FEBRUARY 8.', 1961
The City Council met in regular session, Assistant Mayor Larson presiding. Councilmen Barber,
Keith, Larson, Oliver and Robinson, City Manager Smith and City Attorney Arntson present on roll
call. Bostic•absent.and excused..
Councilman Barber gave the invocation.
The minutes of the regular meeting of February 1, 1961 were approved as read. -
This being the time fixed by the, City Council for further considering Petition- No.- 67 as filed
by Robert L. Alderson and others -, praying for the annexation of certain property -north of
Fruitvale•Boulevard between 14th and 15th Avenue, a letter from the Liberty Savings and Loan
was read :by the Clerk of the Council, said letter stating that the Loan Committee for said aDrpo
ation feels that a release of the 25 feet of land as recommended by the Planning Commission,
would draw the line within 8 feet of the bourse and would be very detrimental to the property,
and therefore regret that further land cannot be released from this mortgage. It appearing that
said petitioners cannot comply with conditions set and established by ordinance, it was-MOVED
by Keith, seconded by Maxwell that the City Attorney be and is hereby instructed to prepare a
resolution accepting the recommendation of the Planning Commission and refusing to; entertain sai
petition of annexation unless the petitioners make proper provision for the specified right -of-
way: carried, Barber, Keith, Larson, Maxwell, Oliver and Robinson voting aye by voice vote.

Moved b Barber, seconded by Robinson that Ordinance No. 207 providing for the= transfer of the
sum of 12,291.82 from the A. E.,Larson Library Trust Fund to the Yakima Valley Regional Library
for the purpose of purchasing a new bookmobile to be used exclusively in servicing-branch
libraries maintained in schools within the corporate limits of the City of Yakima, be passed as
read: carried, Barber, Keith, Larson,.Maxwell, Oliver and Robinson. Bostic absent.
ORDINANCE NO. 207, AN ORDINANCE-providing for the transfer of the sum of $12,291.82 from the
A. E. Larson Library Trust Fund to the Yakima Valley Regional Library, and declaring an emergenc
Moved by Robinson, seconded by Maxwell that Ordinance No. 208 amending Ordinance-No. 194 which
establishes a classification and.compensation plan for City Employees, said amendment providing
for the reimbursement for certain official expenditures, be passed as read: carried, Barber,
Keith, Larson, Maxwell, Oliver and Robinson voting aye on roll call. Bostic absent.
ORDINANCE NO. 208, AN ORDINANCE amending Ordinance No. 194 entitled, "AN ORDINANCE establishing
classification and compensation.plan for all employees of the City of Yakima, except Firemen and
Policemen, and repealing Ordinance No. ?9 and all resolutions, ordinances or parts- of.ordinances
or parts of ordinances in conflict herewith," by adding threto a new section designated Section
9 -A, and declaring an emergency.
An ordinance appropriating the sum of $1,000.00 from the unappropriated moneys in the Current
Expense Fund to Statutory & General for the purpose of reimbursement of officers and employees
for making certain expenditures as part of the compensation plan, was read in its entirety by
the Clerk of the Council and ordered laid on the table for one week to be read and considered
at the next regular meeting of the City Council on February 15, 1961.
Manager Smith having submitted to members of the Council a written report and recommendations on
the dog enforcement program and members of the Council having discussed the minimum requirements
for setting up the enforcement of Ordinance No. 162 requiring the keeping of dogs on the premises
of the owner or custodian except when on leash, it was MOVED by Maxwell, seconded by Barber that
Ordinance No. 209 amending Section 2 of Ordinance No. B -2057 relating to animals'and fowls at
large, said amendment making provisions for the retention of dog and animal license fees during
ing interim period while the City of Yakima is in the process of implementing a system for the
control of dogs, be passed as read: carried, Barber, Keith, Larson, Maxwell, Oliver and Robinson
voting aye on roll call. Bostic absent.
ORDINANCE N0. 209, AN ORDINANCE amending Section 2 of Ordinance No. B -2057 entitled, "AN
ORDINANCE RELATING to animals or fowls at large, or found in the City of Yakima, contrary to any
ordinanee.of the City of Yakima; providing for the taking up, impounding, keeping and disposition!,
of such animals or fowls; fixing the charges therefor and the disposition of money received in
connection therewith; providing for a Humane Shelter and the maintenance thereof by the Yakima
County Humane Society; appointing a Poundmaster under Ordinance No. A -268 as amended by Ordinance
No. B -327; declaring certain practices of certain animals to be public nuisances, defining
offenses and prescribing penalties, and repealing all other ordinances and parts of ordinances in
conflict herewith,tt and declaring an emergency,

the manner of letting the contract for City Advertising, it was MOVED by Robinson, seconded by
Oliver that Resolution No. D -227 directing notice for contract for advertising and specifying
terms, be passed as read: carried, Barber, Keith, Larson, Maxwell, Oliver and Robinson voting
aye on roll call. Bostic absent.
RESOLUTION NO. D -2271 A RESOLUTION directing notice for contract for advertising and specifying
terms.
WHEREAS, it is necessary that on the first Wednesday after the first
Monday in February of each year the City Council of the City of Yakima, Washington, shall pass a
resolution prescribing the form of contract for the city advertising for the ensuing year, now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the form of contract for the city printing for the ensuing year shall
be in substantially the form hereto attached and made a part hereof, and the City Clerk is here-
by directed to give notice for sealed proposals for a contract for doing the city advertising for
the ensuing year by publishing the same for two consecutive issues in the newspaper doing the
city printing, which notice shall contain a general statement of the terms of the contract tobe
let, together with the time and place when said bids will be opened, and providing that any and
all bids may be rejected.

of Bowls for a 30 HP Peerless Water -Pump without calling for bids, be passed as read: carried,
Barber, Keith, Larson, Maxwell, Oliver and Robinson voting aye on roll call. Bostic absent.
RESOLUTION NO. D -228, A RESOLUTION authorizing the purchase of a set of Bowls for a 30 HP Peer -
less Water Pump without calling for bids.
WHEREAS, it is necessary to purchase a set of Bowls for a 30 HP Peerless
Water Pump, and the funds therefor are available in the 1961 appropriation for the Irrigation
Department, and
WHEREAS, it is necessary to obtain such equipment as soon as possible, and
WHEREAS, De Coto Brothers is the only source available to the City from
which to purchase this equipment, and the price quoted is substantially below the list price for
said equipment, and it would serve no purpose to advertise for bids for the same, and the City
Council finds that.it is in the best interests of the people of the City of Yakima to purchase
said equipment from said firm without calling for bids, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the Purchasing Agent of the City of Yakima is hereby authorized and
directed to purchase a set of Bowls for a 30 HP! Peerless Water Pump from DeCoto Brothers without
calling for bids, it being stipulated that the cost of the same will not exceed $495.00 plus sale:
tax.

Manager Smith having submitted a written report to members of the City Council on Police Pension
Amendments which are being considered by the State Legislature now in session, it was MOVED by
Oliver, seconded by Keith that Resolution No. D -229 opposing Senate Bill 94 regarding said
pensions, be passed as read: carried, Barber, Keith, Larson, Oliver and Robinson voting aye on
roll call. Bostic absent.
RESOLUTION NO. D -2291 A RESOLUTION opposing Senate Bill 94 regarding Police Pensions.
WHEREAS, there is presently pending before the Legislature of the State
of Washington Senate Bill 94 regarding Police Pensions for cities, and
WHEREAS, the passage of said Senate Bill 94 would very materially increase
costs to the people of the City of Yakima, and the City Council does not believe that said Bill
is in the best interests of the people of the City of Yakima and wishes to express its opposition
to the passage of the same, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the City Council of the City of Yakima opposes the passage of Senate
Bill 94 relating to Police Pensions in cities and hereby directs the City Clerk of the City of
Yakima to send copies of this Resolution to the several committees of the State Legislature which
may be concerned with the 'consideration of the same.

Manager Smith having included /information on the reorganization of Justic Courts as being con-
sidered by the State Legislature now in session, it was MOVED by Robinson, seconded by Keith
that Resolution No. D -230 opposing the passage of Senate Bill 111 reorganizing said courts,
be passed as read: carried, Barber, Keith, Larson, Oliver and Robinson voting aye on roll call.

RESOLUTION NO. D -2300 A RESOLUTION opposing the passage of Senate Bill 111 reorganizing Justice
Courts.
WHEREAS, there is presently pending before the Legislature of the State of
Washington Senate Bill 111 which provides for,the reorganization of the Justic Courts of the State
of Washington, and
WHEREAS, under the provisions of said Bill, the City of Yakima would have
no right to designate any judge to handle municipal cases, and
WHEREAS, the provisions of said Bill will call for a very considerable
increase in cost to the City of Yakima and at the same time lessen the efficiency and availability
of the Court, and
WHEREAS, the City Council believes that the City of Yakima should have the
optional right to appoint its own Municipal Judge and that Senate Bill 111 is not in the best
interests of the people of the City of Yakima, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA:
That the City Council opposes the passage of Senate Bill 111 in its present
form and, in particular, opposes those portions of the Bill which deprive the City of Yakima of
its Municipal Court and provides for the assessment of a filing fee against the City of Yakima
for each case, and the City Council hereby directs the City Clerk of the City of Yakima to send
copies of this Resolution to the several committees of the State Legislature which may be con-
cerned with the consideration of the same.

City Manager Smith having submitted a written report on the operation of the Municipal Garbage
service to members of the Council, this matter was discussed. No formal action was taken.
Manager Smith reminded members of the Council that February 9, 1961 is Boy Scouts Civic Day and
requested members of the Council to attend ceremonies to be held at 10 o'clock A.M. on this date.
There being no further business to come before the Council, it was MOVED by Maxwell, seconded by
Oliver that we do now adjourn at the hour of 4:35 P.M: carried, Barber, Keith, Larson, Oliver a
Robinson voting aye by voice vote.
