The invocation was given by George Oliver. Minutes of the regular meeting of December 14, 1960 were approved as corrected. In accordance with , action taken by the City Council at their regular meeting of December 14, 1960, it was MOVED by Larson, seconded by Coombs that Ordinance No. 195 accepting the recommendation'of the Planning Commission for the rezone of certain property located at 303 North 1st Street from B- 2,Local Business Zone, to B -3, General Business zone, be passed as read: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 195, AN ORDINANCE accepting the recommendation of the Planning Commission for the rezone of certain property located at 303 North First Street in the City of Yakima, Washington. Also in accordance with action taken by the City Council at their regular meeting of December 14, 1960, it was MOVED by Larson, seconded by Coombs that Ordinance No. 196, accepting the recommenda. tion of the Planning Commission for the rezone of property located at 1107 West Chestnut and 16 South 11th Avenue from R -3 Multiple Housing Zone to B -1 Modified Business zone, be passed as read; carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 1962 AN ORDINANCE accepting the recommendation of the Planning Commission for the rezone of that certain property located at 1107 West Chestnut and.16 South 11th Avenue, the the City of Yakima, Washington. An appeal from the decision of the Planning Commission having been duly filed by L. F. Sainsbury and others in connection with Petition No. 66 which requested the rezone of certain property located in t he 800 Block on South 36th Avenue from R -2 to R -3, it was MOVED by Barber, seconded by Oliver that notice of hearing by the City Council be given for the hour of 3o ' clock P.M. on the 4th day of January, 1960: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and'Robins voting aye by voice vote. An ordinance appropriating the sum of $3,000.00 from the unappropriated funds in the Current Expense Fund to the 35,000.00 General Obligation Airport Bond Redemption Fund having been read in it's entirety by the Clerk of the Council, was ordered laid on the table for one week, and is to be read and considered at the next regular meeting of the City Coucil on December 28, 1960. Moved by Coombs, seconded by Oliver that Ordinance No. 197 amending Section 1 of Ordinance No.. 2 fixing the salary of the City Manager 'at $14,000.00 and providing further that the moving expense of the newly appointed City Manager, Mr. George D. Smith, be paid in a sum not to exceed 500.009 be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 197, AN ORDINANCE amending Section 1 of Ordinance No. 2 of the City of Yakima entitled, "AN ORDINANCE fixing the salary and bond of the City Manager and declaring an emergency, and declaring an emergency. (Moved by Oliver, second ed by Robinson that Ordinance No. 198 transferring $406.18 in the Current Expense 1960 Budget and $575.00 in the Irrigation 1960 Budget, be passed as read: carried, Barbe Bostic, Burns,-'Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 198, AN.ORDINANCE transferring moneys within the 1960 appropriation for 11 -City Manager, and 51 - Irrigation Department, and declaring an emergency. Moved by Larson, seconded by Coombs that Ordinance No. 199 fixing the time of delinquency and prescribing the form of bonds for L.I.D. No. 8?3, be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 1992 AN ORDINANCE fixing the time of delinquency of installments of assessments levied for the payment of the cost of the improvement in Local Improvement District No. 873, and providing for the, issuance of bonds with cougD-ons attached for the payment of the unpaid portion thereof. Moved by Oliver, seconded by Robinson that Resolution No. D -205 authorizing the rebuilding and realigning of the Gallion-Road Roller Wheels with but calling for bids, be passed as read: carrie Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call.' RESOLUTION NO. D -205, A RESOLUTION authorizing the rebuilding and realigning of Gallion Road Roller Wheels without calling for bids. WHEREAS, it is necessary to rebuild and realign the wheels of a Gallion Road Roller owned by the City of Yakima, and the furls therefor are available in the 1960 appropriation for the Street Department, and WHEREAS, it is necessary to detain such rebuilding and realigning as soon as possible, and WHEREAS, the Central Steel and Tank Company of Yakima, Washington is the only concern in the area equipped to do this work, and the price quoted by said company is fair and in line with similar work done for the City, and is would serve no purpose to advertise for bids for the same, and the City Council finds that it is in the best interest of the people of the City,of Yakima to have said company perform said work without calling for bids, now, therefo BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the Purchasing Agent of the City of Yakima is hereby authorized and directed to secure the rebuilding and realigning of the wheels of the Gallion Road Roller by Central Steel and Tank Company of Yakima, Washington without calling for bids, it being stipulat- ed that the cost of the sarrie will not exceed $900.00 including sales tax. BOSTIC Mayor F, 10 DECEMBER 21, 1960 Moved by Barber, seconded by Robinson that Ordinance No. 200 amending sub - section 1 of Section 14 of Ordinance No. 65 providing for licensing and certain other regulations for public dances a cabarets and further providing that when December 31 shall fall on a Saturday, public dances and dancing in cabarets and all music therein shall be permitted until 2:00 A.M. the following morn- ing, be pass ed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 2)0, AN ORDINANCE amending Sub - section 1 of Section 14 of Ordinance No. 65 entitled "AN ORDINANCE providing for the raising of revenues; licensing public dance halls and cabarets; requiring a permit for public dances and cabarets; regulating public dance halls and cabarets; providing for revocation of licenses and permits issued; providing a penalty for the violation thereof; repealing Ordinanc e A -824 and Ordinance A -243 and all other Ordinances and parts of Ordinances in conflict therewith and declaring an emergency," as amended by Ordinance No. B -2067, and declaring an emergency. In accordance with the request of the City Council on December 7, 1960, Manager Smith filed a written report prior to this meeting with members of the City Council under file No. MC4 making recommendations regarding bills to be introduced by individual cities or the Association of Washington Cities at the 1961 °legislative session. His report on this date further explained said report. ' Councilwoman-Coombs announced that she finds it necessary to re.sign from the City Council due to limitations on officers as set forth in the City Charter and the status of the Airport Fixed Base Operatorls Lease of the West Air Company, said company being owned and operated by her husband, Bruce A. Coombs. She read her statement of resignation and handed copies of said statement to the press. Expressing regret and explaining that all possibilities to retain Mrs. Coombs on the Council had been explored, it was MOVED by Robinson, seconded by Barber that said resignationll be accepted: 'carried, Barber, Bostic, Burns, Larson, Oliver and Robinson voting aye by voice vote. Mayor Bostic expressing deep regret lead members of the Council in a standing tribute to Mrs. Coombs for her splended work on the Council. In accordance -with the City Charter, it was MOVED by Larson, seconded by Barber that J. Lex Maxwell be elected to fill the vacancy-. on the City Council created by the resignation of Mrs. C'Ceal Coombs, said appointee to hold office until the next regular municipal election:,.carried, Barber, Bostic, Burns, Larson, Oliver and Robinson voting aye by voice vote. Mayor Bostic in- formed the Council that Mr. Maxwell would take his oath of office at-the hour of 4 o'clock P.M. on_.this --date, .and. that Judge-:Dolph Barnett 'w.ould' officiate: on" this occassion. There being no further business to come before the Council it was MOVED by Oliver, seconded by Barber that we, do now adjourn at the hour of 4 o'clock P.M.: carried, Barber, Bostic, Burns, Larson, Oliver and Robinson voting aye on roll call.
