOLUTION NO. D -2551 A RESOLUTION approving and concurring with the tentative decision of the
Planning Commission for the tentative approval of the proposed plat of Webber Addition No. 1 to
the - City of Yakima.
WHEREAS, on April 4, 1961, a public hearing was had before the Planning
Commission of the City of Yakima upon the petition of Robert L. Gangle for approval of the pro-
posed plat of Webber Addition No. 1 to the City of Yakima and for a modification or varying of the
provisions of Ordinance No. B -2175 because of pre- existing topographic or other physical condi-
tions characteristic of the land of the proposed plat, and the existence of an underground drain-
age pipe easement, and
WHEREAS, at the conclusion of said hearing and after consideration of
the testimony and evidence adduced thereat, said Planning Commission issued its findings, which
ar4 -by this reference incorporated herein and made a part hereof, and that said Planning
Commission further tenatively decided that said petitioner be given tenative approval of said
proposed plat, subject to concurrence by the City Council, and
WHEREAS, the City Council finds that the findings of the Planning
Commission are adequate and are soundly based and should be adopted by-the City Council as its
findings and that it should approve and concur with the tenative approval of said proposed plat,
now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That the findings of the Planning Commission of the City of
Yakima upon the petition of Robert L. Gangle for the approval of Webber Addition No. 1 to th e
City of Yakima are hereby approved and adopted by the City Council as its findings.
Section 2. That the tenative decision of said Planning Commission
giving its tentative approval to said proposed plat with a variation in the requirements of
Ordinance No. B -2175 is hereby approved, and the City Council concurs in said tentative decision.
Section 3. That the Planning Commission of the City of Yakima is hereby
directed to approve the proposed plat in accordance with the standards and requirements contained
in its findings and order, and upon such approval, this order shall be the final decision of the
Planning Commission, and said Planning Commission shall have all the authority of the City Council
in carrying out the provisions thereof.

ORDINANCE N0, 2432 AN ORDINANCE declaring a multiple- residence building at 701- 03 -05 -07 East
Maple, within the City of Yakima, to be a nuisance; requiring the abatement and removal of the
same; providing for serving of Ordinance; and directing the City Attorney of the City of Yakima
to commence an-action for abatement of said nuisance.
This being the time fixed by the City Council for the hearing on Petition No. 68 as filed by
Washington Canners Cooperative requesting the vacation of a portion of Lenox Avenue, a map show-
ing the relationship of the property to be vacated to the - bandime proposed Lenox Overpass and the
Washington-Canners operations, was introduced by the Council. Mr. Adam Schneider,-Mr., Alfred
Garbe, Mr. Lyle Browning and Mr. E. R. Sandmeyer discussed this matter with members of the
Council. City Attorney Arntson reviewed the titles of property in answer to Mr. Schneiders
question as to ownership and Mr. Tom Paddison, Manager of Washington Canners Cooperative, review-
ed the problems of the operation of the cannery, if this property is not vacated. All persons
having been heard both for and against said vacation, it was MOVED by Robinson, seconded-by Keith
that Ordinance No.. 244, providing for the vacation of a portion of Lenox Avenue, be passed as read::
carried, Barber, Bostic, Keith, Lemon, Maxwell and Robinson voting aye on roll call. Larson
absent.
ORDINANCE NO.. 244, AN ORDINANCE providing for the vacation of that portion of Lenox Avenue situate
upon the following described premises. The North 30 feet of Lot 52 and the South 30 feet of Lot
53, all-in St. Paul's Acre Lots, according to the official plat thereof; and the.South 30 feet
of the West 308 feet of the Northeast Quarter of Section 30, Township 13 North, Range 19, E.W.M.;
-all situate in the City of Yakima, Yakima County, Washington.
This being the time fixed.by• the City Council for the hearing on Petition No. 78 as filed by
Martha Dorsett and May Houk requesting the rezone of certain property located between North 4th
Avenue and North 5th Avenue between "B" and "CT' Streets, persons present, were ' h ' eard, both for
and against said action. It was established that the majority of the protests were from persons
owning property in the area but not abutting the property to be rezoned and that protests were
against the manner in which business now in the area is operating. Mr. Winsor Bond, Manager of
May Nursery Company, explained that in their plans for the future they wish to improve by building
fences,etc., to take care of the unsightly part of their operations. Written protests were filed
by Mrs. Della Harris and Mr and Mrs. George Redfern. Oral protests were heard from Mr. & Mrs.
Johnson; Jack Robbilard, F. M. Ellsworth. ;. Mrs..Hattie Folley, Mr. R. C..Rogers, Mrs. Maggie
Burdine, Mr. Earl Babbit and Mrs. Schockley spoke for said rezone. All persons having been heard,
it was MOVED by Robinson, seconded by Barber that the City Attorney be and is hereby instructed
to prepare the necessary.ordinance accepting the recommendation of the Planning Commission to
rezone said property from R -3 Multiple- family residence to B -3 general business: carried, Barber
Bostic, Keith, Lemon, Maxwell and Robinson voting aye by voice vote. Larson absent.
A Petition, being Petiton No. 84, having been filed with the City Clerk on April 20, 1961,• by
the V.F.W. Club and others, requesting the repair and paving of the alley lying between South
5th and 6thAvenues and West Chestnut and West Walnut Streets, it was MOVED by Keith, seconded by
Lemon that said petition be referred to the City Manager for study and recommendation: carried,
Barber, Bostic, Keith, Lemon, Maxwell and Robinson voting aye by voice vote. Larson absent.
A petition; being Petition No. 85, having been filed on April 25, 1961 with the City Clerk by
James A. Wharton and others, requesting the formation of a local improvement district to con-
struct curbs and gutters and surface Hager Avenue, it was MOVED by Robinson, seconded by Maxwell
that said petition be referred to the City-Manager for study and recommendation: carried, Barber,
Bostic, Keith, Lemon, Maxwell and Robinson voting aye on roll call.
An ordinance appropriating the sum of $2,263.00 from the unappropriated funds in the Current
Expense Fund to Statutory and General -for the added-expense entailed in codifying the City
Ordinances, was read in its entirety by the Clerk of the Council and ordered laid on the table
for one week to be read and considered at the regular meeting of the City Council to be held on
the 3rd day of May, 1961.

Budget for the Sewage Treatment Plant, be passed as read: carried, Barber, Bostic, Keith, Lemon,

RESOLUTION NO. D -256, A RESOLUTION transferring $2,200.00 <<,tithin the Maintenance & Operation
classification of the 1961 appropriation for-52.7 - Sewage Treatment Plant.
WHEREAS, a surplus of moneys exist in Account 7 -46, Equipment -Parts &
Repair,'Etc-., of the Maintenance & Operation classification of the 1961 appropriation for 52.7 -
Sewage Treatment Plant, and
WHEREAS, delay in 'the delivery of certain"new pumps required the operation
of a large diesel engine in excess of normal expectations, .thereby increasing fuel consumption
under Account 7 -33, Field & Non- Office, of the Maintenance & Operation classification, and
WHEREAS, an increase in the d-l.orination requirements has left insufficient
moneys in Account 7 -38, Department - Special Materials,. of the Maintenance & Operation classifi-
cation, and
WHEREAS, no moneys were appropriated for Account 7 -42, Land, of the
Maintenance & Operation classification, and the trees and.shrubs on the treatment plant grounds.

WHEREAS, it could not have been reasonably anticipated that such addition-
al expenditures would be required, and the City Council finds that it is in the best interests
of the people of the City of Yakima to make the transfers herein provided and that the action
contemplated herein is authorized by R.C.W. 35.33.120, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
Section 1. That the-following sums are hereby transferred within the
Maintenance & Operation Classification of the 1961 appropriation for 52.7 - Sewage Treatment
Plant, to -wit:,

the.installatior� of improved telephone equipment without calling for bids, be passed as read:

RESOLUTION NO. D -2571 A RESOLUTION providing for the payment for the installation of improved
telephone-equipment without calling for bids.
'WHEREAS, for a number of years last past, all telephone•service within the
City Hall of the City of-Yakima has been handled through a manually operated switchboard, and
WHEREAS, in the 1961 Budget provision was made in Account 7 -57, Telephone,
of the Maintenance & Operation classification of the 1961 appropriation for 08 - City Hall, for ps
for the installation of automatic switchboard - type service, and
WHEREAS, all telephone service for City Hall and the City of Yakima is
furnished by Pacific Telephone & Telegraph Company, and
WHEREAS,, the City of Yakima will be billed for the installation charges of
the new service, said charges not to exceed $785.00 and
WHEREAS, Pacific Telephone & Telegraph Company will own the equipment in-
stalled.and is the sole installer of such equipment, and the City of Yakima finds that it is in
the best interests of the people of the City of Yakima to make such installation made and paid
therefor without calling for bids, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the Purchasing Agent of the City of Yakima is hereby authorized and
directed to secure the installation of automatic telephone equipment in City Hall, Yakima,
Washington, by Pacific Telephone & Telegraph Company without calling for bids, it being stipulat-
ed that the cost of the same will not exceed $7$5.00.

'Moved by Maxwell, seconded by'Keith that Resolution No. D -258 rejecting all bids received to
supply liquid asphalt to the City of Yakima and authorizing the Purchasing Agent to purchase said
asphalt on the open market: carried; Bostic, Keith, Lemon, Maxwell and Robinson voting aye-on
roll call. Barber and Larson absent.
RESOLUTION NO. D -25$, A RESOLUTION rejecting all bids to supply liquid asphalt to the City of
Yakima and authorizing the Purchasing Agent,to purchase such liquid asphalt on the open market.
WHEREAS, heretofore the City of Yakima, by and through its purchasing
Agent, advertised for the receipt of bids for the supplying to the City of Yakima of liquid as-
phalt for the 1961 requirements of the City, and
WHEREAS, three oil companies, to -wit: Shell Oil Company, Standard Oil
Company, and Union•Oil Company, submitted bids to the Purchasing Agent of the City of Yakima to
supply said requirements, said bids being identical in every respect, and
WHEREAS, the City Council believes and finds that the City can purchase
said liquid asphalt at a price under that bid by said companies, and that such bids should be
rejected and the Purchasing Agent authorized to purchase said liquid asphalt on the open market,
now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the bids submitted by Shell Oil Company, Standard Oil Company and
Union Oil Company to supply the 1961 requirements of the City of Yakima for liquid asphalt are
hereby rejected, and the City Manager and the Purchasing Agent are hereby authorized and directed
to purchase said liquid asphalt upon the open market for a price less than that submitted by
said three bidders.

WHEREAS, the said Oscar E. Soderling will reach the extended retirement
age of 67 by July 1, 1961, and
WHEREAS, the said Oscar E. Soderling is satisfactorily performing his
duties as a City Employee, and is in good physical condition and health, and it is deemed in the
best interests of the people of the City of Yakima to extend the retirement .date of the said
Oscar,E. Soderling for one year, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the retirement date of Oscar E. Soderling, an employee of the City
of Yakima, is extended for the period of one year from July 1, 1961.

Mayor Bostic asked to be excused from the next two meetings of the City 'Council and permission
was granted. Since Assistant Mayor Larson will be absent during this same period, and in accord-
ance with the rules of procedure as adopted by the Council, it was MOVED by Keith, seconded by
Maxwell that Councilman Robinson be and is.hereby elected to serve as temporary chairman until
Mayor Bostic or Assistant Mayor Larson shall return: carried, Bostic, Keith, Lemon, Maxwell and
Robinson voting aye by voice vote.
City Manager Smith reported on the Garbage Specificationg bids to be received on May 9, 1961, the
official adoption of the Municipal Code for the City of Yakima, improvement project at Tahoma
Cemetery and Rudkin Lift Station and the summer program on streets. No formal action was tkken
on these matters.
