Councilmen Maxwell and Robinson absent and excused. Councilman Keith gate the invocation. The minutes of the regular meeting of January 11, 1961 were approved as corrected. In accordance with action taken by the City Council at their regular meeting of January 11, 1961, it was MOVED by Barber, seconded by Larson that Resolution No. D -216 affirming the action of the City Planning Co mnission in denying the application of John G. Swanson and L. F. Sainsbury to rezone certain property located at 801 -807 South 36th Avenue, be passed as read: carried, Barber, Bostic, Keith, Larson and Oliver voting aye on roll call. Maxwell and Robinson absent. RESOLUTION NO. D -216, A RESOLUTION affirming the action of the City Planning Commission in denying the application of John G. Swanson and L. F. Sainsbury to rezone Lots 15 and 19 of West - view Addition from R -2, Two Family Residential, to R -3, Multiple Family Residential.' WHEREAS, after proper petition and due notice, a hearing was held before the City Planning Commission on December 6, 1960, upon the petition of John G. Swanson and L. F. Sainsbury to rezone Lots 15 and 19 of Westview Addition from R -2, Two Family Residential, to R -3 Multiple Family Residential, and WHEREAS, on December 7, 1960 said City Planning Commission by letter noti- fied the City Council of the City of Yakima of the denial of said petition by said City Planning Commission, and WHEREAS, thereafter on December 15, 1960, the said John G. Swanson and L. F. Sainsbury, together with their respective spouses, appealed from the denial of said peti= tion to the City Council, and WHEREAS, hearings were held by the City Council on said appeal on January 4, and 11, 1961, and WHEREAS, the City Council finds that the recommendation of the City Plan- ning Commission denying said rezone should be approved upon the grounds that such rezoning is not in accord with good planning and with the Comprehensive Plan of the City of Yakima and that the needs of the City and community do not require such change, now, therefore, BE. IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA** That the action of the City Planning Commission in denying the application of John G. Swanson and L. F. Sainsbury to rezois Lots 15 and 19 of Westview.Addition from R -2, Two Family Residential, to R -3 Multiple Family Residential, is hereby confirmed. ATTEST: J. A. SMITH City. BOSTIC Mayor A petition, being Petition No. 71, having been filed with the City Clerk, January 12, 1961, by Lloyd Hammerstad requesting the rezone of certain property located at 4304 Summitview Avenue from R -1 to B -2 zone, it was MOVED by Barber, seconded by Oliver that said Petition be referred to the City Manager and Planning Commission for study and recommendation: carried, Barber, Bostic Keith Larson and Oliver voting aye by voice vote. Maxwell and Robinson absent. A petition, being Petit on No. 72, having been filed with the City Clerk on January 16, .1961 by by Oscar Larson requesting the rezoneof certain property located at the corner of Lenox Avenue and Ledwich AvenVie from R -2 to M -2 zone, it was MOVED by Larson, seconded by Barber that said petition be referred to the City Manager and the Planning Commission for study and recommendation: carried, Barber, Bostic, Keith, Larson'and Oliver voting aye by voice vote. Maxwell and Robinson absent. A petition, being Petition No. 73, having been filed with the City Clerk on January 17, 1961 by A. R. Kern requesting the formation of a local improvement district for the construction of curb, gutter and surfacing of the West half of North 35th Avenue from Lincoln Avenue North 755 feet, it was MOVED by Barber, seconded by Keith that said petition be referred to the City Manager for further action: carried, Barber, Bostic, Keith, Larson and Oliver voting aye on roll call. Maxwell and Robinson. A local improvement district having been created by Ordinance No. B -22861 being..L.I.D. No. 869, being, the Lenox Avenue Industrial Area Domestic Water System and Manager Smith ovising that no work has been dore by the staff in this and that the Petitioner for this improvement, Mr. Oscar Larson is making certain changes in his plans for this area and adding property to said district, it was MOVED by Larson, seconded by Keith that Ordinance No. 205 dissolving L.I.D. No. 869, be passed as read: carried, Barber, Bostic, Keith, Larson and Oliver voting aye on roll call. Maxwell and Robinson absent. ORDINANCE NO. 205, AN ORDINANCE repealing Ordinance No. B -2286 and dissolving Local Improvement District No. 869. Moved by Larson, seconded by Oliver that Resolution No. D -217 authorizing the City Manager to execute a Project Application to the Federal Aviation Agency requesting federal aid in expanding the Aircraft parking and improving the lighting for aircraft parking apron at the Yakima Municipal Airport, be passed as read: carried, Barber, Bostic, Keith, Larson, and Oliver voting aye on roll call. j RESOLUTION NO. D -2179 A RESOLUTION authorizing the City Manager to execute a Project Application to the Federal Aviation Agency requesting federal aid in certain airport improvements. WHEREAS; the 1961 Budget of the City of Yakima made provision for certain improvements in expanding aircraft parking apron and lighting for aircraft parking apron, and WHEREAS, it is anticipated that a portion of the costs for said improve- ments will be borne by the Federal Aviation Agency, and 11 \ 1 '1 I 1 i 1 r�] 1 115 JANUARY 181 1961 WHEREAS, in order to obtain such federal aid it is necessary execute a Project Application to said Federal Aviation Agency, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager of the City of Yakima is hereby authorized and di- rected to execute on behalf of.said City a Project Applicantion requesting federal aid from the Federal Aviation Agency in connection with the improvement of the Yakima Municipal Airport by expanding the aircraft parking apron and lighting for aircraft parking apron. D -2182 A RESOLUTION authorizing the purchase of law books without calling for bidsl. WHEREAS,there is a need in the Legal Department of the City of Yakima for the purchase of a set of American Law Reports Annotated, lat and 2nd Series, together with the Digest and Indexes thereto,.and WHEREAS, the purchase price of said set of books new would amount to approximately $2,500.00, and WHEREAS, there has been located through Bancroft Whitney Company aset of books which, although used, is in almost new condition, and WHEREAS, the City Council finds that it is in the best interests of the people of the City of Yakima to purchase said set of books for the Legal Department without calling for bids, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the Purchasing Agent of the City of Yakima is hereby authorized to purchase a used set of American Law Reports Annotated, 1st and 2nd Series, together with the Digest and Indexes thereto, through Bancroft Whitney Company at.a price of not to exceed $1,800.0( without calling for bids. BOSTIC Mayor City Manager Smith read a letter. from Northwest Airlines stating -that due'to the extent.ion of the flight engineers current strike to include all of Northwest Airlines equipment., they have been forced to discontinue all domestic service and further stating that service to Yakima will not be restored until after a settlement has been reached. Said letter requested relief from payment of landing fees for January 1961 as set forth in a lease now in force and effect with the City of Yakima. Manager Smith explained that said Airlines had four scheduled flights out of the Airport on January 1, 1961 and that under the terms of.the present lease these flights plus the extra weight charges would result in a payment due the City of, W8.00 for the month of January and that if the city discounted the 108.00 due them for flights from January 1 through January 8, the net amount of landing fees to be waived for the remainder of January, 1961,, would be $280.00. Manager Smith recommending that the Northwest Airlines be excused from paying any landing fees after January 8, 1961 and for the balance of January; that said Airlines pay the Cit; for the number of scheduled flights in effect on January 19 1961 through January 8, 1961; and that, should the existing strike extend beyond.January, 1961, said Airlines commence paying landing fees based on the number and type of scheduled flights as of January 1, 1961, said landinj fees to be based on the number of actual days remaining in the month, it was MOVED by Keith, seconded by Larson that said payment to be made by the Northwest Airlines be made on a prorated basis in accordance with the City Managerls recommendation: carried, Barber, Bostic, Keith, Larson and Oliver voting aye on roll call. Maxwell and Robinson absent. Manager Smith informed the City Courril that the Viewmont Well as purchased January 132 1961 by the City of Yakima from Mr. Elo n Gilbert, will be tested as soon as possible -and the test should be completed the lst week in February. The City Council was informed that the City of Yakima has been selected as the place to hold the National Security Seminar in connection with Civil Defense activities, and that Mr. Furness has requested the City of Yakima to act as host for the seminar on March 92 1961 at the Chinook Hotel, MOVED by Barber, seconded by Larson that the City of Yakima act as host for this Seminar on said date: carried, Barber, Bostic, Keith, Larson and Oliver voting aye on roll.call.
