The minutes of the regular meeting of Monday, April 19th, 1954, were approved as read. Moved by Huey, seconded by Huza, that this being the time for the hearing on the annexa- tion of Richey Road Petition and other property therein described, and there being no objections, in writing; or otherwise., to said annexation to the City of Yakima or any part thereof ; it is ordered that Ordinance No. B -1553, be passed as read; carried: Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1553, AN ORDINANCE providing for the annexation by the City of Yakima, Washington of certain property contiguous to the City of Yakima, -Washington. Moved by Huey, seconded by Huza, that the Cascade Lumber Co. having _filed a grant of easement in connection with the vacation of North 7th "St. between "I" and "KT' Streets, and East 11K" Street from N. 7th Street to the nearest alley west thereof, and there being no objections in writing or otherwise to said vacation proceedings, or any part thereof; it is ordered that Ordinance No. B -1554, be passed as .read, carried: Burns, Huza and Huey voting aye on roll call. ORDINANCE NO. B -1554, AN ORDINANCE providing for the vacation of North Seventh Street between "I" and "K11 ,Streets and East 11K11 Street from North Seventh Street to the nearest alley west thereof. Moved by Huza, seconded by Burns that Ordinance Now B -1555 heretofore introduced on Mon- day April 1954, relative to the expenditure of funds not budgeted in the 1954 budget for expenses incurred in the Lenox Avenue Overpass proceedings, and laid on the table for one week, be read by the City Clerk as provided by the laws of the State of Washington, and passed as read, carried: Burns, Huza and Huey voting aye on roll call. ORDINANCE INTO. B -1555, AN ORDINANCE providing for the expenditure of funds not budgeted, for services and expenses in connection with the Lenox Avenue overpass and pertaining to court litigation in connection therewith, and declaring an emergency. Moved by Huza, seconded by Huey, that Resolution C -1119, providing that the sum of �929.f being the balance in the L.I.D. 680 Contingency fund, be paid to Pat Barkley, one of the contractors of the Bosko Construction Company, -be adopted as read, carried: Burns, Huza and Huey voting aye on roll call. RESOLUTION hO. C -1119, WHEREAS, the City of Yakima*is now holding the sum of $929.84 in the Local Improvement District No. 680 Contingency Fund, which sum was deducted and re- tained from the contract price under contract between said City and Bosco Construction Company and Pat Barkley for certain local improvement district construction work; and V1HEREAS, pursuant to Resolution No. C -1093, adopted by the City Commission on November 23rd, 1953, all judgment creditors claims against said fund have heretofore been paid, and all claims of the State of Washington have heretofore been paid and 14HEREAS, Bosko Construction Company, Inc. assigned itTs claim to said fund to said Pat Barkley and the latter is now threatening suit against aaid city for the said unpaid balance of said retained percentage of said contract price; and 11HEREAS, all other creditors' claims, if any, against said con- tractors or against the City of Yakima with reference thereto are now fully barred by the statute of limitations; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF YAKIMA: That the City Treasurer is hereby authorized and directed to pay to said Pat Barkley the said sum of $929.84, the same being the remaining funds on hand in said contingency fund hereinabove mentioned. day of April, 1954. C -1120, being a resolution of in- tention to improve North 6th Street from East "I" Street to East 11K11 Street, and East 11K1' Street from North 4th Street to the alley east of North 6th Street by grading, ballasting; surfacing and constructing concrete curbs and gutters, be adopted as read, carried: Burns, Huza and Huey voting aye on roll call. RESOLUTION NO. C -1120, BE IT RESOLVED BY THE CITY COND-IISSION OF THE CITY OF YAKIMA: That it is ints intention to improve North 6th Street from East "I Street to East 11K91 Street, also East t1K11 Street from North 4th Street to the alley east of North 6th Street by grading, ballasing, surfacing and constructing concrete curbs and gutters; all of said improvements to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and filed with the City Clerk. The district to be served and assessed for the above described improvement is situate in Yakima. County, 1,1ashington, and described;: as follows, to -wit: Beginning at the northeast corner of the intersection of North 4th Street and East 11K11 Street, thence northerly along the east line of North 4th Street 305 feet, thence easterly and parallel ,,rith East 11K11 Street to North 6th Street, thence southerly along North 6th Street to East 11K11 Street, thence easterly along East T1Kt1 Street to the alley east of North 6th Street, thence southerly along said alley to East "I" Street, thence westerly along East 11I'" Street to the alley M 1 1 1 1 HI 1 April 26, 1954 west of North 6th Street, thence northerly along said alley to a point midway between East "I" Street and East "K" Street, thence westerly along a line midway between East "I" Street and East "K" Street and said line extended to the east line of North 4th Street, thence northerly along said east line to the point of beginning. All persons who may desire to object to said proposed improvement are hereby notified to appear and present such objections, if any, at a meeting of the City Commission to be held at its office in the City Hall in the City of Yakima, Yakima County, Washington, at the hour of 10 :00 o'clock A.m., on Monday, the 24th day of May, 1954; which time and place are hereby fixed for the hearing of all matters relating to said proposed improvement or objections thereto, and for determining the method of payment for said improvement; and the City Clerk is hereby directed to give due notice of said hearing and of the intention to make the aforesaid improvement. All costs and expenses in connection with the construction of said improvement, including the engineering, inspection, advertising, publication of notices and all other expenses incident thereto, shall be levied and assessed against the properti in the proposed district, as provided by law and as above described. This improvement is to be constructed in full accordance with the plans and specifications to be prepared by the City Engineer and the City Engineer is hereby directed to submit to the City Commis Sion at or prior to the date fixed herein for said "hearing, all of the data and other information required by law to be by him submitted. The district to be served by and specially benefited by and assess- ed for the above-described improvement is situate within the City of Yakima, Yakima County, Washington, and is described as follows: Lots to 16, inclusive, of Hillacre Addition.
