Councilmen Maxwell and Robinson absent. The invocation was given by Councilman Barber. Minutes of the regular meeting of February 15, 1961 were approved as read:. This being the,time fixed by Ordinance No.-256 for providing -for the advertising contract for -the City of Yakima, and the bid,of the Republic'Publishing Company being the -only bid received and said bid being -at the same rate as quoted for 1960 or at the rate of $1:.40,per column inch of 11 ems each•or $1.30 per column inch -if-and when such legal advertising is set in columns of 10.2 ems each, it was MOVED by Keith, seconded by-Barber that said'bid-b6 awarded to the Republic Publishing Company and the Mayor and the,-City Clerk be-and are-hereby-authorized,to execute the contract in connection with said bid: carried, Barber, Bostic,- Keith, Larson voting aye by voice vote., Maxwell and Robinson absent. A petition, being petition No.-74; having been filed"February 17, 1961 by John Anderson and other; praying for the annexation of certain property contiguous -to -the City of Yakima between Orchard Avenue and Summitview and - between 44th and 45th"Avenue, -and the'City Manager advising that certain legal problems have come up ih- connection with-.said-petition and recommending that this item be removed from the agenda, it -was MOVED by Larso; seonded by Barber'that. this matter be taken off the agenda for this meeting; carried, Barber, Bostic, Keith, Larson voting aye by voice vote. Maxwell and Robinson absent. A petition, being Petition No. 75,"having been'filed February-20;'1961-with the City Clerk, by the Yakima Valley Junior,College,-requesting the.*vacation of a-public'utility easement, located South of Lenox between 13th and 14th Avenue, it was MOVED.b.y Larson, seconded by Keith-that said petition be referred to the Planning Commission for study and recommendation: carried, Barber, Bostic, Keith and Larson voting aye by voice vote. Maxwell and Robinson absent. Moved by Barber, seconded by Larson that Ordinance No: 213 amending Ordinance No. 194 providing for a classification and compensation plan for city employees, said amendment providing for - reimbursement for certain expenditures made on trips away from the city.on official business, be passed as read: carried, Barber_, Bostic, Keith and Larson voting aye on roll call. Maxwell and Robinson absent. ORDINANCE NO. 2139 AN ORDINANCE amending Ordinance No. 194 entitled, "AN ORDINANCE establishing classification and compensation plan for all employees of the-City of Yakima, except Firemen and Policemen, and repealing Ordinance No. 79 and all resolutions, ordinances or parts.of ordinances in conflict herewith." by adding thereto a new section designated Section 9 -B, and declaring an emergency. Moved by Larson, seconded by Keith that Ordinance No. 214 fixing the time of delinquency and prescribing the form of bonds for-L.I.D. No.$$6, being the Edgewood & Sutor Addition Sanitary Sewer, be passed as read: carried, Barber, Bostic, Keith and Larson voting aye on roll call. Maxwell and Robinson absent. ORDINANCE NO. 2149 AN ORDINANCE fixing the.time of delinquency of installments of assessments levied for the payment of the cost of the improvement'in Local Improvement District No. $$6, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Moved by Keith, seconded by Larson that Ordinance No. 215 fixing the time of delinquency and prescribing the form of bonds for L.I 0. No. 888, being the Parkview Terrace Sanitary Sewer District, be passed as read: carried, Barber, Bostic, Keith and Larson voting aye on roll call. Maxwell and Robinson absent. ORDINANCE NO. 215, AN ORDINANCE fixing the time of delinquency of installments of assessments_ levied for the payment of the--cos-1k; of the improvement in Local Improvement District No. 888, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Moved by-Larson,-seconded by Keith that Resolution No. D -235, being a resolution in memorium of George L. Oliver,.Councilman who passed away on the 13th day of February, 1961, be passed as read: carried, Barber, Bostic, Keith and Larson voting aye on roll call. Maxwell and Robinson absent. RESOLUTION NO. D -2352 A RESOLUTION in memorium of George L. Oliver. WHEREAS, George L. Oliver was duly elected in 1959 to-the first City Council of the City of Yakima under the Council 9 Manager form of government, and WHEREAS, Mr. Oliver was re- elected to said position in the Municipal Election of 1960, and WHEREAS, Mr. Oliver performed his duties and responsibilities as a Citpy Councilman in'a superlative way and in such manner that the entire City of Yakima is greatly in- debted to him, and WHEREAS, Mr. Oliver-met an untimely death on February•13, 1961 while carrying on his duties as a teacher and advisor in the Yakima Public Schools, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City of Yakima "is deeply grateful for the.work performed by the late George L. Oliver'and for the dedicated, public - spirited manner in which he filled his position as a Councilman,of the City of Yakima and as a citizen of this community, and BE IT FURTHER RESOLVED: That a copy'of this Resolution -shall be sent to Mrs. George L. D -236 authorizing the City Manager and the City Clerk to" execute a pipeline crossing''agreemerit with the Yakima Valley Transportation Company in connection with the extension -of -the sewer­pipelifte-'on Nob Hill Boulevard in order to make a connection into Glenside Court;-be­passed'as- read.:" carried, Barber, Bostic, Keith, and Larson voting aye on roll call. Maxwell and Robinson absent. RESOLUTION N0. D =2361' .. A RESOLUTION &u:thorizing the City-- Manager' and- the City Clerk to execute a pipeline.crossing agreement with Yakima Valley Transportation'Company.. 'WHEREAS; in- connection with the "Oktension of the .sewer pipeline of the. City of Yakima west 'on Nob 'Hill-.Bouleva "rd- in" order -to - make.. a connection into Glenside Court it is necessary that said pipe be placed under the tracks of the Yakima Valley Transportation Compa in;two places, and WHEREAS, it­is- necessary that the City execute a--pipeline crossing agree- ment with the said Yakima-Valley Transportation Company, now, therefore,, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the-City'Manager and the City-Clerk of the City of Yakima are hereby .authorized and directed to' execute on- behalf of-the',City-of- Yakima a'pipeline crossing agreement with*Yakima Valley Transportation "Company, a-copy of which agreement is hereto attached and by this reference made a part hereof. (SEAL) THOMAS C.- BOSTIC Mayor Mayor Bostic discussed the matter of -continuing the seal coating"of streets as started in 1960, stating that all other ways will be e`kplored before the Council resorts to issuance of General Obligation Bonds ; "snide -the -1961 Biidget'for- Streets was predicated on the passage of a Bond issue for Street Improvement purposes which- -was'submitted to the voters in November 1.960. No formal. action was taken by the Council on this matter.. Mayor- Bostic also announced that-Eichler-Garbage Service has submitted plans whereby they would take over collection of 'garbage for the City of Yakima and stated that this matter will be investigated further and'if'deemed- advisable 'it will be necessary to call for bids. No formal action was taken by the Council on this matter. Manager Smith informed-the Council that'a Traffic Seminar is to -be held March 6.through 24, 1961 at the North Western University in' "Chicago and requested that Miles Fuller, a member of the engineering staff be allowed to'attend. Moved by Barber, seconded by Keith that said staff membe be allowed to attend the-Traffic Seminar in Chicago: carried, Barber, Bostic,*Keith and Larson voting aye by voice vote. Manager Smith also reported that the test-on'the VieWtont Well (Gilbert Well) was completed on Friday, February 17, 1961, that the maximum - amount pumped was 1900 gallons per minute from the 157 foot level, which is below the capacity of the well as represented by Mr. Elon J. Gilbert, that it will be too costly to put the well in operation and recommended that Iin view of the failure of the tests to substantiate the claim for the well; that the city withdraw the acceptanc of the offer of Elon -J. Gilbert to-sell the Viewmont Well to the City of Yakima as set-forth in Resolution No. D -214. After discussion of the Managers report, it was MOVED by Larson, seconded:. by Barber, that the offer to buy said well be withdrawn: carried, Barber, Bostic, Keith and Larson voting aye by voice vote. Manager Smith advised members of -.the Council that Mr. Robert Steiner who.is.now employed.as Superintendent at Tahoma Cemetery has resigned, said resignation to become effective as of March 1, 1961. Mr. Frank Pozarich, a police office being present, protested the placement of the Animal Control 'Officer under the police system, explaining that -this could have damaging effects to their pensic plan and civil service system. Manager Smith reassured the Council and Mr. Pozarich that full con- sideration to this matter would be given before final action is taken. City'Engineer Mayo reporting that the following bids have been received for the construction of the "Beech Street Storm Sewer and Various Other Sewers: De Blasio Bros; N. L. Kimball 20,191.19 21,952.93 and recommending the bid of De Blasio Bros. as the lowest and best bid, it was MOVED.by Keith, seconded by Barber that said bid be awarded to.De- Blasio Bros. and the City Manager and City. Clerl be and are hereby authorized to enter into a contract, on behalf -of the City of Yakima, with said contractor upon "the filing of the proper bond: carried,- Barber, Bostic, Keith and Larson voting aye by voice vote. Mayor Bostic and Councilman Keith requested that they be excused from the regular meeting of the Council on March 1st; 1961. There being no further business to come before the Council, it was MOVED,by Barber, seconded by Larson that we do now adjourn at the hour of 4:10 P.M: carried, Barber, Bostic, Keith and Lars voting aye-by voice vote.
