HomeMy WebLinkAbout04/20/1960 Business Meeting1 I ;� _I 1 1 -5 APRIL,20, 1960 The City Council met in regular session, Mayor Bostic, Councilmen Barber, Burns, Coombs, Larson, Oliver and Robinson, City Manager Allison:.and City Attorney Arntson present on roll call. Invocation was given by Councilman Barber. The minutes of the regular meeting of April 13, 1960 were approved as read. This being the time for the hearing on Resolution No. D -112, being a resolution of intention to improve North 15th Avenue and other streets and avenues by constructing concrete curb and gutters and su "racing of said streets, said improvements having been requested by property owners on Petitions No. 7, 8, 9, 15 and 35 as duly filed with the City Clerk and accepted by the City Counci: and the City Manager reporting that 64% protest has been filed against the improvement of North 15th Avenue, 77.8% protest has been filed against the improvement of Blackburn Street and that a number of protests have been filed against the improvement of the South half of Stewart Street on this same date, but the percentage is' .unknown since there has not been time for the City Engineer to check same, the Council ordered that the protests against the improvement of Stewart Street be checked by the Engineer and set aside the matter of an ordinance creating an L.I.D. on said petitions until later in this meeting. This being the time for the hearing on Resolution No. D -120 being a resolution of intention to improve certain property,by the construction of water mains, said improvements having been re- quested by property owners as set forth on Petition No. 36 duly filed with the City Clerk and accepted by the City Council and the City Manager reporting that 7.8% protest has been filed against this improvement, and there being persons present wishing to protest said improvement, said persons were heard. It was established that property owners wanted this improvemet but were protesting the Qestimated cost as figured by the City Engineer. All persons having been heard, it was MOVED by Robinson, seconded by Coombs that said protests be made in writing and filed with the City Engineer not later than Friday, April 22, 1960 and this hearing be continued until the regular meeting of the City Council on the 27th day of April,1960: carried, Barber, Bostic, Burns Coombs, Larson, Oliver and Robinson voting aye by voice vote. This being the time fixed for a hearing by Resolution No. D -116 on Petition No. 37, said petition requesting the vacation of the South 100 feet of the Alley in Block 370 in Capitol Addition to North Yakima or the alley adjacent to Aves Millworks and there being no protests in writing or otherwise to said request, it was MOVED by Barber, seconded by Larson that Ordinance No. 107 be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 107. ( This ordinance reconsidered, amended and passed later in these minutes) This being the time fixed for a hearing by Resolution No. D -117 on'Petition No. 30, said petition requesting the vacation of all of the alley in Block 370 in Capitol Addition to North Yakima, except the South 100 feet thereof, or the remaining portion of the alley adjacent to Aves Millwork not covered by the foregoing Ordinance No. 107 and it being deemed advisable by the City Council that no building be constructed on vacated property, aril the City Attorney suggesting that the ordinance providing for said vacation, be corrected to read as follows: "Section 2 (in part) and no building shall be constructed on any portion of said vacated alley without prior approval of the City ", it was MOVED by Larson, seconded by Oliver that Ordinance No. 108 be corrected to read in accordance with the City Attorneys suggestion and passed as corrected: carried, Barber, Bostic., Burns; Coombs, Larson, Oliver and Robinson voting aye on roll call. 'ORDINANCE" N0: 1-08; AN-ORDINANCE providing .for the "va.catzion. of '-the following _described portion,. of ?an.,alley, to: -wit: All.of: the alley in Block 370 in the Capitol Addition to North Yakim , except the South 100 feet thereof. The City Council deeming it advisable that no building be constructed on vacated property, it was MOVED by Robinson, seconded by Coombs that Ordinance No. 107 providing for the vacation of the South 100 feet of the Alley in Block 370 in Capitol Addition, be reconsidered: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote. MOVED by Coombs, seconded by Larson that Ordinance No. 107 be amended to read as follows: " Section 2 (in part) and no building shall be constructed on any portion of said vacated alley without prior approval of the City "; carried, Barber, Bostic, Burns,-Coombs, Larson, Oliver and Robinson ,o ting aye by voice vote. MOVED by Burns, seconried by Oliver that Ordinance No. 107'providing for the vacation of the South 100 feet of the Alley in Block 370 in Capitol Addition, or the alley adjacent to Aves Millworks, be passed as amended: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 107, AN ORDINANCE providing for the vacation of the following described portion of an alley, to -wit: The South 100 feet of the Alley in Block 370 in the Capitol Addition to North Yakima. The City Engineer now having determined that 55% protest have been filed in connection with the improvement of the South half of Stewart Street, in connection with the hearing on Resolution No..D -112, and it having been determined earlier in this meeting that 64% protest have been filed against the improvement of North 15th Avenue and 77.8% protest against the improvement of Blackburi Street, it was MOVED by Burns, seconded by Barber that these three areas as requested by petitions No. 7, 8 and 15 be deleted from any improvement district to be formed at this time and that Ordinance No. 109 providing for the improvement of the Cul -de sac on North 39th Avenue North of Lincoln Avenue and the Alley in Block 267, Syndicate Subdivision by surfacing and concrete curb and gutters and creating'L.I.D. No. 883, be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. ORDINANCE NO. 109, AN ORDINANCE providing for the improvement of certain property by grading, ballasting, surfacing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features; establishing a Local'Improvement District, providing for the method of payment thereof, and creating a special fund. Moved by Barber, seconded by Larson that Resolution No. D -130 transferring $15,000.00 within the dater -Sewer 1960 Budget, said amount to be used in the construction of Wells, bepassed as read. carried, Barber, Bostic, Coombs, Larson, Oliver and Robinson voting aye on roll call. ESOLUTION NO. D -1301 A RESOLUTION transferring the sum of $15,000 from Account 8 to Account 3, 11 within the Capital or Betterment Accounts Classification of the 1960 appropriation for 52- ater. P 16 APRIL 20, 1960 WHEREAS, the construction work for wells and well pumps and pump houses commenced-in 1959 has not been completed, and WHEREAS, more funds are needed in Account 3, Wells, for the continuation of said construction work, and the funds in Account 8, Well pumps and pump houses are not needed at the present time, and WHEREAS, both of said accounts are within the Capital or Betterment Account classification of the 1960 appropriation for 52 - Water, and WHEREAS, the City Council deems it in the best interests of the people of the City of Yakima, and the sums of money herein transferred could not have been reasonably fore- seen at the time of the adoption of the 1960 Budget, or at the time of a previous transfer of funds, and the action contemplated is authorized by R.C.W. 35.33.120, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the sum of $15,0001s hereby transferred from Account 8, Well pumps and pump houses, to Account 3, Wells, all within the Capital or Betterment accounts classification of the 1960 appropriation for 52 - Water, and-the Acting Director of Finance of the City of Yakima is hereby authorized and directed to make the aforesaid transfer. RESOLUTION NO. D -131, A RESOLUTION authorizing the City Manager and City Clerk to execute a farm lease, leasing a portion of the Yakima Municipal Airport to Willis Decoto. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and City Clerk of the City of Yakima are hereby authorized and directed to enter into a farm lease with Willis Decoto for the leasing of a portion of the Yakima Municipal Airport, for a term of five years, in accordance with the terms and con- ditions of said lease, a copy of which is-hereto attached and by this reference made a part hereof (ATTEST: J. RESOLUTION NO. D -1321 A RESOLUTION authorizing the City Manager and City Clerk to execute an agreement with George G. Picatti to act as consulting electrical engineer. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: ° That the City Manager and City Clerk are hereby authorized and °directed to enter into an agreement for the employment of George G. Picatti as a consulting electrical engineer for the above outlined work contemplated at the Yakima Municipal Airport, a copy of which agreement is hereto attached and by this reference made a part hereof. BOSTIC Mayor The City Manager reporting that bids had been called for the sale and removal of the caretakers+ house at Tahoma Cemetery and that no bid had been received, but that A. J. Burdine, Route 7, Box 531 Yakima, Washington has made an offer of $200. for said building and recommending that the Council accept said offer, it was MOVED by Coombs, seconded by Burns that Resolution No. D -133 authorizing the sale of said house to Mr. A. J. Surdine and authorizing the execution of an agreement for said sale, be passed as read: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call. RESOLUTION NO. D -133, A RESOLUTION authorizing the sale of the caret.aker's house at Tahoma Cemetery. WHEREAS, a very old house has existed for some time on Tahoma Cemetery, owned by the City of Yakima and used as a caretaker's house, and WHEREAS, said house is in an extreme state of disrepair, and the land hereon it sets is needed by the Cemetery for expension, and 1 1 1 1 WHEREAS, the City is contemplating certain work;at the Yakima Municipal Airport in connection with apron lighting and providing for a standby power unit, and WHEREAS, in connection with the preparation of plans and specifications of said work, it is necessary to obtain the services of a consulting electrical engineer, and WHEREAS, George G. Picatti is an electrical engineer, duly licensed and registered under the laws of the State of. Washington and is available for such consultation work, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: ° That the City Manager and City Clerk are hereby authorized and °directed to enter into an agreement for the employment of George G. Picatti as a consulting electrical engineer for the above outlined work contemplated at the Yakima Municipal Airport, a copy of which agreement is hereto attached and by this reference made a part hereof. J. Burdine for said sum, and that the same be removed from said Cemetery, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: That the City Manager and City Clerk are�dhereby authorized and directed to execute an agreement for the sale of the caretaker's house at 'Tahoma Cemetery for the sum of $200 :00, a copy of which agreement i­s -'..attached hereto and by this reference made a part hereof. BOSTIC Mayor Petition No. 32, requesting the rezone of certain property situated at the Northeast corner of Nob Hill Blvd and South 28th Avenue between 27th Avenue extended and 28th Avenue, having been filed by John D. Minaglia and others on the 10th day of March 1960 and referred to the City Planning Commission for recommendation by the City Council and.the City Planning Commission now denying said rezone request, it was MOVED by Robinson, seconded by Coombs, that said Planning Commission's recommendation be accepted and filed: carried, Barber, Bostic, Coombs, Larson, Oliver and Robinson voting aye by voice vote. Petition No. 33, requesting the rezone of- certain property situated at 1010 South Broadway between Broadway and 4th Avenue having been file -d by M. P. Yoerger and others on the 14th day'of March, 1960 and.referred to the City Planning Commission for recommendation by the City Council and the Planning Commission now recommending that said request be granted, it was MOVED by Coombs, seconded by Barber that the City Attorney be and is hereby instructed to prepare the ordinance rezoning said property for hearing and consideration at the regular meeting of the City Council on May 4, 1960: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote. The City Council wishing to have two voting delegates representing them at the Association of Washington Cities Convention to be held in Wenatchee, May 11 through the 13th, 1960, it was MOVED by.Larson, seconded by Barber that Councilmen Burns and B(o.stLc be and are hereby appointed to be Yakima's voting delegates: carried, Barber, Bostic, Larson, Oliver, and Robinson voting aye by voice vote. Councilman Barber bringing before the Council the matter placing 12 minute parking meters in front of the Liquor Store located on South 2nd Avenue, this matter was referred to the City Manager for studyand recommendation without formal motion. Councilman Larson requesting the approval of the Council for the locating of the Carnaval for the Diamond Jubilee on North and South. 2nd Street, it was suggested that this request be set forth in writing and submitted to the City Manager for recommendation. No formal action taken. Councilman Oliver requested time in the near future for the Council to study the problem of trash literature which is appearing; on news stands. No formal action taken. Councilman Coombs asked the Council to consider a clean -up fix -up campaign for the City prior to the Diamond Jubilee, pointing out that some areas in our town need this encouragement and suggest- ing that such groups as Labor Unions, the Chamber's Area Beautification Committee and Paint Dealer: be contacted to promote such a campaign. This matter was referred to the City Manager without formal motion. Other matters brought forth by members of the Council were the court decision on the minimum wage and hour law; and keys to the city. No.formal action was taken'on these matters. ager Allison requesting authorization to pay the following blaims on the construction of wells: Midland Drilling Company Domestic Well No. 5 $8,104.42 Gray.& Osborns, Consulting Engineers Service 546.80 it was MOVED by Robinson, seconded by Larson that said claims be paid: carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye by voice vote. Manager Allison reported that Bob Mackey, d/b/a Avis-Rent-'A-Car System is requesting authorization to establish a limousine service between the Airport and downtown Yakima and that West Coast Airlines is recommending this Company for said limousine service aril that since we have an ordinance licensing such service, it will be allowed. nager Allison also discussed street and sidewalk repairs and showed pictures of some of the rst places needing immediate attention. No formal action taken. There being no further business to come before the Council, it was MOVED by Barber, seconded by Oliver that we do now adjourn at the hour of 5:40 P.M., carried, Barber, Bostic, Burns, Coombs, Larson, Oliver and Robinson voting aye on roll call.
