APRIL 19,- 1961
The City Council met in regular session, Mayor Bostic, Councilmen Barber, Lemon, Maxwell and
Robinson, City Manager Smith and City Attorney Arntson present on roll call. Councilmen Larson
and Keith absent and excused.
The invocation was given by City Manager Smith.
The minutes of the regular- meeting of April 12, 1961 were approved as read.
Petition No..76 as filed by N. S. Morris requesting the rezone of property located on the
Northeast corner of Nob Hill Boulevard and South 38th Avenue, having been referred to the Plan-
ning Commission for recommendation, and said commission having denied this request at a public
hearing held April 4,'1961, and Mr.-N rris having filed, with the City Clerk on April 19, 1961,
an appeal from the decision of the Planning Commission, it was MOVED by Maxwell, seconded by
Robinson that the City Council does hereby acknowledge receipt of said appeal and fix the date
of hearing on same for May 3, 1961: carried, Barber, Bostic, Lemon, Maxwell and Robinson voting
aye by voice vote. Keith and Larson absent.
Petition No. 77 as filed by Yakima School District No. 7, having been referred to, the Planning
Commission for recommendation and said commission recommending the vacation of that portion
of the alley adjacent to Lots-6 through 25, Block 2, Bungalow Addition with the provision that
utility easements be retained, it was MOVED by Lemon, seconded by Barber that Resolution No.
D -252 fixing the date of'hearing on said petition at the hour of 3 :00 P.M. on the 10th day of
May, 1961, be passed as read: carried, Barber, Bostic, Lemon and Robinson voting aye on rell
call. Keith and Larson absent.

A RESOLUTION fixing the time for hearing on petition for vacation of
alley.
WHEREAS, a petition has been filed with the City Council of the City of
Yakima, a municipal corporation, praying for the vacation of the following described portion of
an alley, to -wit
now, therefore,
All of the alley adjacent to Lots 6 through 25, Block 2,
Bungalow Addition, according to the official plat thereof,
now on file and of record'in the office of the Auditor of
Yakima County, Washington;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That said petition shall be brought on for hearing and determination--on
Wednesday, the 10th day of May, 1961, at the hour of 3 :00 o'clock in the afternoon on said day

Petition No. 80, as filed by Ray Lucas and W. L. Wolfe requesting the rezone of certain property
located between 6th and 7th Avenues on Walnut,having been referred'to the Planning Commission
for recommendation and said commission recommending that said property be rezoned from R -3
Multi - family residence to B -2 Local Business, it was MOVED by Barber, seconded by Robinson that
Ordinance No. 240 accepting• said recommendation and rezoning said property from R -3 to B -2
Local Business Zone, be passed as read: carried, Barber, Bostic, Lemon., Maxwell and Robinson

ORDINANCE NO. 2401 AN ORDINANCE accepting the recommendation of the Planning Commission and
rezoning certain property located between South 6th'and 7th Avenues, immediately north of
West Walnut Street, in the City of Yakima, Washington.
Petition No. 81 as filed by Earl Moirer and others requesting the,vacation of the North -South
Alley between North Naches Avenge and North 4th Street and directly behind Montgomery Wards:
store, having been referred to the Planning Commission for recommendation and said commission
recommending that the City Council deny-this request because thehpublic interest would best be
served by retaining the alley for public use, it was MOVED by Maxwell, seconded by Barber that
Resolution No. D -253 fixing the date of hearing on said petition at-Ahe hour of 3:00 P.M. on

WHEREAS, a petition has been filed with the City Council of the City of
Yakima, a municipal corporation, praying for the vacation of the alley that runs in a northerly -
southerly direction situate between East Yakima Avenue and East "A" Street and North 4th Street
and North Naches Avenue in the City of Yakima, Washington, more particularly described as follow;

In accordance with action taken by the City Council at their regular meeting on April 12, 1961,
the Council again considered the semi -final estimates on Domestic Well 4 and 5 as submitted by
the firm of Gray and Osborne, Consulting-Engineers, and Mr. Don Gray being present explained tha
all charges on the abandoned well in connection with the construction of Well No. 5 had been
deducted from the original estimate on said well, but on checking said estimate it was determine
that.an item described as 24" x 1$1' Slip Packer for 20" Screen in the amount of $351.03 should
also be deleted from the corrected estimate. The Council wishing to have the corrected figures
for consideration, set this matter aside to be considered later in this same meeting.
In accordance with action taken by the City Council at.their regular meeting on March 22, 19610
the matter of the abatement of certain property owned by Mr. Victor Moreau, located at 701, 03,
05,07 East Maple Street, Manager Smith reported that,after analyzing the various requirements
which should be met if the structure were to be rehabilitated, Mr. Moreau has decided to demolis
the structure and has by written request asked to be allowed four months period or until August
15, 1961 to complete the work since he is doing it himself. The Council wishing to cooperate
with Mr. Moreau but also wishing to have this matter completed as soon as possible, it was MOVED
by Barber, seconded by Maxwell that the City Attorney be and is hereby instructed to prepare
the necessary ordinance to commence an action for abatement and fix the completion date on or
before July 1, 1961: carried, Barber, Bostic, Lemon, Maxwell and Robinson voting aye by voice
vote. Keith and Larson absent.
A petition, being Petition No. 83, praying for the annexation of certain property South of Mead
Avenue between Pleawant and 12th Avenues,-having been duly.filed with the City Clerk on April 18,
1961, by Donald V. Evans and others, it was MOVED by Maxwell, seconded by Barber that said
petition be referred to the City Manager and the Planning Commission for study and recommendation
carried, Barber, Bostic, Lemon, Maxwell and Robinson voting aye by voice vote. Keith and Larson
absent.
In connection with the Ditch Covering Bond issue as voted on by the qualified electors of the
City of Yakima at a special City Election on November $, 1960, an ordinance creating "Rit�,G;
Protection Bond Construction Fund" and appropriating $4,000.00 to said fund was read: / tthe 1�U
of the Council and ordered laid on the table for one week to be considered at the next regular
meeting of the Council on April 26, 1961.
Moved by Maxwell, seconded by Lemon that Resolution No. D -254 providing for the loan of $309000.0
from the Current: Expense Fund to. the "Ditch Protection Bond Construction Fund and providing for
the repayment thereof, be passed as read: carried, Barber, Bostic, Lemon, Maxwell and Robinson
voting aye on roll call.
RESOLUTION NO. D -2542 A RESOLUTION providing for the loan of $30,000.00 from the Current Expense)
Fund to the Ditch Protection Bond Construction Fund and providing for repayment.
WHEREAS, on November-8, 1960, the people of the City of Yakima approved
Proposition No. 8 which provided for the construction of certain ditch protection for certain
parts of the Old Union Ditch and the Pacific Power & Light Wasteway, all as set forth in Ordinanc
No. 171 of the City of Yakima, and
WHEREAS, general obligation bonds will be sold in the sum of $459000.00
to provide most of the money for said construction, and
WHEREAS, said construction work is now in progress but the money from the
sale of said bonds is not yet available, and
WHEREAS, it will become necessary to make certain payments to the contrac-
tor for such construction, and
WHEREAS, the City Council finds that it is in the best interests of the
people. of the City of Yakima to.make a temporary loan of the sum of $30,000.00 from the Current
Expense.Fund to said Ditch Protection Bond Construction Fund on a temporary basis, now, there-
fore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the -sum of $30,000.00 is hereby transferred and loaned from the
Current Expense Fund to the Ditch Protection Bond Construction Fund, said loan to be repaid to
the Current Expense Fund as soon as the moneys become available from the sale of the general
obligation bonds to be issued for the said construction, and the Director of Finance and the
City Treasurer are hereby authorized to make the necessary transfers.

In accordance with action taken earlier in this meeting, and Mr. Don Gray now presenting the
corrected figures on the semi -final estimate on Well No. 5, it was MOVED by Robinson, seconded
by Maxwell that the Semi -Final Estimate on Well No. 4 , providing for the retention of $14,544.81

and showing no payment to the contractor, due at this time; be approved and the well accepted;
and that semi -Final Estimate on Well No. 5 as- corrected be approved and said well`"bbaccepted
and that the Finance Director be and is hereby authorized to pay to Midland Drilling Company
$6,720.45 on Well No. 5,. xx the amount of the corrected semi -final estimate and that the state-
ment in the amount of $785.60 as presented by Gray,and Osborne for professional engineering
services furnished in connection with the construction of Wells 4 and 5, be approved and the
Finance Director be and is hereby authorized to pay same: carried, Barber, Bostic, Lemon,
Maxwell and Robinson voting aye by voice vote. Keith and Larson absent.
The Planning Commission haveing submitted a copy of a petition for modification, the proposed
plat as revised after a hearing by the Planning Commission and a summary of facts in the case of
the application for approval of a plat for Webber Addition No. 1, to the City Council and re-
questing their review and concurrence,, rejection or, modification of the decision for tentative
approval of the proposed plat, Mr. Robert Gangle, petitioner and Mr. Alan A. Mc Donald, attorney
for said petitioner, were heard on this-matter. After discussion, it was MOVED by Maxwell, secon
ed by Barber that the City Attorney be and is hereby directed to prepare a resolution approving
and concurring the tentative decision of the Planning Commission for the tentative approval of th
Proposed Plat of Webber Addition No. 1 : carried, Barber, Bostic, Lemon, Maxwell and Robinson
voting.aye by voice vote. Keith and Larson absent.
Manager Smith.reported that the specifications for bids to contract for private operation of
the residential garbage service for the City of Yakima would be ready on Friday of this week.
There being no further business to come before the Council, it was MOVED by Maxwell, seconded
