Councilmen Barber, Burns, Coombs, Larson, Oliver and Robinson City Manager Allison and City Attorney Arntson present on roll call. Mayor Bostic absent. The invocation was given by Councilman Burns. The minutes of,the regular meeting of September 28 and the special meeting of October 3, 1960 were approved as read. Ordinances No. 164 through No. 172 as prepared by Preston Thorgrimso n & Horowitz, Attorneys at Law, Northern Life Tower, Seattle, Washington, said ordinance covering the nine (9) proposed City of Yakima General Obligation Bond issues to be submitted to'the qualified electors of the City of Yakima at a special election on November 8, 1960, were passed by the City Council on this date as follows: An ordinance providing for the submission of the matter of °whether or not the city should issue general obligation bonds in the amount of $1,950,000 for the purpose of acquiring certain rights of way, to improve certain arterial and other streets, to install certain storm sewers and to aco.uire construction equipment, to the qualified electors of the City at a special electio on November 81 1960, having been read by the Clerk of the Council, it was MOVED by Robinson, seconded by Oliver that page one (1) be amended to include "repaving" as a part of the improve- ment program: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye -on roll call. ORDINANCE NO. .164, AN ORDINANCE of the City Council of the City of Yakima, Washington, providing for the submission to the qualified electors of the city at a special election to be held therein on November 8, 1960, of a proposition of whether or not the city should issue its unlimited tax levy general obligation bonds in the principal sum of $1,950,000, for the purpose of providing funds to acquire certain rights of way, to improve certain arterial and other streets throughbut the city, to install certain storm sewers, and to acquire construction equipment, and declaring an emergency. Moved by Larson, seconded by Barber that Ordinance No. 165 providing for the submission of the matter of whether or not the city should issue general obligation bonds in the amount of $1,140,000 for the purpose of constructing a four -lane railroad overpass on Lenox Avenue, to the qualified voters of the city at a special election on November 8, 1960, be passed as read: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. Bostic abse ORDINANCE NO. 1 65, AN ORDINANCE of the City Council of the City of Yakima, Washington, providing. for the submission to the qualified electors of the city at a special election to be held therein on November 8, 1960, of a proposition of whether or not the city should issue its unlimited tax levy general obligation bonds in the principal sum of $1,140,000 for the purpose of providing funds to construct a railroad overpass on Lenox Avenue with necessary approaches and to acquire and install traffic signals, and declaring an emergency. Moved by Barber, seconded by Robinson that Ordinance No. 166 providing for the submission of the matter of whether or not the city should issue General Obligation Bonds in the amount of $176,000 for the purpose of acquiring land west of Tahoma Cemetery to develop and improve said cemetery, to the qualified voters of the city at a special election on November 8, 1960, be passed as read: carried, .Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. Bostic absen ORDINANCE NO. 166, AN ORDINANCE of the City Council of the City of Yakima, Washington, providing for the submission to the qualified electors of the city at a special election to be held therein on November 8, 1960, of a proposition of whether or not the city should issue its unlimited tax levy general obligation bonds in the principal sum of $176,000 for the purpose of providing funds to acquire land west of Tahoma Cemetery, to develop the same for cemetery purposes, and to make capital improvements to said cemetery, and declaring an emergency. Moved by Robinson, seconded by Larson that Ordinance No. 167 providing for the submission of the matter of whether or not the city should issue general obligation bonds in the amount of- $162,000 for the purpose of constructing a new fire station and equipng said station, to the qualified voters of the city at a special election on November 8, 1960, be passed as read: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 168, AN ORDINANCE of the City Council of the City, of Yakima, Washington, providing for the submission to the qualified electors of the city at a special election to be held therein on November 8, 1960, of a proposition of whether or not the city should issue its unlimited tax levy general obligation bo nds in the principal sum of $158,000 for the purpose of providing, funds to construct a sanitary trunk sewer with all necessary appurtenances on certain streets, county roads and easements now'owned or to be acquired, and declaring an emergency. ORDINANCE NO. 1702 AN ORDINANCE of the City Council of the City of Yakima, Washington, providing for the submission to the qualified electors' of the city at a special election to be held there- in on November 8, 1960, of a proposition of whether or not the city should issue its unlimited tax levy general obligation bonds in the principal sum of $70,000, for the purpose of providing funds to acquire and install traffic signals with necessary accessories at certain street inter- sections within the city, and declaring an emergency. ORDINANCE NO. 172, AN ORDINANCE of the City Council of the City of Yakima, Washington, providing for the submission to the qualified electors of the city at a special election to be held there- in on November 8, 1960, of a proposition of whether or not the city should issue its unlimited tax levy general obligation bonds in the principal sum of $42,000 for the purpose of providing funds to reconstruct portions of the present City-Hall, acquire office machines, and acquire and install air conditioning equipment throughout the City Hall, and declaring an emergency. A petition, being Petition'No. 61, having been filed with the Planning Director by L. F. Sainsbury and wife, requesting the rezone of certain property situated on the Southwest corner of the intersection of Tieton Drive and South,35th Avenue, and the Planning Commission having considered this matter at a public hearing held on October 4, 1960 and recommending that said petition be approved, it was MOVED by Oliver, seconded by Burns that said Petition No. 61 and the report of the Planning Commission be accepted and the City Manager be and is hereby instructed to prepare the necessary ordinance accepting the Planning Commissionts decision: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. In accordance with action taken by the City Council at their regular meeting on September 28, 196 it was MOVED by Barber, seconded by Robinson that Ordinance No. 173 accepting the revised recommendation of the Planning Commission for the rezone of certain property lying west of South 11th Avenue between Spruce and Division Streets, as requested by George T. Corbett and-others on Petition No. 59, be passed as read: carried, Barber, Coombs, Larson, Oliver and Robinson voting aye on roll call. Councilman Burns not voting as he lives near the area to be rezoned. Bostic absent. ORDINANCE N0. 173, AN ORDINANCE accepting the revised recommendation of the Planning Commission for certain property lying West of South 11th Avenue, between Spruce and Division Streets, in the City of Yakirna, .Washington, and declaring an emergency. An ordinance appropriating the sum of $3,000.00 from the unappropriated moneys in the Water -Sewer Fund to the 1960 Budget of said fund was read in its entirety by the Clerk of the Council and ordered laid on the table for one week to be considered at the next regular meeting of the.City Council on the 12th day of October, 1960. Moved by Barber, seconded by Larson that Ordinance No. 174 transferring the sum of $8,304.42 within the 1960 Sewer Maintenance Budget, be passed as read: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 174, AN ORDINANCE transferring the sum of $8,304.32 within the 1960 appropriation for 53 - Sewer Maintenance, and declaring an emergency. In accordance with action taken by the City Council on October 3, 1960, an ordinance adopting the 1961 budget as prepared and filed with the City Clerk, was read by the Clerk of the Council. Councilman Burns protesting the 1961 Budget and Bond Program and wishing to vote against said budget ordinance, other members of the Council.requested that the City Attorney advise as to whether or not a unanimous, vote of approval is necessary for the adoption of said ordinance. The City Attorney needing time for research, it was MOVED by Barber, seconded by Larson that the Council proceed with other business on the agenda: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye.by voice vote. The City of Yakima having become the owner of certain property described as the East Half of Lot 10, Edwards Addition through. a Local Improvement -District Assessment foreclosure, it was MOVED by Robinson, seconded by Oliver that Resolution No. D -181 authorizing the Mayor, City Manager and City Clerk to execute a contract for the sale of said property, be passed as read: carried, Barber, Burnsp Coombs, Larson, Oliver and Robinson voting aye on roll call. r 76 OCTOBER 5, 1960 RESOLUTION NO. D -181, A RESOLUTION authorizing the Mayor, City Manager and.Gity Clerk to execute a contract for the sale of certain land owned by the City of Yakima under Local Improve(I"ent District assessment foreclosure. WHEREAS, the City of Yakima owns the following described real property situate in the City of Yakima, Yakima County, State of Washington, to -wit: The East Half of Lot 10 Edwards Addition, according to the plat thereof recorded in Volume "J" of Plats, Page 6, records of Yakima County, Washington; . having taken title to the same under Local Improvement District assessment foreclosure proceeding in accordance with the statutes and laws of the State of Washington, and WHEREAS, Gary Germunson is desirous of purchasing said property upon certain terms and conditions as contained in the Land Contract hereto attached and by this reference made•a part hereof, and the City of Yakima is willing to sell the same to the said Gary Germunson upon said terms and conditions, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL'OF THE CITY OF YAK IMA: Section 1. Moved by Oliver, seconded by Barber that Resolution No. D -182 authorizing the City Manager and City Clerk to execute an agreement on behalf of the City of Yakima with the Yakima Valley Canal Company, said agreement granting permission to the city to cross the Yakima Valley Canal Companyt right -of -way with a 12 inch domestic water main at 40th Avenue between Summitview and Chestnut, be passed as read: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. RESOLUTION NO. D -182, A RESOLUTION authorizing the City Manager and the City Clerk to execute an Agreement on the behalf of the City with Yakima Valley Canal Company. WHEREAS, it is necessary for the City of Yakima to cross the right-of-way of the Yakima Valley Canal Co. for the construction of a 12 -inch domestic water main at 40th Avenue, between Summitview and Chestnut, in the City of Yakima, and WHEREAS, in order to effect such crossing it is necessary that the Gity enter into an Agreement.with said Yakima Valley Canal Co. to secure such permission and to in- demnify the said canal company against all damage and liability, now, therefore, BE IT RESOLVED BY THE CI'T'Y COUNCIL OF THE CITY OF YAKIMA : That the City Manager and the City Clerk of the City of Yakima are here- by authorized and directed to execute on behalf of said City an agreement.with the Yakima Valley Canal-Co., a copy of which is hereto attached and by this reference made a part hereof, and by which the said canal company grants permission to the City to cross its right -of -way with a 12- inch domestic water main at 40th. Manager Allison reported that a test is being run on the Kiwanis well and at this time it is pumping 1700 gallons of water pr minute Assistant Mayor Coombs remided the Council of the meeting of the Yakima Development Committee on Monday the 10th day of October, 1960 and the meeting of the District Legislative;,,..Cornmittee on the 11th day of October, 1960 and urged all members of the Council to attend both meetinge. Councilman Robinson asked to.- be-:excused,fro.m the next regular meeting of the City Council to ,be. held on the 12th day of October, 1960. TETis,.requestwas granted.
