HomeMy WebLinkAbout06/29/1960 Business MeetingF, 40 JUNE 29p 1960 The City Council met in regular session, Mayor Bostic, Councilmen Barber, Burns, Coombs, Larson and Robinson, City Manager Allison and City Attorney Arntson present on roll call,, Councilman Oliver absent until the hour of 3 :40 P.M. Councilman Larson gave the invocation. Minutes of the regular meeting of June 22nd, 196.0 were approved as read. This being the time fixed by the City Council for the hearing on Resolution No. D -144, being a Resolution of intention to improve certain property by the construction of concrete curbs and gutters and, surfacing of certain streets and alleys as requested by Petition No. 49 -a and 52 and there being written protests filed with the City Clerk and persons present protesting the paving of the alley in Block 374 in Capitol Addition, as requested by petition No. 52, all persons were heard on this matter. Manager Allison reporting that the protest filed in writing amount to 67/, it was MOVED by Burns, seconded by Barber that the paving of the Alley in Block 374 in Capitol Addition be deleted from the proposned Local Improvement District and Ordinance No. 132 - providing for curb, gutters and surfci.ng of Arlirg ton Street .and the West Half of 36th Avenue and creating L.I.D. No. 887, be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson and Robinson voting aye on roll call. Oliver absent. ORDINANCE NO. 132, AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features; establishing a Local Improvement District, providing for the method of paymmnt thereof, and creating a special fund.' This being the time for the hearing on Resolution No. D -143, being a resolution of intention to improve certain property by the construction of pipe sewers as requested by Petition No. 48 aril there being no protests in writing or otherwise, it was MOVED by Barber, seconded by Coombs that Ordinance No. 133 providing for said improvement and creating L.I.D. No. 888, be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson and Robinson voting aye on roll call. Oliver absent. ORDINANCE NO. 133, AN ORDINANCE providing for the improvement of certain property by construct- ing a pipe sewer frith the necessary wye branches and manholes; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. This being.the time for the hearing on Resolution No. D -142, being a resolution of intention. to improve certain property by the construction of a domestic water system as requested by petitions No. 42 and 49 and there being no protests in writing or otherwise, it was MOVED by Robinson, secorAed by Larson that Ordinance No. 134 providing for said improvement and creating L.I.D. No. 889, be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson and Robinson voting aye on roll call. Oliver absent. ORDINANCE NO. 134, AN ORDINANCE providing for the improvement of certain property by constructs the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use and fire protection; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. Coucnilman Oliver present for the balance of this meeting. An ordinance appropriating the sum of $3,960.00 from the Water -Sewer Fund to L.I.D. No. 880, said amount being the pre- payment made. on February 10, 1958, by the Holiday Motels, Inc. for the installation of certain water and sewer lines to serve certain property contiguous to the;: City of Yakima under a certain agreement stating that said payment should be credited on any future local improvement assessments, was read in its entirety and ordered laid on the table for one week to be read and considered at the next regular meeting of the City Council to be held on the 6th day of July, 1960. In accordance with action taken by the City Council and the recommendation of the City Manager made at a regular meeting on June 22, 1960, it was MOVED by Burns, seconded by Larson that Ordinance No. 135 amending Ordinance No. B -2192 and increasing connection charges for water and sewer hook -ups when made to serve property outside of the city limits, be passed as read: carried, Barber, Bostic, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 135, AN ORDINANCE amending Section 2 of Ordinance No. B -2192 entitled "AN ORDINANCE relating to the municipal water and sewerage systems and providing for an alternative procedure for extension, expansion and addition of said water and sewerage systems, and providing for the method of financeing thereof, and repealing Ordinance No.. B -1922, and Sections 11 f and 11 m of Ordinance No. B -606 as amended by Ordinance No. B- 1462" and declaring an emergency. Moved by Larson, seconded by Coombs that Ordinance No. 136 transferring $2,505 within the 1960 Budget for Tahoma Cemetery, be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 136, AN ORDINANCE transferring the sum of. $2,505.00 within the 1960 appropriation for 41 - Cemetery. Moved by Robinson,seconded by Oliver that Ordinance No. 137 transferring the sum of $4,500.00 in the Water and $14,990.00 within the Sewer Maintenance Budgets for 1960, be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. AN ORDITA NCE transferring the sum of $4,500.00 within the 1960 appropriation for 52 - Water, and the sure of 14,990.00 within the 1960 appropriation for 53 - Sewer Maintenance, and declaring an emergency. Moved by Burns, seconded by Barber that Resolution No. D -153 transferring $1250.00 in the Sewage Treatment Plant Budget for 1960, be.pass,ed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. RESOLUTION NO. D -153, A RESOLUTION transferring the sum of $1,205.00 within the 1960 appropria- tion for 54 - Sewage Treatment Plant. WHEREAS, surplusses exist in Accounts 733 Feld and Non- Office and 7 -38 Dept. Special Mau is of the Maintenance & Operation classification of the 1960 appropriation for 54 - Sewage Treatment Plant, and L C 1 u 1 1 41 JUNE 29, 1960 I%HEREAS, additional money is required in Account 7 -46 Equip. -Fars & Repair of the Maintenance and Operations classification because of the need to paint and clean up equip- ment which could not have been- contemplated at the time of the adoption of the 1960 appropriation for 54 - Sewage Treatment Plant, and WHEREAS, additional funds are needed in Account 7 -67 Insurance, Fire, Theft and Liability of the Maintenance & Operation classification of the 1960 appropriation for 54 Sewage Treatment Plant because of an insurance claim being presented in excess of the funds appropriated, and WHEREAS, the City Council finds it in the best interests of the people of the City of Yakima to make the aforesaid transfers and the action contemplated herein is author- ized by R.C.W.35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. That the following-sums are hereby transferred ,within the 1960 appropriation for 54 - Sewage Treatment Plant,, to -wit: From:, Maintenance & Operation 7-33 Field and Non- Office 7 -36 Dept. RESOLUTION NO. D -154, authorizing the City Manager to dispose of stenotype paper. WHEREAS, the City has on hand 44 rolls of stenotype paper which is of no use to the City, and WHEREAS, such paper was purchased at a cost of $.37 a roll, and it is deemed in the best interests of the people of the City of Yakima to dispose of the same at the highest price obtainable, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager is hereby authorized and directed to sell 44'rolls o stenotype paper for the highest price obtainable, the proceeds therefrom to be placed in tY� Current Expense Fund. BOSTIC May oar �_A'lease with the Federal Aviation Agency covering lease of land for the Engine Generator Site at the Yakima Municipal Airport, expiring on the 30th day of June 1960 and said agency submitting a new lease for approval, it was MOVED by Coombs, seconded by Robinson that Resolution No. D -155 authorizing the execution of said agreement with the United States Government, be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. RESOLUTION NO. D -155, A RESOLUTION authorizing the City Manager and City Clerk of the City of (Yakima to execute(_:a Lease Agreement with the United States of America for certain land at the Yakima Municipal Airport. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and 'City Clerk of the City of Yakima are hereby authorized and directed to enter into a Lease Agreement-with the United States of America for certain land at the Yakima Municipal Airport, to -wit: From the 1/4 corner between Sections 35 and 36 (the intersection of 16th Avenue and Washington Avenue) T.13 N., R. 18 E.W.M., proceed north 89049' west along the center line of Washington Avenue 1838.5 feet, thence south 0011' west 237.30 feet to the point of beginning, thence north 89049' west 35 feet to a point, thence south 0011' west 41.0 feet to a point, thence south 89049' east 35.0 feet to a point, thence north 0011' east 41.0 feet to the point of beginning; containing 1435 square feet, more or less, and lying within the SE4 of Section 35 T. 13 N., R. 18 E.W.M., Yakima County, Washington for the Engine Generator Site, • copy of said Lease being hereto attached and by this reference made a • part hereof. BOSTIC Mayor A petition, being Petition No. 54 having been duly filed by Patrick Roche and Aileen Roche, re- questing the vacation of a certain alley on North lst Avenue and referred to the City Manager for action, and the City Engineer recommending that the City should retain its present right -of- way unless the Roche Fruit Company will replace an eighteen inch irrigation main located in this alley with cast iron pipe and also recommending that no building be allowed over the pipe, it was MOVED by Barber, seconded by Robinson that the City Manager be and is hereby instructed to continue negotiations with Mr. Roche: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver, and Robinson voting aye by voice vote. Manager Allison reporting that the following bids were received by a Bid Board comprised of the Purchasing Agent, City Clerk and City Engineer for the construction of sanitary sewers as pro- vided for in L.I.D 886 and 888 De Blasio Bros. Ray Pickens James C. Russell Traub & Traub Bros. N. L. Kimball L. N. Johnson $ 24,103.04 24,324.30 24,933.50 25,297.50 25,915.50 35,774'.70' and recommending the bid of De Blasio Brothers as the lowest and best bid, it was MOVED by Robinson, seconded by Burns that said bid be awarded to De Blasio Bros and the City Manager be and is hereby authorized to enter:.into,a�contract-:.with said bidder: carried, Barber, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote. Bostic voting nay. A petition having been duly filed April 1, 1960 by William J. Allen and others requesting the installation,of a Railroad Crossing Traffic Light for the control of railroad cars and equipment using the spur crossing at First Street at "H ", said petition further stating that the ringing of bells and the blowing of whistles has created a very undesireable situation since it occurs nightly at approximately 2:00 to 3:00 o'clock a.m. and the City Manager recommending that an ordinance be drawn to cover this situation, it was MOVED by Robinson, seconded by Burns that the City Attorney be and is hereby instructed to prepare said ordinance: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote. There being no further business to come before the City Council, it was MOVED by Barber, seconded by Oliver that we do now adjourn at the hour of 4 :45 p.m: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote.
