Councilmen Barber, Keith, Lemon, Maxwell and Robinson, City Manager Smith and City Attorney Arntson present on roll call. Mayor Bostic absent and excused. The invocation was given by City Manager Smith. The minutes of the regular meeting of March 22, 1961 were approved as read. Assistant Mayor Larson welcomed Linda Cooper, Willa Christie and Mike Sonsilla, Franklin Junior High students who were visitors at this meeting. Mr. George M. Leadon having filed a written request to withdraw Petition No. 69, which was filed with the City Clerk January 6, 1961, and requested that certain property contiguous to the City located between North 2nd and North 4th Street, be annexed to the City of Yakima, and Manager Smith explaining that Mr. Leadon had changed his mind as to giving an easement for widening of Buwalda Lane, it was MOVED by Robinson, seconded by Keith that the withdrawal of Petition No. 69 be permitted, since no action other than referral to the Planning Commission has been.taken by the Council: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Bostic absent. A petition, beingg Petition No. 80, having been filed with the City Clerk on March 8, 1961 by Ray Lucas and W.,L. Wolfe requesting the rezone of certain property between South 6th and 7th Avenue on Walnut Street, it was MOVED by Maxwell, seconded by Barber that said Petition be referr- ed to the City Manager and the Planning Commission for study and recommendation: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote: Bostic absent. A petition, being Petition No. 81, having been filed with the City Clerk 3/28/61 by Earl R., Morier requesting that the North South Alley back of Montgomery Ward store between North 4th Street and Naches Avenue be vacated, it was MOVED by Maxwell, seconded by Lemon that said petition be referred to the City Manager for study and recommendation: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote: Bostic absent. Moved by Keith, seconded by Robinson that Ordinance No. 231 fixing the time of delinquency and prescribing the form of bonds for L.I.D. No. $$9 being the Edgwood' and Parkview Terrace Domestic Water District, be passed as read: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Bostic absent. ORDINANCE NO. 231, AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. $$9,, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Moved by Barber, seconded by Robinson that Ordinance No. 232 amending paragraph (n) of Section $$ of Ordinance No. B -1526, the Traffic Code,. said amendment adding Veterans Day as 'a holiday for the use of parking meters, be passed as read: carried, Barber, Keith, Larson, Lemon,Makwell, and Robinson voting aye on roll call. ORDINANCE NO. 232, AN ORDINANCE amending Paragraph (n) of Section $$ of Ordinance No. B -1526, entitled, "AN ORDINANCE relating to and regulating traffic, travel and transportation and their incidents upon the streets and other ways open to the public; prescribing the powers and duties of officers and others in relation thereto; defining offenses; providing penalties, and repeal - ing.Ordinance No. B -131 and all amendments thereof and all other ordinances insofar as they are in conflict therewith, and declaring an emergency ", and declaring an emergency. Inaccordance with action taken by the City Council at their regular meetings of March 8th and 15th, it was MOVED by Keith, seconded by Robinson that Ordinance No. 233 decreasing certain ap- propriation within the 1961 Budget, be passed as read: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. Bostic absent. ORDINANCE NO. 233, AN ORDINANCE decreasing certain appropriations within the 1961 Budget, and declaring an emergency. Also in accordance with action taken by the Council at their regular meeting of March 8, and 15, 1961, it was MOVED by Barber, seconded by Lemon that Resolution No. D -245 providing for the loan of $$1,$10.00 from the Current Expense Fund to the Street Fund and further providing for the repayment of said amount, be passed as read: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye on roll call. Bostic absent. RESOLUTION NO. D -245, A RESOLUTION providing for the loan of $81,810.00 from the Current Expense Fund to the Street Fund and providing for repayment. WHEREAS, in the 1961 Budget of the City of Yakima certain appropriations were made for the construction, repair and maintenance of streets in the City of Yakima, and WHEREAS, at the time of the preparation of the 1961 Budget it was contem- plated that the funds for said improvement and maintenance -work would be procured by the sale of General Obligation Bonds, and WHEREAS, the City Council has determined that it is not in the best interests of the people of the City of Yakima to issue and sell such bonds, and WHEREAS, therefore, sufficient moneys are not available in the Street Fund for the performance of such work and there are inactive funds in the Current Expense Fund, and the City Council finds that it is in the best interests of the people of the City of Yakima to loan the sum of $81,810.00 from the Current Expense Fund to the Street Fund on a temporary basis, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the sum of $81,810.00 is hereby transferred and loaned from the Current Expense,Fund to the Street Fund, said loan to be repaid to the Current Expense Fund on or before June 1, 1964, and the Director of Finance and the City Treasurer are hereby authorized and directed .to make the necessary transfers. r�� f. 1 fl 7� 1 1 MARCH 29, 1961 ADOPTED BY THE CITY COUNCIL this 29th-day-of March, 1961. Bostic absent. RESOLUTION NO. D -2461 A RESOLUTION commending the Better Business Bureau of the Yakima Valley. WHEREAS, the Better Business Bureau of the Yakima Valley has recently been formed for the purpose of assisting public officers in protecting the public from fraud and misrepresent- ation and further for the furnishing of the public with business facts, and WHEREAS, the-f 6rmation of said bureau will materially contribute to the business climate of the City of Yakima in the promoting of better business practices, and WHEREAS, said Better Business Bureau of the Yakima Valley will commence a membership campaign beginning on April 3, 1961, and WHEREAS, the City Council finds that the formation and operation of said bureau will be in the best interests of the people of the City of Yakima and is worthy of support and commend - ation, now, therefore, BE IT RESOLVED -BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Council of the City of Yakima commends the Better Business Bureau of the Yakima Valley for the worthy purposes for which it has been formed and under which it is now operating, and urges the public, generally, to support said bureau. D -247, A RESOLUTION authorizing the crediting of "released matching funds" on deposit with the Statewide City Employees Retirement System, to the credit of the Street Depart - ment, "to the payment of current contributions and "matching funds" of the Street and other Departments, and the reimbursing of the Street Fund for such credits. .WHEREAS, the City of Yakima operates under the Statewide --- E"ity Employees Retirement System Law, as set forth in Chapter 41.44 of the Revised Code of Washington, and WHEREAS, there-is on deposit with the Statewide City Employees Retirement Fund, operated in connection with said system, certain moneys paid by the City of Yakima as "matching funds" for resigned employees which are no longer necessary for the operation of said system, and I WHEREAS, the City. of Yakima is required from time to time to pay, certain moneys to said system for the administration of the same, and WHEREAS, "released matching funds" on deposit with said system may not be repaid in cash to the City but may be credited to current payments by the City, and WHEREAS, it is determined in the best interests of the people of the City of Yakima that $8,300.00 of said "released matching funds" on deposit with said system, to the credit of the Street Department, be credited to the payment of current payments by the Street and other Depart- ments of the City, and that the Street Fund be reimbursed by warrant in the said sum of $8,300.00 as the same should be credited, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and the Finance Director of the City of Yakima are hereby auth- orized and directed to use and credit the sum of $8,300.00 on deposit as "released matching funds" with the Statewide City Employees Retirement Fund, to the credit of the Street Department, to pay monthly contributions and "matching funds" to the Statewide City Employees Retirement System for the Street and other Departments in like amount and, upon such crediting, to reimburse the Street Fund by City warrant. Mrs. Doris Meleni, 309 South Naches Avenue, and Mrs. Bette Galloway being present at this meeting protested, again, the paying of a license fee on dogs and having to keep the dog on private property, or on a leash. The matter of paying dog licenses under protest was discussed and City Attorney Arntson informed the Council and those present that this matter would have to be briefed thoroughly before he would be able to give an opinion since all matters can not be paid under protest. Moved by Maxwell, seconded by Barber that the suggestions made be noted by the Clerk and consid- ered at such time as this matter may be reconsidered: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Bostic absent. Manager Smith reporting that bids for the piping and fencing of the Old Union Ditch Company were received and considered by a bid board on March 27, 1961 and that the bid of N. L. Kimball in the amount of $39,675.22 for the piping of said ditches and the bid of El Dorado Fence Company, Inc. in the amount of $6,451.29 for the fencing of said ditches are the lowest and best bids received, it.was moved by Robinson, seconded by Maxwell that the City Manager be authorized to accept these bids and enter into the necessary contract on behalf of the City of Yakima upon the filing of the proper bond by these contractors: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote. Bostic absent. 1 1 1 1 143 MARCH 29, 1961 On the matter of purchasing 100 "Keys to the City" as authorized by Council action on the 24th day of August, 1960, Manager Smith informed the Council that the Chamber of Commerce is not ready to place their order now but that the Convention Bureau is ready and the City of Yakima will get their keys from the Convention Bureau. No further formal action was taken by,the Council. Councilman Keith was excused at the hour of 4:30 P.M. Manager Smith also informed Council Members that specifications for the Garbage Collection projec will be completed soon and a call for bids placed. There being no further business to come before the Council, it was MOVED by Barber, seconded by Lemon that we do now adjourn at the hour of 4:45 P.M: carried, Barber, Keith, Larson, Lemon, Maxwell and Robinson voting aye by voice vote.
