HomeMy WebLinkAbout12/14/1960 Business MeetingP 0 0 DECEMBER 14, 1960 The City Council met in regular session, Mayor Bostic, Councilmen Barber, Burns, Coombs, Larson, Oliver and Robinson, City Manager Smith and City Attorney Arntson present on roll call. The invocation was given by Councilman Coombs. The minutes of the regular meeting of December _7, 1960 were approved as read. In accordance with action taken by the City Council at their regular meeting of December 7, 19600 it was MOVED by Larson, seconded by Barber that Resolution. No. D -203 requesting the Legislature of the State of Washington to enact prohibiting the sale and use of fireworks throught the State except for authorized public display under proper supervision, be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. RESOLUTION NO. D -203, A RESOLUTION requesting the Legislature of the State of Washington to ban certain fireworks. WHEREAS, the unrestricted use of firecrackers, torpedoes, rockets, and other forms of fireworks materially increases the danger of fire, causes personal harm, and generally disturbs the peace, and WHEREAS, many of the counties and municipalities of the State of Washingt including the City of Yakima, have banned the sale and use of fireworks, and WHEREAS, a few communities in the State of Washington have allowed the unrestricted sale-and -use of such fireworks, and the same are brought into areas where the use is prohibited and create extremely difficult problems in law enforcement, and WHEREAS, it is the understanding of the City Council that a bill will be submitted to the 1961 Session of the Washington State Legislature which will limit the sale and use of fireworks to authorized public displays under proper supervision, and WHEREAS, the City Council believes and finds that such legislation is necessary for the - public peace, health, welfare, and safety of the people of the City of Yakima, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the City of Yakima hereby joins the other communities of the State of Washington in a drive to outlaw the unauthorized and unrestricted use of fire- works and appeals to those ^.few communities wo do allow the unrestricted sale and use of fireworks to ban the sale thereof. Section 2. That the City of Yakima hereby joins the other communities of the State of Washington in respectfully requesting the Legislature to enact legislation pro- hibiting the sale and use of fireworks througheut the State, except for authorized public dis- plays under proper supervision. Mayor A petition, being Petition No.,67, having been filed with the City Clerk by Robert L. Alderson and others on the 9th day of December, said petition praying for the annexation of certain property located between 14th and 15th Avenues, North of Fruityale Boulevard, it was MOVED by Coombs, seconded by Robinson that said peition be referred to the City Manager and the Planning Commission for study and recommendation: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. An ordinance establishing a classification and compensation plan for city employees other than Fire and Police, was read by the Clerk of the Council. After discussion and explanation by the Personel Director, it was MOVED by Coombs, seconded by Barber that said ordinance be.passed as read: Barber, Bostic, Coombs, Larson,Oliver and Robinson voted aye on roll call. Burns voted nay. City Attorney Arntson reminding the Council that an emergency ordinance must have a unanimous vote in favor for passage, Mayor Bostic declared said ordinance lost. Councilman Burns then gave his reasons for voting against said - ordinance stating that he felt more study and consideration should be given to the matter; that this matter is not an emergency as stated in the ordinance and that there is too much differency in the step plan for laborers as compared with the step plan for monthly salaries. The Council wishing to have the classification and compensation plan in effect in 1961, and it having been determined that no material hardship or wrong would be done if an ordinance establish• ing said plan were passed to become effective February 1, 1961, since the Budget Ordinance, being Ordinance No. 175, is the controlling law on salaries, it was MOVED by Robinson, seconded by Oliver that the ordinance,as read by the Clerk of the Council, be amended, striking the emergency clause in the title and correcting Section 13, making said ordinance effective 30 days after its final passage, approval and publication and in all sections where - necessary correct the effective date to February 1, 1961: carried, Barber, Bostic, Coombs, Larson, Oliver and Robinson voting aye by voice-.vote. Burns not voting. MOVED by Coombs, seconded by Larson that Ordinance No. 194 establishing a classification and compensation plan for all employees of the City of Yal4ima except the Firemen and Policemen, be passed as amended: carried, Barber, Bostic, Coombs, Larson, Oliver and Robinson voting aye on roll call. Burns voting Nay. ORDINANCE NO. 194, AN ORDINANCE establishing classification and.compensation plan for all employees of the City of Yakima, except Firemen and Policemen, and repealing Ordinance No. 79 and all resolutions, ordinances or parts of ordinances in conflict herewith. Moved by Barber, seco nded.by Oliver that Resolution No. D -204, transferring $475.00 within the 1960 Budget for the Municipal Garbage, be passed as read: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. RESOLUTION NO. D- 2040 A RESOLUTION transferring funds within the Maintenance & Operation Classification of the 1960 appropriation for 32 - Municipal Garbage. WHEREAS, surpluses exist in Accounts 7 -32, Janitorial; 7 -46, Equipment Parts & Repair, Etc.; 7 -52, Dues - Associations; 7 -53 Subscriptions;; and in Account 7 -57, Telephone 1 1 1 Y_ 11- 1 1 1 1 iH- SEE 10i DECEMBER 14, 1960 & Telegraph, of-the Maintenance and Operation classification of the 1960 appropriation for 32 - Municipal Garbage, and I _ WHEREAS, at .the time of the' adoption of the 1960 Budget insufficient moneys were appropriated'in Accounts 7 -60, Taxes - State, and 7 -61, Taxes -City, of the Maintenance & Operation classification for 32 - Municipal Garbage, and WHEREAS, the .City Council finds it is in the best intersts of the people of the City of Yakima to make the' aforesaid transfers,. and the action contemplated herein is authorized by R. C.W. 35.33.120, now, therefore, BE ;'IT RESOLVED BY THE CITY COUNCIL OF THE CITY., OF YAKIMA': Sectio n.1. Spratt requesting the rezone of certain property at 303 and 305 North 1st Street from B -2 to B -3, and the Planning Commission having submitted a written report recommending that said rezone application be approvec it was MOVED by Barber, seconded by Burns that said report be accepted and the City Attorney be and is hereby instructed to prepare the ordinance rezoning said property in accordance with said request: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote. A petition being Petition No.•64;whaving been duly filed by M. E. Stone requesting the rezone of certain property located on the east side of the 600 block of'North 5th Avenue and.the Planning Commission having submitted a written report recommending that this request be denied because if granited, would create a Gene ral'Business island in the middle of'an R -3 residential zone and en- courage strip or spot zoning in this area, it was MOVED by Oliver, seconded by Larson that said report be accepted and filed:' carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote. A petition, being Petition No. 65 having been duly filed by Theresia M. Gilkey and others, re- questing the rezone of certain property located at 16 South 11th Avenue and 15 South 12th Avenue, and the Planning Commission havip filed a wri -tten report recommending that said application be approved, it was MOVED by Barber,.seconded . by Larson that.said report be accepted and the City, Attorney.be and is hereby instructed to prepare the necessary Iordinance rezoning said property,, from`R -3•to B -1 for the next regular meeting of the City Council on December 21, 1960: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and'Robinson voting aye by voice vote. Petition No. ,66 having been duly filed by John G. Swanson and others requesting the rezone of certain property located at 801 -80.7 South 36th Ave.; and the Planning Commission having filed a written report recommending that said application be denied, it was MOVED by Robinson, seconded by Coombs,that said report be received and filed: carried,. Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote., Mr. Sainsbury, a property owner and petitioner.on Petition No. 66, being present, was instructed by;the City Attorney that if he wished to carry this matter further, he must file, an appeal from the decision of the Planning Commission with the City Clerk not later than December 21, 1960.- The City Engineer having filed the assessment roll for and reporting the completion of L.I.D.-No. 886, being the Edgewood Sewer'District,'it.was.MOVED by Oliver, seconded by Coombs that the City Clerk be and is hereby instructed to give zmotice of hearing on said assessment roll.f or January 4, 1961 at the hour of 3 o'clock P.M. to each property owner and "by publication as required by statute: carried, Barber, Bostic; Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote. The City Engineer having filed the assessment roll and reported the completion of L.T.D. No. 888, being the Parkview Terrace Sanitary Sewer District, it was MOVED by Oliver, seconded by Coombs,. that said report be accepted and the City Clerk be'and is hereby instructed to give notice of hearing on said assessment roll to each property onier*'and by publication.as required-by statute, for 'January 49 1961 at the hour of 3.o 1clock P.M.: carried, Barber, Burns, Coombs,.Larson, Oliver and Robinson voting aye by voice vote. The Planning Commission having filed a.written report on action taken on the "Webber Addition No. 1" plat, said ,report was acknowledged by members of ., the City Council, but no formal action was taken on the matter. The Planning Director having filed, with members of the Council, a memo report on the Proposed Major Arterial Revision development for the City ,of Yakima., it was .MOVED by Barber, seconded by Robinson that said report,.be referred to the City Manager for study and recommendation: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote. City Engineer Mayo reported on the progress of the by -pass highway and recommended that our Major Street Plan be.ammended to co- ordinate our plans more closely with the State and County Systems. - ADDITION as ordered by the City Council 12/21/60) F, 102 DECEMBER 14, 1960 Manager Smith reported on the proceedures and costs of taking care of our streets during the icy weather. There being no further business to come before the Council, it was MOVED by Barber, seconded by Oliver that we do now adjourn at the hour of 5 :10 P.M.: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote. ATTEST: FA I M A Y 0 R The following-information was inadvertently omitted from the minutes of 12/11/60 and ordered corrected at the regular meeting of 12/21/60. Manager Smith read a letter from John S. Moore, Jr. Chairman of the Yakima County Planning Commission, said letter directed to the Yakima City Planning Commission, stating that the County Planning Commission has developed a proposed land use and arterial plan for the area ifinediately adjacent to the City of Yakima and requesting an opportunity to meet jointly with the City Planning Commission to discuss the various ramifications of the problem in view of the recent development concerning the Major Arterial Plan for the City.
