R- 2013 -110 A RESOLUTION authorizing the City Manager to execute an Agreement with the North Yakima Conservation District for the supply and delivery of native riparian and upland plants related to the City of Yakima Wastewater Treatment Plant Outfall Relocation and Floodplain Habitat Restoration Project. WHEREAS, the City of Yakima (City) owns and operates wastewater collection and treatment facilities in accord with applicable Federal, State and Local regulations; and WHEREAS, the City's Wastewater Treatment Plant (WWTP) discharges its outfall to the Gap to Gap Reach of the Yakima River; and WHEREAS, the levies in the Gap to Gap reach of the Yakima River are being set back in order to meet the objectives of the Yakima River Basin Water Enhancement Project and the Yakima County Flood Control Zone District; and WHEREAS, the City is completing floodplain restoration projects as part of its new outfall alternative project; and WHEREAS, funding from grants is being provided to obtain and plant native riparian and upland plant species throughout the floodplain restoration project site; and WHEREAS, North Yakima Conservation District maintains a native plant nursery to support riparian and upland vegetation projects; and WHEREAS, North Yakima Conservation District has been determined the most cost effective alternative for supplying up to 5,500 native plants for delivery to the project site as needed by the City's Project Manager; and WHEREAS, the City will need access to a continuous supply of high quality native riparian and upland plant species for up to 5 years to ensure the success of the floodplain restoration project; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to enter into a Memorandum of Agreement (MOA) with the North Yakima Conservation District, attached hereto and incorporated herein by this reference, to supply and deliver containerized, conservation grade native riparian and upland plants to support the City's Floodplain Restoration and Alternative Outfall projects. AX C441 ST: Micah Cawley ayor So0a Claar Tee, City Cleo <' F' AS Ole MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF YAKIMA AND NORTH YAKIMA CONSERVATION DISTRICT RELATING TO GROWING, CULTIVATING, AND DISPERSING CONSERVATION GRADE VEGETATION FOR CITY OF YAKIMA RESTORATION PROJECTS IN THE YAKIMA RIVER FLOODPLAIN INTRODUCTION This Memorandum of Agreement (MOA) is entered into by the City of Yakima (City) and North Yakima Conservation District (District). II. PURPOSE AND SCOPE A. Purpose The parties agree that there is a need for sufficient site specific riparian plant species and other vegetation, available for planting in the City of Yakima's Floodplain Restoration Project (Project) or use in floodplains and revegetation work in this area. The parties further agree that it is in the best interest of all parties to work together as partners in providing these plantings to the Project. The parties agree that there are no alternative riparian vegetation suppliers that can supply conservation grade, native riparian planting material to be delivered as needed during the 2013 fall planting season. B. Scope The scope of this MOA will be restricted to the containerizing, cultivating, and dispersing of conservation grade vegetative material; specifically tree, shrub and plant seedlings and for the purpose of planting and revegetation work in the City of Yakima's Floodplain Restoration Project. This MOA will begin on or about Marchl, 2013, and will continue for no longer than 1 year from the initial agreement date or until the funds have been expended. This MOA can be extended on a year to year basis up to a total of 5 years. III. ROLES OF THE CITY OF YAKIMA AND NORTH YAKIMA CONSERVATION DISTRICT A. The City will provide financial compensation to the North Yakima Conservation District for 5,500 containerized trees and shrubs in the amount of $25,000. Any expenses over $25,000 will be incurred by the North Yakima Conservation District. The North Yakima Conservation District shall provide 3,200 Black Cottonwood (Populus balsamifera trichocarpa), 900 Red Osier Dogwood (Cornus stolonifera), 900 Woods Rose (Rosa woodsii), and 500 Golden Currant (Ribes aureum), unless otherwise specified by City of Yakima Utility Engineer responsible for the Project. B. NYCD shall bill the City of Yakima monthly for delivered containerized trees and shrub. Billing shall be sent to the City of Yakima Utility Engineer responsible for the Project. C. The North Yakima Conservation District will provide facilities, irrigation, plant materials, soil, pots, oversight, and labor for containerization of vegetation during the growing season. D. The North Yakima Conservation District will deliver the vegetation for volunteer planting groups or as requested by the City's project manager. E. The seedlings and potting materials become the property of the City of Yakima as soon as they are delivered to the Project site. IV. GOALS A. The goal of this cooperative relationship is to provide site specific trees and shrubs and other native vegetation for restoration of floodplains and riparian zones adjacent to the main stem of the Yakima River. B. It shall be the goal of the City of Yakima and North Yakima Conservation District to perform this task in a cooperative fashion with the overall objective of providing site specific planting materials for revegetation work in the Yakima area. V. PROVISOS A. Nothing in this MOA is intended to create any rights in any party not a party to this neither MOA nor third party beneficiaries. B. Nothing in this MOA creates a resource obligation outside that stated within the agreement. C. This is not an exclusive agreement, and in the event NYCD cannot supply all plants necessary to carry out the goals, the City reserves the right to purchase plants from alternate suppliers. D. The City's project manager retains the right to refuse delivery of any vegetation that does not appear viable upon delivery. SUBMITTED BY: Debbie Cook, Utilities & Engineering Director Scott Schafer, Wastewater Division Manager Ryan Anderson, Utility Engineer SUMMARY EXPLANATION: The City is currently developing the design of an alternative outfall for the discharge of treated effluent to the Yakima River in response to Yakima County Flood District's Gap to Gap Levee Setback project. The alternative outfall will include a diversion structure that will allow the effluent to discharge into one or more natural channels before draining into the Yakima River; creating a floodplain restoration area. The North Yakima Conservation District maintains a native plant nursery to support riparian and upland vegetation projects such as the one being conducted by the City. In addition, it has been determined that working with the North Yakima Conservation District offers the City the most cost effective alternative for supplying up to 5,500 native plants for delivery to the project site as needed by the City's Project Manager. As such, the City's Wastewater Division desires to enter into a Memorandum of Agreement (MCA) with the North Yakima Conservation District for the supply and delivery of native plants. The costs for the native plants are to be funded from secured grants. The City will need access to a continuous supply of high quality native riparian and upland plant species for up to 5 years to ensure the success of the floodplain restoration project.
